Brief For Former And Current Law Library Directors, Professors, And Academics As Amici Curiae In Support Of Defendant-Appellant, Michelle M. Wu, Austin Martin Williams

Georgetown Law Faculty Publications and Other Works

The Copyright Act and libraries have a shared purpose: to spread knowledge to the public. See Campbell v. Acuff-Rose Music, Inc., 510 U.S. 569, 574 (1994) (noting the purpose of copyright is “[t]o promote the Progress of Science and useful Arts”). Libraries rely on balanced, careful application of the fair use balancing test to achieve that purpose. Amici respectfully submit that the District Court's decision collapsed copyright law's multi-part fair-use balancing test into a theory focused primarily on economics. Amici further respectfully submit that the District Court's fair-use analysis was broadly applied to Internet Archive's (IA) activities without distinguishing …

Desmoglein-2 As A Cancer Modulator: Friend Or Foe?, Kay Myo Min, Charlie Ffrench, Barbara Mcclure, Michael Ortiz, Emma Dorward, Michael Samuel, Lisa Ebert, Mỹ Mahoney, Claudine Bonder

Department of Pharmacology, Physiology, and Cancer Biology Faculty Papers

Desmoglein-2 (DSG2) is a calcium-binding single pass transmembrane glycoprotein and a member of the large cadherin family. Until recently, DSG2 was thought to only function as a cell adhesion protein embedded within desmosome junctions designed to enable cells to better tolerate mechanical stress. However, additional roles for DSG2 outside of desmosomes are continuing to emerge, particularly in cancer. Herein, we review the current literature on DSG2 in cancer and detail its impact on biological functions such as cell adhesion, proliferation, migration, invasion, intracellular signaling, extracellular vesicle release and vasculogenic mimicry. An increased understanding of the diverse repertoire of the biological …

Culturally Responsive-Sustaining Computational Thinking: Enactment In Elementary Classrooms, Victoria Macann, Aman Yadav Dec 2023

Culturally Responsive-Sustaining Computational Thinking: Enactment In Elementary Classrooms, Victoria Macann, Aman Yadav

Journal of Computer Science Integration

Technology has increasingly permeated many aspects of everyday life and this evolution raises the need for individuals to understand how the digital world works and what opportunities and risks it brings (Nouri, Zhang, Mannila & Norén, 2019). For this to be an experience for everyone, we need to rethink how we integrate computational thinking (CT) and provide teachers with tools to center their students’ identities, experiences, and cultures in the classroom. In this paper, we present two case studies of primary (elementary) teachers from a full primary (student ages 5–13) semi-rural school in the North Island of New Zealand that …

2020-Current year OA Pubs

BACKGROUND: Current guidelines for gender-affirming hormone therapy (GAHT) for transgender women are mostly based on clinical experience from experts in the field and treatments used on postmenopausal women. While care is currently provided with the best available evidence, there is a critical gap in knowledge about the safest and most effective estradiol routes of administration for GAHT in transgender women; this statement is supported by the World Professional Association for Transgender Health on their Standards of Care for the Health of Transgender and Gender Diverse People, version 8. Furthermore, the reported rates of cardiometabolic adverse events in transgender women highlight …

Technology And Mental Health Counseling, Hanna Cespedes, Elizabeth Robey, Tyler Wilkinson

Journal of Technology in Counselor Education and Supervision

The use of technology in the field of mental health has been an increasing interest of study and utilization in recent years, especially during and after the Covid 19 pandemic in which social distancing practices were encouraged to limit the spread of the virus. During this time, the use of technology for health-related appointments became vital as many offices shut down and/ or had limited in-person access. Furthermore, technology has already been integrated and researched significantly in other areas of the healthcare fields such as psychiatry and nursing. However, there is a lack of understanding of the role of technology …

Social Engineering Cyber Threats, Young B. Choi, Josh Rubin Dec 2023

Social Engineering Cyber Threats, Young B. Choi, Josh Rubin

Journal of Global Awareness

The article explores the pervasive threat of social engineering in cybersecurity, emphasizing its success in infiltrating information systems by manipulating individuals rather than employing traditional hacking methods. The author underscores the vulnerability arising from human trust, as individuals, especially those lacking technology education, tend to be targets. While cryptography offers partial security, social engineering complicates overall system security. Mitigation strategies include educating employees on threats, risks, and security policies, coupled with enforcing penalties for noncompliance. Additionally, employing two-factor authentication and physical token-based access adds layers of protection. The article delves into semantic attacks, classifying various exploitation methods and emphasizing the …

Impact Of Covid-19 Pandemic On Marketing Of Education, Shreekant Joag Dec 2023

Impact Of Covid-19 Pandemic On Marketing Of Education, Shreekant Joag

Journal of Global Awareness

The COVID-19 pandemic forced many schools to partially or totally switch to remote communication methods for delivering education in the years 2020-2021. It is believed that forced compliance with unfamiliar and even unpreferred modes of behavior can have a profound and lasting impact on people’s attitudes and opinions toward the behavior itself because of first-hand exposure and experience. It is, therefore, possible that this experience with remote teaching and learning could have materially changed both instructors’ as well as students’ attitudes toward remote delivery of education. Such changed attitudes may predict their future choices and behavior.

This paper will present …

Climate Change And Its Effects On Conflicts, Ann Lalicker Dec 2023

Climate Change And Its Effects On Conflicts, Ann Lalicker

Journal of Global Awareness

Over the last 50 years, scientists studied the Earth’s warming temperatures and the resulting effects. Although climate change is not a new concept in current events, the consequences it has on exacerbating growing tensions and sustaining violent and nonviolent situations are less widely discussed. Of course, conflicts, internal or international, and their causes are multifaceted and cannot just be explained by one factor alone. However, climate change has a definite role in creating tensions that lead to violent or nonviolent conflict, including famine and displacement, as well as war. Although this rapid climate change is relatively recent in human history, …

The Coming Transformative Impact Of Large Language Models And Artificial Intelligence On Global Business And Education, Eva K. Jermakowicz

Journal of Global Awareness

Rapid advances in the capabilities of Large Language Models (LLM) as a basis for Artificial Intelligence (AI) applications, and their sudden wide accessibility, have garnered significant attention recently. These technologies (e.g., ChatGPT, BARD), which have the ability to predict and generate human language, have led to excitement and concerns regarding their use in various industries. This paper explores the history of LLM, examines their applications in business and education, and delves into the critical ethical concerns and challenges of these emerging technologies to ensure that their uses are not only effective, but also responsible and equitable.

Anglo-Saxons And The Irish Sea, Ryan Patrick Crisp Dec 2023

Anglo-Saxons And The Irish Sea, Ryan Patrick Crisp

The Thetean: A Student Journal for Scholarly Historical Writing

Recently, Peter Brown described the Irish Sea in the early Middle Ages as "a Celtic 'Mediterranean of the north."' That assessment may be more than this small sea can measure up to, but sufficient evidence concludes that there was substantial naval activity in this area during the early Middle Ages. Interestingly, the Anglo-Saxons, though they had access to the Irish Sea, never ventured forth upon these waters in great numbers. This fact makes their few voyages upon this Celtic lake worth examining.

The Voice Of Inexperience, Erika Rummel

The Thetean: A Student Journal for Scholarly Historical Writing

Erasmus had a great deal to say about marriage. He wrote a eulogy on marriage, a handbook of marriage, and half a dozen dialogues dealing with courtship and marriage. Altogether we have a thousand printed pages of good advice, a remarkable fact when you consider chat the man who dispensed all this good advice about marriage remained unmarried himself.

The Hungarian Secret Police And The Budapest Uprising Of 1956, Stuart Schulzke Dec 2023

The Hungarian Secret Police And The Budapest Uprising Of 1956, Stuart Schulzke

The Thetean: A Student Journal for Scholarly Historical Writing

For fourteen days during late October and early November of 1956, Hungary staged a revolution and set up an autonomous government. The Hungarians forced Soviet military personnel to withdraw only to see them reenter the country, reestablish Soviet authority, and overthrow the short-lived Hungarian government. This sequence of events suggests an occupied nation's predictable reaction against foreign influence. However, it obscures one of the most critical aspects of Hungary's Revolution in 1956: the role of the Hungarian State Secret Police. Probably no governmental branch in Hungarian history has been more hated by the Hungarian people than the Allamvedelmi Hatosag (AVH), …

Edvard Benes And His Policy To Expel Czechoslovakian Germans, Travis Mueller Dec 2023

Edvard Benes And His Policy To Expel Czechoslovakian Germans, Travis Mueller

The Thetean: A Student Journal for Scholarly Historical Writing

At the end of World War II, Poland, Romania, Hungary, and the Czechoslovak Republic expelled fifteen million Germans from their homelands in Eastern and Central Europe. During the eviction to the occupied zones of Germany, two million Germans perished.1 Often brutally mistreated, these Germans suffered the wrath of a great European backlash against the Nazis. Nowhere was the expulsion more brutal than in the Czechoslovak Republic. The two nations' shared border and intertwined history made the expulsion of over three million Germans mainly from the Sudetenland-particularly severe.

Medicine And The Mines, Troy Madsen Dec 2023

Medicine And The Mines, Troy Madsen

The Thetean: A Student Journal for Scholarly Historical Writing

When Denver & Rio Grande Western Railroad laborers stumbled onto eastern Utah's coal deposits in 1881, they sparked the development of Carbon County's explosive mining communities. Known across the state for their rampant disorder and untamed energy, the volatile coal mining towns of eastern Utah departed dramatically from the ecclesiastical, agrarian societies dotting the rest of Utah's map. Raucous taverns and seamy brothels quickly surfaced along Main Street in Helper. Violent union strikes shook the foundations of the communities' coal companies. Dark clouds of imminent danger hung continually above the portals of the region's somber, murky mines. Deeply rooted ethnic …

Postmodern Philosophy And Its Influence On Modern Museum Theory And Development, Mauri Liljenquist Dec 2023

Postmodern Philosophy And Its Influence On Modern Museum Theory And Development, Mauri Liljenquist

The Thetean: A Student Journal for Scholarly Historical Writing

History legitimizes its role in society through the benefits it provides for the public. The idea of history in the ivory tower, while it appeals to some historians and scholars, can never be sufficient to justify the field. Instead it is what emerges from the ivory tower and how that product influences and affects the outside world that determines the value of historical endeavors. The dissemination of history to the public is one of the most significant aspects of the profession. Accuracy and integrity in research and writing are the primary responsibilities of the historian. Following these, the next most …

Perpetuated Inferiority, Kristine Ashton Dec 2023

Perpetuated Inferiority, Kristine Ashton

The Thetean: A Student Journal for Scholarly Historical Writing

Nineteenth-century schools taught more than reading, writing, and arithmetic. They were expected to convey patriotism and civic responsibility and to mold moral character. While publishers designed textbooks to teach children to spell and to read, they also inculcated the books with social values through word choice and lesson plans. The printers, journalists, teachers, and ministers who wrote the schoolbooks selectively filled their pages with political, economic, social, and moral concepts that shaped children's views of their nation's past and their position within the present society.

Judaism Transformed, Kyrenia Palmer Dec 2023

Judaism Transformed, Kyrenia Palmer

The Thetean: A Student Journal for Scholarly Historical Writing

The Sabbatean movement, Judaism's first true heresy, originated in the Ottoman province of Palestine in the 1660s. The movement centered around an aspiring Messiah called Sabbatai Sevi. With the aid of a personal prophet, young Nathan of Gaza,· this man made himself a household word throughout the Jewish Diaspora and induced thousands of Jews to inflict radical penitential sufferings upon themselves in a sort of apocalyptic ecstacy. However, Sabbatai Sevi was not the decisive factor in Judaism's spiritual awakening, nor was Nathan of Gaza ( though without his support the movement never would have spread). Rather, the great messianic revival …

Re-Visions: Examining Narratives Of Asian American Mental Health, Kenji Aoki Dec 2023

Re-Visions: Examining Narratives Of Asian American Mental Health, Kenji Aoki

Asian American Literature: Discourses & Pedagogies

This paper examines the intersection between Asian American mental health and resilience tropes. While research has acknowledged that Asian Americans have disparate mental health gaps regarding mental health stigma and how Asian American young adults are the only racial group in which suicide is their leading cause of death, there has been limited study that attempts to directly convey Asian American voices beyond broad statistical or cultural generalizations. To supplement ongoing research and Asian American livelihoods, this essay conjectures and attempts to illuminate the histories, mental illness, and health narratives of Asian Americans, the good, the bad, the ugly, the …

Monstrous Matrilineage In Chinese American Literature, Leina Hsu Dec 2023

Monstrous Matrilineage In Chinese American Literature, Leina Hsu

Asian American Literature: Discourses & Pedagogies

In this paper, I explore the monstrous relationships between Chinese American mothers and daughters in The Joy Luck Club by Amy Tan, Bone by Fae Myenne Ng, and Severance: A Novel by Ling Ma. I employ monsters as metaphors and motifs that illustrate the womens’ genealogical trauma and resistance. By putting Chinese American matrilineages in a monstrous context, I elevate them as alternative knowledge sources that haunt the margins of Western society. In The Joy Luck Club, ghosts reveal the invisibility and survivor mindset of Chinese American immigrant mothers. For Bone, skeletons represent the unspoken trauma that plagues Chinese American …

Memory, Politics, And Literary Imagination In Viet Thanh Nguyen’S The Refugees, Jian Zhu Dec 2023

Memory, Politics, And Literary Imagination In Viet Thanh Nguyen’S The Refugees, Jian Zhu

Asian American Literature: Discourses & Pedagogies

Despite the official conclusion of the Vietnam War, the struggle for remembrance and recollection endures. Within the pages of The Refugees, Viet Thanh Nguyen offers a transnational lens through which to examine the formation and contestation of collective memories between the United States and Vietnam. Despite its military defeat, the United States appropriated anti-communist ideology during the Cold War era to assimilate the refugee community, leveraging a discourse of “freedom and democracy” as a means to reshape historical narratives. In stark contrast, Vietnam commemorated its revolutionary struggle against imperialism through the establishment of museums, statues, and public cemeteries within …

Course Design As Critical Creativity: Intersectional, Regional, And Demographic Approaches To Teaching Asian American Literatures, Thomas X. Sarmiento Dec 2023

Course Design As Critical Creativity: Intersectional, Regional, And Demographic Approaches To Teaching Asian American Literatures, Thomas X. Sarmiento

Asian American Literature: Discourses & Pedagogies

This essay offers a theoretical and reflective exploration of critically informed acts of creativity expressed in my course design for and teaching of Asian American literatures at a predominantly white, public land-grant, Midwestern university. I argue that teaching is both a creative and critical activity as it generates new ways of knowing and being through an assessment and curation of extant literary texts and scholarly discourses. Given my geographic, scholarly, and personal orientations, my course features intersectional, regional, and ethnically diverse perspectives that aim to queer what “Asian America/n” signifies. I hope my situated pedagogical insights inspire other scholar-teachers to …

"Loving You No Matter What You Do": Ai's Dramatic Monologues, 1970s Asian American Feminisms, And Reproductive Justice, Catherine Irwin

Asian American Literature: Discourses & Pedagogies

This essay makes visible the 1970s involvement of Asian American and Women of Color feminists in reproductive justice. Grounded in the Asian American feminist praxis of remembering, this essay analyzes how three dramatic monologues by the Asian American mixed-race poet Ai engage with the discourses of reproduce justice set forth by Asian American and Women of Color activists leading up to the 1973 Roe v. Wade decision. Using an Asian American feminist lens, this paper argues that the speakers in Ai’s monologues utilize these discourses circulating about abortion and women’s health care to construct images of the treatment of dispossessed …
