The rules governing the scope of liability in cases where firearms cause injuries—some well-established, others fairly novel—help to define the responsibilities of users, owners, and sellers of these popular but dangerous products. As the U.S. Supreme Court has recently expanded an individual’s right to keep and bear arms, some have wondered whether the Second Amendment might operate to limit the reach of these various tort doctrines. Voluntary Dismissals, Jurisdiction & Waiving Appellate Review, Bryan Lammon

Litigants have long tried to manufacture a final, appealable decision by voluntarily dismissing their claims after an adverse interlocutory decision. Recently—and especially since the Supreme Court’s decision in Microsoft Corp. v. Baker—courts have thought that these dismissals created a jurisdictional problem. Either the voluntary dismissal did not produce a final decision, or the dismissal extinguished Article III jurisdiction. But the problem with these appeals is not jurisdictional. It’s waiver. A voluntary dismissal after an adverse interlocutory decision waives the right to appellate review. An agreement to exchange competitive sensitive information among rivalrous competitors usually results from an intent to inhibit or restrict the discretion of those firms to engage in competition. Basic economic logic about competition leads to that conclusion. Hence, such an exchange is in itself a naked agreement in restraint of trade without legal justification. Currently, case law requires a more convoluted and irrelevant inquiry into market definition and market power before a court can condemn such agreements. Background: Peripheral intravenous catheter (PIVC) failure and difficult intravenous access (DIVA) are pervasive issues causing patient suffering and increased costs. Despite their prevalence, there is a gap in internal medicine and pediatric resident training to manage these challenges effectively.

Objective: This study aimed to assess the value of ultrasound-guided-PIVC (USGPIVC) education for internal medicine and pediatric residents and the impact of a 1-hour multidisciplinary workshop on their knowledge and confidence.

Methods: A cross-sectional survey study was conducted at an academic medical center in 2022 to assess residents’ perceptions of USG-PIVC education. This was followed by a USG-PIVC simulation-based workshop with …

Interdisciplinary teams of adults are needed to enhance the capacity of schools to provide the most appropriate educational experiences for young children who have or are at risk for developmental delays and disabilities (Division for Early Childhood, 2014). When educators, families, and community partners connect around shared goals, we begin to reimagine instructional opportunities and create more equitable access to educational resources for children and families. We share insights from community partners who participated in a collaborative dramatic inquiry study designed to enrich preschoolers’ learning experiences and serve children and families.

On August 11, 2023, Hip-Hop celebrated its 50^th anniversary. In honor of this milestone, we share an activity that is designed to harness the power and art of Hip-Hop to support learning in mathematics for students with and without exceptionalities. Using a vignette, we examine why culturally sustaining practices are pivotal to learning and how teachers can collaborate with middle-school students to strengthen an evidence-based practice such as schema-based instruction by honoring the funds of knowledge that students possess. The main purpose of this article is to present approaches and strategies to making 2-D visual arts instruction meaningful and accessible for students who are blind or low vision. In collaborative workspaces, such as meeting rooms, it is desirable to optimize the direction of audio pickups (referred to herein interchangeably as 'beams') and also camera cropping to be focused on the location of a participant that is currently speaking during a collaborative session. Such optimizations are typically performed using audio triangulation techniques based on a speaker that is actively speaking during a meeting. Terms such as “woke,” “social justice,” “cancel culture,” “identity politics,” “politically correct,” “critical race theory,” and “DEI” have been increasingly misused and politicized by both the left and the right in recent years. This paper will examine the Hebrew Bible and explore what it says about social justice, compassion for the indigent, inclusion, and many other terms causing such an uproar. The authors assert that the ancient prophets, the true social justice warriors, would be horrified by the actions of both the left and right.
