Criminal Law's Hidden Consensus, Steven Arrigg Koh

American criminal law is facing a crisis of meaning. On one hand, the “traditional school” invokes the archetype of the violent criminal—a murderer, rapist, or thief—who must be prosecuted and punished. On the other hand, the “critical school” invokes the archetype of the low-level drug offender, sentenced to a draconian prison term for mere possession of low levels of marijuana. On this account, the criminal legal system is itself systemically pathological, perhaps even warranting abolition. Like ships passing in the night, the two schools appear irreconcilable. Academic freedom is under assault in the United States.1 Like the authoritarian populism rising across the globe, domestic attacks on individual professors and academic institutions buttress a broader and multifaceted campaign to undermine multiracial democracy and the institutions that sustain and safeguard it.2 The individuals and entities driving this antidemocratic movement have also targeted the electoral process; public education; the right to bodily autonomy; the civil rights and liberties of minoritized and marginalized communities; and freedom of speech and expression (increasingly marshaled against pro-Palestinian advocacy).3 Their openly stated goal is to delegitimize, defund, and “lay siege to” …

The United States has a long history of devastating immigration enforcement and surveillance. Today, in addition to more than 34,000 people held in immigration detention, Immigration and Customs Enforcement (“ICE”) surveils an astounding 296,000 people under its “Alternatives to Detention” program. The number of people subjected to this surveillance has grown dramatically in the last two decades, from just 1,339 in 2005. ICE’s rapidly expanding Alternatives to Detention program is marked by “digital cages,” consisting of GPS-outfitted ankle shackles and invasive phone and location tracking. This study aims to 1) evaluate the efficacy of H2O2-peroxyacetic acid (PAA) mixer to inactivate Listeria monocytogenes in 0.1% buffered-peptone-water; 2) evaluate the reduction and mitigation of cross-contamination on peppers. For the study-1, aliquots of 1.0-ml mixer solutions (0.25, 0.50 and 0.84%) were added to the first 3-well of 8-strip-deep-well microplates. Then, the 0.1 ml of 10-fold dilution the Nalidixic-acid-resistant (NaL) L. monocytogenes was added and mixed immediately with a multichannel pipette. The main objective of this thesis is to determine the potential impacts on stormwater runoff in lowly urbanized coastal/subcoastal environments under a changing climate and land use/cover. This paper focuses on the perceived barriers to travel from marketing material for individuals with disabilities compared to those without disabilities and the direct impact on leisurely travel participation, particularly in outdoor spaces. Employing a cross-sectional study design encompassing both quantitative and qualitative data collection methods, this research investigates the experiences and transparency of trail accessibility in the state of North Carolina. Quantitative data were gathered through trail assessment accessibility checklists, while qualitative insights were obtained via in-depth interviews. One way that job satisfaction can be increased is through understanding and changing organizational cultures through better communication. The Competing Values Framework (CVF; Quinn & Rohrbaugh, 1983; Belasen & Frank, 2010; Lund, 2003) has been used to understand how organizational cultures and their communicative norms relate to job satisfaction. The plains spotted skunk (Spilogale interrupta) is a data-deficient small carnivore native to the central plains of North America that has experienced significant population declines. My dissertation investigates the species’ distribution, habitat associations, and interspecific interactions in South Dakota, providing crucial information for conservation actions. In Chapter 1, I developed ensemble distribution models on a broad scale, incorporating species location data from 1985–2020, environmental factors, and six predictive modeling algorithms. I identified key predictors including mean temperature diurnal range and proportion of area as pasture, and estimated ~31,300 km2 of potential habitat, predominately in eastern South Dakota. Pancreatic cancer is one of the deadliest cancers to treat. The primary cause for the drug resistance is the dense extracellular matrix (ECM) that surrounds the tumor and restricts blood supply. Gemcitabine (GEM) and paclitaxel (PTX) are drugs that are clinically used in the treatment of pancreatic cancer. GEM, however, is rapidly metabolized by cytidine deaminase (CDA) and eliminated from the body, and paclitaxel is a substrate for P- glycoprotein (P-gp) efflux receptors. The Afrikaner breed of cattle is indigenous to South Africa and due to their hardiness was once the most popular breed amongst farmers. The objectives for this study were to: (1) estimate environmental effects (age at first calving, season) and (2) genetic variance affecting longevity in Afrikaner cattle using survival analysis and a Weibull model and (3) evaluate the effect of the Infusion Project on longevity utilizing a Cox model. North American river otters (Lontra canadensis) play a critical role as an apex predator in riverine ecosystems. Respiratory disease has historically been recognized as a limiting factor to wild bighorn sheep (Ovis canadensis) herds throughout North America with epizootics resulting in large-scale die offs and reductions in recruitment. The primary etiologic agent associated with pneumonia outbreaks in bighorn sheep is Mycoplasma ovipneumoniae. This bacterial pathogen is frequently carried asymptomatically by domestic sheep (Ovis aries) and goats (Capra hircus); however, when these domestic hosts come in contact with and spread this pathogen to bighorns, the disease can cause epizootics and large-scale mortality. Little is known about the dietary knowledge (DK) and eating habits (EHs) of patients with type 2 diabetes (T2D) in Lebanon. Therefore, the aim of this study was to assess the DK and EH of the population with T2D and determine their associated factors. A cross-sectional survey enrolling 351 patients with T2D was carried out, using the snowball sampling technique. The search for ecofriendly products to reduce crop dependence on synthetic chemical fertilizers presents a new challenge. The present study aims to isolate and select efficient native PGPB that can reduce reliance on synthetic NPK fertilizers. A total of 41 bacteria were isolated from the sediment and roots of mangrove trees (Avicennia marina) and assessed for their PGP traits under in vitro conditions. Therefore, finding solutions to various attacks, such as the blackhole attack, is crucial for the success of WSN applications. Using a mixed research approach, including an interview with a professional and a review of existing literature, the study finds a disconnect between salmon companies and their customers, indicating a need for improved marketing strategies.
