“This Isn’T Justice”: Abused Women Navigate Family Law In Greater Vancouver, Wendy Chan, Rebecca Lennox
“This Isn’T Justice”: Abused Women Navigate Family Law In Greater Vancouver, Wendy Chan, Rebecca Lennox
Canadian Journal of Family Law
With the implementation of the Family Law Act in 2013, the family legal system in British Columbia saw a series of progressive reforms. These include the recognition of emotional, psychological, and financial control as family violence, a new protection order process to replace the limited restraining orders formerly available to abuse victims, a mandate that courts consider how exposure to family violence impacts children, and minimum mandatory training standards for family dispute resolution professionals. While there has been a great deal of legal commentary on these new provisions, there is a paucity of scholarly research documenting the experiences of frontline …
Mediator Discretion In Cases Involving Intimate Partner Violence, Michaela Keet, Jeff Edgar
Mediator Discretion In Cases Involving Intimate Partner Violence, Michaela Keet, Jeff Edgar
Canadian Journal of Family Law
Mediation is a centerpiece in the ‘agreement culture’ around family law litigation. It is recognized by the courts as offering inherent protections to deal with challenging cases such as those involving intimate partner violence. To learn more about how mediators invoke and view the process’s protections, we conducted a series of interviews with senior mediators, trainers, and policymakers in the field. This article synthesizes current views within the mediation field about how to identify and screen for IPV, and implications for process management. At the heart of these interviews was the theme of mediator discretion: mediators describe and value discretion …
The Intersection Of Child Protection And Family Law Systems In Cases Of Domestic Violence, Wanda Wiegers
The Intersection Of Child Protection And Family Law Systems In Cases Of Domestic Violence, Wanda Wiegers
Canadian Journal of Family Law
Both the child protection and the family law systems are intended to promote the best interests of children, and both can profoundly affect the relationships between children and their parents or caregivers. Over the past two decades, both systems have also accorded more weight in the assessment of best interests to how exposure to domestic violence can harm or place children at risk. However, these systems have evolved differently, are governed by different statutes, and are administered in different ways. Child protection proceedings purport to have primarily a protective function and invariably involve a public agency, while family law proceedings, …
The Powerful Actors Of The Criminal Justice System: Understanding Prosecutorial Discretion From The Viewpoint Of Prosecutors. A Public Administrator's Perspective, Ja'von Long
West Chester University Doctoral Projects
Prosecutors are one of the most powerful actors in the American criminal justice system, yet there is a lack of qualitative research related to the topic. There is also a lack of policy reform that has affected prosecutors in the way that it has other actors of the system such as police officers and judges. The research seeks to increase understanding of how prosecutors view the discretion and power prosecutors hold and seeks to provide more information on the institutional and organizational pressures that can affect prosecutors and their decision-making process. The study further explores how cognitive biases along with …
“Any Means Necessary To Refuse Erasure By Algorithm:” Lillian-Yvonne Bertram’S Travesty Generator, Zach Whalen
“Any Means Necessary To Refuse Erasure By Algorithm:” Lillian-Yvonne Bertram’S Travesty Generator, Zach Whalen
Communication & Digital Studies Articles
Lillian-Yvonne Bertram's 2019 book of poetry is titled Travesty Generator in reference to Hugh Kenner and Joseph O'Rourke's Pascal program to “fabricate pseudo-text” by producing text such that each n-length string of characters in the output occurs at the same frequency as in the source text. Whereas for Kenner and O'Rourke, labeling their work a “travesty” is a hyperbolic tease or a literary burlesque, for Bertram, the travesty is the political reality of racism in America. For each of the works Travesty Generator, Bertram uses the generators of computer poetry to critique, resist, and replace narratives of oppression and to …
Fostering Engagement With Voicethread In Online Intermediate Spanish Language Classes, Karen Acosta, Ericka H. Parra Dr
Fostering Engagement With Voicethread In Online Intermediate Spanish Language Classes, Karen Acosta, Ericka H. Parra Dr
The Coastal Review
It is estimated that more than 1.5 billion students have been affected during the course of the global coronavirus pandemic by school and university closures. As a way to navigate this new instructional landscape, the researchers aimed to find a tool that would allow students to develop and practice communicative language skills in their online Spanish classes. In this research study, participants used VoiceThread over the course of a semester and then reflected on their comfort level using communicative skills in Spanish before and after using the tool, as well as whether they perceived that using the platform in their …
Judging Youth Time, Lisa M. Kelly
Judging Youth Time, Lisa M. Kelly
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
Questions of time, culpability and rehabilitation permeate youth criminal law. This paper examines competing claims about time and justice in R. v. P. (C.), a recent decision of the Supreme Court of Canada upholding a leave requirement for youth appeals in circumstances where adults enjoy an appeal as of right. In light of the relatively low stakes of the case in terms of actual appellate practice, I question why the majority worked so hard, often at the expense of logic, to deny a formal equality claim that would have changed little in reality. I argue that an enduring, if unstated, …
The Significance Of R. V. Albashir In The Evolution Of Constitutional Remedies, Anne M. Turley, Zoe Oxaal
The Significance Of R. V. Albashir In The Evolution Of Constitutional Remedies, Anne M. Turley, Zoe Oxaal
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
This paper examines the impact of the Supreme Court of Canada’s decision in R. v. Albashir on constitutional remedies under section 52(1) of the Constitution Act, 1982 and section 24(1) of the Canadian Charter of Rights and Freedoms. Albashir marks a step in the evolution of constitutional remedies by adding to the list of factors that can justify a court declaring a law invalid on a prospective-only basis. It recognizes a new exception to the presumption of retroactivity that applies when a court declares a law to be invalid. Where a court suspends its declaration of invalidity, once the suspension …
Diving Into Correctional Education Program Research: A Systematic Review, Evelyn Roehn
Diving Into Correctional Education Program Research: A Systematic Review, Evelyn Roehn
Undergraduate Honors Theses
In the last three decades, there has been a growing interest in correctional education programming and its effects on the recidivism rates of offenders. Research has concluded that programs such as general education equivalency (GED), college credit, and trade/vocational skill-building work to reduce recidivism rates among offenders. Although current research is widely accepted among scholars, several questions remain. 1) How is recidivism defined, and how does the definition change the rates? 2) How are researchers addressing selection bias in their study, and what impact does this have on their findings? 3) How are inmates with learning disabilities and language barriers …

Fostering Reading: Supporting Foster Children Through Virtual Learning, Evette Harrell, Leah Washburn-Moses
Mid-Western Educational Researcher
Professional literature presents evidence that foster care agencies, foster parents, and educators are unprepared to meet the distinctive educational needs of foster youth. Although there is a general lack of evidence on specific interventions developed for foster youth, some studies have addressed the impact of tutoring. This paper studies the impact of a pilot program that paired 15 teacher candidates with 15 foster youth for virtual reading tutoring as part of a college course. Data were collected from youth, parents, and teacher candidates through surveys and focus groups. The results of this study suggested that the tutoring relationship produced several …

Change Is The Only Constant: How Dialectical Behavior Therapy (Dbt) Can Be Made More Culturally Responsive Across Treatment Settings, Angela Susan Van Berkel
Change Is The Only Constant: How Dialectical Behavior Therapy (Dbt) Can Be Made More Culturally Responsive Across Treatment Settings, Angela Susan Van Berkel
Psychology Doctoral Specialization Projects
This program design demonstrates how Dialectical Behavior Therapy (DBT), a well-regarded, existing evidence-based practice (EBP) used to treat many transdiagnostic and complex mental health disorders around the world, can be made more culturally responsive across treatment settings. An overview of the literature regarding global access to mental health treatment reveals that much effort has been made to close the mental health treatment gap by promoting EBPs. However, most EBP research is conducted in Western countries using majority white populations, which calls into question the generalizability and effectiveness of EBPs among U.S. cultural and racial minority and international populations. Despite the …
Counties As Catalysts For Change_ Exploring The Economic Costs Of Child Maltreatment Through Its Connection To Incarceration, Kayla Solomon
Counties As Catalysts For Change_ Exploring The Economic Costs Of Child Maltreatment Through Its Connection To Incarceration, Kayla Solomon
Scripps Senior Theses
This study posits the question, what is the relationship between child maltreatment and adult incarceration at the county-level, and how can we utilize an understanding of it to inform child welfare strategies? Child maltreatment is a public health crisis and an obstacle to the United States Economy. Inspired by my high school capstone project on the connection between the foster care and criminal justice systems, I entered this project hoping to add to the myriad of literature that influences child welfare policy throughout California and the broader United States. This project serves to culminate my college career and exemplifies my …

Race, Gatekeeping, Magical Words, And The Rules Of Evidence, I. Bennett Capers
Faculty Scholarship
Although it might not be apparent from the Federal Rules of Evidence themselves, or the common law that preceded them, there is a long history in this country of tying evidence—what is deemed relevant, what is deemed trustworthy—to race. And increasingly, evidence scholars are excavating that history. Indeed, not just excavating, but showing how that history has racial effects that continue into the present.
One area that has escaped racialized scrutiny—at least of the type I am interested in—is that of expert testimony. In this brief Essay written for the Vanderbilt Law Review Symposium, Reimagining the Rules of Evidence at …
