A Comparative Look At Various Countries' Legal Regimes Governing Automated Vehicles, Brittany Eastman, Shay Collins, Ryan Jones, Jj Martin, Marjory S. Blumenthal, Karlyn D. Stanley Jan 2023

A Comparative Look At Various Countries' Legal Regimes Governing Automated Vehicles, Brittany Eastman, Shay Collins, Ryan Jones, Jj Martin, Marjory S. Blumenthal, Karlyn D. Stanley

Journal of Law and Mobility

News and commentary about automated vehicles (AVs) focus on how they look and appear to operate, along with the companies developing and testing them. Behind the scenes are legal regimes—laws, regulations, and implementing bodies of different kinds—that literally and figuratively provide the rules of the road for AVs. Legal regimes matter because public welfare hinges on aspects of AV design and operation. Legal regimes can provide gatekeeping for AV developers and operators seeking to use public roads, and they can allocate liability when something goes wrong. Guiding and complementing legal regimes is public policy. Policy documents such as articulations of …

Regulatory Frameworks For Smart Mobility: Current U.S. Regulation Of Connected And Automated Vehicles And The Road Ahead, Olivia Dworkin, Jorge Ortiz, Nicholas Xenakis Jan 2023

Regulatory Frameworks For Smart Mobility: Current U.S. Regulation Of Connected And Automated Vehicles And The Road Ahead, Olivia Dworkin, Jorge Ortiz, Nicholas Xenakis

Journal of Law and Mobility

On June 7, 2023, Senator Gary Peters from Michigan gave an interview about autonomous vehicle technology where he stated that: “From a competitive standpoint, there’s no question that it is absolutely essential that this technology get developed here and deployed here in the United States. We’re facing significant international competition from other countries that understand that autonomy represents not only the future of mobility, but it drives other technologies in a significant way.” Just last year, Senator Peters and eleven of his colleagues had also written a letter to Secretary of Transportation Pete Buttigieg that: “The federal government has the …

Children Of Men: The Roberts Court’S Jurisprudence Of Masculinity, Melissa Murray Jan 2023

Children Of Men: The Roberts Court’S Jurisprudence Of Masculinity, Melissa Murray

Faculty Articles

On June 24, 2022, the U.S. Supreme Court issued its much-anticipated decision in Dobbs v. Jackson Women’s Health Organization, upholding a Mississippi ban on pre-viability abortions and overruling Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey, once the twin pillars of the Court’s abortion jurisprudence. Given the intense focus on Dobbs, the Court’s other consequential decisions on gun rights and religious freedom received less attention. The neglect of these other decisions is unfortunate because, when viewed in tandem with Dobbs, these other decisions suggest the Roberts Court’s commitment to an ascendant “jurisprudence of masculinity” that prioritizes, both …

A Fiduciary Theory Of Progressive Prosecution, Bruce A. Green, Rebecca Roiphe Jan 2023

A Fiduciary Theory Of Progressive Prosecution, Bruce A. Green, Rebecca Roiphe

Faculty Scholarship

Progressive prosecutors differ from their more traditional counterparts primarily in the way in which they make decisions. They tend to bind their discretion by announcing categorical policies rather than making fact-based decisions case by case. This Article catalogs the unusual degree of pushback progressive prosecutors have encountered from the public, legislatures, courts, police, and their own subordinate prosecutors. Drawing on fiduciary theory, it explains this reaction as a response to progressive prosecutors’ abdication of their fiduciary role. As a public fiduciary, prosecutors are entrusted with protecting the public’s abstract interest in justice, and an integral part of this role is …

Desistance As A Signal Of Rehabilitation: Understanding Public Perception And The Moderating Role Of Redeemability, Jasmyn Stevens Jan 2023

Desistance As A Signal Of Rehabilitation: Understanding Public Perception And The Moderating Role Of Redeemability, Jasmyn Stevens

College of Graduate Studies: Theses & Dissertations

The criminal offender label is enduring and comes with significant real-world consequences. While there is a wealth of literature on offender rehabilitation, less emphasis has been placed on the varying ways that individuals define this concept. The goal of this study is to understand how variations in both punitiveness and rehabilitative definitions affect general beliefs about desistance from crime. Additionally, belief in redeemability is examined as a moderator of this relationship. Using data from an anonymous, national-level, opt-in survey collected through Amazon’s Mechanical Turk (MTurk) platform, I test three hypotheses using logistic regression. Results indicate that while increased punitiveness is …

AbstractPsychoactive substance (PAS) abuse is a major public health problem leading to increased morbidity and mortality. In Nigeria, the incidence rate of PAS abuse has remained high, particularly in the youth population. The purpose of this study was to examine the influence of social factors and school enrollment status on PAS abuse in youth in Southeast Nigeria. The social ecological model and the theory of reasoned action were the theoretical frameworks used for this study; they were selected due to their focus on multiple levels of factors that influence behavior. A quantitative cross-sectional study design approach was used to determine …

Railroad tank cars are the main mode of transportation for carrying flammable liquids and other hazardous materials, in any mode of ground transportation system. These tank cars, if punctured during derailments may explode releasing large amounts of hazardous materials and posing serious threats to human life and leading to economic losses. To minimize such catastrophes, in 2015, United States Department of Transportation (USDOT) proposed to improve the thermal and puncture performances of these tank cars and introduced two new design specifications: DOT-117 and DOT-117R. Tank cars with 9/16 inches …

How Might We Reimagine Transportation Technology To Combat Forced Labor: Conference Explanations And Recommendations From The Law And Mobility Program’S Annual Conference 2023, Brittany Eastman

Journal of Law and Mobility

The University of Michigan Law School’s Law and Mobility Program (LAMP), a resource for scholarship about the legal implications of emerging transportation technology with a particular focus on connected and automated vehicles (CAVs), hosts an annual conference. The topic of the LAMP Annual Conference 2023 considered how we might reimagine transportation technology in a way that combats the systemic vulnerabilities that leave certain populations more likely to experience forced labor. This topic was selected because there are multiple lenses through which to consider the transportation equity outcomes for users, industry workers, and society at large; forced labor is just one …

Foreign Affairs, Nondelegation, And The Major Questions Doctrine, Curtis Bradley, Jack Landman Goldsmith Jan 2023

Foreign Affairs, Nondelegation, And The Major Questions Doctrine, Curtis Bradley, Jack Landman Goldsmith

Public Law and Legal Theory Working Papers

Some of the Supreme Court Justices and scholars who support a reinvigoration of the nondelegation doctrine would allow for an exception for grants of authority relating to foreign affairs. Others have criticized such an exception as unprincipled or as reflecting improper “foreign affairs exceptionalism.” This Article argues against a foreign affairs exception to the nondelegation doctrine but contends that the doctrine should be applied less strictly when a statutory authorization relates to an area of independent presidential power. The President has more independent power relating to foreign affairs than domestic affairs, so this limitation on the nondelegation doctrine will do …

Parents’ Perceptions Of The Traits, Characteristics, And Circumstances Of Modern-Day Mass Shooters, Matt Talbot Jan 2023

Parents’ Perceptions Of The Traits, Characteristics, And Circumstances Of Modern-Day Mass Shooters, Matt Talbot

Walden Dissertations and Doctoral Studies

There is little research on parents’ perceptions about the traits, characteristics, and circumstances ascribed to mass shooters and the sources of information shaping these perceptions. Understanding parents’ beliefs about mass shooters and mass shootings can serve to inform approaches to training and education and recommendations for media reporting on such events. Evidence-based knowledge helps parents become more equipped to serve as early interventionists for those who may be moving along a pathway of violence. Application of Gerbner’s cultivation theory frames the process by which media sources shape perceptions. In this phenomenological qualitative study, semi structured interviews were conducted with 19 …

Effects Of Social Determinants On Access To Care Among Patients With Diabetes In Florida, Nekeisha Latoya Walker Jan 2023

Effects Of Social Determinants On Access To Care Among Patients With Diabetes In Florida, Nekeisha Latoya Walker

Walden Dissertations and Doctoral Studies

Diabetes imposes a major burden on society, especially in the state of Florida, in the form of increased medical costs, lost productivity, early mortality, and intangible costs in the form of diminished quality of life. Access to diabetic care affects health administration in Florida by impacting the overall cost of treating the condition. Limited access to care can lead to an increased risk of complications resulting in a higher cost of treatment. The purpose of this quantitative study was to determine whether access to care dependent variables (access to doctors and length of time since last routine checkup) were associated …

Teachers’ Perceptions Of Social Emotional Learning Instruction And High Residential Mobility Students’ Reading Literacy, Janel Dorene Morris Jan 2023

Teachers’ Perceptions Of Social Emotional Learning Instruction And High Residential Mobility Students’ Reading Literacy, Janel Dorene Morris

Walden Dissertations and Doctoral Studies

Based on recommendations from research, leaders in a north Texas public school district implemented social emotional learning (SEL) to address academic gaps among high residential mobility (HRM) students. Incorporating SEL instruction improves academic achievement 11 percentile points on average; however, in Adoniram School District (ASD), 2021 passing rates fell 8% from 2019 despite adopting SEL curriculum. The purpose of this qualitative case study was to explore how ASD elementary teachers instructed SEL, and their perceptions of how SEL techniques influenced HRM elementary students’ reading literacy development. The study on social and emotional skills (SSES) conceptual framework guided this study because …

The Daily Patterns Of Emergency Medical Events, Mary Elizabeth Helander, Margaret K. Formica, Dessa K. Bergen-Cico Jan 2023

The Daily Patterns Of Emergency Medical Events, Mary Elizabeth Helander, Margaret K. Formica, Dessa K. Bergen-Cico

Social Science - All Scholarship

This study examines population level daily patterns of time-stamped emergency medical service (EMS) dispatches to establish their situational predictability. Using visualization, sinusoidal regression, and statistical tests to compare empirical cumulative distributions, we analyzed 311,848,450 emergency medical call records from the U.S. National Emergency Medical Services Information System (NEMSIS) for years 2010 through 2022. The analysis revealed a robust daily pattern in the hourly distribution of distress calls across 33 major categories of medical emergency dispatch types. Sinusoidal regression coefficients for all types were statistically significant, mostly at the p < 0.0001 level. The coefficient of determination ($R^2$) ranged from 0.84 and 0.99 for all models, with most falling in the 0.94 to 0.99 range. The common sinusoidal pattern, peaking in mid-afternoon, demonstrates that all major categories of medical emergency dispatch types appear to be influenced by an underlying daily rhythm that is aligned with daylight hours and common sleep/wake cycles. A comparison of results with previous landmark studies revealed new and contrasting EMS patterns for several long-established peak occurrence hours--specifically for chest pain, heart problems, stroke, convulsions and seizures, and sudden cardiac arrest/death. Upon closer examination, we also found that heart attacks, diagnosed by paramedics in the field via 12-lead cardiac monitoring, followed the identified common daily pattern of a mid-afternoon peak, departing from prior generally accepted morning tendencies. Extended analysis revealed that the normative pattern prevailed across the NEMSIS data when re-organized to consider monthly, seasonal, daylight-savings vs civil time, and pre-/post- COVID-19 periods. The predictable daily EMS patterns provide impetus for more research that links daily variation with causal risk and protective factors. Our methods are straightforward and presented with detail to provide accessible and replicable implementation for researchers and practitioners.

Assessing Visions Of Democracy In Regulatory Policymaking, Shoba Sivaprasad Wadhia, Christopher J. Walker Jan 2023

Assessing Visions Of Democracy In Regulatory Policymaking, Shoba Sivaprasad Wadhia, Christopher J. Walker

Faculty Scholarship

Motivated in part by Congress’s failure to legislate, presidents in recent years seem to have turned even more to the regulatory process to make major policy. It is perhaps no coincidence that the field of administrative law has similarly seen a resurgence of scholarship extolling the virtues of democratic accountability in the modern administrative state. Some scholars have even argued that bureaucracy is as much as if not more democratically legitimate than Congress, either in the aggregative or deliberative sense, or both.

In our contribution to this Ensuring Democratic Accountability in the Administrative State Symposium, we make a modest intervention …

Bail And Mental Illness, Samuel Wiseman Jan 2023

Bail And Mental Illness, Samuel Wiseman

Faculty Scholarship

In many parts of the United States, the bail system is strikingly unfair, imposing burdensome, and often unmeetable, financial conditions on pretrial liberty even for low-risk defendants. Reforms that reduce or eliminate cash bail and lower pretrial detention rates have made progress in recent years, but now face growing opposition even in generally progressive jurisdictions such as San Francisco and New York City. One source of this opposition is rising concern about crime—particularly crime associated with the unhoused, who disproportionately suffer from mental illness, including substance abuse disorder. This is not a coincidence, as one effect of a cash-bail system, …

Examining The Impact Of Aging On Gross Domestic Product (Gdp) Growth And Infrastructure Investment In India: A District-Level Study, Sahil Tekchandani Jan 2023

Examining The Impact Of Aging On Gross Domestic Product (Gdp) Growth And Infrastructure Investment In India: A District-Level Study, Sahil Tekchandani

CMC Senior Theses

India, like many other countries around the world, has a rapidly aging population. Unlike most developed nations, however, India’s economy is not growing quickly enough to adequately support the increase in old age population share. Using district-level data from the Indian Census and the International Crops Research Institute for the Semi-Arid Tropics, this study performs linear regressions to analyze the impact that aging has on GDP growth and infrastructure investment. GDP growth is examined in the primary, secondary, and tertiary sectors, while the focus of infrastructure investment is on roads and banks. The study finds that a higher old age …
