Presumed Guilt: Epistemic Closure In Pregnancy Prosecutions, M. Eve Hanan Jan 2025

Presumed Guilt: Epistemic Closure In Pregnancy Prosecutions, M. Eve Hanan

Scholarly Works

Criminal law and reproductive justice scholars are calling attention to the increase in prosecutions for pregnancy outcomes in the United States. Trace amounts of controlled substances in newborns are prosecuted as child abuse. Miscarriages are prosecuted as illegal abortions or homicides. This area of criminal law existed side-by-side with Roe v. Wade for late-term pregnancy outcomes. The Dobbs decision has further emboldened these prosecutions by removing the protections of the Due Process Clause from the pre-viability phase of the pregnancy.

Using a case study of a woman who was pressured to plead guilty to manslaughter and sentenced to eight years …

Unpunishment Purposes, Meredith B. Esser Jan 2025

Unpunishment Purposes, Meredith B. Esser

Scholarly Works

Sentencing scholarship often begins by exploring the traditional purposes of punishment: deterrence, retribution, incapacitation, and rehabilitation. However, little scholarship exists addressing how these four punishment purposes apply in the post sentencing or second-look contexts. Further, abstract theories of sentencing can often seem sterile and disconnected from the realities of how violent, disproportionate, and dehumanizing the actual experience of incarceration is for many people, and tend to downplay the impact of incarceration on the families and communities of those who are incarcerated. This Article attempts to reconceptualize the traditional purposes of punishment to meet the current historical moment, and it does …

Bridging Movement Lawyering & International Human Rights Advocacy, Citlalli Ochoa Jan 2025

Bridging Movement Lawyering & International Human Rights Advocacy, Citlalli Ochoa

Scholarly Works

The human rights field is often criticized for its lack of enforcement and implementation, lawyering methodologies, and its roots in imperialism, exceptionalism, and Eurocentric values. In response to some of these critiques, human rights scholars and advocates have embraced more grassroots approaches that in many instances resemble the movement lawyering methodologies employed in social justice advocacy in the United States. In the same way that movement lawyers have centered impacted communities and engaged in long term, coordinated legal and political advocacy to achieve normative change, human rights advocates have used the international human rights framework to exert political pressure, facilitate …

Co-Morbid Indomethacin-Responsive Headaches In A Woman In Her Late 60s With Paroxysmal Hemicrania And Hypnic Headache: A Case Report, Ashlyn Brown, Randolph W Evans, Claudia Carrizo, Mark Burish

Faculty, Staff and Student Publications

Paroxysmal hemicrania (PH) and hypnic headache (HH) are rare indomethacin-responsive headache syndromes. This case report details the new onset of both disorders in a woman in her late 60s. One headache type presented as severe pain centered on the right eyebrow, lasting 30 minutes, occurring more than 8 times daily, and associated with ipsilateral lacrimation and rhinorrhea. The second type was a right frontal severe pain, with onset at 4 a.m., occurring only during sleep, lasting 30 minutes, and with no associated factors. The patient's response to indomethacin for both headache types was confirmed through an unblinded ABAB study design: …

Great Lakes Water Level Trends Using The Moving Statistics Method, With Implications For Climate Change And Cities, Brian Barkdoll, Opeyemi Alamutu Jan 2025

Great Lakes Water Level Trends Using The Moving Statistics Method, With Implications For Climate Change And Cities, Brian Barkdoll, Opeyemi Alamutu

Michigan Tech Publications

Increasing magnitudes of precipitation and evaporation are predicted for future climate change. Knowing whether these trends are occurring can help water managers plan with respect to future erosion, flooding, and design changes for shoreline infrastructure. Data from all the Laurentian Great Lakes (Erie, Michigan-Huron, Ontario, St. Clair, and Superior) were analyzed here to determine whether these trends are being realized. The MovingStatistics Method is used here using the moving average and moving standard deviation. It was found that Lakes Erie and St. Clair had the highest moving average trend of 0.5 mm/month, while Lake Ontario had the highest moving standard …

Development And Validation Of The Mealtime Behaviors Self-Report Questionnaire, Taylor Rae Perry Jan 2025

Development And Validation Of The Mealtime Behaviors Self-Report Questionnaire, Taylor Rae Perry

Electronic Theses & Dissertations (2024 - present)

Disturbances in eating are a hallmark feature of eating disorders (EDs). However, these disturbances extend beyond dietary patterns, as clinicians have long observed aberrant mealtime behaviors in individuals with EDs. Despite these observations, research on aberrant mealtime behaviors has been limited to a small case study of individuals with anorexia nervosa. Clinically, however, individuals across all ED diagnoses appear to exhibit these behaviors. Notably, there is currently no existing measure designed to assess aberrant mealtime behaviors. Developing such an assessment could provide clinicians with valuable information to inform mealtime interventions. Therefore, the present study aimed to examine the prevalence of …

A Structurationally Informed View Of Emergency Medical Services Professionals’ Work-Related Communication And Behaviors While Off Duty, Susan J. Burnett Jan 2025

A Structurationally Informed View Of Emergency Medical Services Professionals’ Work-Related Communication And Behaviors While Off Duty, Susan J. Burnett

Electronic Theses & Dissertations (2024 - present)

Work-life interrelationships and boundaries are common areas of study in communication research. While some scholars maintain that the domains of work and personal lives and their boundaries are static and exist in designated times and spaces, others argue that domains are constructed around situated contexts and through the performance of situated activities that not only produce a time and place for the domain but call upon enactment of an identity appropriate for managing the domain and the boundaries around it. The people who work in emergency medical services (EMS), emergency medical services professionals (EMSPs) face special challenges in managing work-life …

Adaptive Evolution Shapes The Transmissibility Of West Nile Virus In New York State, Sean M. Bialosuknia Jan 2025

Adaptive Evolution Shapes The Transmissibility Of West Nile Virus In New York State, Sean M. Bialosuknia

Electronic Theses & Dissertations (2024 - present)

Arthropod-borne viruses (arboviruses), which are maintained in nature in complex transmission cycles involving hematophagic invertebrates and their vertebrate hosts, are the cause of a significant and expanding global health burden. Defining arbovirus-host interactions is necessary if we are to understand the adaptive and epidemiological potential of arboviruses. The results presented with West Nile virus (WNV Flaviviridae: Orthoflavivirus), are a compilation of such studies. WNV is the most prevalent arboviral pathogen in the U.S. and the most geographically distributed arbovirus in the world. Despite the evolutionary potential of these RNA viruses, WNV and other arboviruses have experienced only limited …

Reproductive Justice: People Matter! History Matters! Places Matter!, Jazmin L. High Jan 2025

Reproductive Justice: People Matter! History Matters! Places Matter!, Jazmin L. High

Electronic Theses & Dissertations (2024 - present)

Research has established that racial disparities in contraceptive use exist in the United States with African American women being more likely than white women to report using a contraceptive method associated with lower efficacy or no contraception at all. Several factors have been suggested to explain low uptake of highly effective forms of contraception and disparities including cost, systemic racism, negative attitudes, and cultural mistrust stemming from the history of medical racism. However, the lived experiences of rural African American Southern women are underrepresented in contraceptive research. Utilizing mixed methods, this study explores the contraceptive experiences of 14 rural African …

Phantasma, Grace Wright Jan 2025

Phantasma, Grace Wright

Electronic Theses & Dissertations (2024 - present)

Ever since the infamous Ides of March, scholars have been debating the true psychology behind Brutus’s betrayal. The purpose of this project is to take a step back from the politicized motivations and explore the emotional, strenuous conditions of Julius Caesar’s assassination. This project will transform William Shakespeare’s Julius Caesar into a novella with its central focus on the relationship dynamics between the key figures of Caesar, Brutus, and Cassius. The intention of the novella is to not only analyze the play through a critical queer lens, but to interrogate the themes of violence and desire that surround male relationships …

Theoretical Foundations And Applied Performance Of Periodicity-Aware Imputation: Variable Bandpass Block Bootstrap Methods For Incomplete Time Series, Asmaa Ahmad Jan 2025

Theoretical Foundations And Applied Performance Of Periodicity-Aware Imputation: Variable Bandpass Block Bootstrap Methods For Incomplete Time Series, Asmaa Ahmad

Electronic Theses & Dissertations (2024 - present)

Time series data are prevalent across a wide range of disciplines, including health surveillance, public policy, and environmental monitoring. In the presence of underlying cyclical patterns, the integrity of time series analysis depends critically on the ability to detect, model, and impute structured missing data without compromising the temporal structure. This dissertation introduces and validates a novel imputation framework that integrates the Variable Bandpass Periodic Block Bootstrap (VBPBB) into multiple imputation procedures, improving the accuracy, robustness, and interpretability of time series models under high rates of missingness and noise. The overarching goal of this dissertation was to develop and evaluate …

Stress And Resilience In Higher Education Administrators: Exploring The Role Of Mindfulness, Michael Baumgardner Jan 2025

Stress And Resilience In Higher Education Administrators: Exploring The Role Of Mindfulness, Michael Baumgardner

Electronic Theses & Dissertations (2024 - present)

This dissertation explores stressors experienced by higher education administrators (HEAs) and examines the role of mindfulness practices in mitigating stress and fostering resilience and job satisfaction. HEAs manage essential institutional functions yet face intensifying pressures from volatile funding streams, shifting demographics, changing public perceptions, political and cultural challenges, technological disruptions, and pandemic-related change. Despite HEAs central role in sustaining higher education, limited research examines how these professionals experience stress, and even less has considered mindfulness as a potential resource for coping and resilience.

Guided by a qualitative methodological approach, this study draws on semi-structured, thick description interviews with 18 HEAs …

Video Analytics And Fourth Amendment Vision, Andrew Guthrie Ferguson Jan 2025

Video Analytics And Fourth Amendment Vision, Andrew Guthrie Ferguson

Scholarly Articles in Law Reviews & Journals

What does the Fourth Amendment have to say about video analytics running on citywide camera systems? Video analytics (also known as computer vision) involves hardware and software in cameras that turns video surveillance streams into useful data, identifying, categorizing, matching, and alerting police about objects, people, and incidents. Video analytics can identify objects (e.g., hat, backpack, person, car) and track that person or thing back in time and through the streets using video surveillance footage. For police officers conducting virtual patrols or retrospective investigations, video analytics lets police scan thousands of linked cameras for suspicious behavior or a particular suspect, …

Understanding The Influence Of Image Enhancement On Underwater Object Detection: A Quantitative And Qualitative Study, Ashraf Saleem, Ali Awad, Sidike Paheding, Evan Lucas, Timothy C. Havens, Peter C. Esselman Jan 2025

Understanding The Influence Of Image Enhancement On Underwater Object Detection: A Quantitative And Qualitative Study, Ashraf Saleem, Ali Awad, Sidike Paheding, Evan Lucas, Timothy C. Havens, Peter C. Esselman

Michigan Tech Publications

Underwater image enhancement is often perceived as a disadvantageous process to object detection. We propose a novel analysis of the interactions between enhancement and detection, elaborating on the potential of enhancement to improve detection. In particular, we evaluate object detection performance for each individual image rather than across the entire set to allow a direct performance comparison of each image before and after enhancement. This approach enables the generation of unique queries to identify the outperforming and underperforming enhanced images compared to the original images. To accomplish this, we first produce enhanced image sets of the original images using recent …

A Transferable Approach For Quantifying Benthic Fish Sizes And Densities In Annotated Underwater Images, Peter C. Esselman, Shadi Moradi, Joseph K. Geisz, Christopher Roussi Jan 2025

A Transferable Approach For Quantifying Benthic Fish Sizes And Densities In Annotated Underwater Images, Peter C. Esselman, Shadi Moradi, Joseph K. Geisz, Christopher Roussi

Michigan Tech Publications

Benthic fishes are a common target of scientific monitoring but are difficult to quantify because of their close association to bottom habitats that are hard to access. Advances in image-acquisition technologies, machine vision and deep learning have made capturing and quantifying fishes with cameras increasingly feasible. We present a method and open-source software called ‘FishScale’ to estimate benthic fish lengths, numeric abundance and biomass density in underwater environments assessed with down-looking monocular images. ‘FishScale’ estimates fish abundances and size frequencies from near-nadir monocular images where fish have already been semantically segmented. The software accounts for lens distortion, underwater magnification effects …

Regulatory Sandboxes: One Decade On, Hilary J. Allen Jan 2025

Regulatory Sandboxes: One Decade On, Hilary J. Allen

Scholarly Articles in Law Reviews & Journals

Regulatory sandboxes have spread like wildfire since the U.K Financial Conduct Authority launched its sandbox for financial technology businesses (fintech) one decade ago. Despite widespread adoption, however, there is little empirical evidence available to assess whether the signature sandbox policy com- bination of regulatory rollbacks and regulatory guidance is in fact good policy. The empirical evidence that is available suggests that regulatory sandboxes are beneficial for the tech firms that participate in them, but tells us nothing about how regulatory sandboxes have impacted the broader enterprise of regulation, or whether the innovation generated by sandbox participants is beneficial for any- …

But For Borders: The Protection Gap For Internally Displaced Persons, Anita Sinha Jan 2025

But For Borders: The Protection Gap For Internally Displaced Persons, Anita Sinha

Scholarly Articles in Law Reviews & Journals

Internal displacement, the phenomenon of people who are dislocated from their homes but remain within the border of their countries of origin, was once a forced migratory occurrence interchangeable with cross-border migration. This changed after the Second World War with the promulgation of the 1951 Convention Relating to the Status of Refugees, which was premised on an insistence on drawing a legal line in the sand based on which side of a border displacement transpires upon. Internally displaced persons (IDPs)-both in recent history and in the projected future-far outnumber people displaced across borders. Both rhetorical maneuverings and traditional international legal …

Crises, Coloniality, And Energy Transformations In Puerto Rico, Laura Kuhl, Marla Perez-Lugo, Carlos Arriaga Serrano, Cecilio Ortiz Garcia, Ryan Ellis, Jennie C. Stephens

Sociology Faculty Publications

Increased attention to inclusive processes is essential to ensure injustices are not perpetuated during energy transitions. Crises, such as the collapse of the electric grid in Puerto Rico after Hurricane Maria, present the promise of opening windows of opportunity for new ideas and voices to inform the future, but they also create opportunities for powerful interests to reinforce existing power dynamics. While coloniality has been recognized as a barrier to sustainable energy transformations, greater integration of the literature on climate coloniality and sustainability transitions is needed. This chapter analyzes visions of the future of the energy system among diverse constituents …

Identifying Notch-Regulated Genes Using A Specific Notch Signaling Inhibitor, Hammed Gafar Jan 2025

Identifying Notch-Regulated Genes Using A Specific Notch Signaling Inhibitor, Hammed Gafar

EWU Masters Thesis Collection

Bone remodeling is a dynamic process that requires a balance between bone resorption by osteoclasts and bone formation by osteoblasts to maintain skeletal integrity. Disruptions to this equilibrium can lead to pathological conditions such as osteoporosis. Osteoclasts originate from macrophages, and their differentiation is regulated by several signaling pathways, notably the notch signaling pathway. Gamma-secretase, an enzyme crucial for initiating notch signaling, can be inhibited by DAPT. However, DAPT also targets non-Notch substrates, complicating the identification of genes specifically regulated by Notch. To address this limitation, this study employed IMR-1A, a selective Notch pathway inhibitor that disrupts the assembly of …

Gen Y More Black Corporate Directors, Chaz Brooks Jan 2025

Gen Y More Black Corporate Directors, Chaz Brooks

Scholarly Articles in Law Reviews & Journals

Corporate diversity has been in the spotlight for decades. Recent efforts have followed years of legal scholarship, arguments on the business rationale for greater diversity, and more recently, the racial unrest during the summer of 2020. Called by some, a “racial reckoning,” the summer of 2020 catalyzed many corporate declarations on the importance of diversity, and more to the point of this article, the necessity of righting the economic disadvantages of Black Americans. This article looks specifically at one intervention by a corporate player following summer 2020, Nasdaq’s volley to increase corporate diversity through required disclosure. This article reviews the …
