Ethical Oversight And Social Licensing Of Portable Mri Research, Barbara J. Evans Jan 2024

Ethical Oversight And Social Licensing Of Portable Mri Research, Barbara J. Evans

UF Law Faculty Publications

This article explores two questions: (1) whether portable MRI research might escape regulatory oversight altogether under existing U.S. privacy and research ethical frameworks, leaving research participants without adequate protections, and (2) whether existing regulatory frameworks, when they do apply, can guard society’s broader interest in ensuring that portable MRI research pursues socially beneficial, ethically sound aims that minimize the potential for externalities affecting nonparticipating individuals and groups, who might be stigmatized or otherwise harmed even if they decline participation in the research.

Arianism Revised: The Re-Emergence Of An Infamous Heresy, Mia K. Hardy Jan 2024

Arianism Revised: The Re-Emergence Of An Infamous Heresy, Mia K. Hardy

The Kennesaw Journal of Undergraduate Research

Arian heresy, a Trinitarian heresy that suggests the members of the Trinity differ in essence, function, and rank, has existed in Christianity for centuries but hasn't often recaptured the mainstream discussion of orthodoxy. That is, until the 1970s. Since then, the available literature surrounding the subjects of complementarianism, eternal subordination, the Holy Trinity, and Arian philosophy has grown, and the overlap between these factors cumulated into what was arguably one of the most divisive theological debates within modern Evangelicalism. What factors contributed to the reemergence of this centuries-long debate in modern times? The overarching goal of this work is to …

Making A Case For A Digital Marketing Concentration: An Analysis Of Traditionally Generalized Online Mba Programs, Paige Gardiner, Maureen Andrade Jan 2024

Making A Case For A Digital Marketing Concentration: An Analysis Of Traditionally Generalized Online Mba Programs, Paige Gardiner, Maureen Andrade

Atlantic Marketing Journal

Over the last decade, business schools have added online MBA programs to meet student demand for access, price, and geographic convenience while trying to ensure a solid tuition revenue base. Online MBA programs have been forced to waive the GMAT and reduce the number of credits required for graduation while seeking ways to bring additional value to their online programs. This research examines whether offering online MBA students a specialized marketing concentration in digital marketing will make students marketable to businesses. The research examines this conjecture and provides a recommendation for MBA stakeholders. Study 1 shows the industry demand for …

Roberts Rules Of (Dis)Order: Doctrinal Doublespeak On Affirmative Action And Stare Decisis, Vinay Harpalani Jan 2024

Roberts Rules Of (Dis)Order: Doctrinal Doublespeak On Affirmative Action And Stare Decisis, Vinay Harpalani

SMU Law Review

In this Article, I argue that Chief Justice John Roberts engaged in doublespeak in his SFFA v. Harvard/UNC majority opinion. He essentially overruled Grutter v. Bollinger (2003) but did not admit doing so, and even structured the SFFA opinion as if he was following Grutter’s precedent. My Article considers why Chief Justice Roberts engaged in this “stealth overruling” of Grutter and exposes his doctrinal sleight of hand in doing so. I first consider how Chief Justice Roberts may have been concerned about the Court’s legitimacy in the wake of its ruling in Dobbs v. Jackson Women’s Health Organization (2022)—where it …

Representation In Healthcare Matters: Perspectives On Inadequate Physician Diversity And Its Potential Impact On Minority Patients, Madison Andrews Jan 2024

Representation In Healthcare Matters: Perspectives On Inadequate Physician Diversity And Its Potential Impact On Minority Patients, Madison Andrews

Sociology Honors Papers

Disparities in access to healthcare among U.S. racial and ethnic groups, including access to quality services, have existed for centuries (Gibbons, 2005), leading to inequality in health outcomes as race/ethnicity intersects with gender and socioeconomic status (Wellons et al., 2009; Yan et al., 2023). Patients from minority communities face disadvantages due to the lack of diversity amongst physicians, including communication barriers, lack of trust, lesser rapport, and lower level of comfort with doctors who are non-representative of patients’ demographics (Ha & Longnecker, 2010; Lopez et al., 2023; Maldonado et al., 2014; Weech-Maldonado et al., 2003). It is important, then, to …

Impact Of A Covid-19 Related Lockdown On The Experience Of Informal Caregiving In Singapore, Vicky Mengqi Qin, Abhijit Visaria, Rahul Malhotra

ROSA Journal Articles and Publications

Introduction: Lockdowns, while limiting COVID-19 transmission, can affect provision of care by informal caregivers and their caregiving experience. We assessed, among informal caregivers in Singapore, (a) the perceived impact of a 2-month (April to May 2020) nationwide lockdown on their care provision, (b) correlates of different perceptions of the impact of the lockdown on care provision, and (c) association of different perceptions of the impact with negative and positive experiences of caregiving. Methods: In the August 2020 wave of the Singapore Life Panel (SLP; nationally representative, longitudinal monthly survey of Singapore citizens and permanent residents aged 50-70 years at baseline), …

Pirates Of The Academe: A Critical Criminological Analysis Of Intellectual Property Laws Criminalizing Filipino College Students Using Pirated Papers From Sci-Hub, Jasper Franz T. Mapa

Asia-Pacific Intellectual Property Management and Innovation Book Series

This study addresses the unrecognized impact of shadow libraries and piracy websites on copyright and intellectual property laws within academic institutions. Focusing on students from the Philippines who faced criminalization for using Sci-Hub, the study aims to provide valuable insights and bridge gaps in the existing literature from critical criminological perspectives. By exploring the criminalization resulting from intellectual property laws, student motivations for accessing Sci-Hub, and the social characteristics that influenced their usage, the researcher sought to gain a comprehensive understanding of the phenomenon. Using snowball sampling, four participants were recruited for this study. The findings revealed four main themes: …

Why Broker Novel Concepts Into Economic Sociology? Transcending The New Economic Sociology, Aaron Z. Pitluck Jan 2024

Why Broker Novel Concepts Into Economic Sociology? Transcending The New Economic Sociology, Aaron Z. Pitluck

Faculty Publications – Sociology and Anthropology

This Current Sociology Monograph draws together six articles that broker novel concepts into economic sociology. To orient this enterprise, this article examines the concepts of creativity and novelty in social theory and explains why it is challenging work to broker concepts across intellectual communities. To understand the existing boundaries across which one could broker, it next describes how the subfield of economic sociology has been shaped by the separation of economics and sociology as distinct fields, which ultimately led to a decline of sociologists studying the economy. Two counter-acting organizational forces that sought to institutionalize a subfield of economic sociology …

Banned Books & Banned Identities: Maintaining Secularism And The Ability To Read In Public Education For The Well-Being Of America's Youth, Megan M. Tylenda Jan 2024

Banned Books & Banned Identities: Maintaining Secularism And The Ability To Read In Public Education For The Well-Being Of America's Youth, Megan M. Tylenda

Indiana Journal of Law and Social Equality

Books containing LGBTQ+ themes and characters are being removed from public school libraries at a rapid rate across the United States. While a book challenge has made it to the Supreme Court once before, the resulting singular plurality opinion left courts without a clear test to apply, ultimately leaving students’ First Amendment rights in the air. Additionally, the increasingly relaxed view of courts towards religious influence in public schools indicates that if a modern case were to reach the Supreme Court, religious challenges may be accepted, which would leave LGBTQ+ students who seek to see themselves represented in literature without …

Swimming: A Great Decision And An Even Better Journey, Eva M. Hunnius Jan 2024

Swimming: A Great Decision And An Even Better Journey, Eva M. Hunnius

Emerging Writers

Swimming is loved, feared, and cherished by so many around the world. People love it because it gives them a sense of freedom and peace, while also receiving a great workout. Some may fear it because they do not know how to swim, or they feel like there are many dangers and risks to swimming. Others cherish it because it is the only sport they have ever known. In my case, swimming is one of the only things that has been with me since I was a little kid. This remains true for many athletes. In this discussion, I hope …

Fifa's One Association - One Vote Rule: Does Democratic Governance Ensure Its "Corporate" Integrity?, Ilias Bantekas Jan 2024

Fifa's One Association - One Vote Rule: Does Democratic Governance Ensure Its "Corporate" Integrity?, Ilias Bantekas

American University Business Law Review

This article suggests that in the absence of any requirement in favor of democratic governance of corporations and non-profit entities in national law, as well as in light of a general practice of bifurcated systems (oscillating between de jure equality and power-based governance) in respect of intergovernmental organizations, a nondemocratic governance structure in international sports federations would not deviate from the general rule. What is clearly at stake in complex organizations is effectiveness in achieving the aims of the organization, irrespective if all members are satisfied. The deceptively democratic nature of sporting federations such as FIFA is very much the …

The Art Of Re-Presenting : Power And Agency For Black Women Amid Trauma, Oppression And Everyday Life, Diane Carol Vermette Jan 2024

The Art Of Re-Presenting : Power And Agency For Black Women Amid Trauma, Oppression And Everyday Life, Diane Carol Vermette

Wayne State University Theses

In this thesis, the work and lives of seven Black American women artists who created artwork in the twentieth century are explored to discover how they have used their work to represent Black women in America. Using four critical concepts: Double Consciousness, First, Second, and Third Wave Feminism, Black Feminist Thought, and Intersectionality, several critical questions are answered in order to discover the historical and social context in which they worked and how this affected their ability to reflect the lives, struggles, hopes, and identities of themselves and other Black women. Using the word re-presenting as a signifier of how …

Constructing The Birthing Body Across The 20th Century: A Thematic Analysis Of Infertility Disorders In The New England Journal Of Medicine, Nicola Davis Jan 2024

Constructing The Birthing Body Across The 20th Century: A Thematic Analysis Of Infertility Disorders In The New England Journal Of Medicine, Nicola Davis

Public Health Theses

Obstetrics and Gynecology (OB/GYN) is a medical subspecialty primarily concerned with birth care, reproduction, and gynecological health. OB/GYN practice plays a historically significant role in the treatment of infertility and reproductive disorders as cultural ideologies of fertility and motherhood have been co-constructed alongside the development of OB/GYN medical practice and knowledge. These constructs inform obstetric practice and serve as a framework for contemporary reproductive care. Modern birth care in the medical setting often reinforces a myriad of issues including stigmatization of birthing people’s bodies, over-medicalization of birth, obstetric racism, and obstetric violence. This paper focuses on the evolution of particular …

Real Versus Perceived Crime Rates: Examining Causes Of The Disconnect Between Fear And Reality, Sage L. Eck-Miller Jan 2024

Real Versus Perceived Crime Rates: Examining Causes Of The Disconnect Between Fear And Reality, Sage L. Eck-Miller

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Americans are more fearful of crime than at any other point in the past two decades, even though crime rates are at the lowest point in close to 30 years. Previous literature has examined various causes of this exaggerated fear, ranging from gender differences to perceived neighborhood disorder as the cause. There have been multiple findings suggesting that neighborhood disorder plays a significant role in creating fear of crime. The presence of trash, unkempt lawns, and run-down properties lead people to believe crime is worse in their area than it actually is. This study examines fear of crime in association …

Racial Capitalism, The Precariat, And Us Immigration: Past And Present, Lily Dunkin Jan 2024

Racial Capitalism, The Precariat, And Us Immigration: Past And Present, Lily Dunkin

Scripps Senior Theses

Combining the lens of the political economic theories of Racial Capitalism and the Precariat, and applying them to a historical analysis of the US immigration system and its modern implications in US States, we are better able to understand to manner in which the immigration regime works to provide a cheap, exploitable labor force for US industry elites. By establishing and fortifying pre-existing racial hierarchies within the US while also utilizing the precariat’s philosophies on flexible labor and a lack of economic security, elites are able to weaponize the fear instilled by the US Immigration system and leverage their bottom …

The Female Force: Gender Salience And Political Interests In The 2011 Tunisian Revolution, Katherine Meagor Jan 2024

The Female Force: Gender Salience And Political Interests In The 2011 Tunisian Revolution, Katherine Meagor

Scripps Senior Theses

To acknowledge the role of women and their rights in Tunisian society, the 2011 Tunisian Revolution offers a case study for the multi-faceted dimensions of political movements that affect civil society. With the understanding that women exercised political agency differently and were affected by the changing political opportunity structure, this study aims to address the following questions: how did women navigate their female gender identity and political interests during the 2011 Tunisian Revolution? How did gender identity affect female participation during the Revolution? How did the Revolution prompt activism among women? How did the intersection of various identities contribute to …

The Holy Abject: The Narrative Arc Of Female Christian Martyrdom And Its Implications For Subjecthood In The Roman Empire, Gillian Murdock Gardner Jan 2024

The Holy Abject: The Narrative Arc Of Female Christian Martyrdom And Its Implications For Subjecthood In The Roman Empire, Gillian Murdock Gardner

Scripps Senior Theses

This thesis aims to utilize modern critical theory to reveal how the hagiographies of early female Christian martyrs follow a standardized narrative arc. The martyr’s body is hyperfeminized, transformed, and eventually eclipsed in a simultaneous process of unbecoming in the corporeal realm and becoming in a divine register. The martyr’s augmented femininity signals her ability to endure as far as womens’ abject position in the Empire allows, while her bodily transformation conveys a transgression of the ontological pairings of active masculinity and passive femininity that govern Roman social order. Finally, the martyr’s death communicates an imperial attempt to reestablish the …

An Introductory Guide To Developing Liberal Arts And Sciences Education, Azamat Sakiev Jan 2024

An Introductory Guide To Developing Liberal Arts And Sciences Education, Azamat Sakiev

GHEA21 Open Educational Resources

Human learning styles, goals, and beliefs about the purpose of education differ greatly. What should we learn, how do we learn it, and to what end, are some of the key questions that underlie this difference. There is no one-size-fits-all approach to learning because individuals have unique needs, different preferences, and varying aptitudes. Because of this there are several approaches and philosophies to education, of which liberal arts and sciences is one. The task in this guide is to define what this approach is, outline its characteristics, and identify prospective areas for its development in which anyone could contribute.

Essays On Public And Nonprofit Financial Dynamics, Yunjun Kim Jan 2024

Essays On Public And Nonprofit Financial Dynamics, Yunjun Kim

Theses and Dissertations--Public Policy and Administration

This dissertation consists of three essays that explore different dimensions of financial dynamics in the public and nonprofit sectors. Each chapter examines how the fiscal behavior of neighboring jurisdictions, policy interventions, and financial practices influence fiscal decision-making and financial performance within these entities.

In the first essay, I investigate yardstick competition in local government spending in South Korea by leveraging the exogenous variation introduced by by-elections. This approach allows me to estimate the influence of neighboring jurisdictions on local expenditures. Contrary to previous empirical studies from other countries, my findings reveal no significant interdependence in spending among South Korean municipalities, …

Studying Conspiracy Theory After The (Current) Rise Of Right-Wing Populism, Mark Fenster Jan 2024

Studying Conspiracy Theory After The (Current) Rise Of Right-Wing Populism, Mark Fenster

UF Law Faculty Publications

The American historian Richard Hofstadter intended his still-influential essay on the “Paranoid Style in American Politics,” which initiated the modern study of conspiracy theories, as a response to the mid-1950s rise of right-wing populism in the US. Reflecting on the lessons we can learn from the insights and weaknesses of Hofstadter’s timely intervention into contemporary politics, as well as the author’s three decades studying conspiracy theories, the chapter asks how current academic work, which takes place within and responds to another rise in rightwing populism, should understand and intervene in the present and prepare for the future.

Civil Procedure For The Anthropocene, Roger Michalski, Emily S. Taylor Poppe Jan 2024

Civil Procedure For The Anthropocene, Roger Michalski, Emily S. Taylor Poppe

Faculty Articles

Climate considerations must become an element of procedural analysis. Scholars, rule makers, legislators, and judges have historically prioritized procedural values including cost, speed, and accuracy. More recent waves of scholarship—including critical perspectives—have emphasized participation as a further procedural goal. Yet this list has grown stale. Current environmental realities force all areas of law, including civil procedure, to reckon with climate change. In the future, proceduralists will be forced to integrate climate-aware thinking into their analyses, proposals, and discussions. Predictably, minds will disagree on how to accomplish this and the kinds of trade-offs that are warranted. Yet the fundamental point of …
