Executive Compensation: The Role Of Human Capital And Geographic Preferences, Panagiotis Giannakis, Dorothea Roumpi, Lauren E. Aydinliyam, John E. Delery
Management Faculty Publications and Presentations
Human capital is crucial for sustainable competitive advantage, and certain workforce groups have a greater impact than others. The top management team, responsible for directing firm strategy and structure, is one such group, and executive turnover can be detrimental for a firm. While existing literature often suggests that executives change jobs primarily for higher pay, this is not always true. Drawing on human capital research and the geographic preference theory, we examine how an executive’s human capital and geographic preferences affect changes in compensation during job transitions. Using a sample of 351 executives who moved among S&P 500 companies from …
Is Illegality A Defence To Restitutionary Claims?, John D. Mccamus
Is Illegality A Defence To Restitutionary Claims?, John D. Mccamus
Osgoode Hall Law Journal
The traditional English jurisprudence granting restitution of benefits conferred under agreements rendered unenforceable because of illegality was unsatisfactory. As a general principle, it held that there was a presumption against restitutionary relief for benefits conferred under such agreements (the Holman principle). This principle was subject to a series of exceptions granting relief to parties who were innocent of fault with respect to the illegal conduct or, at least, less at fault than the defendant. The main difficulty with this approach was that it denied relief in cases where, though the plaintiff was implicated to some extent in the illegality as …
A Historic Case Of Relapsing-Remitting Alzheimer's Disease In An Adolescent Attributed To Scarlet Fever., Richard Lathe, Brian J. Balin
A Historic Case Of Relapsing-Remitting Alzheimer's Disease In An Adolescent Attributed To Scarlet Fever., Richard Lathe, Brian J. Balin
PCOM Scholarly Works
We draw attention to a historic case of a boy who suffered from scarlet fever (typically caused by the bacterium Streptococcus pyogenes) at age 7 years and went on to develop the symptoms of Alzheimer's disease (AD). His physicians believed that the subsequent dementia was related to the infection. After death at 24 years of age, postmortem brain examination revealed abundant AD-type senile plaques and fibrils, formally confirming AD. Other potential causes of early-onset dementia are discussed, but these are distinct from patient E.H. This case is pertinent regarding the current debate about the potential role of infection in …

Program evaluation data suggest that undergraduate students struggle with writing in a clear and concise manner and appropriately citing. Faculty implemented the plan-do study-act cycle to pilot the Transparency in Learning and Teaching (TILT) project framework and to explore the use of artificial intelligence (AI) and discuss approaches to using AI, along with the TILT framework, in a writing-intensive course to identify the pros and cons of using ChatGPT in an online classroom. The TILT framework reinforces adult learning by helping students clearly understand the assignment's purpose and establish a clear relationship between assignment and students' professional lives. Faculty encouraged …

Dental Hygiene Faculty Publications
Purpose Dental caries among young children remains a public health concern in the United States (US). Children of caregivers with low oral health literacy (OHL) tend to have greater unmet dental needs and poorer oral health status. The purpose of this study was to examine the understanding of pediatric dental terms associated with the dental caries process among low-income caregivers.
Methods This study included 14 caregivers with children enrolled in a Special Supplemental Nutrition Program for Women, Infants and Children (WIC) in the Southeastern US. Through structured phone interviews, the validated Oral Health Literacy Inventory for Parents (OH-LIP) was used …

This study explores college students' perceptions of an AI-driven mHealth application designed to promote well-being. With rising mental health challenges in academic settings, students increasingly seek digital tools that provide holistic support for physical, mental, and financial health. Through focus groups, this qualitative study examines students' preferences for personalized health tracking, educational content, and flexible reminders within a private, supportive community. Key findings emphasize students' desire for a balanced, all-in-one app that integrates health and wellness tools without overwhelming them with notifications. Students also highlighted the importance of social media integration for outreach, though concerns were raised about potential stress …
A "New" New Departure, Paula A. Monopoli
A "New" New Departure, Paula A. Monopoli
Faculty Scholarship
In the wake of enactment of the Fourteenth and Fifteenth Amendments, women’s rights activists embarked on an exercise in popular constitutionalism known as “the New Departure.” Frustrated by the failure of Congress to include women in the Reconstruction Amendments, suffragists turned to a strategy based, in part, upon republican theory. They argued that women had an inherent right to vote grounded in natural law and in their status as citizens of the United States under the Fourteenth Amendment. They operationalized that theory by engaging in mass-voting events and were prosecuted for illegal voting. These activist efforts came to an end …

Modeling efforts are needed to predict trends in COVID-19 cases and related health outcomes, aiding in the development of management strategies and adaptation measures. This study was conducted to assess whether the SARS-CoV-2 viral load in wastewater could serve as a predictor for forecasting COVID-19 cases, hospitalizations, and deaths using copula-based time series modeling. SARS-CoV-2 RNA load in wastewater in Chesapeake, VA, was measured using the RT-qPCR method. A Gaussian copula time series (CTS) marginal regression model, incorporating an autoregressive moving average model and Gaussian copula function, was used as a forecasting model. Wastewater SARS-CoV-2 viral loads were correlated with …
Agency, Index & Process: Investigating The Role Of The Artist’S Body In Digital Sculpture Production, Alan Magee
Agency, Index & Process: Investigating The Role Of The Artist’S Body In Digital Sculpture Production, Alan Magee
Doctoral
Contemporary Digital Sculpture has emerged out of recent developments in digital art, 3d modelling and virtual modes of production. These advances range from the creation of more powerful software and hardware systems to the to nascent XR sectors, and the potential for materialisation through technologies such as 3d printing, laser-cutting, or CNC1 machining. However, critical discourse remains predominantly focused on the end product, often overlooking the embodied labour processes inherent in its creation. As revealed through indexical traces of the artist’s body, these processes encapsulate the gestures, actions and subjective agency of artistic activity. Consequently, with the limitations of digital …
Public Art Coordination: Shaping The Irish Arts Landscape, Jennifer Haughton
Public Art Coordination: Shaping The Irish Arts Landscape, Jennifer Haughton
Doctoral
Appointing public art coordinators responsible and accountable for programming and commissioning in the public sphere is a growing trend internationally. My aim in this PhD thesis is to undertake an inquiry into the practice of how public art coordination facilitates artists in producing ambitious public art works. Appropriating Mary Parker Follett’s (1866–1933) concept of multiple leadership in addition to curatorial, rights, and management theory, I argue for an increased accommodation of public art coordination as a public leadership service arising from the construction sector. Adopting Ricoeurian hermeneutics alongside vignettes, my thesis constitutes a deep dive into the habitat and culture …

Writing a handbook implies describing the fundamental information needed by those teaching or researching in a field. This is a challenging task when the field is still maturing. This handbook grew from the idea that we could ‘collaboratively write’ engineering ethics education. In this introduction, we define the field in three dimensions: engineering, ethics, and education. The latter dimension is divided into three parts: the subjects that shape the teaching of engineering ethics education, the understanding of learners and learning that informs the pedagogical choices made, and the fusion of these two in the pedagogical methods used in teaching engineering …
Engaging Student Nurses In Lifestyle Management: The Role Of Technology-Based Interventions And Mobile Health Applications, Daniela Austin
Engaging Student Nurses In Lifestyle Management: The Role Of Technology-Based Interventions And Mobile Health Applications, Daniela Austin
School of Psychology Theses
Despite their knowledge of health risks and their future role as health promoters, pre-registered nursing students frequently struggle with unhealthy behaviours, including high rates of overweight and obesity. This thesis investigated these challenges in a student nurse population in the South West of England, exploring lifestyle patterns, perceived barriers and motivators, and the potential of mobile health (mHealth) interventions to support behaviour change.Using a multi-method approach across four studies, the research examined students’ current health behaviours, attitudes towards digital tools, and the feasibility and acceptability of theory-driven interventions. The first study, a cross-sectional survey, assessed diet, physical activity, and attitudes …
Exploring The Mechanisms Of Functional Imagery Training For Sleep Problems: A Single Arm Pilot Study, Ross Allen, Jackie Andrade
Exploring The Mechanisms Of Functional Imagery Training For Sleep Problems: A Single Arm Pilot Study, Ross Allen, Jackie Andrade
School of Psychology Theses
Functional Imagery Training (FIT) is a brief motivational intervention grounded in the Elaborated Intrusion theory of desire. It helps individuals use personalised, emotionally vivid mental imagery to support goal pursuit by drawing on past successes to plan actions, overcome obstacles, and rehearse behavioural strategies. Delivered in the client-centred style of Motivational Interviewing (MI), FIT aims to strengthen motivation for sustained behaviour change. While FIT has shown promise in areas such as weight loss and anxiety, its application to sleep-related behaviour change remains unexplored. This single-arm pilot study examined whether FIT is associated with improvements in sleep quality and motivation to …

There were many experiences which were shared by participants, though various factors can impact these realities.ConclusionThis research concludes that parenting a …
Does The Use Of Audits Decrease The Infection Rate In A Medical Care Setting?, Kylie Borchert, Kristel K. Bakker
Does The Use Of Audits Decrease The Infection Rate In A Medical Care Setting?, Kylie Borchert, Kristel K. Bakker
Annual Research Symposium
Nosocomial infections are a significant health concern in medical settings. Reports of low compliance rates with hand hygiene standards, guidelines of which are outlined and mandated by the CDC and WHO, are frequent. Factors contributing to nonadherence include lack of knowledge and an unclear understanding of correct techniques (4). Evidence shows that improved hand hygiene can reduce infection rates (1), especially when healthcare providers are included in interventions that aim to improve compliance (4).
If You Have Nothing To Hide, You Still Have Something To Fear: How Libraries Can Support Alternative Information Channels, Abbie Steuhm
If You Have Nothing To Hide, You Still Have Something To Fear: How Libraries Can Support Alternative Information Channels, Abbie Steuhm
Annual Research Symposium
Libraries in the U.S. have seen massive increases in book challenges in recent years. Since books are one of the library’s vital resources, censoring books can have a great impact on libraries and patrons. To counteract the effects of censorship, libraries need to adopt and support alternative information channels so information can still be accessed through other channels even if one is shut down.
The Kincare Craze In Child Protection: Romanticism, Subterfuge, And Racial Separatism, James G. Dwyer
The Kincare Craze In Child Protection: Romanticism, Subterfuge, And Racial Separatism, James G. Dwyer
FIU Law Review
A deluge of federal and state legislation in recent years aims to channel maltreated children removed from parents’ custody into kin placements, responding to advocates for parents who claim this is categorically better for children than entering or remaining in foster care with biologically unrelated caregivers. The claim has romantic appeal, sufficient to beguile legislators. But the research on outcomes for children in different post-removal placements does not support it. In reality, motivations other than child welfare underlie the advocacy for this legislation. The core aim is to evade federal child-welfare mandates adopted in the 1990s and long condemned by …
Policy And Poppycock In Proximate Cause Cases A/K/A Scope Of Liability And Starting To Make Sense, Thomas Galligan
Policy And Poppycock In Proximate Cause Cases A/K/A Scope Of Liability And Starting To Make Sense, Thomas Galligan
FIU Law Review
Studying proximate cause is like trying to decode mumbo jumbo. Courts continue to use words like direct, remote, natural and probable, foreseeable, hindsight, and intervening and superseding causes, and they make them sound like tests. They make them sound like law. Furthermore, as one test is debunked and another appears, courts continue to apply the debunked tests. They just pile on a new one as well. Then, they calm themselves and say that proximate cause is all a matter of policy. After all, Leon Green said that; William Prosser said that. It must be true. But courts fail to ever …
Interesting Intersections Of Immigration And First Amendment Law, David Hudson, Maximiliano Gluzman
Interesting Intersections Of Immigration And First Amendment Law, David Hudson, Maximiliano Gluzman
FIU Law Review
This essay identifies four areas of immigration law in which pressing First Amendment claims play a prominent and dominant role. The first area involves denial of admission or deportation based on pure or symbolic speech. At various times, Congress has enacted grounds of inadmissibility and deportability that squarely fall within the purview of the First Amendment. The second area involves so-called retaliatory deportations, when the government initiates or accelerates removal proceedings against a noncitizen who is in violation of immigration laws allegedly for the non-citizen’s activism, protest activity, or other First Amendment speech or expressive conduct. The third area involves …
Dispute System Counter-Design, Andrew B. Mamo
Dispute System Counter-Design, Andrew B. Mamo
FIU Law Review
This article introduces the concept of “counter-design” as a practice of challenging and reimagining dispute resolution systems from the ground up and from the inside out. Counter-design provides a critical response to traditional Dispute System Design (DSD) by positing that designs necessarily privilege certain perspectives and interests over others, even when designers follow best practices and ethical principles. Through practices of counter-design, individuals interact with dispute resolution systems, not merely to seek resolutions within the existing framework, but to actively challenge and reshape these systems from within. This concept underscores the dynamics of power, inclusion, and representation within DSD. Counter-design …
Individual Academic Freedom And The Current Forces Of Economics And Technology, George R. Wright
Individual Academic Freedom And The Current Forces Of Economics And Technology, George R. Wright
FIU Law Review
There are always a number of cultural constraints on higher education institutions. Such cultural constraints always matter. But sometimes, as in our day, such constraints are especially severe. These constraints are broadly economic; more specifically market-based; and technological in nature. They operate on public and private universities and on law schools in particular. Our concern herein is for such constraints in the many cases in which a faculty member’s speech on some matter of public interest arguably impairs a legitimate interest of the employer-university or law school. The weight of the educational institution’s interests in such academic speech cases is, …
The Interchangeable-Part Structure Of Food And Drug Law, Adam I. Muchmore
The Interchangeable-Part Structure Of Food And Drug Law, Adam I. Muchmore
FIU Law Review
This Article demonstrates that nested tiers of interchangeable parts serve as the foundation for the regulatory programs administered by the U.S. Food and Drug Administration. Core interchangeable parts used in FDA-administered programs include product categories, prohibitions on adulteration and misbranding, agency-registration requirements, current good manufacturing practices, product standards, marketing authorization requirements, postmarket requirements, and user fees. In each of these areas, Congress or the FDA has engaged in interchangeable-part lawmaking (IPL). IPL occurs when a government takes a portion of its law in one subject area and uses it as a model for its own law in another subject area. …
Clarifying Concreteness: Statutory Grants Of Standing After Spokeo And Transunion, Naomi Eid
Clarifying Concreteness: Statutory Grants Of Standing After Spokeo And Transunion, Naomi Eid
FIU Law Review
Article III limits the federal judicial power to deciding “cases” and “controversies,” demanding that a plaintiff suffer real, concrete, de facto harm to sue in federal court. In Spokeo and TransUnion, the Supreme Court clarified the outer limits of concreteness by making clear to plaintiffs that an injury in law is not an injury in fact. The Court largely grounded the decisions in the separation of powers, setting a tone that appears less deferential to Congress in its creation of statutory rights of action. A plaintiff does not automatically satisfy the injury-in-fact requirement whenever Congress grants a right and purports …
Carried Interest: Recent Tax Holding Envisions Need For New Legislation, Patrick Lucas
Carried Interest: Recent Tax Holding Envisions Need For New Legislation, Patrick Lucas
FIU Law Review
In the financial world, carried interest represents the share of the profits of a private equity fund allocated to its manager which is disproportionate when compared to the manager’s relative capital contribution. On May 3, 2023 the Tax Court issued its memorandum opinion in ES NPA Holding, LLC v. Commissioner. The decision quickly became popularized as providing reassurance to sponsors of private equity funds that they will rarely, if ever, realize income as a result of the issuance of a profits/carried interest (the so-called front-end issue for carried interest). The so-called back-end issue is how the income arising from a …

Artificial Intelligence: Catalyst For New Policies Or A New Wave Of Design Piracy?, Blagovesta Leroy
FIU Law Review
The absence of adequate intellectual property protection for fashion designs in the U.S.A. not only undermines the creativity and livelihoods of designers but also fosters the fast fashion industry, contributing to global resource unsustainability and human rights concerns in overseas manufacturing facilities. As Artificial Intelligence (“AI”) advances rapidly, there is a growing concern that its deployment in the fashion industry could accelerate these issues. This paper explores the impact of AI on the fashion industry, highlighting the shortcomings of the existing U.S. intellectual property framework in protecting designers from AI-driven design replication and counterfeiting. Drawing insights from the EU design …
