Using State And Local Governments’ Purchasing Power To Combat Wage Theft, Courtlyn G. Roser-Jones Jan 2024

Using State And Local Governments’ Purchasing Power To Combat Wage Theft, Courtlyn G. Roser-Jones

Washington and Lee Law Review

Regulatory efforts to curb wage theft are failing. And for good reason: these laws generally empower individual workers to pursue their rights when employers neglect to pay them what they are owed and deter employers with substantial penalties. But the vast majority of workers do not take formal action against their employers. So, when the penalties for committing wage theft are almost entirely triggered by claims workers do not bring, they do not deter employer behavior. Instead, because the likelihood of being penalized at all is so low, some employers make profit-maximizing decisions to commit wage theft on a large …

Ship Shaping: How Congress And Industry Influenced U.S. Naval Acquisitions From 1933-1938, Henry H. Carroll Jan 2024

Ship Shaping: How Congress And Industry Influenced U.S. Naval Acquisitions From 1933-1938, Henry H. Carroll

Harvey M. Applebaum ’59 Award

Studying shipbuilding politics across time can yield key insights into present-day shipbuilding acquisition reform issues, such as the effects of naval industry consolidation and potential “ally-shoring” of warship production on domestic political support for future naval funding. Past studies of naval acquisitions during the late interwar period often focus on how President Franklin Delano Roosevelt and the Navy Department prepared the nation for the beginning of World War II. However, Congress and the shipbuilding industry played an often-overlooked role in creating the political support needed to expand the Navy during the tumultuous late interwar period. Self-interested domestic interest groups were …

Consent And Disagreement, Aditi Bagchi Jan 2024

Consent And Disagreement, Aditi Bagchi

Faculty Scholarship

Contracts purport to settle rights and obligations between parties. The fact that parties have consented to a given set of terms seems to hold the promise of preempting conflict about those terms after the fact. But contract gives rise to disputes about consent itself. Many disputes about implied conditions, for example, are best understood as disagreements about the scope of consent.

This article identifies several moral ambiguities in the concept of concept. We not only disagree about the analytic merits of competing conceptions among ourselves but, even as individuals, we tend not to endorse and consistently apply a single version …

(2024) Different Maps, Same Territory: Dialogical Self Theory And Its Predecessors, David Kennedy Jan 2024

(2024) Different Maps, Same Territory: Dialogical Self Theory And Its Predecessors, David Kennedy

Collected Papers of David Kennedy

Dialogical Self Theory has not emerged in a historical vacuum. Its fore-runners, whether the Eastern Atman, the tripartite Platonic self with itsclear hierarchical relations, the Cartesian “ghost in the machine,” theFreudian ego-id hydraulic model or the Jungian topography of ego andunconscious, represent the theoretical grounding from which the dia-logical self has emerged and self-articulated as much as have WilliamJames, George Herbert Mead and Mikel Bakhtin. Most of them, includ-ing DST, center on developmental models, and see the self as intrinsi-cally oriented toward a more integrated sense of itself that Jung called“wholeness,” although their internal politics differ. Plato is an authoritar-ian, …

“With Intent To Destroy, In Whole Or In Part”: Genocide, Ethnic Cleansing, And A Lost History, Alexander K.A. Greenawalt Jan 2024

“With Intent To Destroy, In Whole Or In Part”: Genocide, Ethnic Cleansing, And A Lost History, Alexander K.A. Greenawalt

Elisabeth Haub School of Law Faculty Publications

Drawing upon original research into the travaux préparatoires of the 1948 Genocide Convention, this Article advances several claims that complicate the standard account according to which genocide must entail a purpose to physically destroy at least a substantial part of a protected group. The core of the Article closely explores the words “intent,” “destroy,” and “in part,” showing how international authorities have settled on a received and largely uninterrogated wisdom regarding the meaning of these terms, one which is supported neither by the drafting history of the Genocide Convention, nor even by the actual results of the judicial decisions that …

Social Acceptance, Well-Being, And The Desire To Start A Family Of Lgbtq+ People In Thailand, Wirunphat Manitsorasak Jan 2024

Social Acceptance, Well-Being, And The Desire To Start A Family Of Lgbtq+ People In Thailand, Wirunphat Manitsorasak

Chulalongkorn University Theses and Dissertations (Chula ETD)

Despite Thailand’s image as a “living paradise” for LGBTQ+ individuals, empirical research on social acceptance and family formation remains limited. Public discourse has questioned whether the growing visibility of LGBTQ+ populations may contribute to the national fertility decline. Given this context, this study focuses on LGBTQ+ individuals and explores three dimensions: (1) societal tolerance toward LGBTIQAN+ individuals and sexual diversity, (2) public attitudes toward LGBTIQAN+ parenting, and (3) the well-being and family formation intentions of LGBTQ+ individuals. Employing a quantitative approach, the study draws on two data sources: (1) secondary data from three waves of the World Values Survey (2007, …

Alexander The Lynkestian And The Thracians At Thebes: A Note On The Tale Of Timokleia, Sulochana Asirvatham Jan 2024

Alexander The Lynkestian And The Thracians At Thebes: A Note On The Tale Of Timokleia, Sulochana Asirvatham

Department of Classics and General Humanities Faculty Scholarship and Creative Works

The Thracians are a well-attested part of the Alexander’s army in Asia. But when, exactly, did they appear in the king’s force? The question is prompted by the story of Timokleia of Thebes, which is found in Plutarch (Alex. 12; De mul. virt. 24) and Polyainos (8.40) and happens to be the only source for Thracian presence in the Macedonian army before the Hellespont. During the Macedonian destruction of Thebes in summer 335, Timokleia is raped by a Thracian or a leader of the Thracians. The story is evidently designed to ennoble the figures of Alexander and Timokleia as idealized …

A Citizen’S Perspective Of Clientelism In Morocco, Adam Lahlou Jan 2024

A Citizen’S Perspective Of Clientelism In Morocco, Adam Lahlou

Honors Program Theses

This undergraduate research thesis aims to examine the implications of clientelism in Morocco from the perspectives of the citizens. Clientelism, or patronage-based political exchange can have a significant impact on political systems, and representative politics. While studies have been done examining citizen’s perspectives on clientelism, this aimed to be the first study in the context of Morocco. Using qualitative data from interviews and literature examination, the author tested three assumptions. He analyzed if clientelistic networks in Morocco are entrenched via Urban-Rural divides, if clientelism has had a symbiotic relationship with the Amazigh’s movement for greater political representation, and if Moroccan …

Blinded By The Light: Resolving The Conflict Between Satellite Megaconstellations And Astronomy, David A. Koplow Jan 2024

Blinded By The Light: Resolving The Conflict Between Satellite Megaconstellations And Astronomy, David A. Koplow

Georgetown Law Faculty Publications and Other Works

The sudden emergence of large constellations of small satellites in low altitude orbits represents one of the most dramatic contemporary innovations in outer space. Promising low-cost, low-latency global communications and spectacular capacities for remote sensing of the Earth, these satellites will soon number in the tens of thousands, sponsored by diverse corporations and countries around the world. But this proliferation of spacecraft comes at a steep cost in unavoidable interference with ground-based astronomy: as the satellites overfly the observatories, they block the views of remote objects and phenomena, leaving obliterating white streaks on the collected imagery, and obscuring access to …

A Corpus-Based Comparison Of Keywords And Themes From The Book Of Mormon And The Bible, Brett James Hashimoto, Joshua Cowley Jan 2024

A Corpus-Based Comparison Of Keywords And Themes From The Book Of Mormon And The Bible, Brett James Hashimoto, Joshua Cowley

Faculty Publications

The Book of Mormon has been studied for its thematic, literary, and theological content using almost exclusively qualitative methods (e.g., Turley, 2019; Morrill, 2017). However, scholars have conducted little analysis comparing it to the Bible, even though those who view it as scripture consider it directly comparable in purpose. (e.g., The Book of Mormon, 2015; McConkie, 1985). The present study applies quantitative linguistic analysis to statistically derive the distinctive language from the two volumes of scripture and identifies the key themes and language from the two books. To accomplish this, corpora of The King James Version of the Bible (66 …

Analysis Of Toxic Chemical Agents And Therapeutics For Toxic Inhaled Agents’ Exposure, Khadija Bilkis Jan 2024

Analysis Of Toxic Chemical Agents And Therapeutics For Toxic Inhaled Agents’ Exposure, Khadija Bilkis

Electronic Theses and Dissertations

When inhaled, toxic inhalation agents (TIAs) such as cyanide (CN), ammonia and sulfur compounds (e.g. methanethiol (MeSH)) can be fatal. Many TIAs cause cellular hypoxia, cytotoxic anoxia, apnea, respiratory failure, neurodegenerative disorder, circulatory collapse, seizures, and potential death by blocking mitochondrial cytochrome c oxidase. All TIA’s have the potential to be employed as chemical warfare agents, terrorist weapons, or dangerous occupational gases. Although many TIAs are potential threats, there are minimal FDA-approved treatments for these substances useful in a mass-casualty situation. Recently, cobinamide (Cbi) has come to light as a potential antidote for MeSH poisoning. However, methods for analyzing MeSH …

Reverse-Engineering Of Disinformation Campaigns During The War In Ukraine, Lora Pitman, Ava Baratz, Kelly Morgan, Marcy Alvarado Jan 2024

Reverse-Engineering Of Disinformation Campaigns During The War In Ukraine, Lora Pitman, Ava Baratz, Kelly Morgan, Marcy Alvarado

School of Cybersecurity Faculty Publications

Information operations have long been a part of warfare. Disinformation campaigns, in particular, are usually launched by states in order to mislead and confuse populations in adversarial countries, but also to obtain support for their actions from domestic audiences. These campaigns threaten human security, at the individual level, but also state- and even international security. The invasion of Ukraine by Russia came with a new wave of disinformation not only in Ukraine itself, but also in countries from various other continents. This paper studies the characteristics of the spread of disinformation from the first day of the war in February …

Mesopotamian Journal of CyberSecurity

The explosive growth of Internet of Things (IoT) devices has led to escalating threats from distributed denial of service (DDoS) attacks. Moreover, the scale and heterogeneity of IoT environments pose unique security challenges, and intelligent solutions tailored for the IoT are needed to defend critical infrastructure. The deep learning technique shows great promise because automatic feature learning capabilities are well suited for the complex and high-dimensional data of IoT systems. Additionally, feature fusion approaches have gained traction in enhancing the performance of deep learning models by combining complementary feature sets extracted from multiple data sources. This paper aims to provide …

Go With The Flow: The Psychology And Ethics Of Atomic Motion In Lucretius, Sophia Ophelia Tobár Jan 2024

Go With The Flow: The Psychology And Ethics Of Atomic Motion In Lucretius, Sophia Ophelia Tobár

Graduate School of Arts and Sciences

Lucretius innovates upon prior Epicurean philosophers by making the discussion of atomic movement in his didactic epic not just a complement to his exegesis of Epicurean philosophy, but in developing new scientific explanations for Epicurean doctrine through the principles of atomic motion. I claim that Lucretian tranquility is a kinetic phenomenon, an approach which provides new insight on the psychological and the ethical elements of his philosophy, and allows his On the Nature of Things to be brought into a fuller conversation with current scholarship on Epicurean psychology and ethics. I examine how atomic movement is emulated on the individual/psychological …

Jesus’ Authority Over Evil Spirits: Healing Demoniacs In The Gospel Of Mark, Michée B. Badé Jan 2024

Jesus’ Authority Over Evil Spirits: Healing Demoniacs In The Gospel Of Mark, Michée B. Badé

Journal of Adventist Mission Studies

The gospel of Mark highlights nine distinct healing miracles. Among them, five involve the healing of demoniacs—individuals “possessed by demons,” or as some may prefer, “demonized.” These accounts form a significant portion of Mark’s healing narratives and are a notable theme in his Gospel, which is one of the earliest records of Jesus’ life and ministry. These stories not only demonstrate Jesus’ authority over evil spirits but also reflect his deep compassion for those suffering from spiritual oppression.

The purpose of this article is twofold. First, it aims to highlight Jesus’ authority over evil spirits, as manifested in nature, animals, …

A Comparative Analysis Of The American Revolution And The Jacobite Rebellions As “Civil Conflicts” Against Great Britain, Mandi Nash Jan 2024

A Comparative Analysis Of The American Revolution And The Jacobite Rebellions As “Civil Conflicts” Against Great Britain, Mandi Nash

Theses

British history consists of a large number of armed conflicts engaged against almost every country and continent in the world. While British history has a history rich with conflicts, two particular conflicts feature front and center when one is thinking in terms of a civil conflict– the American Revolution and the Jacobite Rebellions. A civil conflict is any conflict that takes place between citizens of the same country. Both the Jacobite Rebellions and the American Revolution were conflicts against Great Britain when Scotland and America were under British rule. Despite being two separate civil conflicts that differed in many ways, …

Feature Comment: Don’T Let Post-Employment Conflicts Derail Your Contract Award, Jessica Tillipman, Bryan Dewan

GW Law Faculty Publications & Other Works

Often referred to as “revolving door” restrictions, the U.S. Government has devised numerous laws, policies and procedures designed to combat unethical or anti-competitive conduct that may stem from a Government employee’s decision to leave federal service. The laws range from ethics restrictions designed to minimize the appearance of impropriety while a federal employee endeavors to leave the Government, to criminal laws, which seek to punish conflicts of interest and improper conduct that may occur after Government service concludes.

In addition to the ethical and criminal considerations that must be taken into account when navigating the Government’s myriad post-Government employment restrictions, …

The Rise Of Isis: A Growing Threat To The World, Grace Ralstin Jan 2024

The Rise Of Isis: A Growing Threat To The World, Grace Ralstin

Pepperdine Policy Review

ISIS has inflicted terror onto civilians in several ways, through ransoms, kidnapping, beheadings, mass shootings, and bombings. These acts of terror are funded through the internet. They use this tool as a mechanism to spread online propaganda and radicalize people, in addition to terrorizing civilians with cyberterrorism to collect money. This analysis also compares ISIS to other terrorist organizations, specifically in their online propaganda tactics and funding. Further, it will posit policy recommendations that are aimed at helping policymakers combat online terrorist activity. The goal should be making cyberspace safer for the public and increasing challenges for terrorists to conduct …

Human Rights, Poverty, And Care Of Girls And Women With The Prospect Of A Baby, Mccauliff, Catherine M.A.

Santa Clara Law Review

Human rights provide the lens used here to examine the treatment of women and girls at a time in their lives when they deserve the utmost respect, understanding and assistance, when they are early in a pregnancy, wanted or not, the result of violence or not, or a miscarriage of a wanted child. We live in a society where “[e]ssentially, people will have children if they feel they have job security, a stable economy, and feel supported in starting a family.” Some countries and cities provide assistance to a mother upon the birth of a child in the form of …

Power Dynamics And Oppression: Analyzing Structural Control In Suzanne Collins’S The Hunger Games, Hannah Micciolo

Capstone Showcase

The Hunger Games is a popular novel universe that describes a totalitarian dictatorship through the lens of the oppressed. Through the book, the viewer is given insight into how Panem operates the way it does even though the majority of its citizens are oppressed by the minority in a much more obvious manner. However, within modern society, the tactics used by the oppressors are much more ambiguous and distorted. This essay will explore the structures put in place by the Capitol in tandem with modern examples to mirror each other and increase awareness of the the tactics governments use both …

No Body, No Crime: The Advent Of Cyberwar And International Humanitarian Law, Emma Reeves Mansour Jan 2024

No Body, No Crime: The Advent Of Cyberwar And International Humanitarian Law, Emma Reeves Mansour

Scripps Senior Theses

Cyberwar is a relatively new type of combat that is increasing in popularity and prevalence in modern warfare. Actors are using advanced technology, often in the form of a virus, to target a state’s infrastructure, data, and all else that exists online. What is even more alarming than the attacks themselves is the lack of International Humanitarian Law (IHL) to regulate cyberattacks, leaving states and civilians incredibly vulnerable. As the world continues to shift digitally, all actors will become more and more vulnerable to these types of attacks, and it is critical that new law is adopted to ensure that …

Administering A Democratic Industrial Policy, Joel Michaels, Amy Kapczynski Jan 2024

Administering A Democratic Industrial Policy, Joel Michaels, Amy Kapczynski

Center for Law and the Economy

In Washington today, we are witnessing what many call the “return of industrial policy.” Some argue that a new political economic paradigm is emerging, departing from the neoliberal order of the last several decades. High-stakes questions about how to administer industrial policy have followed, for good reason: industrial policy necessarily involves a great deal of administrative discretion. Yet we have no adequate literature discussing how that discretion should be deployed. Administrative law scholarship has largely ignored the distinctive tools of industrial policy, such as grantmaking, lending, government contracts and ownership stakes. These tools require flexibility and discretion, and often cannot …

Music-For-The-State: Hegemony, Culture Production, And Creative Labor In Us Army Music, Michael S. Grenier Jan 2024

Music-For-The-State: Hegemony, Culture Production, And Creative Labor In Us Army Music, Michael S. Grenier

Open Access Master's Theses

Analyzing the historical development and ideological underpinnings of the regulatory and doctrinal texts that make up the US Army’s Body of Knowledge, this paper offers a critical theory interpretation of Army lore as a mediating device for the Army State Apparatus. The lore enshrined in the Body of Knowledge reinforces the needs of the State by setting the conditions and expectations for Army Musicians. Examining how Army Musicians are hailed by the lore as always-already Army Musicians as such, the paper builds up to an analysis of Army Music as a labor system of culture production, ultimately positioning the Army …
