Exploring Supervisory Experiences After The Legalization Of Recreational Marijuana In Colorado, Charles Daniel Mason
Walden Dissertations and Doctoral Studies
AbstractColorado became the first state to decriminalize recreational marijuana in 2014. This new public policy resulted in unproven regulatory changes in any population in the United States. The purpose of the study was to discover the core perspective and experiences of 12 supervisors who experienced this phenomenon in their professional occupations, through the lens of accountability. The risk perceptions of supervisors’ due to policy shifts regarding recreational marijuana in Colorado were analyzed using the Delve system and hand coding. Findings indicated employees’ use of marijuana had a direct impact on productivity, which decreased significantly over time. Employees displayed signs of …

Scotus On Immigration: A Review Of Recent Decisions & What's To Come
Cardozo Journal of Equal Rights & Social Justice
The symposium discusses recent Supreme Court decisions on immigration, focusing on cases that address issues such as mandatory detention, limits on judicial review, and the expansion of executive discretion. These rulings have significant implications for immigration law and practice, particularly in areas of detention, due process, and the ability of federal courts to review immigration-related decisions.
Search And Seizure Budgets, Kiel Brennan-Marquez
Search And Seizure Budgets, Kiel Brennan-Marquez
Faculty Articles and Papers
This Article proposes a new means of restraining police power: quantitative limits on the number of law enforcement intrusions-searches and seizures-that may occur over a given period of time. Like monetary constraints, search and seizure budgets would aim to curb abusive policing and improve democratic oversight. But unlike their monetary counterparts, budgets would be indexed directly to the specific police activities that most enable escalation and abuse. What is more, budgets are a tool that finds support, conceptually, in the American framing experience. The Fourth Amendment has long been understood to require procedural limits, such as probable cause, on specific …

Reckless Associations, Jane R. Bambauer, Saura Masconale, Simone M. Sepe
UF Law Faculty Publications
This Article provides a theoretical foundation and practical guide for a new form of liability that has proven necessary in the Internet era: the tort of Reckless Association. This tort would hold de facto leaders of informal networks responsible when radicalized members of the network cause physical harm to others. Recent prosecutions of the leaders of the Oath Keepers and other white supremacists who organized the Charlottesville protest, and rumblings of a similar prosecution against Donald Trump, demonstrate that there is a public appetite for this form of legal responsibility. To date, these prosecutions proceed on theories of incitement or …
The Right To Remain Silent. . . Sometimes: Why § 1983 Claims For Miranda Violations Are Necessary To Fifth Amendment Protection, Logan Moore
Missouri Law Review
The police arrive at your workplace and ask to speak with you. Feeling embarrassed and confused, you agree to accompany them to an isolated room to answer questions. As you pass by the concerned looks and accusatory whispers of your co-workers, you wonder to yourself, “what did I do?” Once in the room, the feeling of helplessness becomes insurmountable. The officers have blocked the exit and begin to vehemently accuse you of a crime. Although you adamantly deny any involvement in or knowledge of the crime, the officers seem prepared to keep you in the room until you make a …
The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman
The Fallibility Of The Brandenburg Test Through The Lens Of The Capitol Insurrection, Lauren M. Hausman
Western New England Law Review
This Article explores the insurrection that occurred at our Capitol in relation to the Brandenburg test. The paper seeks to discuss whether free speech has gone too far, whether Brandenburg needs reform, and how we could effectuate such changes. While the Article certainly has political undertones, sincere efforts were made to present the facts in a more neutral fashion. Despite the political nature of the Article, I wholeheartedly believe that discussing the insurrection is critical to not only our nation’s history, but to the law.

Development Of Ambient Ionization Mass Spectrometry Approaches For The Characterization And Quantification Of Psychoactive Small-Molecule Constituents In Complex Plant Matrices, Megan Isabella Chambers
Legacy Theses & Dissertations (2009 - 2024)
Drug chemistry sections of forensic crime laboratories are tasked with analyzing a variety of unknown materials, a subset of which are derived from plants. In comparison to the analysis of small-molecule drugs, these plant matrices are incredibly complex and present unique challenges. When traditional chromatographic approaches are used to interrogate these materials in forensic investigations, large amounts of time, resources, and funds are directed towards the extensive sample preparation steps required. Exacerbating the issue is that the matrix characteristics often result in instrument downtime to accomplish the maintenance required to address ingredients adhering to columns or clogging syringes, which are …

Accreditation Commission For Education In Nursing (Acen): A Mixed Methods Study To Determine Accreditation Readiness At A Non-Profit Organization Located In Western North Carolina, Leslie Queen
Doctor of Education Dissertations
The accreditation process allows programs to complete the reflection process of program evaluation, where they assess and measure themselves via preset standards and suggested outcomes. The theoretical framework of Getzels and Guba (1957) was used to determine if the people within the nonprofit organization studied could successfully fulfill the predetermined expectations of the organization. This study also examined the value of program evaluation, explained the process used by schools of nursing that wish to seek national accreditation, investigated the benefits and strengths of attaining accreditation, and uncovered possible barriers that may hinder accreditation efforts. By exploring these topics, conclusions were …

The Airline Pilot Shortage: A Result Of Age Discrimination Or Excessive Training Requirements?, Katherine Hancock
The Airline Pilot Shortage: A Result Of Age Discrimination Or Excessive Training Requirements?, Katherine Hancock
Journal of Air Law and Commerce
In its relatively short history, public air travel has seen its fair share of airline pilot shortages. Before the COVID-19 pandemic, the industry was facing yet another. There was virtually no part of the airline industry untouched by the pandemic, and pilot supply was no exception. As an attempt to mitigate profit loss, airlines offered pilots early retirement packages. When air travel returned to pre-pandemic numbers earlier than expected, airlines struggled to fill cockpit seats, which was a major factor in causing the extensive flight cancellations and delays in 2022.
Legislators sought to alleviate the issue by raising the federally …

A Content Analysis Of State-Level Restorative Justice Statutes, Mason Karlyn Myers
A Content Analysis Of State-Level Restorative Justice Statutes, Mason Karlyn Myers
Electronic Theses and Dissertations
Restorative justice programs have garnered attention as a potential policy solution to address critical issues within the criminal justice system, such as mass incarceration, re-victimization, and costliness. However, effective implementation of these programs faces various challenges, including communication gaps, inadequate program design, and implementation issues. These challenges may be further exacerbated by the lack of consistent policies at the state level guiding restorative justice practices. Surprisingly, limited research has been conducted to examine restorative justice statutes at the state level. In response to this gap in the literature, this study analyzes the restorative justice policies of all fifty states, including …
