Impact Of Covid-19 On A Smoking Cessation Intervention: A Look At Recruitment And Retention, Elizabeth S. Hawes
Impact Of Covid-19 On A Smoking Cessation Intervention: A Look At Recruitment And Retention, Elizabeth S. Hawes
All ETDs from UAB
While smoking prevalence rates have declined in the general population over the past 50 years, persons in the criminal legal population have disproportionally high rates of smoking. Previous research suggests that smoking cessation interventions and campaigns have missed targeting this population. Due to the COVD-19 pandemic, many ongoing clinical trials had to rapidly shift to using remote trials, including our smoking cessation trial with the criminal legal population. The purpose of this secondary analysis was to compare recruitment rate, study adherence, retention, NRT adherence, and quit attempts for participants who completed the study as planned (In Person), after implementation of …

In his 2021 book ‘Truth-Telling: History, Sovereignty and the Uluru Statement’, Henry Reynolds called for an inquiry into the historical record of Samuel Walker Griffith, Federation ‘father’ and first Chief Justice of the High Court of Australia. Reynolds’ iconoclasm targeted a historical figure whose name is memorialised in a Riverina town, a Canberra suburb and a Queensland university. Reynolds charged that Griffith was morally and politically responsible for the violence carried out by an agency of the Queensland government, the Native Police. This historically grounded allegation relates to Griffith's pre-Federation Queensland political career, 1874–93, when he served intermittently as Premier, …

As participation in electronic sports (esports) continues to expand globally, colleges and universities are considering how such competitive video gaming might impact recruitment, retention, and the overall student engagement experience. This mixed-methods study focuses on the perceptions of college students in both the United States and Italy regarding the esports phenomenon. A compilation of the research findings from two case studies compared and contrasted themes associated with the benefits and risks to college students participating in esports. The findings highlighted the notion that even during challenging times such as the COVID-19 pandemic, the college students in this study were still …
How To Do The History Of Sexual Science, Benjamin Kahan, Greta Lafleur
How To Do The History Of Sexual Science, Benjamin Kahan, Greta Lafleur
Faculty Publications
This introduction maps the ways in which sexual scientific thought circulated during the fin de siècle, tracing the interconnections between and breaks in the global circuits of sexological thought and how this circuitry continues to structure sexuality in the present. In so doing, Kahan and LaFleur position their approach and that of the special issue as a whole within the larger field of sexology, placing it in more robust dialogue with sexuality studies and attending in particular to sexology's racial and imperial logics. They examine the ways in which racial science and colonial knowledge constitute sexual science as an amorphous …

Transforming Military Justice: The 2022 And 2023 National Defense Authorization Acts, David A. Schlueter, Lisa Schenck
Faculty Articles
For the past decade there have been numerous and significant changes to the Uniform Code of Military Justice (UCMJ), the statutory basis for the military justice system. Although the Military Justice Act of 2016 made major changes to the UCMJ, the calls for change continued. One of the most-often heard calls for reform over the last decade has suggested removing commanders from the military justice system. Some have argued that a command-centric military justice system was outdated, and it was time to make the system look more like the federal criminal procedure system. Other critics have advocated for a military …

Despite the major reforms to the American military justice system in the 2016 Military Justice Act, the drumbeat for reform has continued. One of the most-often heard calls for reform over the last decade has suggested removing commanders from the military justice system. Some have argued that a command-centric military justice system was outdated, and it was time to make the system look more like the Federal criminal procedure system. Other critics have advocated for a military justice system that looks more like those of our allied nations. This article briefly addresses the 2022 and 2023 NDAA changes to the …
Revolutionizing Justice: Unleashing The Power Of Artificial Intelligence, Samuel D. Hodge Jr.
Revolutionizing Justice: Unleashing The Power Of Artificial Intelligence, Samuel D. Hodge Jr.
SMU Science and Technology Law Review
The practice of law is changing, and most lawyers are unprepared for this metamorphosis. This statement is not an exaggeration but the acknowledgment that artificial intelligence (“AI”) has altered the way lawyers do business. Instead of having a “battle of forms,” attorneys will now be confronted with the “battle of computers.” Linking artificial intelligence and the law, however, is a natural progression. Both operate in similar fashions: each examines and applies “historical examples in order to infer rules to apply to new situations.”
While many attorneys are unsure how to integrate this new technology into their practices, they already use …

Status To Be Determined: Analyzing Indian Status Within The General Crimes Act In A Post-Castro-Huerta Landscape, Joshua Zoeller
Status To Be Determined: Analyzing Indian Status Within The General Crimes Act In A Post-Castro-Huerta Landscape, Joshua Zoeller
Saint Louis University Law Journal
The General Crimes Act, codified at 18 U.S.C. § 1152, is an older statute that pertains to federal criminal jurisdiction over crimes committed in Indian Country. The General Crimes Act is limited in scope as it only applies to cases where the alleged perpetrator of the crime is not a Native American but the victim is determined to be a Native American. But who decides how to label each party as “Indian” or “non-Indian” (to borrow language used in the courts)? And is ‘Indian status’ an element of the statute that the prosecution must prove or is it reserved for …

Exploring Supports And Barriers To Inclusion In Occupational Therapy Education, Arielle Ramirez, Anne F. Kiraly-Alvarez
Exploring Supports And Barriers To Inclusion In Occupational Therapy Education, Arielle Ramirez, Anne F. Kiraly-Alvarez
Journal of Occupational Therapy Education
The recent innumerable social and racial injustices and healthcare disparities experienced globally have catapulted diversity and inclusion discussions to the forefront. The purpose of this study was to identify the supports and barriers to inclusion in occupational therapy (OT) education from the experiences of OT students from historically marginalized groups and the perspectives of OT faculty/staff. The authors used a convergent mixed methods design for the study, which consisted of an online survey and semi-structured interviews. 131 students and 35 faculty/staff completed the survey, while 20 students and 11 faculty completed interviews. Five themes emerged from the data: 1) Barriers …
Law's Credibility Problem, Julia Simon-Kerr
Law's Credibility Problem, Julia Simon-Kerr
Faculty Articles and Papers
Credibility determinations often seal people's fates. They can determine outcomes at trial; they condition the provision of benefits, like social security; and they play an increasingly dispositive role in immigration proceedings. Yet there is no stable definition of credibility in the law. Courts and agencies diverge at the most basic definitional level in their use of the category.
Consider a real-world example. An immigration judge denies asylum despite the applicant's plausible and unrefuted account of persecution in their country of origin. The applicant appeals, pointing to the fact that Congress enacted a "rebuttable presumption of credibility" for asylum-seekers "on appeal." …

The Fight For Felon Re-Enfranchisement: Rethinking The Eleventh Circuit's Approach To Senate Bill 7066, Ashley Grabowski
The Fight For Felon Re-Enfranchisement: Rethinking The Eleventh Circuit's Approach To Senate Bill 7066, Ashley Grabowski
University of Florida Journal of Law & Public Policy
Florida’s passage of Amendment 4, which restored voting rights to certain convicted felons upon completion of their terms of sentence, was celebrated as a landmark victory for democratic representation and recidivism efforts. However, this victory was gutted by the Florida Legislature’s passage of Senate Bill 7066, which interpreted “all terms of sentence” to include repayment of a felon’s legal financial obligations—fines, restitution, costs, and fees—ordered by the sentencing court. This Note surveys the toll that Senate Bill 7066 imposes on democracy and equity, and challenges the Eleventh Circuit’s decision to uphold the Bill as constitutionally valid in Jones v. Governor …

The Impact Of Youth On Coerced Confessions, Mike Nocera
The Impact Of Youth On Coerced Confessions, Mike Nocera
Research Days Posters 2023
In the 1950s, psychologist and former police officer John E. Reid changed the course of police work when he developed the Reid Technique for interrogation. The Reid Technique, primarily focused on intimidation, aggression, and observation of suspect behavior, is considered the gold standard in police interrogation and still remains a cornerstone of our modern legal system. However, due to this prominence, it has largely been subjected to scrutiny by scholars, who now assert that the Reid Technique practices are overly aggressive, inaccurate, and encourage wrongful convictions. The aggressive nature of the technique seems to have an extremely dangerous effect of …
Marijuana And The Capitalist Agenda, Mallory Detamble
Marijuana And The Capitalist Agenda, Mallory Detamble
Research Days Posters 2023
In recent years, the United States has loosened restrictions on the commodification of marijuana. This move towards less strict policy counteracts much of the mainstream ideology surrounding marijuana during the 20th century. Such a shift in public opinion is at least partially attributable to the capitalist society itself. By analyzing the ways in which marijuana can be sublimated into capitalism, we can better understand how profit motivates today’s industries more than ethical and social circumstances. By comparing the circumstances of the 20th century, to the circumstances we are now presented with, the ways in which our legal system handles drug …

Ignored, Harassed, And Endangered: States Must Provide Gender-Affirming Healthcare To Transgender Youth In Juvenile Detention, Jake Gnolfo
Loyola University Chicago Law Journal
In 2019, the U.S. Court of Appeals for the Ninth Circuit in Edmo v. Corizon, Inc. held a prison’s denial of gender-affirming care to a transgender adult prisoner constituted cruel and unusual punishment under the Eighth Amendment. However, the reality for incarcerated transgender juveniles is much different. It is incredibly hard, if not impossible, for transgender juveniles to obtain access to gender-affirming care while detained. Furthermore, states have begun banning gender-affirming healthcare for all transgender youth. Preliminary injunctions of these laws have been swift and successful; however, transgender juveniles remain left out of the conversation. While being restrained of their …
Revisiting The Geography Of Globalisation In The Covid-19 Pandemic Using Risk Theory, Kunphatu Sakwit
Revisiting The Geography Of Globalisation In The Covid-19 Pandemic Using Risk Theory, Kunphatu Sakwit
Journal of Social Sciences
My review paper is part of Covid-IAS Project, funded by National Research Council of Thailand. The paper focuses on the geography of globalisation in the Covid -19 pandemic. I employ Ulrich Beck’s concept of risk society to critically examine geography. Although Beck is not a geography theorist, his theory can be used extensively and alternatively to study the geography of globalisation. By drawing upon Beck, I argue that the geography of globalisation in the context of Covid -19 displays forms of dependency upon the politics of knowledge about Covid -19 vaccines. With the production of knowledge, the vaccines have caused …
