Tracing The Desert Island: Atlantis, Unknowability, And Colonial Imagination, Edwige Crucifix Jan 2024

Tracing The Desert Island: Atlantis, Unknowability, And Colonial Imagination, Edwige Crucifix

French and Francophone Studies Faculty Research and Scholarship

This contribution studies the myth of the desert-ocean in Pierre Benoit’s 1919 [1920] hit novel L’Atlantide. Locating the mythical lost continent in the Sahara, the novel catered to the period’s exoticism while serving colonial ideology. While the desert was materially crucial for the Empire, it also provided new symbolic ground, becoming a favored locus of the colonial imagination as a site of extreme hostility, due as much to its climate as to its anticolonial activity. As the ultimate colonial fantasy, the desert also paradoxically provided fertile ground for a contrapuntal utopian discourse, apparent when reading Benoit’s novel in light …

In Search Of Border Sanctuaries: Religion, Landscape, And Territory In The Peloponnese, Shannon Mailhouse Dunn Jan 2024

In Search Of Border Sanctuaries: Religion, Landscape, And Territory In The Peloponnese, Shannon Mailhouse Dunn

Bryn Mawr College Dissertations and Theses

Despite the impact of scholarly models for the distribution of Greek sanctuaries, this is the first comprehensive and critical study of “border sanctuaries,” a type of sacred site that has been strongly associated with territorial borders of poleis in ancient Greece. When used as a distinct site type, it correlates location in a border zone with specific functions related to that border, such as community definition or territorial control. Focusing on the Archaic and Classical periods, and building on scholarship of borders, religion, and landscape, this study presents four border zones throughout the Peloponnese, and treats each sanctuary within it …

Industrial Hemp Production And Potential Risks In Kentucky, Hoyeon Jeong Jan 2024

Industrial Hemp Production And Potential Risks In Kentucky, Hoyeon Jeong

Theses and Dissertations--Agricultural Economics

Since the Agricultural Improvement Act of 2014 and 2018 legalized Industrial Hemp (Cannabis Sativa. L), interest in grain, fiber, and floral hemp production has seen growing pains. As an emerging crop, there is a research gap in the impact of weather and agronomic conditions on hemp production including THC (Delta 9 Tetrahydrocannabinol) and pollen drift as risks in hemp cultivation. The first essay aims to measure the impact of weather and agronomic factors on hemp grain, fiber, and floral yields in Kentucky using a yield-weather model with information on field locations. The results show that heat conditions during the growing …

Innovation Originators, Tabrez Y. Ebrahim, Rafeel Wasif

Michigan Technology Law Review

Asian Americans are one of the most striking and undertheorized ethnic groups in the field of innovation. While a prolific ethnic group when it comes to being named as inventors on U.S. patents, very little has been written on this observation, perhaps because of previously limited datasets and unwieldy data analysis on ethnic backgrounds about patenting at the United States Patent & Trademark Office (USPTO). Research on inventor diversity and ethnicity in innovation has begun to explore some ethnic groups, but a more holistic account should focus on one particular overlooked group. Recently, entrepreneurship studies concerning ethnicity have shown that …

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman Jan 2024

Battling The Form: A Front-End Approach To Default-Use Noncompetes, Rachel Arnow-Richman

UF Law Faculty Publications

A growing consensus holds that employer overuse of noncompete agreements adversely affects workers and the economy. But there is little agreement on how best to regulate these instruments. States have experimented with an array of idiosyncratic reforms that capture the most egregious misuses, while the Federal Trade Commission (FTC), has issued an outright ban that would prohibit all employee noncompetes and comparable instruments nationwide.

This Article argues that any effective reform strategy must target what it terms “default-use” noncompetes—boilerplate restraints imposed by employers as a matter of course without close consideration of their underlying justification. Some unlawful noncompetes are clearly …

Highly portable and accessible MRI technology will allow researchers to conduct field-based MRI research in community settings. Previous guidance for researchers working with fixed MRI does not address the novel ethical, legal, and societal issues (ELSI) of portable MRI (pMRI). Our interdisciplinary Working Group (WG) previously identified 15 core ELSI challenges associated with pMRI research and recommended solutions. In this article, we distill those detailed recommendations into a Portable MRI Research ELSI Checklist that offers practical operational guidance for researchers contemplating using this technology.

Israel, Palestine, And The Trolley Problem: On The Futility Of The Search For The Moral High Ground, Jack Russell Weinstein Jan 2024

Israel, Palestine, And The Trolley Problem: On The Futility Of The Search For The Moral High Ground, Jack Russell Weinstein

Digital Press Books

Arguments about Israel and Palestine are almost always accusatory and polemical. Rather than learning from one another, opponents jockey for the moral high ground trying to find that one attack they believe proves their side to be completely on the right, without compromise. This means Israel’s advocates dismiss Palestinian land claims without due consideration and Pro-Palestinian voices falsely accuse Israel of the most heinous modern crimes: colonialism, genocide, and apartheid. None of this is productive or healthy.

In Israel, Palestine, and the Trolley Problem: On the Futility of the Search for the Moral High Ground, philosopher Jack Russell Weinstein interweaves …

Data’S Demise And The Rhetoric Of Sffa, Shakira Pleasant Jan 2024

Data’S Demise And The Rhetoric Of Sffa, Shakira Pleasant

SMU Law Review

The Supreme Court’s holding that Harvard College’s and the University of North Carolina’s (UNC) “admissions systems” are invalid under the Equal Protection Clause of the Fourteenth Amendment and Title VI of the Civil Rights Act of 1964 was an anticipated result. The Court’s 2016 decision in Fisher v. University of Texas at Austin (Fisher II), left some speculation that race-conscious admissions could eventually be struck down by the Court; however, Fisher II also offered some guidance for future litigants to address challenges. Colleges and universities needed to use data to “scrutinize the fairness of their admissions programs” to satisfy the …

Racial Classifications In Higher Education Admissions Before And After Sffa, David E. Bernstein Jan 2024

Racial Classifications In Higher Education Admissions Before And After Sffa, David E. Bernstein

SMU Law Review

Hundreds of law review articles have discussed the legality of affirmative action programs. Virtually all of them begin with the implicit assumption that the racial classifications used in these programs are legitimate and uncontroversial (an assumption I challenge in my 2022 book, Classified: The Untold Story of Racial Classifications In America). That assumption has been undermined by Students for Fair Admissions, Inc. v. President and Fellows of Harvard College (“SFFA”).

Chief Justice Roberts, writing for a 6–3 majority, asserted that the underlying classifications are “imprecise in many ways” and “opaque.” He quoted Justice Gorsuch’s concurring opinion, which criticized the classifications …

The Course Of Empire: An Analysis, Devyn Woodard Jan 2024

The Course Of Empire: An Analysis, Devyn Woodard

Emerging Writers

This essay delves into the themes of and motivations for Thomas Cole’s series of paintings, The Course of Empire. Through an analysis of the different rhetorical appeals and fallacies employed by Cole in the series of paintings, the deeper meaning behind the works comes to light. This analysis serves as a bridge between the environment the paintings were created in almost two hundred years ago, and the contemporary global landscape, which is still in need of its lessons, even so many years later.

“I Didn't Want Them To Feel Like I Was Fragile”: A Qualitative Analysis Of Disability, Intimacy, And Sexual Culture At Yale, Mafalda Von Alvensleben Jan 2024

“I Didn't Want Them To Feel Like I Was Fragile”: A Qualitative Analysis Of Disability, Intimacy, And Sexual Culture At Yale, Mafalda Von Alvensleben

Public Health Theses

This thesis examines how Yale as an educational institutional shapes disabled students’ sexual and romantic lives. It explores the ways in which the institution's policies, culture, and physical environments influence these experiences via a qualitative and landscape analysis. The analysis was based off nine semi-structured interviews with students who self-identified as disabled from both undergraduate and graduate programs, as well as a landscape analysis that incorporates formal, journalistic style interviews with eleven Yale faculty, staff, and administrators. Taken together, this study illuminates the challenges posed by systemic ableism within the university's academic and social frameworks. It highlights the inadequacies of …

Tolled Education: An Economic Markets And Goods Analysis Of Inefficiencies In American Public Education, Ethan Dilks

Indiana Journal of Law and Social Equality

The goal of this Comment is to evaluate the failures of the current system of education within the United States via policy and economic market and goods analysis lenses; in doing so, it will establish that public education in the United States is a toll good, and the only way to properly fix the inefficiencies that result is to reduce excludability and convert the education into a public good. First, Part I will overview how we got here by describing relevant laws and history, the current state of federal case law, and the dire situation for many students throughout the …

Interdisciplinary Unit Planning For The International Baccalaureate Diploma Programme (Ibdp) To Support Multilingual Language Learners, Jessica R. Dubie

All Electronic Theses and Dissertations

The research conducted in this thesis intends to consider the possibilities within the International Baccalaureate Diploma Programme (IBDP) to establish similar levels of interdisciplinarity as the rest of the IB continuum, specifically in the support of multilingual language learners (MLL), given the high numbers of students completing the coursework in their second or third language around the world. In considering various IB publications and the research conducted by Ecctis (2021), the basic framework for how to define interdisciplinarity in the Diploma Programme would be established, but the methodology and support for MLL students in this academic level would come from …

Exploring The Impact Of Invasive On Grassland Diversity: A Study In Montana, Ella Gaffney

Undergraduate Theses, Professional Papers, and Capstone Artifacts

For the capstone project with the University of Montana Davidson Honors College, I investigated the diversity index of grassland and rangeland plots across the state of Montana. My study, conducted from June to August 2023, includes data collected by my team. The purpose of this research project was testing the hypothesis that the diversity index decreases in plots containing invasive grass species.

During the summer of 2023, the Spatial Analysis Lab surveyed over 1000 plots in rangelands and grasslands across the state of Montana to locate an invasive grass, Ventenata dubia. Data collected includes species identification, ocular estimates of …

The Relationship Between Climate Distress And Climate Education Among College Students, Sylvie T. Heriza

Undergraduate Theses, Professional Papers, and Capstone Artifacts

This study examines the relationship between climate change education and climate distress among college students at the University of Montana. Utilizing a correlational design, forty-seven participants completed a survey assessing their concern with climate change and experience learning about climate change in university classes. Findings underscore the importance of addressing climate-related distress within higher education contexts and highlight avenues for improving university support systems. The study contributes to understanding the intersection of climate change awareness and mental health concerns among college students.

Improving Accessibility And Understanding: Studying The Impact Of Human Activities And Dam Removals On Anadromous Fish Species In The Pacific Northwest, Adia F. Bennett Jan 2024

Improving Accessibility And Understanding: Studying The Impact Of Human Activities And Dam Removals On Anadromous Fish Species In The Pacific Northwest, Adia F. Bennett

Scripps Senior Theses

Human activities in North American watersheds have significantly impacted anadromous fish, causing some species of salmon and steelhead to become threatened and endangered. These fish hold ecological, cultural, and economic importance, yet factors such as habitat destruction, overfishing, pollution, climate change, and hydroelectric dams continue to degrade populations. Dams are particularly harmful to anadromous fish, sparking a recent movement advocating for dam removals. This study uses NOAA’s 2022 Biological Viability Assessment to examine the response of anadromous fish to recent dam removals in the Pacific Northwest. Four populations were selected to analyze due to their interaction with sites that had …

Scripps Senior Theses

This thesis argues that external foreign powers, namely the United States and Syria, influenced foreign policy elites in Jordan and Lebanon to either pursue or reject normalization agreements with Israel throughout history. This thesis also examines how elite foreign policy-makers shape Lebanese and Jordanian public opinion through their policies with Israel.

Loan To Own, Robert W. Miller Jan 2024

Loan To Own, Robert W. Miller

Faculty Publications

Convertible debtor-in-possession ("DIP") financing is symptomatic of a paradigm shift in the control of large bankruptcy cases. During the prior era of lender control, distressed investors used DIP financing to shape the trajectory of bankruptcy cases and extract monopolistic rents at the expense of other constituencies. Enter the original loan-to-own: a common strategy commenced with a DIP loan, continued with a stalking-horse bid, and culminated in an acquisition of the debtor's assets. More recently, private equity sponsors ("Sponsors") and other sophisticated insiders are usurping control of bankruptcy cases. Convertible DIP financing (Loan-to-Own 2.0) is a byproduct. This Article situates convertible …

Politicians The Founders Warned You About, Neil Fulton Jan 2024

Politicians The Founders Warned You About, Neil Fulton

Faculty Publications

Many articles have explored the Founders' intentions regarding the constitutional text. Much less attention has focused on the Founders' ideas regarding the traits needed of the leaders in a constitutional republic. The Constitution focuses on governing structures, many of which relate to the electoral process. The Constitution does not spell out the ideal traits of the leaders elected pursuant to those processes. Nonetheless, the Founders possessed clear views about the virtues and qualifications that ideal political leaders required. Indeed, the Founders issued warnings about certain archetypal political figures who, because of their flagrant disregard of the ideal virtues and qualifications, …
