Why News Organizations ‘Platform’ Illiberal Politics: Understanding News Production, Economic Insolvency, And Anti-Democratic Pressure Through Cnn’S 2023 Trump Town Hall, Nik Usher
Communication: Faculty Scholarship
This article discusses how the economic insolvency of the contemporary mainstream media makes it particularly vulnerable to manipulation by illiberal political actors. Through a case study of CNN’s 2023 Trump Town Hall event, this article argues that democratic backsliding itself has become a potent constraint structuring news production routines and news decision-making. The metajournalistic discourse about the event maligned the role of CNN in “platforming” the former president, underscoring how platform logics have hijacked newsroom decision-making and news judgment. Journalists and other commentators pointed to the continuing power of Trump to dominate coverage and the continued inability of mainstream media …

Covid-19 Disruptions And Coping Strategies For Media Houses In Uganda: Case Of Next Media Services, Arthur Matsiko
Covid-19 Disruptions And Coping Strategies For Media Houses In Uganda: Case Of Next Media Services, Arthur Matsiko
Master of Arts in Digital Journalism
News production in the legacy media houses occurs in enclosed spaces. Editors, reporters, sub-editors, and news producers discuss and develop story ideas for production and dissemination on television, radio and print platforms. However, the Covid-19 pandemic presented a significant change in the traditional operation of the newsroom. This disruption interfered with the journalistic norms of story ideation, news sourcing, gatekeeping and distribution. Local and regional media organisations struggled through the Covid-19 pandemic because technological adoption mechanisms had long been dragged. By the time the pandemic hit Ugandan newsrooms, most media houses lacked fall-back plans, which led to several changes such …

Industrial Safety: How Complacency At Industrial Facilities Has Evolved As A Result Of Widespread Corporate Leadership Induced Reductions In Force Of Essential Critical Infrastructure Workers, Christina Kniffin-Downs
Graduate Thesis and Dissertation 2023-2024
With the renewal of interest in nuclear energy as a green energy source, battery plant manufacturing for electric vehicles, and semiconductor fabrication plant construction, it is necessary to address the evolution of complacency as it relates to industrial facility leadership and the widespread reduction in force of essential critical infrastructure workers. As a skilled craft person in the piping trades, with almost two decades of experience in mechanical construction, ten of those years as a nuclear worker, and as a traveling pipefitter working at chemical, refinery, and gasification plants, I am intimately aware of the behaviors, practices, and procedures inherent …

A Case Study Of Technology Integration At A Community College During A Disruption Of Learning Due To A Global Pandemic, Cara Suzanne Barth-Fagan
Dissertations
This paper discusses the challenges and opportunities of remote learning during the COVID-19 pandemic. It highlights the financial stress, digital divide, and inequalities in educational opportunities that arose during this period. However, it also acknowledges the advantages of remote learning, such as flexible scheduling, individualized learning, and global collaboration. The study design used was qualitative, aiming to identify the perceived levels of student engagement and support between faculty and students, and the perceived levels of success of completing a blended learning course in an online, hybrid, or hyflex format during a global pandemic. The paper concludes by emphasizing the importance …

The Trials Of Bail: Pre-Trial Presumption Of Innocence Under The Unlawful Activities (Prevention) Act, 1967 And General Criminal Laws, Radhika Chitkara
National Law School of India Review
The crisis of undertrial prisoners in India, constituting three-fourths of the total prison population, has occasioned a normative recognition of the relationship between bail and the presumption of innocence (‘PoI’). The same recognition, however, does not extend to special criminal laws such as the UAPA, where almost every single prisoner is an undertrial on account of provisions prohibiting grant of bail. With a focus either on outcomes (prison population) or exceptions (national security considerations), the jurisprudential relationship between bail and PoI per se remains underexplored under both the general and special criminal legal regimes. At issue is the ‘thin’ conception …
Special Challenges In The Execution Of Arbitral Awards In India In Public- Private Partnerships: A Trade Perspective, Srividhya Ragavan, Niraj Kumar Seth
Special Challenges In The Execution Of Arbitral Awards In India In Public- Private Partnerships: A Trade Perspective, Srividhya Ragavan, Niraj Kumar Seth
National Law School of India Review
With around 47 million pending cases at various stages of Indian judiciary and one of the lowest levels of judges per million of population in the world, India’s arbitration regime presents a ray of hope for millions of Indians who face the prospect of justice being denied to them due to inordinate delays caused by a clogged judicial pipeline. The enactment of the Arbitration and Conciliation Act, 1996 was presented as a viable alternative to resolving commercial disputes in a timely manner. This paper uses a case study to discuss how arbitration in India has not fulfilled the timeliness promise …
The Impact Of Civilian Investigative Agency Resources On The Timeliness Of Police Misconduct Investigations, Sharon Fairley
The Impact Of Civilian Investigative Agency Resources On The Timeliness Of Police Misconduct Investigations, Sharon Fairley
Articles
As many cities and counties turn to civilian oversight of law enforcement to enhance accountability, resource allocation is a critical issue with which police reform advocates, oversight entity administrators, and political leaders struggle almost every budget cycle. Resources are tremendously important in this context. Historically, lack of resources has been an important, if not the decisive factor leading to an oversight entity’s demise.
This Article reports on a unique and newly created dataset composed of case management and budgetary information from civilian oversight entities responsible for independent police misconduct investigations. The data were collected and analyzed to provide greater insight …
Historical Analogy And The Role Morality Of Reason-Giving, Darrell Miller
Historical Analogy And The Role Morality Of Reason-Giving, Darrell Miller
Articles
The Supreme Court has turned ever more to analogical reasoning from history and tradition to decide significant matters of public policy. Nowhere is this phenomenon more evident than in the Court’s 2022 decision in New York State Rifle and Pistol Association v. Bruen.
The Court’s crafting of a Second Amendment test that turns almost entirely on the strength of analogies—and on a topic of such intense public salience—has thrust analogical reasoning to the forefront of judicial and academic debate. While many have questioned the workability of Bruen’s focus on historical analogs, this Essay is less concerned about the pragmatics of …
Private Security And Public Police, Ben Grunwald, John Rappaport, Michael Berg
Private Security And Public Police, Ben Grunwald, John Rappaport, Michael Berg
Articles
Private security officers outnumber police by a wide margin, and the gap may be growing. As cities have claimed to defund the police, many have quietly expanded their use of private security, reallocating spending from the public to the private sector. It is difficult to know what to make of these trends, largely because we know so little about what private security looks like on the ground. On one prevalent view of the facts, a shift from public to private security would mean little more than a change of uniform, as the two labor markets are deeply intertwined. Indeed, academics, …

Technology, Tradition, And “The Terror Of The People”, Darrell Miller, Alexandra Filindra, Noah Kaplan
Articles
In New York State Rifle & Pistol Ass’n v. Bruen, the Supreme Court man- dated a text, history, tradition, and analogy–only approach to Second Amendment cases.
No longer can policymakers rely on empirical data alone to carry their litigation burden. Now such data must conform to a still-emerging “historical tradition of fire- arm regulation” to meet constitutional muster. Some despair that reams of data, careful experiments, and rigorous statistical analyses no longer have any relevance to the gun debate.
But those that claim that Bruen signals the end of empirically grounded policy solutions badly misread the opinion. Empirical studies can …

The Future Of Jacobson V. Massachusetts And Modern Substantive Due Process For Public Health Preparedness, Helen S. Webster
The Future Of Jacobson V. Massachusetts And Modern Substantive Due Process For Public Health Preparedness, Helen S. Webster
Saint Louis University Journal of Health Law & Policy
Both the threat of public exposure to Ebola in the United States in 2014 and the COVID-19 pandemic beginning in 2020 prompted states to impose quarantine and mask mandates, among other responses, to protect the public’s health. When these state actions were eventually challenged on substantive due process grounds in courts across the nation, judges struggled to determine which legal test applied when reviewing the constitutionality of the state actions. On one hand, courts considered the precedent set forth in Jacobson v. Massachusetts, a 1905 Supreme Court case that upheld a Massachusetts vaccine mandate as a valid exercise of …

The Supreme Court’S Access To Court Decisions In 2023-2024, Jane Perkins, Amanda Avery, Arielle Linsey, Sarah Somers
Saint Louis University Journal of Health Law & Policy
The Supreme Court’s 2023–24 Term produced a number of controversial decisions, affecting everything from where unhoused people can sleep to the president’s absolute immunity. In this Article, we discuss significant decisions that have implications for access to court for civil litigants, focusing on a trio of decisions that curtail the power of administrative agencies. Also highlighted are decisions that address jurisdiction, standing and mootness, sovereign immunity, statutory construction, due process, and equal protection. We close with a brief preview of cases before the Court during the 2024–2025 Term.

Exploring The Intersectional And Spatial Implications Of The Police Power To Search Dwellings Incident To Lawful Arrest: A Comment On R. V. Stairs, Danardo S. Jones
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines whether the Supreme Court of Canada’s decision in R. v. Stairs to alter the baseline police power to conduct searches incident to lawful arrest adequately addresses issues of intersectionality and spatiality. The paper’s principal focus is on race and class, which is analyzed through the lens of critical theories around race and space/spatialization, drawing on Black geographies and Critical Race Theory (“CRT”). It will also consider critical legal theories that urge us to conduct a distributional analysis of the differential impacts of legal standards. Importantly, the paper considers how courts do and should conceptualize privacy and domesticity …
Operation Lone Star: Laying To Rest The Notion That Immigration Is An Invasion, Anna Carolina Mares
Operation Lone Star: Laying To Rest The Notion That Immigration Is An Invasion, Anna Carolina Mares
Georgia Law Review
Operation Lone Star, promoted by Texas as a border protection program, faces legal challenges for exceeding federal authority over immigration. In response to a federal lawsuit over the placement of buoys in the Rio Grande—a physical barrier aimed at deterring migrants—Texas defended its actions under the State War Power provision, asserting that it was “repelling an invasion” and required no congressional approval. This Note examines the rhetoric framing immigration as an invasion, beginning with an analysis of immigration powers and federalism before addressing the issues in United States v. Abbott. While the constitutionality of a state unilaterally declaring an …

Multi-Jurisdictional Hazard Mitigation Plan For Landslides For The Big Sandy Area Development District, Kentucky, Matt M. Crawford, Hudson J. Koch, Jason M. Dortch
Multi-Jurisdictional Hazard Mitigation Plan For Landslides For The Big Sandy Area Development District, Kentucky, Matt M. Crawford, Hudson J. Koch, Jason M. Dortch
Contract Reports--KGS
Landslides are a complex geologic hazard that occurs worldwide, impacting lives, infrastructure, and property. The Big Sandy Area Development District, Kentucky incurs high landslide activity impacting several municipalities. This hazard mitigation planning project includes landslide susceptibility and risk assessments for the Big Sandy Area Development District. We based the landslide susceptibility model on statistics of hillslope morphological features such as slope, curvature, roughness, aspect, and elevation. Using a dual machine learning approach, we modeled the probability of landslide occurrence, defined as an area that is occupied, or might be occupied in the future, by a landslide. We also developed the …
Adapting A Human Rights-Based Framework To Inform Militaries’ Artificial Intelligence Decision-Making Processes, Daragh Murray
Adapting A Human Rights-Based Framework To Inform Militaries’ Artificial Intelligence Decision-Making Processes, Daragh Murray
Saint Louis University Law Journal
Key global powers are engaged in the development of artificial intelligence (“AI”) for military purposes, and it is widely accepted that the development and deployment of AI tools will lead to a revolution in military strategy and the practice of warfighting. The question is whether these tools can be designed, developed, and deployed in a manner that facilitates compliance with international legal obligations—in particular the law of armed conflict and international human rights law—and if so, how. To date, this question has not been answered satisfactorily. This article examines how concepts and procedures derived from international human rights law can …
