The Eucharist Of The Latter-Day Saints: The Sacrament In The Broader Christian Context, Robin Douglas Jan 2024

The Eucharist Of The Latter-Day Saints: The Sacrament In The Broader Christian Context, Robin Douglas

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

This paper views the sacrament prayers and rituals of The Church of Jesus Christ of Latter-day Saints in the broader context of Christian eucharistic worship, focusing on how the Latter-day Saint observances both resemble and differ from those of other Christian communities. It argues that, contrary to what is often supposed, the Church has a relatively “high” eucharistic theology.

Is The Juridical Field Of Environmental Law In India Gendered? A Study Of Environmental Justice In Goa Through An Ecofeminist Lens, Shweta Dilip Singh Sinha Jan 2024

Is The Juridical Field Of Environmental Law In India Gendered? A Study Of Environmental Justice In Goa Through An Ecofeminist Lens, Shweta Dilip Singh Sinha

Theses and Dissertations

The aim of this study is to examine whether the “juridical field,” as defined by Bourdieu, of environmental law in India (Goa), is gendered. As per Bourdieu, the legal field is neither as neutral nor as autonomous as the legal profession asserts it is. It relies heavily on the juridical practices of universalization, appropriation, and naming or categorization in order to constantly reimagine and negotiate its own boundaries. This study examines these juridical practices including acts of symbolic violence committed in the process of ‘naming’ or ‘defining’ within legal terms extra-legal concepts, mainly environmental toponyms, such as, ‘“forest,” “CRZ” (Coastal …

Incorporating Unicorns: An Empirical Analysis, Anat Alon-Beck Jan 2024

Incorporating Unicorns: An Empirical Analysis, Anat Alon-Beck

Faculty Publications

There is a growing concern among regulators and academics about how to regulate unicorns - entities large enough to have a public impact yet remaining in the private domain. An examination of corporate charters within a selected sample of unicorn firms reveals an important finding: 97% of these entities are incorporated in Delaware. This concentration provides Delaware with significant leverage to shape regulatory frameworks, especially concerning the protection of parties who may lack the ability to safeguard their interests through contractual means.

This groundbreaking discovery on the dominance of Delaware showcases a substantial deviation from incorporation trends in other business …

Textiles, Dress And Politics: A Diachronic Perspective Through The Case Studies Of Ancient Rome And Medieval Iceland, Meghan Korten, Zofia Kaczmarek Jan 2024

Textiles, Dress And Politics: A Diachronic Perspective Through The Case Studies Of Ancient Rome And Medieval Iceland, Meghan Korten, Zofia Kaczmarek

Textile Crossroads: Exploring European Clothing, Identity, and Culture across Millennia

People dress for more than just aesthetic reasons. Over the centuries, dress became a sign of human civilization, allowing us to identify the origin, gender, and status of the wearer. Textiles and clothing influence our body, posture, movements, and the way we are perceived by society. Textiles are also a tool used by people to further their agenda, that is why they found their place in the political life of many ancient and modern societies.

According to Michel Foucault, power can be understood as a set of activities influencing the life of the other: It provokes, forbids, or permits, but …

What Does It Mean To Be An Ethical Lawyer? The Importance Of Context, Lynn Mather, Leslie C. Levin Jan 2024

What Does It Mean To Be An Ethical Lawyer? The Importance Of Context, Lynn Mather, Leslie C. Levin

Bibliography of Research Using UMLS Alumni Survey Data

Although the entire legal profession shares a single ethical code, lawyers’ understanding of what it means to be “ethical” shows considerable variation. This article discusses the factors that shape lawyers’ ethical conduct in practice. We review the role of legal education, bar associations, the workplace, and hard and soft regulators in the construction of lawyers’ ethical values. We then explore the important role that practice contexts play in shaping lawyers’ understanding of appropriate ethical conduct. Some of the key explanatory factors for differences among lawyers include type of client, office size, specialty and specialization, regulators, and the extent to which …

Part 5: Are Disability Rates Rising In Hampton Roads?, Dragas Center For Economic Analysis And Policy, Old Dominion University

State of the Region Reports: Hampton Roads

In this chapter, we examine one particular corner of a much larger disability story – those individuals who have a work history and subsequently seek to receive income from the Social Security Administration because of that disability. Contrary to what many people believe, both the number of applications for worker disability and rates of approval of those applications have trended downward in recent years. We explore the differences in disability rates and workers across Hampton Roads.

Dignity Deferred: Supriyo V. Union Of India And Lgbtq Rights, Ryan Thoreson Jan 2024

Dignity Deferred: Supriyo V. Union Of India And Lgbtq Rights, Ryan Thoreson

Faculty Articles and Other Publications

In Supriyo v. Union of India, a five-judge bench of the Supreme Court declined to find that same-sex couples have a right to marry under India’s Constitution. The various opinions in the case repeatedly recognised and affirmed the dignity of lesbian, gay, bisexual, transgender, and queer (LGBTQ) people, but ultimately found that exclusion from civil marriage did not run afoul of constitutional guarantees. In this Essay, I examine the limited understanding of dignity employed by the bench in Supriyo, juxtaposing this with both domestic and comparative LGBTQ rights decisions that embraced a more substantive understanding of dignity. I argue that …

The Necessary And Proper Stewardship Of Judicial Data, Aziz Huq, Zachary Clopton Jan 2024

The Necessary And Proper Stewardship Of Judicial Data, Aziz Huq, Zachary Clopton

Articles

Governments and commercial firms create profit and social gain by exploiting large pools of data. One source of valuable data, however, lies in public hands yet remains largely untapped. While the deep reservoirs of data produced by Congress and federal agencies have long been available for public use, the data produced by the federal judiciary is only loosely regulated, imperfectly available to the public at large, and largely ignored by scholars.

The ordinary process of litigation in federal courts generates an enormous volume of data. Especially after recent developments in large language models, this data holds immense potential. It can …

R. V. Sharma: Reckoning With Destabilizing Truths In Constitutional Equality Adjudication, Debra Parkes, Sonia Lawrence Jan 2024

R. V. Sharma: Reckoning With Destabilizing Truths In Constitutional Equality Adjudication, Debra Parkes, Sonia Lawrence

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

The Supreme Court of Canada’s 2022 decision in R. v. Sharma provides a window on contemporary but divergent judicial approaches to systemic racism in the criminal legal system and how these inform equality challenges based on race. The Sharma majority follows a trend identified by Efrat Arbel in recognizing the “crisis” of Indigenous mass incarceration using language which diffuses the causes of the crisis and does not generate urgent redress. However, in some cases, including in the Sharma dissent, recognition by judges can be an acceptance of accountability as part of the system which has produced these effects. We then …

Key Developments At The World Bank Inspection Panel (2013-2024), Dilek Barlas

Perspectives

Through the lens of important cases, this essay reflects on major developments that occurred at the Panel during the tenure of the author as the Executive Secretary of the World Bank Inspection Panel and shows how the Panel has evolved to improve accessibility, has influenced overall development policies, and has become a catalyst for institutional change. The essay observes that the Panel’s success has largely been due to its structural and operational independence, reporting as it does directly to the Bank’s Board of Executive Directors. However, there are challenges facing the Panel on certain issues, including most importantly its independence, …

Second Look Myopia: State Sentencing Reform And The Local Prosecutorial Response, Alexandra Harrington Jan 2024

Second Look Myopia: State Sentencing Reform And The Local Prosecutorial Response, Alexandra Harrington

Journal Articles

This Article advises caution against over-reliance on local prosecutors’ offices to effect second-look reforms and to filter cases worthy of review. Using the lens of New York’s recent second-look law, the Domestic Violence Survivors Justice Act (DVSJA), I analyze the ways in which the local prosecutor can serve as a functional barrier to statewide implementation of sentencing reform. The New York State Legislature enacted the DVSJA—after advocacy from hundreds of directly impacted individuals, stakeholders, and organizations and after significant opposition from only the District Attorneys’ Association—to change the way the State sentences survivors of domestic violence. The DVSJA also allows …

Charter Schools And Emos: Who's In Charge, Brendan Glynn Jan 2024

Charter Schools And Emos: Who's In Charge, Brendan Glynn

American University Business Law Review

Charter schools are a popular sight in the educational field today. For the IRS to consider a charter school a 501(c)(3) organization, nonprofit charter schools must be organized and operated exclusively for educational purposes, meaning purposes relating to the instruction of individuals to improve their capabilities. To be organized for educational purposes, the articles of the organization must limit the entity to educational purposes while also preventing the organization from engaging in substantial noneducational activities. To operate exclusively for educational purposes, an organization’s activities must be substantially in furtherance of educational purposes while also not substantially benefitting a private individual. …

Prosecutorial Independence Lost: How Prosecutorial Bureaucracy Is Politicized In South Korea, Neil Chisholm Jan 2024

Prosecutorial Independence Lost: How Prosecutorial Bureaucracy Is Politicized In South Korea, Neil Chisholm

Emory International Law Review

How is prosecutorial independence lost? How does a prosecution system’s design affect its political independence? This Article analyzes the inner workings of South Korea’s Prosecutors’ Office, which adheres to the Continental European style of prosecutorial organization and independence that emphasizes mechanisms of bureaucratic accountability for prosecutors. Based on interviews with prosecutors, police, judges, lawyers, scholars, and activists, it shows how independence is lost in three key areas of prosecutorial activity: personnel policy, investigations, and charging decisions. This article argues that aspects of the Continental tradition make prosecutors vulnerable to politicization.

Personnel policy has selected prosecutors meritocratically at young ages, trained …

Deadly Journeys: Climate Change, U.S. Border Enforcement, And Human Rights, Julia Neusner Jan 2024

Deadly Journeys: Climate Change, U.S. Border Enforcement, And Human Rights, Julia Neusner

Case Western Reserve Journal of International Law

Extreme weather events and slow onset disasters, exacerbated by climate change, are increasingly driving global displacement. As displaced people seek cross-border protection in unprecedented numbers, the United States has responded by tightening border controls and restricting asylum access. These policies have exposed migrants and asylum seekers in transit to greater risks of injury and death due to the impacts of climate change and climate-related disasters. Drawing on legal analysis, historical context, and firsthand interviews with people seeking U.S. asylum, this Article examines the implications of U.S. policies that limit freedom of movement and asylum access. The Article raises critical legal …
