Finding Rights In The Fine Print: How Terms Of Services Agreements Can Turn Consumer Search History Into Digital Property, Dalia Wrocherinsky Jan 2024

Finding Rights In The Fine Print: How Terms Of Services Agreements Can Turn Consumer Search History Into Digital Property, Dalia Wrocherinsky

American University Business Law Review

On October 16, 2023, the Colorado Supreme Court handed down the country’s first court opinion on the constitutionality of reverse keyword warrants. It found that Google’s Terms of Service created a Fourth Amendment property interest in a user’s search history such that police copying this data constituted a seizure. This was a completely novel contention that implicates basic, yet increasingly relevant and unsettled principles of property, contracts, and Fourth Amendment law.

This Comment will argue that fundamental principles of property, contracts, and Fourth Amendment law support the Colorado Supreme Court’s theory. It will explore how property rights are created and …

How Economically Marginalized Adolescents Of Color Negotiate Critical Pedagogy In A Computing Classroom, Jean Salac, Lena Armstrong, Megumi Kivuva, Jayne Everson, Amy J. Ko Jan 2024

How Economically Marginalized Adolescents Of Color Negotiate Critical Pedagogy In A Computing Classroom, Jean Salac, Lena Armstrong, Megumi Kivuva, Jayne Everson, Amy J. Ko

Computer Science Faculty Work

Background and Context: With the growing movement to adopt critical framings of computing, scholars have worked to reframe computing education from the narrow development of programming skills to skills in identifying and resisting oppressive structures in computing. However, we have little guidance on how these framings may manifest in classroom practice. Objectives: To better understand the processes and practice of critical pedagogy in a computing classrooms, we taught a critically conscious computing elective within a summer academic program at a northwest United States university targeted at secondary students (ages 14–18) from low-income backgrounds and would be the first …

“A Real Man . . .”: Deconstructing Machismo Heteronormative Standards With K–12 Latino Male Educators Through Dialogic Spaces, Mario Echeverria Jan 2024

“A Real Man . . .”: Deconstructing Machismo Heteronormative Standards With K–12 Latino Male Educators Through Dialogic Spaces, Mario Echeverria

Dissertations

In a K–12 educational landscape where 75% of educators are white women, recruitment of Latino male educators is crucial for diversification, yet these educators represent just 2% of the teaching workforce in the United States (NCES, 2020). These educators grapple with a layered sense of identity as they navigate expectations of hegemonic masculinity and machismo norms that dictate their roles as disciplinarians and saviors, especially for young boys of color (Brockenbrough, 2018; Lara & Fránquiz, 2015; Martino & Kehler, 2006; Mills et al., 2004; Singh, 2021). Unfortunately, Latino male educators leave the profession at twice the rate of their Latina …

The Effects Of Language-Related Misunderstanding At Work, John Fiset, Devasheesh P. Bhave, Nilotpal Jha Jan 2024

The Effects Of Language-Related Misunderstanding At Work, John Fiset, Devasheesh P. Bhave, Nilotpal Jha

Research Collection Lee Kong Chian School Of Business

Demographic, technological, and global trends have brought the language used at the workplace to the forefront. A growing body of research reveals that language could result in misunderstanding at work, and influence employees' performance and attitudinal outcomes. Language at work encompasses standard language (e.g., English) as well as several hybrid forms of language (non-native accents, code-switching, and jargon). We delineate how these forms of language could result in misunderstanding. We then identify relational, affective, and informational mechanisms that underlie the relationship between language-related misunderstanding and employees' performance and attitudinal outcomes, and highlight key boundary conditions. In doing so, we uncover …

Geopolitics And Geospatial Strategies: The Rise Of Regulatory Supply Chain Controls For Semiconductor Gpn In Japan, South Korea And Taiwan, Yuko Aoyama, Eunyeong Song, Shan-Yu Wang Jan 2024

Geopolitics And Geospatial Strategies: The Rise Of Regulatory Supply Chain Controls For Semiconductor Gpn In Japan, South Korea And Taiwan, Yuko Aoyama, Eunyeong Song, Shan-Yu Wang

Geography

In this article, we present an analysis of how East Asian states (specifically, Japan, South Korea and Taiwan) are adapting to the emerging geopolitical contexts of the 'great powers competition' between the United States and China. To the extent that the previous literature on GPN/GVC governance included the state as one of the extra-firm actors, geopolitics has not been explicitly dealt with in its role in shaping GPN/GVC governance. We build on the existing research on GPN/GVC governance and propose a shift in perspective, from one of cost-driven to diplomacy-driven governance. Taking the case of the semiconductor industry, we conduct …

[Review Of The Book Jews, Food, And Spain: The Oldest Medieval Spanish Cookbook And The Sephardic Culinary Heritage, By H. J. Piner.], Martha Daas

World Languages and Cultures Faculty Publications

[Introduction] Tell me what you eat, and I will tell you who you are. This should be the motto of any book that examines the medieval food culture of Iberia. In her new book entitled Jews, Food, and Spain, Hélène Jawhara Piñer seeks to demonstrate both the process through which the Jewish cuisine of the Iberian Middle Ages acted as a cultural identifier, and how this culinary culture has been maintained in the modern Sephardic communities. Piñer's book aims to fill the gap in Spanish culinary history by "reintegrating Jewish cuisine into the historically transmitted food heritage of …

Social Media Sanctuaries: A Discourse Analysis Of Indian International Students' Agency And Liminality During The Russian-Ukrainian Conflict, Bhavika Sicka, Nadiya Ungo, Dennis Gregory

Educational Leadership & Workforce Development Faculty Publications

This study used a social media discourse analysis approach to illuminate the narratives of Indian international students in Ukraine who experienced displacement and upheaval because of the Russo-Ukrainian war. We used agency and liminality as analytic lenses to highlight how this uniquely situated population used Facebook to navigate conflict, voice their demands, support each other, challenge hegemonic narratives, re/construct their diasporic identities, and re-orient their futures. Findings indicate that Indian international students in Ukraine displayed insurmountable courage and resilience during the war, enacting agency from the margins to amplify their voices and actuate desired futures. Furthermore, South Asian students in …

Reclaiming & Reasserting Third World Womanhoods In U.S. Higher Education, Bhavika Sicka Jan 2024

Reclaiming & Reasserting Third World Womanhoods In U.S. Higher Education, Bhavika Sicka

Educational Leadership & Workforce Development Faculty Publications

This study combines narrative inquiry with Third World feminism to bring a nuanced and scopic perspective of Third World women student experiences in US higher education. Specifically, it utilises Talpade Mohanty's concept of Third World womanhood to visibilise the experiences of five Third World international female students. Understanding womanhood as transnationally fluid and contextual, I investigate how women international students from the Third World perceive themselves to be misrepresented or homogenised in Western higher education. I also examine how gender and foreignness act as dynamic, interrelated categories in doubly‐othering this population. The purpose is to identify how Third World women …

Global South Sisterhood In Virtual Exchange: A Critical Autoethnography, Bhavika Sicka, Arzu Atajanova Jan 2024

Global South Sisterhood In Virtual Exchange: A Critical Autoethnography, Bhavika Sicka, Arzu Atajanova

Educational Leadership & Workforce Development Faculty Publications

We are two women international students from the Global South, situated in Turkey and the U.S. respectively. In this article, we utilized collaborative autoethnography to critically reflect on our intellectual, emotional, linguistic, and cultural growth during a virtual exchange program that we participated in during the COVID-19 pandemic. Through this co-exploration, we analyzed our experiences and reflections as participants in a COIL program to consider, more broadly, the evolution and trajectory of virtual mobility in an uneven higher education landscape. Our virtual exchange emerged as a digital and transnational third space, unbounded by hegemonic epistemic, linguistic, or geographical borders. We …

Between The Entrepreneurial Impetus For Higher Profits And Consumer Rights Or Types Of Unfair And Misleading Commercial Practices: Insights From Bulgaria, Silviya Atanasova Topleva

International Journal on Consumer Law and Practice

The application of unfair misleading commercial practices affects the economic interests of consumers, threatening legal security and the achievement of market equilibrium. In response to these imbalances, the law builds a solid regulatory network for consumer protection. In the codification of the protection of consumer interests from unfair commercial practices, an important place is occupied by secondary legislation of the EU, and in particular Directive 2005/29/EC concerning unfair business-to-consumer commercial practices in the internal market. The article presents a classification of the types of unfair misleading commercial practices based on the regulatory framework at the European and national level. The …

Toward Equal Access: A Model For Lay Advocacy Programs Serving People Who Are Deaf Or Hard Of Hearing, Melissa Bell

JADARA

Advocacy programs are prevalent among state government agencies that specialize in serving persons who are deaf or hard of hearing around the United States. The work is crucial to ensuring equal access and equal opportunity, yet the lay advocacy profession is not yet formalized with certification, ethical standards, or training programs for advocates serving this population. Research was conducted to advance efforts to maximize these programs’ effectiveness by compiling components of an ideal model for lay advocacy programs. Directors from state agencies that specialize in serving this population around the country refined the model and described the structure of their …

Translanguaging Through Experiencing: The Lived Experiences Of Multilingual Learners Studying Chinese, Jiangping Cai Jan 2024

Translanguaging Through Experiencing: The Lived Experiences Of Multilingual Learners Studying Chinese, Jiangping Cai

Open Access Dissertations

Although the United States has a population with diverse linguistic and cultural backgrounds, multilingual education has been greatly influenced by monolingual and raciolinguistic ideologies (Flores & Rosa, 2019; García, 2014; Ruiz, 1984). With world language enrollment continuing to decline (Lusin et al., 2023), investigation of the lived experiences of diverse groups of multilingual learners (MLLs) would help to understand language learning from a sociocultural perspective, and better support multilingual education and planning. The purpose of this qualitative study was to explore the Chinese learning experiences of native English multilingual students studying Chinese at a U.S. public university language program. The …

From Page To Stage: Enlightenment Common Sense & The Semiotics Of The Body, 1660–1820, Nilton X. Gomes

Open Access Dissertations

How did eighteenth-century audience members or novel readers come to see beyond the facades of literary characters and narrators? By looking into moments of bodily concealment in the eighteenth-century novel and theater, this dissertation examines how authors and playwrights in this period wrote with subtly and force to make the body as and in many instances more legible to their readers as the words on the page or the dialogues on the stage in attempts to suture the gap that lies between what a writer intends and what a reader grasps in a literary work. It also stresses the body’s …

Advancing Clinical-Community Partnerships To Address Pediatric Food Insecurity, Nader Hamdi

Open Access Dissertations

Background: Children and families experiencing low income in the United States are at a greater risk of food insecurity (FI) and suboptimal diet quality than the general population. Childhood FI, which is associated with numerous poor health and developmental outcomes, has become so pervasive that the American Academy of Pediatrics recommends universal FI screenings. Routine FI screening in clinical settings presents opportunities for clinic-community partnerships to connect families experiencing FI with food access and nutrition education (FANE) programs. A variety of FANE programs, including the Supplemental Nutrition Assistance Program - Education (SNAP-Ed), are administered at the federal level to …

An Integrated Framework For Establishing Long-Term Transportation Management Strategies Promoting Sustainable Urban Growth, M Imtiaz Rahman

Graduate Theses, Dissertations, and Problem Reports (ETD)

Urban land areas are experiencing a more rapid expansion compared to their population growth on a global scale. This phenomenon, known as urban sprawl, is characterized by low-density development in the outskirts of cities. This unplanned urban growth leads to changing urban transportation patterns, posing a threat to sustainable development. In response, government agencies implement growth management practices, with transportation management strategies playing a crucial role in achieving sustainable urban growth. However, developing effective growth management strategies is difficult because of several challenges, including limited understanding of the key influencing factors, the complex interdependencies among these factors, and the uncertainties …

Research has shown that ethnic–racial socialization (ERS) predicts education and mental health outcomes for adolescents. However, limited research has evaluated the ERS experiences of Latinx students. The current study examined ERS experiences of Mexican American youth in four focus group interviews that were transcribed and analyzed at both the individual and group level using interpretive phenomenological analysis. Main themes included feeling like an outsider, navigating discrimination, encountering social/emotional difficulties, and achieving a positive identity. Each theme contained two to three subcategories that provide further insight into the Mexican Americans' ERS experiences. Participants reported within-group discrimination, motivation to disprove stereotypes, and …

The Relationship Between Social Justice Attitudes And Compassion In Preservice Teachers: A Critically Compassionate Intellectualism Framework, Megan Hut Jan 2024

The Relationship Between Social Justice Attitudes And Compassion In Preservice Teachers: A Critically Compassionate Intellectualism Framework, Megan Hut

Graduate Theses, Dissertations, and Problem Reports (ETD)

This dissertation aims to gain further knowledge about the implementation of the Critically Compassionate Intellectualism (CCI; Cammarota & Romero, 2003) framework in teacher education. This framework, originally developed to provide a better education for Latine students who were being silenced in their original schools, emphasizes authentic caring, critical pedagogy, and social justice content. CCI aims to provide students with an education that better equips them to be part of our democratic society and is supposed to lead to an increase in students’ critical consciousness through developing compassionate relationships and making content related to students’ experiences. Based on the success of …

Research Collection School Of Computing and Information Systems

Massive Open Online Courses (MOOCs) platforms are becoming increasingly popular in recent years. Online learners need to watch the whole course video on MOOC platforms to learn the underlying new knowledge, which is often tedious and time-consuming due to the lack of a quick overview of the covered knowledge and their structures. In this paper, we propose ConceptThread , a visual analytics approach to effectively show the concepts and the relations among them to facilitate effective online learning. Specifically, given that the majority of MOOC videos contain slides, we first leverage video processing and speech analysis techniques, including shot recognition, …

A 2024 Guide To Assessing: Resiliency And Resistance In Iran, Robert Burrell, David Diorio

GNSI Publications

This essay applies a data-driven and human-centric methodology to examine resiliency and resistance aspects in the Islamic Republic of Iran. It applies a four-phase process to analyze state resiliency, assess resistance to governance, identify various resistance movements, and provide possible options for an external actor to influence Iran's stability or to support resistance to the Islamic Republic. The methodologies utilized in this essay were previously published by Small Wars and Insurgencies and Expeditions with the Marine Corps University Press. In analyzing Iran, the data finds the Islamic Republic is a fragile regime governing a state with multiple and deep societal …

Placing Legal Context In Context, Chad Squitieri Jan 2024

Placing Legal Context In Context, Chad Squitieri

Scholarly Articles

In Biden v. Nebraska, Justice Barrett authored a concurrence in which she characterized the major questions doctrine as a linguistic canon that accounts for the “legal context” surrounding delegations of power. Some scholars have critiqued Justice Barrett's concurrence on the grounds that empirical research suggests that ordinary readers do not account for “majorness” in the way that the major questions doctrine requires. This Essay argues that those critiques miss the mark because they conflate factual context with legal context. Justice Barrett's concurrence should be considered within the broader textualist tradition of understanding “ordinary meaning” as a legal concept, and not …

Judicial Power And Potential Unconstitutionality: A Scholastic Perspective, Kevin C. Walsh Jan 2024

Judicial Power And Potential Unconstitutionality: A Scholastic Perspective, Kevin C. Walsh

Scholarly Articles

There is a fundamental legal distinction between making the law and applying it. All manner of juridical confusion follows from neglect of this distinction, as the Supreme Court’s statutory severability doctrine strikingly illustrates. In this lecture, I diagnose the cause of severability doctrine’s problems and identify a basic framework for replacement doctrine by drawing on that perennial philosophy which “view[s] the history of philosophy as the development of basic doctrines long discerned and taught, a development by way of deepening appreciation as opposed to constant replacement of one worldview by another.”

Anglo-Saxon Res Judicata Culture For Civil Law Systems, Cesare Cavallini Jan 2024

Anglo-Saxon Res Judicata Culture For Civil Law Systems, Cesare Cavallini

Northwestern Journal of International Law & Business

One traditional aspect distinguishing the common law system from the civil law one lies in the perceived disparities in the inspiration of the law-making process. The Anglo-Saxon system typically grounds its rules in explicit and discernible policies spanning social, anthropological, and economic realms directly relevant to the circumstances. In contrast, the civil law tradition frequently necessitates a fixed conceptual framework, sometimes detached from the practical needs of society. Or, at least, this dynamic persisted until recent changes prompted by the “doing business” model, which has timidly ascended to the forefront of the State agenda, particularly across Europe, notably in Italy. …
