Amicus Brief In Sec V. Jarkesy On Original Public Meaning Of Article Ii & Presidential Removal, Jed Handelsman Shugerman

In holding that the SEC’s administrative law judges’ protections against removal were unconstitutional, the Fifth Circuit extended Free Enterprise Fund v. PCAOB, 561 U.S. 447 (2010), and Seila Law LLC v. CFPB, 140 S. Ct. 2183 (2020). Those precedents were based on an incomplete historical record. Subsequent historical research shows that the Founding generation never understood Article II to grant the President an indefeasible removal power.

To be sure, this evidence does not suggest Congress should have unlimited power to protect any executive office or delegate removal to itself. Rather, the bottom line is that the evidence of original public …

A unitary executive is an exacting ideal. It asks that all power in an administration be gathered in the person of the President, who should have full authority to determine the actions of officials and employees. Even if the President does not directly control every executive action (how could he?), when officials fail to implement presidential preferences, the unitary theory dictates that the President must have the power to remove them. The model posits a tightly organized hierarchy—every rung implementing the substantive decisions of the rung above, with orders flowing from the top: a command-and-control structure for government action. Restatements of the common law, the chief achievements of the American Law Institute (ALI), fulfilled a need that had long been expressed by lawyers and judges in England and America. Supreme Court Justice Joseph Story, responding in 1837 to the Massachusetts state legislature’s inquiry whether common law should and could be codified, reported that there could be tremendous saving of effort and time by lawyers and judges if a group of experts set out in written form the agreed principles and doctrines of common law. This chapter describes the creation of the Archive Kit, which is a digital teaching tool. It consists of a collection of digitized letters from the University of New Mexico's special collections, a worksheet, and a lesson plan. The Archive Kit is designed to be accessible, flexible, and easy to set up. When Congress convenes under the Twelfth Amendment and the votes of presidential electors are counted, there are three different responsibilities to consider. First, who presides over the joint session where counting takes place, and what is the role of that presiding officer? Second, who counts the electoral votes? Third, who resolves disputes about those electoral votes?

This Essay answers those questions. First, the presiding officer in the joint session is the President of the Senate, and she acts as any other presiding officer of a legislature. She initiates actions pursuant to precedent, parliamentary procedures, and the wishes of the chamber. …

The Article first shows that the innovative design of securitization vehicles is to give banking entities exposure to residual and subordinated parts of these vehicle’s capital stacks without triggering a legal conclusion that the vehicles are bank “affiliates” or “investment companies,” thus avoiding regulation under the banking laws and investment company laws. The Article then applies this transactional-based analytical framework to the 2007-09 financial crisis. It presents data showing how the traditional banking sector owned, controlled, and backstopped many of the securitization vehicles at the heart of the crisis.

The article begins, "The  Constitution does not prohibit the citizens of each State from regulating or prohibiting abortion. Roe and Casey arrogated that authority. We now over rule those decisions and return that authority to the people and their elected representatives." It is now one year, and one full election cycle, since the Supreme Court closed its opinion in Dobbs v. Jackson Women's Health Organization with those words. That is time enough to gauge how the "people and their elected representatives" have used the authority "return[ed]" to them.

Ijv’S Political Ties And R&D Strategy: Asymmetric Contingencies Of Market Versus Governmental Policy Turbulence, Jie Yang, Jeiqiong Ma, Harold Doty, Jeoung Yul Lee

The purpose of this article is to empirically explore (1) the impact of political ties on international joint ventures’ (IJVs) R&D strategy and (2) the moderating effects of market turbulence and governmental policy turbulence on the relationship between IJV political ties and R&D investment in China. Our sample consists of 1,344 observations taken from 224 IJVs over a period of 6 years (2012–2017), and we applied hierarchical moderated regression analysis (HMRA) with panel data to analyze our three hypotheses. Our findings show that IJVs with political ties tend to invest more in R&D than their counterparts without political ties. Interestingly, …
