'Their Limbs Were Loosened In Listening Horror': The Sublime In The Lay Of The Children Of Hurin, Matthew Thompson-Handell Dec 2024

'Their Limbs Were Loosened In Listening Horror': The Sublime In The Lay Of The Children Of Hurin, Matthew Thompson-Handell

Journal of Tolkien Research

Tolkien's unfinished Lay of the Children of Húrin, written primarily during the second half of the 1920s, is a distinctive and remarkable piece of writing whose style stands apart from much of his other writing. In particular, it demonstrates the aesthetic of the sublime as explained and described by Edmund Burke in his 1757 work A Philosophical Enquiry into the Origin of Our Ideas of the Sublime and Beautiful. The Lay presents a range of scenes and images that portray the qualities which (for Burke) generate the sublime - such as terror, obscurity, power and vastness - and which …

Prevent Defense: Trade Secret Protection In Professional Sports, Kevin Paule

Florida Entertainment and Sports Law Review

Data has never been more important in professional sports. On the field, players obsess over advanced statistics and the use of analytics. Off the field, front offices use newfound statistics and modeling to gain a competitive edge in setting starting lineups, drafting players, and structuring contract extensions. Stadium scoreboards and baseball cards now prominently display statistics that were an afterthought a generation ago. Thus, with this growth in analytics comes a need for teams and leagues to protect their information. Trade secret disputes are nothing new—companies have always taken efforts to protect their secrets and limit unfair competition. But, with …

Pga Tour's Anti-Trust Issues Come To A Head In The Liv Golf Controversy, Luke Haber

Florida Entertainment and Sports Law Review

Professional sports leagues have seen competitor leagues arise in the past—the WHL and the NHL; the AFL and the NFL; the ABA and the NBA; and now, LIV Golf and the PGA Tour. The professional golf landscape hopes the current divide will be solved by a merger between the PGA Tour and LIV Golf, however the PGA Tour faces unique challenges. The Tour currently classifies its players as independent contractors but retain a high degree of control over the players’ media rights and ability to play in professional golf events outside of the Tour. Additionally, critics have pointed to the …

(Anti)Competitive Football Leagues, Garry A. Gabison

Florida Entertainment and Sports Law Review

Governing bodies adopt a number of rules allegedly necessary for the good functioning of their leagues. However, many of these rules violate the competition laws. One way to circumvent competition scrutiny is through multi-club ownership. This business model may become more attractive given these recent decisions. This business model may, however, deplete the trust we have in sport competitions. More effective merger regulation may well be the last savior of sporting competition.

This Article provides cosplayers and their lawyers with insights on the types of claims that are most likely to be asserted by rightsholders, the potential defenses that may be raised …
