Getting It Right The First Time: Making Child Sex Offender Sentencing In The Fourth Circuit More Efficient With A New Methodology For Crafting Content- Based Special Conditions Of Supervised Release, Nicholas S. Curcio
Vanderbilt Law Review En Banc
Defendants convicted of child-sex crimes across the U.S. Court of Appeals for the Fourth Circuit have brought a number of appeals in recent years claiming that portions of their sentences must be vacated. They assert that the district court judges that sentenced them failed to abide by their statutory obligations under 18 U.S.C. § 3583(d) to appropriately impose certain restrictions on their ability to consume pornographic material or use the internet following their release from prison. While the Fourth Circuit tried to address this issue in 2020, appeals in the following years revealed that some district court judges were still …

Drone Vs. Drone, Mariah Smith
Drone Vs. Drone, Mariah Smith
Cybersecurity Undergraduate Research Showcase
This paper focuses on the problems that drones pose to digital and physical infrastructure, as well as potential solutions to combat these issues. One solution is incorporating drone usage into ethical hacking. These drone-based attacks are affecting not only economic spaces but also seemingly high-security areas such as prison systems. It is only a matter of time before critical infrastructure is targeted. Conversely, by simulating drone attacks, drones equipped with complex hacking tools and sensors can detect unauthorized pathways and infiltrate networks for the greater good. Incorporating these new practices would enhance digital and physical protection. "Drone vs. Drone" highlights …

Understanding Contributing Factors To Injury Severity And Improper Driver Actions In Work Zone Crashes And Evaluating Smart Work Zone Applications For Safety Improvement, Rakesh Rangaswamy
USF Tampa Graduate Theses and Dissertations
A work zone can be described as a roadway designated for construction, maintenance, or other activities that temporarily disrupt the normal traffic flow. Due to this disrupts in traffic conditions, work zones may bring sudden shifts in driving experience, depending on the sort of work zone present, creating unpredictable maneuvers, and putting both motorists and workers at risk. To understand these issues, this study uses work zone accident data obtained from Florida and uses several methodological techniques, including the mixed logit model with variance and mean heterogeneity, temporal instability test, log-likelihood test, out-of-sample analysis, and ANOVA test.
Firstly, this study …

More Than A Place For Social Capital Creation: Public Library As A Place For Immigrants’ Social Integration, Nafiz Z. Shuva
More Than A Place For Social Capital Creation: Public Library As A Place For Immigrants’ Social Integration, Nafiz Z. Shuva
Publications and Research
Studies have shown that public libraries, one of the most trusted social institutions, play an important role in helping immigrants adjust to their host country. Although there have been quite a few international studies reporting the role that public libraries play in newcomers lives in the host country, few studies, especially in the context of the U.S., comprehensively reported local public libraries’ role in newcomers’ social integration. Previous studies on immigrants’ usage of public libraries have mainly focused on highlighting public libraries as meeting places that facilitate social capital creation for newcomers or describing the usage of public libraries among …

Can Lower-Body Strength And Power Alleviate Load Carriage Performance Decrements (Tactical Deficit) In Simulated Law Enforcement Job Tasks?, Ashley M. Bloodgood, Joseph Dulla, Megan Thompson, Matthew R. Moreno, Robin (Rob) Marc Orr, J. Jay Dawes, Robert G. Lockie
International Journal of Exercise Science
International Journal of Exercise Science 17(4): 1577-1594, 2024. Law enforcement agencies typically have recruits complete fitness assessments without personal protective equipment (PPE). PPE negatively impacts performance. Greater strength and power could alleviate performance decrements due to the extra load, termed the tactical deficit (TD). The purpose of this study was to examine whether lower-body strength or power related to the TD in civilians performing police tasks. Twenty participants (12 men, 8 women) completed baseline tests, including: standing broad jump (SBJ); relative SBJ; absolute and relative isometric leg/back dynamometer (LBD) and one-repetition maximum hexagonal bar deadlift (HBD). In two other sessions, …
Reconceiving Corporate Rights And Regulation In The Ai Era, Michael R. Siebecker
Reconceiving Corporate Rights And Regulation In The Ai Era, Michael R. Siebecker
Sturm College of Law: Faculty Scholarship
Can existing corporate governance principles properly guide the relationship between shareholders and directors as artificial intelligence (“AI”) plays an increasingly prominent role in corporate management, planning, and operations? Without a doubt, AI technologies allow corporations to enjoy enhanced efficiency and innovation. But the vast range of AI capabilities—from sophisticated data analytics to autonomous decision-making—raises profound questions about whether traditional governance principles remain sufficiently robust to cabin the proper development and deployment of such a powerful and rapidly evolving set of new technologies. Current corporate governance structures that focus on human actors and traditional business decision-making mechanisms seem ill-suited to address …
Patrol-Level Law Enforcement Experiences With Gray Area Mental Health Crises, Stephanie Louise Schilling
Patrol-Level Law Enforcement Experiences With Gray Area Mental Health Crises, Stephanie Louise Schilling
Walden Dissertations and Doctoral Studies
Law enforcement officers (LEOs) often find themselves responding to mental health crises that are gray area situations that neither clearly warrant arrest nor hospitalization but still require intervention. This qualitative study involved addressing the critical issue of how patrol-level officers in California manage such crises despite limited mental health training and restrictive legal frameworks. The study involved filling a gap in literature by focusing on nuanced challenges officers face in these situations, rather than use of force or racial disparities. Grounded in Bronfenbrenner’s bioecological model, the research involved exploring lived experiences of six patrol-level officers using interpretative phenomenological analysis (IPA). …

Improper Indeterminate Incarceration: Navigating The Constitutional Quandaries Of The Reagan Tokes Law's Powers And Procedures, Sophie M. Piteo
Cleveland State Law Review
This Article advocates for an amendment to the statutory provisions that make up Ohio’s indefinite sentencing scheme to better protect offender’s constitutional rights. Through an analysis of the Reagan Tokes Law and the Ohio Supreme Court’s ruling in State v. Hacker, this Article traces the evolution of Ohio’s indefinite sentencing framework, which was reinstated in 2019. It contrasts the current scheme with the previously invalidated, but very similar, Bad Time Law, which was struck down in 2000 for violating the separation of powers clause and due process rights. While the Reagan Tokes Law emerged from concerns for public safety …

Cohort Study Of Microelement Status In “Healthy” Population Of Russian Megapolis, Andrew K. Martusevich, Konstantin A. Karuzin
BioMedicine
The aim of the study was at the cohort assessment of microelement status in large city residents classified as “apparently healthy people”. The population study included 2,025 randomly selected middle-aged (2045 years) persons without chronic diseases or acute infectious pathologies. The set of subjects was standardized by age and gender. A blood sample was taken once from each person to determine concentrations of microelements. The level of peripheral blood microelements were determined by atomic absorption spectrometry using «Shimadzu AA7000» device (Japan). The study of a large population of city residents demonstrated inhomogeneity in their microelement status. Deficit conditions were found …

Exploring Community Adaptation To Public Safety Power Shutoff Events: Findings From Two Case Studies Of Unincorporated Mountain Communities In Southern California, Ramiro M. Brown
Master's Theses
As aging electrical infrastructure in the US continues to succumb to unyielding weather patterns brought on by climate change, there is an urgency among Investor-Owned Utilities (IOUs) to reduce the likelihood of their equipment sparking a wildfire. Public Safety Power Shutoffs (PSPS) – the intentional de-energization of the electrical grid on high fire weather danger days – have become a staple in IOU Wildfire Mitigation Plans (WMPs) since 2018 as one way to avoid wildfire ignitions via electrical infrastructure. One criticism of PSPS events is that they create their own hazard by cutting off power to thousands – sometimes millions-of …
The Effects Of Sleep And Culture On A Police Officer’S Mindset Involved In A Traffic Collison, Christopher Gary Cano
The Effects Of Sleep And Culture On A Police Officer’S Mindset Involved In A Traffic Collison, Christopher Gary Cano
Walden Dissertations and Doctoral Studies
The host police department experienced 58 traffic collisions from 2019-2020, which resulted in adverse outcomes for police officers and community members. The police department seeks a solution to reduce and prevent future collisions. This problem is not an isolated incident, as traffic collisions have been the leading cause of death and injury to police officers in the United States for the last three decades. Previous research focused on the causative factors of traffic collisions (speeding, distracted driving); however, little research has been dedicated to why a police officer would engage in risky driving. Is the mindset of a police officer …
