Anti-Queer Policy As It Translates To Violence Against The Lgbt Community, Kendall Bush Jan 2023

Anti-Queer Policy As It Translates To Violence Against The Lgbt Community, Kendall Bush

Honors Theses and Capstones

In recent years, the amount of anti-LGBT policy introduced is rapidly increasing (ACLU, 2023). Contemporary policy focuses mainly on queer youth and gender identity, attacking gender-affirming health care and limiting LGBT discussions in public schools. Although these policies are particularly insidious, they follow a trend of queer persecution in the United States. Within federal policy and across state legislation, the panopticon of anti-LGBT policy ensures that queer bodies are policed and monitored. This paper posits that the increase in anti-queer policy translates to an increase in experiences of external and indirect violence. Based on findings from the UCR and various …

The Vertical Transfer Pipeline And Its Leaks: Tracking Students From Associate’S Programs To Bachelor’S Degrees, Kerstin Gentsch, Yoshiko Oka, Sarah Truelsch, A. W. Logue

Publications and Research

This longitudinal study of 17,455 students, the majority from underrepresented groups, investigated leaks in the vertical transfer pipeline from associate’s-degree program entry to bachelor’s-degree receipt. Investigated were both the size of the leaks and some associated variables. Pipeline progress examinations included quantification of early persistence, plus application to, enrollment and persistence in, and graduation from, bachelor’s programs. The examined associated variables included student demographic characteristics and possible pipeline leak malleable factors: academic preparation and performance and financial need. Overall, only 23% of the original cohort received a bachelor’s after eight years. In addition, this study is the first to identify …

The Private Costs Of Behavioral Interventions, Avishalom Tor Jan 2023

The Private Costs Of Behavioral Interventions, Avishalom Tor

Journal Articles

The increasing popularity of behavioral interventions—also known as nudges—is largely due to their perceived potential to promote public and private welfare at dramatically lower costs than those of traditional regulatory instruments, such as mandates or taxes. Yet, though nudges typically involve low implementation costs, scholars and policymakers alike tend to underestimate their often-substantial private costs. Once these costs are accounted for, most nudges turn out to generate significantly lower net benefits than assumed, and some prove less efficient or less cost-effective than traditional instruments. At other times, the private costs of behavioral interventions are sufficiently large to render them socially …

Allocating State Authority Over Charitable Nonprofit Organizations, Lloyd Hitoshi Mayer Jan 2023

Allocating State Authority Over Charitable Nonprofit Organizations, Lloyd Hitoshi Mayer

Journal Articles

This Essay considers the allocation of state authority to enforce the legal obligations particular to charities and their leaders among state officials, including attorneys general, judges, and legislators, and private parties. It first describes the existing allocation. It then reviews the most common criticisms of this allocation, which primarily focus on two concerns: politicization and lack of sufficient enforcement. Finally, it evaluates the most notable proposals for reallocating this authority, including the reallocation of this authority in part to private parties.

This Essay concludes that reform proposals have two fundamental flaws. First, proposals aimed at countering the political nature of …

Comparing Cigarette-Cue Attentional Bias Between People With Hiv/Aids And People With Opioid Use Disorder Who Smoke, Gopalkumar Rakesh, Joseph L Alcorn, Rebika Khanal, Seth S Himelhoch, Craig R Rush

Faculty, Staff and Student Publications

BACKGROUND: Special populations like people living with HIV/AIDS (PLWHA) and people with opioid use disorder (OUD) smoke tobacco cigarettes at rates three to four times greater than the general population. Patients with tobacco use disorder exhibit attentional bias (AB) for cigarette cues. Eye tracking can quantify this bias by measuring fixation time (FT) on cigarette and matched neutral cues, to calculate an AB score. Although previous studies have measured this bias in people who smoke without any other comorbid conditions, no study, to our knowledge, has measured or compared this bias in special populations.

METHODS: We performed exploratory analyses on …

Dementia is a global public health problem with increasing prevalence and incidence worldwide. The African continent is expected to bear the biggest brunt of the burden of dementia by 2050 because of the rapid demographic changes, including rapid population growth, an increase in life expectancy, and ageing. However, French-speaking Sub-Saharan African (FS-SSA) countries are underrepresented in research on dementia in Africa. While the reasons are diverse and complex, linguistic and cultural barriers to research, disproportionately affect these countries and may be significant factors. Any efforts, therefore, to redress the burden of dementia in Africa must consider the specific demographic, cultural, …

The Race To Ban Race: Legal And Critical Arguments Against State Legislation To Ban Critical Race Theory In Higher Education, Vanessa Miller, Frank Fernandez, Neal H. Hutchens

Missouri Law Review

Anti-critical race theory bills have garnered national attention in the K-12 context. However, many critical race theory (“CRT”) bans also impact institutions of higher education. The bills seek to prohibit the teaching of ideas that include the premise that racism and sexism are pervasive in our society. Those opposing CRT believe its tenets promote anti-white racism, cultural division, and threaten the public institution of education. Scholars and educators have criticized anti- CRT bills for their mischaracterization of the use and tenets of CRT and related theories of scholarship. This Article argues that state anti- CRT laws and policies in higher …

We studied social-psychological effects over time of a faculty-mentor workshop intervention that addressed attitudes associated with language variety and their impact on scientific communication (SC) skill development of PhD and postdoctoral STEM research trainees (N = 274). Six months after their mentors attended the workshop, all mentees had significant gains in productivity in speaking tasks. In particular, mentees with high language discomfort rated their quality of communication with their mentor and their enthusiasm about communicating more highly (p < .05 for both measures), compared to mentees with low language discomfort. In addition, mentees raised speaking nonstandardized varieties of English reported significant reductions in discomfort related to language use (p = .003), compared to mentees raised speaking standardized English. We conclude that training mentors to understand and respond to …

Teaching & Learning Faculty Publications

The article addresses diversity issues related to language, gender, and culture. Topics include fundamental areas of research essential to the discussion on language diversity in the context of education with respect to equity, poverty, stereotype threat, Pygmalion Effect, non-sexist language, and Matthews Effect. The discussion on diversity and equity creates a space to think about issues of access, opportunity, voice, and equal participation within society and educational settings. Diversity among humans requires thoughtful considerations, accommodations, and differentiations in educational treatment, yet providing equal opportunities for growth and learning for all.

Open To All: Administrators’ And Teachers’ Perceptions Of Issues Of Equity And Diversity In Teacher Leadership, Jori S. Beck, Kaavonia Hinton, Brandon M. Butler, Peter D. Wiens

Teaching & Learning Faculty Publications

This study is a response to calls for more research on diversity in teacher leadership (TL), particularly in urban schools. Critical race theory illuminated the role race and racism can play in determining who gets access to TL positions and how that access is characterized using liberal discourse and ideology. We used a component mixed methods design to explore whether administrators and teachers perceived that teacher leadership positions were open to everyone. Beliefs that TL opportunities are “open to all” allow the field to accept the status quo, making it difficult to see (or do anything about) racial inequities.

Large language models (LLMs) excel in providing natural language responses that sound authoritative, reflect knowledge of the context area, and can present from a range of varied perspectives. Agent-based models and simulations consist of simulated agents that interact within a simulated environment to explore societal, social, and ethical, among other, problems. Simulated agents generate large volumes of data and discerning useful and relevant content is an onerous task. LLMs can help in communicating agents' perspectives on key life events by providing natural language narratives. However, these narratives should be factual, transparent, and reproducible. Therefore, we present a structured narrative prompt …

When ethics committees are consulted about patients who have or need court appointed guardians, they lack empirical evidence about several common issues, including the relationship between guardianship and prolonged, potentially medically unnecessary hospitalizations for patients. To provide information about this issue, we conducted quantitative and qualitative analyses using a retrospective cohort from Veterans Healthcare Administration. To examine the relationship between guardianship appointment and hospital length of stay, we first compared 116 persons hospitalized prior to guardianship appointment to a comparison group (n=348) 3:1 matched for age, diagnosis, date of admission, and comorbidity. We then compared 91 persons hospitalized in the …

Engineering Management & Systems Engineering Faculty Publications

Communication is a critical process that facilitates team members' coordination, expertise exchange, decision-making, and, consequently, team elfectiveness. A focus on effective communication is critical in virtual teams due to their lack of face-to-face interactions and social presence. Communication becomes challenging in remote settings, and specific skills emerge as more essential to success. It is known that effective teams rely on planning, execution, and interpersonal skills to be successful. Still, the specific impact of these skills on virtual team effectiveness is not well understood. Additionally, conflict can emerge as a significant barrier to collaboration for remote teams that can hinder their …

A practical, structured methodology for strategically prioritizing emerging aviation R&D in such an environment is lacking. The existing multi-criteria decision aid tools are primarily utilized at an enterprise level, take months to set up and collect data, require large teams of experts, are used on an infrequent basis, and are not conducive to a …

Minding Accidents, Teneille R. Brown Jan 2023

Minding Accidents, Teneille R. Brown

University of Colorado Law Review

Tort doctrine states that breach is all about conduct. Unlike in the criminal law context, where jurors must engage in amateur mindreading to evaluate mens rea, jurors are told that they can assess civil negligence by looking only at the defendant’s external behavior. But this is false. Here I explain why, by incorporating the psychology of foresight. Foreseeability is at the heart of negligence—appearing as the primary test for duty, breach, and proximate cause. And yet, it has been called a “vexing morass” and a “malleable standard” because it is so poorly understood. This Article refines and advances the construct …

Separation Of Church And Law: The Ministerial Exception In Demkovich V. St. Andrew The Apostle Parish, Jonathan Murray

University of Colorado Law Review

Religious freedom is increasingly invoked to defeat liability for behavior that has long been regulated under accepted, neutral law, an argument to which many courts and judges appear receptive. One such area of law seeing this activity is the ministerial exception-a judicial principle recognized under the First Amendment. The ministerial exception guarantees religious organizations' discretion in how they select their "ministers,"or religious employees dedicated to the organization's religious mission. However, current law lacks clarity regarding the application of the exception to an organization's treatment of its ministers. Recently, the Seventh Circuit, sitting en banc, chose to categorically expand the application …
