Controlling Moral Hazard In Limited Liability With The Consumer Sales Practices Act, Nathaniel Vargas Gallegos

The few states that have passed the Model Consumer Sales Practices Act have common definitions and case law regarding the definition of a “supplier.” This definition is broad enough to include managers of companies in limited liability entities in the states that have adopted the model act. The practicality is that business principals, owners, and managers can be held personally liable for deceptive practices under the state acts. But this is not a piercing of the corporate veil or of the limited-liability company. This Article is meant to accomplish four purposes: (1) exhibit the origins of the act, (2) show …

The complex and beautiful relationship the people in Victorian England had to the bee is one that goes beyond ideas of politics and religion. This thesis will explore this relationship by utilizing print, ephemera, jewelry, and household items, to demonstrate how the representation and symbolism of the bee was recognized and cherished by Victorians. While bees did certainly have an intimate relationship to the areas of politics and religion, one that is acknowledged throughout this work, their connection to grander themes of introspection, industrialism, folklore, morality, and status helps us understand the Victorians on a deeper level.

The flute works of Claude Arrieu (1903-1990) are relatively unknown, as is Arrieu herself. A composer active throughout the twentieth century and a radio producer in Paris during the 1930s and 1940s, Arrieu and her music are now often lost amongst the more popular works of her French contemporaries. Her compositional output, which includes music written for traditional concerts and over seventy scores for radio and film, displays her ease in navigating the early twentieth century’s changing mediums of music performance. Arrieu composed several pieces for solo flute with piano or orchestra, including the Sonatine for Flute and Piano (1943) …

Madness in literature has a long and colourful history. While its representation varies significantly in different literary periods, madness is nonetheless a consistent theme responding to inherent conflicts of civilisation. Thus, in the eighteenth-century novel, madness is subdued and forced to express itself in the language of rationality, while in the nineteenth century the theme becomes increasingly subversive. In the form of the madwoman trope (Gilbert and Gubar 1979), madness is simultaneously a reaction to restrictive patriarchal norms, and a frame in which the gender conflicts of the time can be safely and effectively played out. Local history and lore reports that the Vernal Public Library owed its inception to a performance of Queen Esther Opera in 1907. However, the Vernal Express makes no mention of such a performance (nor can any such opera be identified), while it does record multiple other community fundraising events held to benefit the public library. One such, a unique event in public library history, occurred in 1908 when the public library association held a benefit performance of a stage version of Owen Wister’s popular Western novel, The Virginian. This Article examines whether the United Nations ("U.N.") Treaty, the Convention on the Elimination of All Forms of Discrimination Against Women ("CEDAW'), is a "paper tiger"-a law that seems powerful but is in fact weak and ineffectual. While some scholars question the Treaty's effectiveness based on statistical studies, others point to legal reforms in state parties as evidence of its success. Neither provides a nuanced middle ground by examining the CEDAW at a micro rather than a macro level. This Article fills this gap by conducting a qualitative analysis of 10 Indian judicial opinions. In this article, I examine the international law on the use of force alongside a feminist analysis of the ongoing Russian aggression in Ukraine. I draw on records of mushroom foraging to evidence how everyday practices of communities are destroyed by military aggression that disrupts the embodied ecologies reproduced in intergenerational human and nonhuman encounters. The mushrooms foraged in Ukraine, the mushrooms destroyed during military encounters, and the mushrooms growing beside land mines provide an aperture for shifting both feminist and international legal accounts of armed conflict. The use of high-fidelity simulation and standardized patients (SPs) in occupational therapy (OT) education is expanding. However, the implementation of simulation varies across programs, leading to inconsistent outcomes and research limitations. Furthermore, details on SP use and training are lacking in OT literature. This article aims to provide OT educators with considerations for improving simulation fidelity by effectively using highly trained SPs. For example, recruiting SPs from diverse backgrounds is necessary to improve sociological fidelity, and proper training of SPs is required to ensure psychological fidelity. This qualitative study uses the first person, “I” to explore the Black Storytelling Tradition as method and methodology. As a Black scholar I centered my grandfather’s empirical knowledge of haints (a metaphor for demoralizing, oppressive, colonizing, and assimilating societal and educational practices upheld by the dominant class) and my empirical teacher knowledge as an American Descendant of Slavery (ADOS) as the site of inquiry. Girls’ Studies is a relatively new academic field characterized by its focus on the complexity of girlhood experiences and understanding girl as a unique social identity separate from the notion of future women. In bringing Girls' Studies theory into the work of theatre scholarship and new play development, I present a framework for the interdisciplinary field of Girls' Theatre Studies. Chapter One is an exploration of girlhood presentations in contemporary theatre through a postfeminist lens. The Relationship Between International Criminal Tribunals And National Militaries, Frank Rosenblatt

This article studies the possibilities and perils of international criminal tribunals collaborating with national military forces to support the investigation and prosecution of international crimes. It does so through a case study of Bosnia-Herzegovina in 2002, where a multinational military peacekeeping coalition called Stabilisation Force (SFOR) headquartered in Sarajevo supported the work of the International Criminal Tribunal for the former Yugoslavia (ICTY) in The Hague. Through that case study, the article extracts larger lessons potentially applicable to other post-conflict scenarios involving both military forces and international courts. This dissertation examines the ruptured temporality of “wartime” in works by artists, poets, and filmmakers belonging to the Russian and Soviet avant-gardes between 1914 and 1928. Wartime, this study argues, shaped the aesthetics and temporality of canonical works from cubo-futurist illustrated books and collage painting to agitprop theatre and groundbreaking silent film produced in an era of industrialized warfare, revolutionary upheaval, and civil unrest. I reveal the ways in which manifest notions of time were challenged and dismantled in a myriad of artistic forms, styles, and concepts responding to the First World War.

This Article reviews the recent emergence of the space-cyber nexus as a distinct warfighting domain, solidified during the Russian invasion of Ukraine, and analyzes the (missing?) laws of space-cyber warfare. The Article further suggests a roadmap for the development of norms and rules under the constraints of contemporary geopolitics and difficulties in multilateral rulemaking. As space-based infrastructure became critical to modern militaries and economies, it has, as a result, become a prime target. "The development of highly sensitive and efficient analytical methods utilizing advanced instrumentation is necessary to help improve disease diagnosis and therapeutics. A major neuro-consequence of traumatic brain injury (TBI) is oxidative stress from the generation of reactive oxygen species and the depletion of antioxidant defenses. Alteration in concentrations of certain small molecules also occurs with the disease progression and can help understand TBI pathophysiology. Two analytical methods employing liquid chromatography with tandem mass spectrometry (LC-MS/MS) were developed and validated to monitor the potential small-molecule TBI biomarkers at sub-ppb levels.
