วิทยานิพนธ์ มาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกม: กลไกเพื่อความสนุกหรือการพนันแฝง มีวัตถุประสงค์เพื่อศึกษาเพื่อศึกษาการทำงานของระบบกล่องสุ่มภายในวิดีโอเกมว่าเป็นกลไกเพื่อความสนุกหรือการพนันแฝง ผลกระทบที่อาจเกิดต่อผู้เล่นและต่อสังคม และเพื่อมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมของประเทศไทยและต่างประเทศ เพื่อเสนอแนวทางที่เหมาะสมในการกำกับควบคุมการใช้ระบบกล่องสุ่มภายในวิดีโอเกมสำหรับประเทศไทย โดยศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐ และภาคเอกชน จำนวน 17 คน ผลการศึกษาพบว่า การทำงานของระบบกล่องสุ่มภายในวิดีโอเกม เป็นทั้งระบบที่เป็นส่วนหนึ่งของวิดีโอเกมและระบบที่มีลักษณะและการส่งผลทางจิตเหมือนกับการพนัน เสมือนการพนันแฝงภายในวิดีโอเกม แต่ระบบกล่องสุ่มภายในวิดีโอเกมไม่มีสถานะเป็นการพนันตามพระราชบัญญัติการพนัน พ.ศ. 2478 ระบบกล่องสุ่มภายในวิดีโอเกมส่งผลกระทบทั้งในด้านความไม่เป็นธรรมต่อผู้เล่น ด้านสุขภาพ และด้านเศรฐกิจและสังคม ซึ่งอาจส่งผลให้เกิดปัญหาอาชญากรรมอื่นตามมา ในปัจจุบันประเทศไทยยังไม่มีกฎหมายหรือหน่วยงานใดที่กำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมโดยตรง และไม่มีมาตรการของภาคเอกชนไทยในการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกม ในส่วนของมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมของต่างประเทศ ในส่วนของภาครัฐมีการใช้มาตรการทางกฎหมายการพนัน กฎหมายคุ้มครองผู้บริโภค และกฎหมายกล่องสุ่มภายในวิดีโอเกมโดยตรง ภาคเอกชนมีการทำข้อตกลงในภาคอุตสาหกรรมเกม มีมาตรการของร้านค้าออนไลน์ และมาตรการจัดเรทวิดีโอเกม แนวทางของมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมที่เหมาะสมสำหรับประเทศไทย คือ 1) มีการนิยามการพนันไว้ในกฎหมายอย่างชัดเจน 2) ให้มีกฎหมายเกี่ยวกับระบบกล่องสุ่มภายในวิดีโอเกมโดยตรง 3) ให้มีการจัดเรทวิดีโอเกมโดยพิจารณาจากระบบการเล่น 4) ให้มีมาตรการสำหรับผู้ให้บริการเกมจากต่างประเทศ นอกจากนี้ควรมีการประชาสัมพันธ์ให้ความรู้เพิ่มเติม และส่งเสริมการทำงานของทุกภาคส่วนที่เกี่ยวข้อง

เอกัตศึกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาความรับผิดในทางอาญากรณีการทำให้ทรัพย์ของผู้อื่นหรือผู้อื่นเป็นเจ้าของรวมสูญหาย ในขอบเขตความผิดอาญาฐานทำให้เสียทรัพย์ โดยผู้วิจัยมุ่งศึกษาวิวัฒนาการความผิดฐานทำให้เสียทรัพย์ องค์ประกอบความผิด แนวคิดและการตีความกฎหมายในกรณีของการทำให้ทรัพย์ของผู้อื่นหรือผู้อื่นเป็นเจ้าของรวมสูญหายไป เปรียบเทียบกับแนวคิดและมาตรการการลงโทษของกฎหมายต่างประเทศ ที่กำหนดให้การทำให้ทรัพย์ของผู้อื่นสูญหายเป็นความผิดฐานทำให้เสียทรัพย์จากการศึกษาพบว่าแนวคิดเรื่องการบังคับใช้กฎหมายอาญาความผิดฐานทำให้เสียทรัพย์ของประเทศไทย ในกรณีการทำให้ทรัพย์ของผู้อื่นหรือผู้อื่นเป็นเจ้าของรวมสูญหาย แบ่งออกเป็น 2 แนวคิด กล่าวคือ แนวคิดแรกเห็นว่า การทำให้ทรัพย์สูญหายถูกตีความว่าเป็นรูปแบบหนึ่งของการทำลาย อันเป็นลักษณะของการกระทำความผิดฐานทำให้เสียทรัพย์ แต่ในอีกแนวคิดหนึ่งเห็นว่า วัตถุประสงค์ของการลงโทษความผิดฐานทำให้เสียทรัพย์ต้องเป็นการกระทำต่อทรัพย์โดยตรงเท่านั้น จึงไม่ครอบคลุมถึงการทำให้ทรัพย์สูญหายด้วย จากปัญหานี้ทำให้การตีความกฎหมายถูกแบ่งเป็น 2 แนวทาง ไม่มีความชัดเจนแน่นอน ขัดต่อหลักประกันทางอาญา และการไม่กำหนดให้การทำให้ทรัพย์ของผู้อื่นหรือผู้อื่นเป็นเจ้าของรวมสูญหายให้เป็นความผิดอาญาที่ชัดเจน ย่อมเป็นช่องว่างทางกฎหมายที่ผู้กระทำผิดไม่ได้รับการลงโทษที่ได้สัดส่วนกับการกระทำ และผู้เสียหายไม่ได้รับความยุติธรรมจากการดำเนินคดีดังนั้นผู้วิจัยจึงขอเสนอแนะแนวทางแก้ไขปัญหาความรับผิดในทางอาญากรณีการทำให้ทรัพย์ของผู้อื่นหรือผู้อื่นเป็นเจ้าของรวมสูญหาย โดยการเสนอให้เพิ่มเติม “ทำให้สูญหาย" ให้เป็นลักษณะการกระทำที่เป็นความผิดอาญาฐานทำให้เสียทรัพย์ ในประมวลกฎหมายอาญามาตรา 358 อันเป็นการขยายขอบเขตวัตถุประสงค์ที่กฎหมายมุ่งคุ้มครอง

การศึกษาเชิงพรรณนานี้มุ่งศึกษาลักษณะ ปัจจัยที่สัมพันธ์ต่อความขัดแย้ง รูปแบบการจัดการที่มิได้เข้ากระบวนการศาลจากโรงพยาบาลตติยภูมิในกรุงเทพมหานครและปริมณฑลในช่วงแพร่ระบาดของโรคโควิด-19 รวมถึงผลกระทบจากสถานการณ์ ตลอดจนโอกาสพัฒนาแนวคิดยุติธรรมเชิงสมานฉันท์ โดยศึกษาข้อมูลเบื้องต้นจากหน่วยงานบริหารความขัดแย้งผ่านแบบสอบถาม และสัมภาษณ์เชิงลึกในผู้ที่เคยได้รับความเสียหายในบริการทางการแพทย์ ผู้บริหารระบบและไกล่เกลี่ยความขัดแย้ง ผลการศึกษาจากการสำรวจจากโรงพยาบาล 19 แห่ง พบว่าการให้ข้อมูลที่ไม่เหมาะสม และปัญหาการสื่อสาร เป็นเหตุสำคัญสูงสุด (ร้อยละ 71.5) ผู้ไกล่เกลี่ยที่เคยอบรมหลักสูตรการเจรจาไกล่เกลี่ย หรือการบริหารความขัดแย้งมีเพียงส่วนน้อย (ร้อยละ 12.2) และไม่มีผู้รู้จักแนวคิดยุติธรรมสมานฉันท์ ผลสัมภาษณ์เชิงลึกพบว่าความขัดแย้งนั้นเกี่ยวเนื่องกับผู้ป่วยเชื่อว่าความเสียหายนั้นเกิดจากการบริการ ความบกพร่องของสื่อสารหรือท่าทีของผู้ให้บริการ ส่วนอุปสรรคต่อความสำเร็จการยุติความขัดแย้งที่สำคัญ คือ ผู้บริหารความขัดแย้งขาดอำนาจตัดสินใจ แสดงออกไม่จริงใจและไม่เป็นกลาง ผู้ให้บริการทางการแพทย์ที่ไม่แสดงความเห็นใจ และรูปแบบการเยียวยาที่ไม่ตรงความต้องการกับผู้เสียหาย สอดคล้องกับกรณียุติความขัดแย้งสำเร็จพบว่าคณะผู้เสียหายได้รับเยียวยาเพียงพอ ได้รับการสื่อสารที่เข้าใจและเข้าหาสม่ำเสมอ ดังนั้นผู้บริหารควรร่วมบริหารความขัดแย้ง ให้ความสำคัญกับภาระงานและส่งเสริมพัฒนาทักษะผู้ปฏิบัติ รวมทั้งนำหลักยุติธรรมสมานฉันท์มาประยุกต์ใช้ ที่มุ่งเน้นเยียวยาให้อภัยและนำไปสู่ยุติความขัดแย้งได้

สารนิพนธ์ฉบับนี้ศึกษาถึงพลวัตที่ซับซ้อนของการค้ามนุษย์เพื่อบังคับก่ออาชญากรรมโดยองค์กรอาชญากรรมหลอกลวงทางไซเบอร์ข้ามชาติในบริบทที่เกิดขึ้นในพื้นที่ภูมิภาคเอเชียตะวันออกเฉียงใต้และผลกระทบที่มีต่อความมั่นคงของมนุษย์ในหลากหลายมิติ ในสถานการณ์ปัจจุบันที่การพัฒนาทางเทคโนโลยีมีความก้าวหน้าและแพลตฟอร์มดิจิทัลกลายเป็นเครื่องมือที่ถูกใช้ในการหลอกลวงทางออนไลน์ ยังคงขาดงานศึกษาในทางวิชาการที่เกี่ยวข้องกับการหลอกลวงคนเพื่อบังคับก่ออาชญากรรม โดยเฉพาะอย่างยิ่งในมุมมองที่มีผลกระทบต่อความมั่นคงของมนุษย์ สารนิพนธ์ฉบับนี้จึงนำเสนอให้เห็นถึงกลไลวิธีการหลอกลวงบุคคลให้เข้ามาเป็นผู้ก่ออาชญากรรมออนไลน์ โดยเผยให้เห็นด้านมืดของเทคโนโลยีที่มีผลต่อการแสวงหาผลประโยชน์ของมนุษย์และความเชื่อมโยงกับเครือข่ายองค์กรอาชญากรรมข้ามชาติ และประเมินถึงผลกระทบในหลายมิติของอาชญากรรมที่มีต่อความมั่นคงของมนุษย์ ทั้งความมั่นคงในระดับบุคคล ในด้านเศรษฐกิจและความปลอดภัยของชุมชน รายงานฉบับนี้จัดทำโดยการวิเคราะห์ข้อมูลทุติยภูมิ วิเคราะห์ถึงความสัมพันธ์กับการค้ามนุษย์ อุปสรรคต่อการปรามปรามอาชญากรรมรูปแบบใหม่นี้ที่เป็นผลจากความซับซ้อนทางเทคโนโลยี การไม่เปิดเผยตัวตนในโลกออนไลน์ กรอบกฎหมายที่ไม่พอเพียงต่อการแก้ปัญหา ความแตกต่างของเขตอำนาจศาล และอุปสรรคในการคัดแยกหรือช่วยเหลือคุ้มครองผู้เสียหาย นอกจากนี้ ชี้ให้เห็นถึงช่องว่างของความตระหนักรู้และทักษะความเข้าใจและใช้เทคโนโลยีดิจิทัลที่ทำให้เกิดความเปราะบางในสังคม เสนอแนะการแก้ไขปัญหาโดยการเพิ่มศักยภาพในการเก็บหลักฐานทางดิจิทัล เสริมสร้างการตระหนักรู้ของสังคม ทักษะความเข้าใจต่อเทคโนโลยี การปรับปรุงกรอบกฎหมายให้มีความสอดคล้องการสนับสนุนให้มีความร่วมมือระหว่างประเทศ และการสร้างกลไกช่วยเหลือคุ้มครองเหยื่อผู้เสียหายที่มีประสิทธิภาพ งานศึกษาฉบับนี้เป็นส่วนหนึ่งของการศึกษาประเด็นปัญหาของการค้ามนุษย์และอาชญากรรมไซเบอร์ในเชิงกว้างที่เน้นให้เห็นถึงความจำเป็นในการตอบสนองต่อปัญหาด้วยวิธีการบูรณาการ และยึดตัวบุคคลเป็นศูนย์กลางเพื่อปกป้องไว้ซึ่งความมั่นคงของมนุษย์ภายในโลกดิจิทัลปัจจุบัน

การศึกษาเรื่อง “ความท้าทายในการทำงานร่วมกันระหว่างสำนักงานตำรวจแห่งชาติและองค์การตำรวจสากลในการจัดส่งผู้ร้ายข้ามแดน” มีวัตถุประสงค์เพื่อวิเคราะห์ความท้าทายและอุปสรรคในการประสานงานระหว่างสำนักงานตำรวจแห่งชาติของไทยและองค์การตำรวจสากล (INTERPOL) ในกระบวนการส่งผู้ร้ายข้ามแดน การวิจัยใช้ระเบียบวิธีวิจัยเชิงคุณภาพ โดยการสัมภาษณ์เชิงลึกกับเจ้าหน้าที่ตำรวจ กองการต่างประเทศ ฝ่ายตำรวจสากลและประสานงานภูมิภาค และการวิเคราะห์เอกสารที่เกี่ยวข้อง ผลการศึกษาพบว่าความท้าทายหลักในการทำงานร่วมกันระหว่างสององค์กรในการจัดส่งผู้ร้ายข้ามแดน คือการยึดถือหลักการไม่แทรกแซงกิจการภายในระหว่างรัฐ ซึ่งส่งผลให้เกิดความล่าช้าในการดำเนินการ อุปสรรคเกิดจากความแตกต่างของระบบกฎหมายและกระบวนการทางกฎหมายของแต่ละประเทศที่แตกต่างกันทำให้การประสานงานระหว่างประเทศต้องใช้เวลามาก และรัฐอื่นจะเข้าไปก้าวก่ายไม่ได้ นอกจากนี้ การพิจารณาด้านสิทธิมนุษยชนยังมีบทบาทสำคัญในการตัดสินใจส่งผู้ร้ายข้ามแดนอีกด้วย ข้อเสนอแนะที่สำคัญในการเพิ่มประสิทธิภาพการทำงานร่วมกัน ได้แก่ การสร้างความเข้าใจและความเชื่อมั่นระหว่างประเทศในการดำเนินงานทางกฎหมายและการคุ้มครองสิทธิมนุษยชน เพื่อให้การประสานงานระหว่างประเทศเป็นไปอย่างราบรื่นและมีประสิทธิภาพ

ประเทศไทยเป็นตลาดการค้าขนาดใหญ่ของนักสะสมโบราณวัตถุและศิลปวัตถุทั่วโลก ทำให้ประสบปัญหาการค้าโบราณวัตถุและศิลปวัตถุข้ามชาติที่ผิดกฎหมายมาอย่างต่อเนื่อง กฎหมายที่มีหน้าที่ป้องกันและคุ้มครองโบราณวัตถุและศิลปวัตถุในปัจจุบัน คือ พระราชบัญญัติโบราณสถาน โบราณวัตถุ ศิลปวัตถุ และพิพิธภัณฑสถานแห่งชาติ พ.ศ. 2504 ไม่สามารถคุ้มครองและแก้ไขปัญหาได้อย่างเพียงพอ ยังพบปัญหาการบุกรุก ขุดค้นโบราณสถานเพื่อให้ได้โบราณวัตถุ การค้าโบราณวัตถุและศิลปวัตถุที่ผิดกฎหมาย รวมทั้งอำนาจหน้าที่ของพนักงานเจ้าหน้าที่ตามกฎหมายฉบับนี้ที่ไม่สามารถปราบปรามอาชญากรรมเกี่ยวกับทรัพย์สินทางวัฒนธรรมของชาติได้อย่างแท้จริง การแก้ปัญหาขณะนี้มีเพียงการติดตามทวงคืนผ่านอนุสัญญาระหว่างประเทศเท่านั้น ทั้งการใช้มาตรการทั่วไปและมาตรการพิเศษในการแสวงหาพยานหลักฐานตามกฎหมายเฉพาะก็มีเพียงการค้นในเขตโบราณสถานหรือสถานที่การค้าโบราณวัตถุหรือศิลปวัตถุเท่านั้น ทำให้ไม่สามารถปกป้องโบราณวัตถุได้ทัน นอกจากนี้ คดีในฐานความผิดที่เกี่ยวกับการค้าโบราณวัตถุและศิลปวัตถุที่ผิดกฎหมายในลักษณะองค์กรอาชญากรรมข้ามชาติยังไม่ได้รับการวินิจฉัยให้เป็นคดีพิเศษที่มีความสำคัญและส่งผลกระทบต่อความมั่นคงของชาติ ซึ่งจำเป็นต้องใช้มาตรการพิเศษในการแสวงหาพยานหลักฐานเพื่อหาต้นตอของการกระทำความผิดได้แต่อย่างใด ทั้งๆ ที่ รูปแบบของการกระทำความผิดคดีนี้มีการใช้วิธีที่ซับซ้อน มีส่วนเกี่ยวข้องกับอาชญากรรมร้ายแรง ใช้วิธีทางเทคโนโลยีในการกระทำความผิด จนทำให้ไม่สามารถปราบปรามและจับกุมกลุ่มบุคคลที่มีส่วนเกี่ยวข้องทั้งหมดได้ ดังนั้น การกำหนดบทนิยามของโบราณวัตถุและศิลปวัตถุให้สอดคล้องกับหลักสากล การกำหนดให้คดีการค้าโบราณวัตถุและศิลปวัตถุที่ผิดกฎหมายในลักษณะองค์กรอาชญากรรมข้ามชาติตามความผิดพระราชบัญญัติโบราณสถานฯ เป็นคดีพิเศษ เพื่อสามารถวินิจฉัยให้นำมาตรการพิเศษที่จำเป็นมาใช้ในการแสวงหาพยานหลักฐาน จึงจะเป็นการแก้ปัญหาในการหาพยานหลักฐาน เพื่อสืบสวน สอบสวนถึงต้นตอและตัวการสำคัญของกลุ่มบุคคลที่กระทำความผิดได้อย่างทันท่วงที โดยนำมาตรการพิเศษตามกฎหมายที่ใช้ในการปราบปรามอาชญากรรมร้ายแรง เช่น การค้นยานพาหนะ การเข้าถึงข้อมูลทางเทคโนโลยีและการสะกดรอยทางอิเล็กทรอนิกส์ การปฏิบัติการอำพราง และการเคลื่อนย้ายภายใต้การควบคุม มาใช้จึงอาจเป็นการแก้ปัญหาได้ ดังนั้น วิทยานิพนธ์ฉบับนี้จึงมีวัตถุประสงค์เพื่อเสนอแนวทางเพิ่มเติมที่จะนำมาตรการพิเศษในการแสวงหาพยานหลักฐานมาใช้ในคดีการค้าโบราณวัตถุและศิลปวัตถุที่ผิดกฎหมายในลักษณะองค์กรอาชญากรรมข้ามชาติ

We think of scams primarily as a problem for older adults. Indeed, in the past few years, states and the federal government have undertaken a range of legal actions designed to prevent seniors, as a distinct class, from scams-- from more harshly punishing perpetrators of scams directed towards older adults to authorizing financial institutions to closely monitor and rapidly freeze the accounts of their older clients. But this successful, popular, and bipartisan law reform movement has taken place without a thorough empirical understanding of whether, in fact, seniors fall victim to scams more frequently than other age groups.

The Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) is now expected to allow participants to redeem their food benefits online, i.e., via online ordering, rather than only in-store. However, it is unclear how this new benefit redemption model may impact participants’ welfare since vendors may have an asymmetric information advantage compared with WIC customers. The WIC online ordering environment may also change the landscape for WIC vendors, which will eventually affect WIC participants. The present study investigated the perceived quality of homicide evidence provided to law enforcement by the coroner versus medical examiner systems. Respondents (N=15) from county law enforcement agencies in three different Southeastern states that utilize either the coroner, medical examiner, or combination of both systems were presented with a 17-question virtual survey that included questions regarding personal background, educational background, employment history, knowledge of the medical examiner versus coroner systems, and personal experience with one or both systems involving homicide investigations. This Note discusses the following three parts. Part I provides an overview of the cash bail system, its history, and its contemporary use in Washington state. Part II presents the effects of bail on pretrial release, analyzing low-income and racial inequalities and the adverse impacts it can have on the accused. Students in the Anniston School District are placed in the alternative setting (i.e., the Avery Alternative Center) for fighting and violence more than any other disciplinary infraction. The disproportionality of students of color and minority groups enrolled in the alternative setting for fighting is also alarming. Why is this happening? Why does student conflict often end in physical aggression and violence, especially disputes involving minorities? What can stop the violence? The news of the many atrocities being committed as the war in Ukraine rages on has prompted a chorus of calls seeking to hold perpetrators accountable. Heralded as a critical player is the International Criminal Court (the ICC or “Court”). Unlike in the past where states have decried requests to increase the Court’s budget or refused to cooperate with the Office of the Prosecutor’s (“OTP”) efforts to gather evidence or arrest suspects, states are generously donating funding and other resources to bolster the Court’s likelihood of bringing successful prosecutions.

The problematic portrayals of rape investigations in televised media reify a culture ofvictim blaming and perpetuate an ideology that is harmful to victims and survivors. The current study sought to explore differences in a previously incarcerated individual’s personality traits based on biological sex. It was posited that within a population of individuals who were formerly incarcerated, males would demonstrate a greater prevalence of personality traits that have been previously associated with involvement in the criminal justice system, compared to females. A total of 2,400 previously incarcerated people from Wave IV of The National Longitudinal Study of Adolescent Health (ADD Health) were asked questions related to personality traits. An important piece of this profile is an ancestry estimate, and methodological accuracy is taken seriously. Traditional typological nonmetric methods of ancestry are heavily critiqued for being subjective and lacking scientific rigor in analysis. In addition, these methods are noted for conflating morphological traits with specific ancestral categories, ignoring the reality of continuous human variation.
