Daca’S Stratified Tracks For Economic Mobility And Lessons For Addressing Immigrants’ Long-Term Inequality, Els De Graauw, Shannon Gleeson
Daca’S Stratified Tracks For Economic Mobility And Lessons For Addressing Immigrants’ Long-Term Inequality, Els De Graauw, Shannon Gleeson
UC Law Journal
Since 2012, the politically tenuous Deferred Action for Childhood Arrivals (DACA) program has provided temporary deportation relief and work authorization to over eight hundred thirty-five thousand undocumented young people who fit certain criteria. This Essay draws on one hundred fifteen interviews with DACA applicants in California, New York, and Texas during the heyday of the program to better understand its impacts on recipients’ school and work experiences. We confirm many of the key benefits DACA status has provided to recipients, notably opening doors for them educationally and professionally.
However, our research also confirms DACA’s uneven impacts. Those without four-year college …

Registered Dietitian Nutritionists’ Knowledge, Confidence, And Experiences With Treating Trafficked Individuals: A Call For Interprofessional Continuing Education, Christen C. Cooper, Lydia Mcroberts
Registered Dietitian Nutritionists’ Knowledge, Confidence, And Experiences With Treating Trafficked Individuals: A Call For Interprofessional Continuing Education, Christen C. Cooper, Lydia Mcroberts
Journal of Dietetic Education
Background: Victims of human trafficking (HT) frequently face malnutrition, dehydration, low food security, and infections. When identified, victims of HT are normally treated with interprofessional team (IPT) care that often excludes Registered Dietitian Nutritionists (RDNs). Although RDNs are trained to treat these conditions, they may lack knowledge, confidence, and skills, for working with this population, as well as the opportunities to work on such IPTs. To date, no study has explored RDNs’ knowledge of or work with individuals who are trafficked. Objective: To explore RDNs’: HT knowledge, confidence in the ability to work with victims of HT, and barriers to …

All Decisions
The landlord initiated a holdover proceeding against the tenant for allegedly illegally subletting the rent-stabilized apartment. The tenant defaulted at the inquest, but later filed an order to show cause to vacate the default judgment. The court granted respondent's order to show cause and vacated the default judgment and warrant pursuant to CPLR § 5015(a)(1). The court found that respondent had a reasonable excuse for her default and set forth potentially meritorious defenses of no illegal sublet. The court vacated the default judgment and warrant, and restored the proceeding for trial.

Man Up: Masculinity And Emotional Abuse Victimization, Kola Brown
Electronic Theses and Dissertations Archive
Intimate Partner Violence (IPV) is often only thought of in the context of physical violence towards women perpetrated by men. Historically, this form of violence garnered much attention due to its objective and visible nature. Unfortunately, other forms of abuse and male victims are often not recognized and result in victim blaming. One such form of abuse is psychological aggression. Studies show that men experience IPV at nearly equal rates as women, but that men experience psychological aggression, also referred to as emotional abuse, at higher rates. Additionally, Black families have the highest rates of abuse. However, due to abuse …
Exploring Sensory Ethnography In Open Inquiry: What Does River Want Me To Know?, Marianne (Ria) Jago
Exploring Sensory Ethnography In Open Inquiry: What Does River Want Me To Know?, Marianne (Ria) Jago
Talking Heads Seminar Series
This presentation features a creative and narrative research approach to research relationality and wisdom-seeking with place. A multi-modal practice-based approach will be outlined as a pathway that can be developed by people of any background. Through transdisciplinary methods in sensory ethnography and creative geography, I notice my sensed relatedness, or entanglement, with the cosmological Being of River. Deeply influenced by Indigenous listening methods I understand sensory engagement with River as ecologically essential research, and describe a practice-based pathway to learn from, and to "think with” water.
This research responds to the invitations of Indigenous Elders, and "wild" places, to listen …

Seeing Race & Sexuality: Child Welfare & Forced Labor, Annie Isabel Fukushima, Jens Nilson, Kaden Richards
Arkansas Law Review
This Article examines how child welfare responds to children who are forced to labor through a case study of California. We use an intersectional framework to argue that a conceptualization of current sociolegal responses to human trafficking cannot be delinked from racialized and sexualized forms of governmentality. In using an intersectional framework, we hope to draw upon intersectionality as a way to “point[] to the ways that structural inequality, persistent disadvantages, and structural abandonment are some of the root causes of microlevel violent interactions and at the same time influence how effective macrolevel justice policies are at responding to or …

Frequency & Severity Modeling Of Cyber Risk, Vilma Yayra Mensah Ofori
Frequency & Severity Modeling Of Cyber Risk, Vilma Yayra Mensah Ofori
Theses and Dissertations
In an era where cyber risks are escalating at an unprecedented rate, understanding andmitigating data breach risks has become critical for organizations. This paper proposes a novel frequency-severity model to assess hacking data breach risks at the individual company level, focusing on the Finance, Healthcare, and Technology sectors. Our anal- ysis reveals significant heterogeneity in breach frequencies and severities across sectors and individual companies within those sectors. To model breach frequency, we employ a Zero-Inflated Poisson (ZI-Poisson) model with random effects, capturing unobserved heterogeneity and within-firm correlations over time. Breach severity is modeled using a log-normal regression, given the symmetrical …
Apostille's Effect On Doing Business In Indonesia, Margaretha Uly Pakpahan
Apostille's Effect On Doing Business In Indonesia, Margaretha Uly Pakpahan
Journal of Private International Law Studies
Legalization through Apostille should simplify the legalization process, doing activities abroad and improving Indonesian economic quality. Legalization is a series of procedures performed to authenticate a signature, stamp or seal which aims to provide a valid status for a public document. The legalization process in Indonesia consists of two steps, namely legalization at the Ministry of Law and Human Rights after which legalization is carried out at the Ministry of Foreign Affairs. Furthermore, the document is shown to the representative of the country intended for legalization. In practice, the legalization process mostly carried out by various agencies in Indonesia, this …

The Case For Mediation Representation Clinics And Externships, John Lande
The Case For Mediation Representation Clinics And Externships, John Lande
Faculty Publications
This article recommends that law schools offer mediation representation clinics and externship courses to assist self-represented litigants in cases with legally-represented parties. These courses would prepare law students to practice in the modern world. Students would get experience working with real clients, conduct interviews, help clients assess their goals and interests, analyze claims, perform legal research, prepare documents, coordinate with mediators, and negotiate with counterpart attorneys.
The courses would address the needs of multiple stakeholders including self-represented litigants, law students, law schools, courts, attorneys, mediators, and society in general. Law schools would develop these courses in collaboration with many potential …

Searching For Justice: Moving Towards A Trans Inclusive Model Of Access To Justice In Canada, Evan Vipond, Pierre Cloutier De Repentigny
Searching For Justice: Moving Towards A Trans Inclusive Model Of Access To Justice In Canada, Evan Vipond, Pierre Cloutier De Repentigny
Dalhousie Law Journal
Access to justice literature has paid little attention to the role of gender identity and gender expression as barriers to justice that must be addressed. As a marginalized and disenfranchised population, trans and gender nonconforming people experience specific barriers to justice that cisgender people typically do not. This paper seeks to address the gap in access to justice literature by attending to specific barriers to justice that trans people face in Canada. These barriers include socioeconomic inequalities; exclusion from the legal system; sex/gender certification and bigenderism within the legal system; and transphobia and cissexism within the legal system. Calling for …

Foreword: Voting Rights In A Politically Polarized Era, Maureen Edobor, Christopher B. Seaman
Washington and Lee Law Review
American democracy is under profound stress. Increasing polarization and a winner-take-all mentality to politics have led to increased conflict both within the halls of Congress and nationwide. In an era of exceedingly close elections where control of the Presidency, Congress, and state governments can turn on a relative handful of votes, the laws and processes governing democracy have themselves become a battleground.
Legal Support For Local Election Officials, Rebecca Green
Legal Support For Local Election Officials, Rebecca Green
Washington and Lee Law Review
Local election officials (“LEOs”) face enormous pressure. They must administer elections when a wide swath of the American public has grown mistrustful of their work; they increasingly face ominous personal attacks and threats; they cope with chronic underfunding of elections; and they must navigate frequent changes in the law governing elections. Lawyers provide a critical avenue of support for local election officials. They provide guidance on how to implement legislative mandates and judicial orders; they anticipate and prevent disputes from arising; and they represent election officials when they or their offices are sued—a more common occurrence today than ever. Although …

Alternative Dispute Resolution In Agency Administrative Programs, Kristen Blankley, Kathleen Claussen, Judith Starr
Alternative Dispute Resolution In Agency Administrative Programs, Kristen Blankley, Kathleen Claussen, Judith Starr
Articles
This Article studies how federal agencies use and might better use different types of alternative dispute resolution (ADR)-including mediation, conciliation, facilitation, factfinding, minitrials, arbitration, and the use of ombuds-in the programs Congress has entrusted them to administer. The use of ADR by the executive branch of the federal government to resolve disputes with or among private actors has deep historical roots. ADR related to managerial agency matters such as employment or procurement is well-established across the government and performed under a uniform set of laws. Much less has been known, however, about the scope and reach of ADR in the …

Two Essays On Labor Heterogeneity, Enxi An
Two Essays On Labor Heterogeneity, Enxi An
Theses and Dissertations in Business Administration
Labor heterogeneity limits firm flexibility, subsequently affecting a firm's capacity to adapt and grow within a dynamic economic landscape and to formulate effective financial strategies. Firms with high labor heterogeneity tend to incur significant labor adjustment costs, making it costly and challenging to adjust their workforce in response to economic changes. While retaining skilled labor can be advantageous in preserving valuable human capital, it also incurs considerable economic costs that significantly influence firms' financial strategy and decision-making processes. This dissertation comprises two essays that explore the implications of firms' dependence on skilled labor.
The first essay empirically investigates how labor …

Building Partnerships Through Third-Party Facilitation: Best Practices From The Community Collaborative Initiative, Shariq Siddiqui, Abdul Samad, Rafeel Wasif
Public Administration Faculty Publications and Presentations
Small minority group organisations rarely collaborate with other nonprofits owing to a lack of expertise and resources. Third-party facilitators can help these groups navigate the process of collaboration. However, the literature has largely ignored their role in the process. We address this gap by studying the challenges third-party facilitators face in the collaboration process and best practices they can apply using the Community Collaboration Initiative (CCI), a unique third-party-facilitated collaboration process working with Muslim American nonprofits.
