They're Just Not Ready Yet: A Developmental Argument For Abolishing Juvenile Transfer, Taylor Gerry
They're Just Not Ready Yet: A Developmental Argument For Abolishing Juvenile Transfer, Taylor Gerry
Research Papers
The purpose of this paper is to examine and identify the core issues of juvenile transfer laws, arguing for abolishment. This paper utilizes a comprehensive overview of the literature on juvenile transfer laws to explain the history of the juvenile justice system and provide an overview of juvenile transfer laws and their core issues. The justification for the use of juvenile transfer is based on the idea that they will deter individual juvenile offenders along with those that may become juvenile offenders in the future, and because of that deterrence, juvenile transfer laws are said to reduce recidivism rates. In …

The Meaning And Challenges Of An Interdisciplinary Sentencing Exercise: Reflections From A Death Penalty Mitigation Practice, Anup Surendranath, Maitreyi Misra
Socio-Legal Review
Due to the death penalty sentencing framework’s requirement of taking into account the context of the individual accused who is to be punished, the Supreme Court of India has characterised death penalty sentencing as socio-legal in nature. In this paper, we consider the tensions that have emerged when the legal is forced to interact with the social—when death penalty sentencing law, legal practice, and process has to account for perspectives from the social sciences. One of the mechanisms through which the law conducts this socio-legal examination at the stage of sentencing is mitigation. Mitigation is an exercise by the defence …

Socio-Legal Review
As the earliest Editor’s Notes for the Socio-Legal Review (‘SLR’ or ‘Review’) recorded, SLR was established in 2005 with the help of a publication grant from the UK-based Modern Law Review (‘MLR’), and the support of Professors Tim Murphy and later Martin Loughlin of the London School of Economics. A chance encounter that some students had with Professor Tim Murphy, at the time the General Editor for MLR and founding Editorial Board member for the UK-based journal Law and Critique, at an academic conference at the National Law School of India University, Bengaluru (‘NLSIU’) led to active discussions around what …

Electronic Theses and Dissertations
Although podcasts as a whole are growing in popularity, the true crime genre of podcasts continues to be especially popular, particularly with female listeners. The unique intersection of informational and entertainment goals associated with true crime podcasts raises ethical questions about how these priorities should be balanced. This study focused on learning more about listeners’ motivations, habits, and perceptions via an online survey. Additionally, it explored the gendered nature of true crime podcast consumption. A total of N = 657 participants completed the survey providing information about why they listen to true crime podcasts, how often they listen, and how …

Moderation In Online Incel Forums: A Comparison Of Warning Behaviors, Katherine Elizabeth Norris
Electronic Theses and Dissertations
Incels constitute an online community characterized by shared negative perspectives concerning masculinity, women, and societal norms. Platforms such as Twitter and Reddit have implemented content moderation measures aimed at curtailing the dissemination of incels' ideologies, which often promote violence and suicidal ideation. To observe the influence of content moderation on incel discourse, this study examined posts from two distinct incel forums: one subject to moderation and another without such restrictions. Employing thematic analysis, common themes within the posts were identified, and the occurrence of negative language was quantitatively assessed. Findings revealed that the moderated forum exhibited a higher prevalence of …

Electronic Theses and Dissertations
In this study, I will explore some of the root causes behind middle school students' failure to attend class. Data shows that students are labeled chronically absent when they miss more than 10% of a school year, regardless of the absences- expelled, unexcused, or suspended. According to the U.S. Department of Education, about seven million students were labeled chronically absent in the 2015-16 school year, equating to roughly one out of every six students across the United States being absent for 15 or more days. The problem exists nationwide; however, it is more prominent in urban areas with low socioeconomic …

The Impact Of State Legislative Activity On Judicial Independence, Alec Haas
The Impact Of State Legislative Activity On Judicial Independence, Alec Haas
Williams Honors College, Honors Research Projects
The role of judicial officials to release independent decisions remains a vital component to the very existence of the judicial branch. However, due to disagreement over various individual court’s interpretation of their respective state constitution, numerous state legislatures have begun to introduce bills that significantly weaken state judiciaries. Many of these bills have statutes that lower the burden for judicial impeachment, remove jurisdiction over subject matter, change the election system for judicial officials, reduce the resources of the court, and introduce politics into seemingly non-partisan matters. Influenced by the passage of bills that weaponize state legislatures against the courts, this …

Examining The Experiences Of Dei Practitioners: A Look At The Racial Disparity In Policing Of Black People And The Subsequent Need For Adaptive Leadership, Lashawn Taylor
Theses and Dissertations
For centuries, Black people in the U.S. have had to navigate structural and institutional racism. This is especially true for the system of policing, which evolved from pre-emancipation slave patrols. Though law enforcement agencies have made strides in the past 160 years, Black people continue to be targeted and killed by police at a disproportionate rate. Evidence shows that DEI training initiatives within policing often fail to reduce this racial disparity that exists in policing. Yet, improved training outcomes surrounding racial relations continues to be a priority. The purpose of this qualitative, phenomenological study was to examine the experiences of …

Theses and Dissertations
This integrative systematic review aimed to enhance understanding of resilience among Chinese emerging adults with early relational trauma by synthesizing available information on how culture is incorporated into the conceptualization, measurement, and interpretation of resilience in the current body of literature. By utilizing a qualitative content analysis approach, the researcher identified main ways in which resilience was conceptualized, assessment tools used to assess, and culturally-specific elements in conceptualizing and understanding resilience. Analysis results indicated the static way of conceptualization was most common among other ways of conceptualizing. Results also revealed that the majority of literature incorporated culture in their conceptualizations …

Trauma Across Culture: A Phenomenological Study Exploring The Historical Effect Of Colonialism, Genocide, And Resilience On Descendants Of Indigenous Peoples In The United States, Monique Lumas-Wright
Theses and Dissertations
Throughout history, massive killings have gravely affected the succession of cultures, and the impact of its traumatization is vast. The centuries-long enslavement of African Americans, the ethnocide of Native American/Alaskan Natives, and the genocide of European Jews represent some of the most horrific catastrophes of human history through the destruction of identity, culture, language, and religion. The destabilization of these distinct groups and the extreme violence experienced by historical injustices have resulted in cultural, mental, emotional, and physical obstructions with profound economic, psychological, and health impacts encompassing both the wounds inflicted by oppression and resilience. The literature review examined the …

Social Capital: The Link Between State Political Culture And Civic And Political Participation, Austin Marie Conner
Electronic Theses and Dissertations
Systemic racism inhibits African Americans’ civic and political participation, yet the scholarship on this topic is scarce and examines Black behavior as homogenous. This study utilizes Putnam’s social capital theory and Elazar’s state political culture typology to identify social and regional distinctions in African American civic and political behavior. Both social capital and state political culture have been linked to civic and political participation, however, not much is known about how these two constructs specifically influence African American civic and political behavior. Utilizing data from the 2016 Collaborative Multiracial Post-Election Survey, this study conducts five logistic regression models to examine …
Squatters Squabbles: The Use Of Mediation To Provide Beneficial Solutions To Adverse Possession Claims In New Jersey, Bayla Zohn
Cardozo Journal of Conflict Resolution
In our society, law is a complex and ever-evolving field, constantly adapting to fit our needs. Yet, there are certain legal matters we would expect to have clear and obvious resolutions. Property ownership should be simple and unambiguous, governed by "established legal rules and precepts." Examine a deed, survey the stated legal owner of the tract of land, and your answer should be uncomplicated. Yet, there are a multitude of complex laws that allow individuals to obtain legal ownership of land in a seemingly illicit fashion.
Literature Unbound: Black Carceral Consciousness From 1965 – 1975, Allan L. Ford
Literature Unbound: Black Carceral Consciousness From 1965 – 1975, Allan L. Ford
Wayne State University Dissertations
Genre has the capacity to help readers my closely understand certain writings; however, strict reliance on genre alone can cloud or betray the author's intentions. This is especially true when the author is imprisoned. From autobiographic writings by Huey Newton and Rubin Carter, to the collected letters and essays of Angela Davis, George Jackson, and Eldridge Cleaver, to certain works of poetry by Ericka Huggins and Etheridge Knight, a certain expression of humanity is alive in their words. I use a method of analysis for these works called Black carceral consciousness to perform close readings of these works in an …

Taiwan's Medical Injury Law In Action, Chih-Ming Liang, Robert B Leflar, Chih-Cheng Wu
Emory International Law Review
Taiwan’s healthcare system, lauded internationally for its universal insurance coverage, moderate costs, and high quality of care, has one significant group of detractors: its physicians. Overworked, squeezed financially by the nation’s global budgeting system’s annual payment restrictions, and oppressed by both criminal prosecutions and civil malpractice actions, doctors and hospitals raised criticisms that culminated in legislative reforms enacted in 2017 and 2022. Are the reforms making any difference?
This Article offers the first comprehensive examination in English of how Taiwan’s medical injury law works. The Article is based on interviews with judges, attorneys, physicians, scholars, and other citizens, literature reviews, …

Racial Bias, Accomplice Liability, And The Felony Murder Rule: A National Empirical Study, G. Ben Cohen, Justin D. Levinson, Koichi Hioki
Akron Law Faculty Publications
Two long criticized prosecutorial tools—the felony murder rule and the accomplice liability doctrine—play an outsized role in the operation of American homicide law. Though each of these tools have separately faced intense criticism for their resistance to the supposedly foundational principles of moral culpability and individual responsibility, their legacy is also defined by the way they function symbiotically and specifically to heighten racialized punishment. This Article addresses the weighty combined reach of the accomplice liability doctrine and felony murder rule, and proposes that racial bias has fueled the operation and survival of these tools. Specifically, it suggests that implicit racial …

This Article focuses on the promise and challenges of progressive prosecution through the lens of the election of Jason R. Williams to Orleans Parish District Attorney’s Office. Orleans Parish was the epicenter of mass incarceration, wrongful convictions, violence, and racism over the last thirty years. The election of Jason Williams as District Attorney in 2021 resulted in policy changes in the Orleans Parish District Attorney’s Office. In the first two years of the administration, incarceration rates dropped by one-third, impacting over one thousand people. Dozens of individuals serving draconian punishments for lowlevel offenses were resentenced. Eighteen individuals were exonerated. But …

In their introduction to this edition of Dædalus, Goodwin Liu and Camara Phyllis Jones write that “it is unlikely that implicit bias can be effectively addressed by cognitive interventions alone, without broader institutional, legal, and structural reforms.” They note that the genesis for the volume was a March 2021 workshop on the science of implicit bias convened by the Committee on Science, Technology, and Law of the National Academies of Sciences, Engineering, and Medicine. That workshop provided an opportunity to demonstrate that implicit bias is a common form of cognitive processing that develops in response to social, cultural, and …
False Accuracy In Criminal Trials: The Limits And Costs Of Cross Examination, Lisa Kern Griffin
False Accuracy In Criminal Trials: The Limits And Costs Of Cross Examination, Lisa Kern Griffin
Faculty Scholarship
According to the popular culture of criminal trials, skillful cross-examination can reveal the whole “truth” of what happened. In a climactic scene, defense counsel will expose a lying accuser, clear up the statements of a confused eyewitness, or surface the incentives and biases in testimony. Constitutional precedents, evidence theory, and trial procedures all reflect a similar aspiration—that cross-examination performs lie detection and thereby helps to produce accurate outcomes. Although conceptualized as a protection for defendants, cross-examination imposes some unexplored costs on them. Because it focuses on the physical presence of a witness, the current law of confrontation suggests that an …
