Academic Support Programs At Hbcu Law Schools, Marla L. Dickerson

This qualitative descriptive case study delves into the effectiveness of academic support programs (ASPs) for students at Historically Black Colleges and Universities (HBCU) law schools, focusing on enhancing academic performance and passing the bar exam. The underrepresentation of minority lawyers in the United States, which is attributed partly to standardized test disparities, underscores the need for tailored support mechanisms. Drawing from social cognitive theory (SCT), the study investigates how ASPs impact academic success, informed by participant interviews and thematic analysis.
Key findings reveal four prominent themes. Firstly, effective features of ASPs for promoting academic performance include personalized guidance from academic …

Fines and fees are commonplace in the United States criminal justice system as a form of punishment for both minor and severe offenses. While substantial research has demonstrated that these financial consequences disproportionately affect certain communities, studies that depict a narrative of these impacts are vastly underrepresented in the field. This project expands upon past literature by delving into the effects of these practices on individuals and their families. The current study outlines the findings from a content analysis of twelve semi-structured interviews on the impacts of fines and fees in Oregon. The findings create a deeper understanding of how …

The purpose of this study was to analyze the websites of Texas public four-year, private four-year, and two-year institutions of higher education (IHEs) to determine the extent to which website content corresponds with the recommendations of undocumented scholars and supporters. The study aimed to investigate whether the website content differs based on various institutional-level characteristics and to identify any relationships between contextual-level factors that may affect the information presented on websites. Emerging forms of automation using artificial intelligence (AI) and distributed ledgers are raising transformative questions for the practice of law. Deal lawyers are well-situated to understand the convergence of various modes of automation and their implications for their clients and the markets they facilitate. This Article contends that digesting threats and leveraging opportunities associated with new technologies calls for granular, context-specific assessment. It presents one instance of automation in one predominant market—the market for asset-backed securities (ABS)—by comparing securitization to a blockchain-based analog, tokenization. The rapid advancement of artificial intelligence (AI) presents a transformative moment for the legal profession. This Article examines the increasing likelihood of AI reshaping the legal practice, highlights the critical issue of bias, and describes how a multisystem approach to AI can assist in mitigating issues of bias and ultimate fairness. This issue is especially crucial when incorporating AI in automating judicial decision-making. An open, multisystem approach serves as a strategy in mitigating potential biases embedded in AI systems. Artificial Intelligence (AI) is changing our society and bringing the legal profession with it. The use of Generative AI (GenAI) in legal proceedings has received negative publicity from high profile mishaps in court filings. In one case, attorneys used the publicly available online GenAI tool, ChatGPT, to write a legal brief in which ChatGPT proceeded to make up its own citations. Following this, among other instances of the misuse of GenAI, courts have begun to require disclosures and limit the use of GenAI technology. The internet has become more ubiquitously available than ever before, with search engines serving as the portals to an unparalleled amount of information. As a byproduct of this phenomenon, a vast amount of internet search history has also begun to enter legal proceedings as evidence. The most intimate questions that defendants have asked their search engines have begun to be examined under the scope of the Federal Rules of Evidence or a state equivalent. Exploring Advocates’ Perceptions Of Rural And Urban Sexual Assault Survivors’ Experiences Seeking Civil Protective Orders, Hannah C. Samuels

Civil protective orders (CPOs) are one of the most utilized legal remedies that exist for sexual assault survivors. While they are available for every survivor in Illinois, a survivor’s community context can impact their experience petitioning for a CPO. Prior research with domestic violence survivors suggests that the rurality and urbanicity of a community may impact a sexual assault survivors experiences seeking a CPO, but little research has been conducted with sexual assault survivors specifically. The landlord commenced a non-payment proceeding against the tenant based on the tenant's alleged default on rent for a market rate apartment. The tenant argued that the apartment was illegally deregulated and the landlord is charging an illegal rent. The court granted the tenant's motion for discovery to allow them to investigate their claims. The court also denied the landlord's motions to strike the tenant's defenses and for summary judgment. The court found that there are triable issues of fact concerning the apartment's regulatory status and fraud.

Identity Shifting Behaviors, Perceptions Of Diversity, And Perceived Discrimination In South Asian Employees, Himali Bhandari

Workplace discrimination is a significant issue in the workplace for minority racial and ethnic groups, especially for South Asian employees in the US. This study investigated the relationship between perceived workplace diversity climate and identity shifting behaviors (manifestation and suppression behaviors of group identity) that South Asian employees might display at work. Furthermore, it was also expected that perceptions of racial discrimination experiences would mediate this relationship. It was hypothesized that perceived diversity climate will be negatively related to suppression behaviors and positively related manifestation behaviors, mediated by perceptions of racial discrimination. Right now, noncitizens only have the right to an attorney if they can afford one. While courts have grappled with the inherent due process issue accompanying this standard, no court has held that noncitizens have the right to a government- appointed attorney. This paper promotes the provision of government-appointed attorneys to noncitizens in removal proceedings in immigration court under a due process lens. This paper will first briefly examine the difference between criminal and civil matters related to the Sixth Amendment right to an appointed attorney. In 2021, Texas Governor Greg Abbott launched Operation Lone Star (OLS) under the guise of border security. For over three years, OLS has threatened the lives of migrants and U.S. citizens alike. While advocates have primarily challenged OLS under U.S. state and federal law, this Note examines arguments based on the U.S.'s international treaty obligations, particularly emphasizing the importance of enforcing international mechanisms of accountability.
