Entity Of The State: The Transparency Of Restricting Telecommunications Firms As Threats To America’S National Security, Benjamin W. Cramer
Entity Of The State: The Transparency Of Restricting Telecommunications Firms As Threats To America’S National Security, Benjamin W. Cramer
Notre Dame Journal on Emerging Technologies
This paper analyzes recent American regulations regarding international telecommunications firms that have been restricted from doing business in the United States, as apparent threats to national security. The paper will include policy-oriented research into the relevant legislation, plus more theoretical research on the framing of geopolitical disputes and the transparency of the resulting regulatory actions. There has been some suspicion from journalists and government watchdogs that such restrictions are politically motivated, with dramatic claims of national security threats leading to non-transparent trade regulations. This paper discusses the framing of geopolitical disputes and their impact on trade policy in the telecommunications …

Pedestrian Bridge For Discovery & Innovation, Matthew Hale, Dylan Stegman, Jake Porter
Pedestrian Bridge For Discovery & Innovation, Matthew Hale, Dylan Stegman, Jake Porter
Civil, Environmental and Sustainable Engineering Senior Theses
A new pedestrian bridge was designed adjacent to the Children’s Discovery Museum of San Jose spanning across the Guadalupe River in the Downtown San Jose area. This design includes structural, geotechnical, and construction components. The architectural aspects of the bridge include two intertwined mass timber arches, galvanized steel cables, and a deck consisting of wide flange I-beams and a proprietary structural glass deck system. These features allow the bridge to seamlessly integrate into the surrounding environment as well as expose structural components of a pedestrian bridge that would otherwise be covered by a traditional bridge deck. All disciplinary components of …
Highway 17 Wildlife Crossing, Taryn Chisholm, Seema Singh, Justin Uyeno
Highway 17 Wildlife Crossing, Taryn Chisholm, Seema Singh, Justin Uyeno
Civil, Environmental and Sustainable Engineering Senior Theses
Highway 17 is an essential corridor for people to commute between the Bay Area and the Santa Cruz regions, but this highway also creates a barrier between wildlife territories, fragmenting their habitats and stranding animal populations on either side. The lack of crossing infrastructure along Highway 17 forces wildlife to attempt to cross the highway into oncoming traffic, causing wildlife-vehicle collisions (WVC) which endangers the lives of motorists and animals alike. In order to address this problem, the team designed a precast, concrete culvert crossing underneath Highway 17 to provide a safer passageway to increase habitat connectivity as well as …

Ai Ethical Compliance Is Undecidable, Lorin Brennan
Ai Ethical Compliance Is Undecidable, Lorin Brennan
UC Law Science and Technology Journal
One response to concerns about AI systems has been to espouse “ethical AI,” that is, to elucidate ethical norms and then impose a legal requirement that AI systems comport with these norms. But will it work? More precisely, does there exist an effective procedure by which an AI system developer, or regulator, can determine in advance whether an AI system, once put into operation, will consistently generate output that conforms to a desired ethical norm? This paper argues “no.” The Halting Problem shows that there is no algorithm that can reliably do so for all AI systems running any allowed …

Essays On Civil Procedure: Remedies, Federal Courts, And Marginalized Groups, Portia Pedro
Essays On Civil Procedure: Remedies, Federal Courts, And Marginalized Groups, Portia Pedro
Yale Graduate School of Arts and Sciences Dissertations
This dissertation is a series of essays on the processes that judges use to make procedural decisions and the ways in which judges use procedure to navigate the tensions between law and equity, standards and rules, finality and fairness, and states and marginalized groups. It explores the procedure of procedure—how procedure develops and what hinders or furthers procedural decisionmaking. Some of these essays describe the ways in which racial subordination and the subordination of other marginalized groups manifest in civil procedure, remedies, and federal courts. The dissertation challenges the dominant understanding of these three areas of law as neutral and …

Mclaughlin-Walsh Residence Hall Expansion, Rebecca Huang, Shanelle Smith
Civil, Environmental and Sustainable Engineering Senior Theses
An expansion of McLaughlin-Walsh Residence at Santa Clara University was designed to provide additional housing accommodations to on-campus residents. The design included both the structural and geotechnical components. The proposed solution included a vertical expansion of the residence hall with the design of a podium to span over the existing structure to support an additional residential structure. The loads of the additional residential structure were estimated to complete the design of the podium structure. The podium was designed to support the estimated loads using reinforced concrete columns, steel beams, prefabricated trusses, and concrete on metal deck. The podium design was …

Less Is More?: Accountability For White-Collar Offenses Through An Abolitionist Framework, Pedro Gerson
Less Is More?: Accountability For White-Collar Offenses Through An Abolitionist Framework, Pedro Gerson
Faculty Scholarship
White-collar crime is underenforced: not enough cases are brought, not many convictions are secured, and when they are, those who were convicted usually benefit from leniency not seen in other kinds of criminal wrongdoing. Calls for accountability center on strengthening the traditional tools of criminal law enforcement to reach actors that have so far eluded criminal liability. These responses, however, risk further entrenching the systems that have led the United States to mass incarceration and its many real and tangible harms. In this Article, I question whether an abolitionist framework is possible for white-collar crime. First, I argue that given …
Don't Pull The Trigger On New York's Concealed Carry Improvement Act: Addressing First And Second Amendment Concerns, Morgan Band
Don't Pull The Trigger On New York's Concealed Carry Improvement Act: Addressing First And Second Amendment Concerns, Morgan Band
Fordham Law Review
Despite the increasing prevalence of mass shootings in the United States, the U.S. Supreme Court in New York State Rifle & Pistol Ass’n, Inc. v. Bruen struck down a 100-year-old New York statute that had restricted access to concealed carry permits. The statute had required applicants to demonstrate a “proper cause” for needing a concealed carry permit. But even if an applicant made the necessary showing, licensing officials retained discretion under the statute to decline to issue a permit. In striking down the statute, the Court distinguished between “may-issue” jurisdictions, such as New York, which give licensing officials discretion in …
License & (Gender) Registration, Please: A First Amendment Argument Against Compelled Driver's License Gender Markers, Lexi Meyer
Fordham Law Review
For as long as the United States has issued drivers’ licenses, licenses have indicated the holder’s gender in one form or another. Because drivers’ licenses are issued at the state level, states retain the authority to regulate the procedures for amending them. In some states, regulations include requirements that a transgender person undergo gender confirmation surgery before they can amend the gender marker on their driver’s license. Because many transgender people neither desire nor can afford gender confirmation surgery, these laws effectively preclude such people from obtaining gender-accurate identification. In doing so, these laws implicate multiple constitutional rights.

Answering The Call For Telephone Consumer Protection Act Reform: Effectuating Congressional Intent Within 47 U.S.C. § 227(B)(1)(A), Justice M. Hubbard
University of Michigan Journal of Law Reform
This Note analyzes the current state of the civil law surrounding the Telephone Consumer Protection Act (TCPA) and highlights a glaring flaw within the current practice of assigning liability to telephonic solicitors utilizing an automatic telephone dialing system (autodialer): solicitors can be subjected to liability even though their actions are not what Congress intended to prevent. Congress enacted the TCPA in response to unique consumer privacy and public safety concerns. For example, the use of an autodialer created a substantial likelihood that autodialers would call emergency services and could “seize” their telephone lines and prevent those lines from being utilized …
Jury Representation: Are Minnesota Counties Ensuring A Jury Of Your Peers?, Madison E. Weyker
Jury Representation: Are Minnesota Counties Ensuring A Jury Of Your Peers?, Madison E. Weyker
Political Science Theses and Capstones
The Equal Protection Clause of the Fourteenth Amendment states that the defendant in the courtroom is meant to have a jury that is largely representative of the local community in which the trial is held. This raises the question of whether juries are representative of the population in which they reside. To analyze this question, I compare the demographics of the 87 counties in Minnesota gather and analyze data from the Minnesota Judicial Branch’s Committee of Equality and Justice (Wahi et al., 2021). The results show that there are discrepancies at each stage of the jury process. Additionally, they show …

Evolving Online Terrain In An Inert Legal Landscape: How Algorithms And Ai Necessitate An Amendment Of Section 230 Of The Communications Decency Act, Ellison Snider
Minnesota Law Review Vols. 106:2 onward (2021-present)
The consequences of online speech are undeniable, and yet, as the internet rapidly evolves, Section 230 of the Communications Decency Act (CDA 230), the federal law most concerned with internet regulation, stays the same. The pervasive presence of algorithms and artificial intelligence (AI), sophisticated technologies used by platforms to autonomously organize and facilitate the spread of online speech, vindicates a reassessment of CDA 230’s scope and applicability in the context of the modern internet. The internet’s impact on modern society is profound. In recent years, it has supported powerful grassroots organizing for social movements and allowed connection to distant loved …

This work discusses the study and development of a graphical interface and implementation of a machine learning model for vehicle traffic injury and fatality prediction for a specified date range and for a certain zip (US postal) code based on the New York City's (NYC) vehicle crash data set. While previous studies focused on accident causes, little insight has been offered into how such data may be utilized to forecast future incidents, Studies that have historically concentrated on certain road segment types, such as highways and other streets, and a specific geographic region, this study offers a citywide review of …
Explaining Guatemalan Vigilantism, Bryant Mcconkie
Explaining Guatemalan Vigilantism, Bryant Mcconkie
Sigma: Journal of Political and International Studies
Ripped from his home in Concepción, Guatemala, the evening of October 13, 2015, Mayor Bacilio Juracán was brutally beaten, doused with gasoline, and burned to death by attackers convinced he had orchestrated the murder of a political rival they supported. In just this one isolated incident, the town hall, various cars, and at least six additional buildings were burned along with the mayor (“Linchan y Queman” 2015). A growing number of similar lynchings—vigilante attacks in which victims of the mob are severely injured or killed—across Guatemala have thrust Guatemalan vigilantism into the public consciousness, perplexing governments and political theorists alike …
The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick
The Impact Of Gender On The Acceptance Of Surveillance Technology, Jody Messick
Sigma: Journal of Political and International Studies
A classic dilemma facing governments and citizens alike is the trade-off between privacy and security. This concept is found in the Constitution’s Fourth Amendment, which implies that citizens have a right to be protected against “unreasonable searches and seizures by the government” (FindLaw 2019). The technological revolution, and its implications for privacy, has complicated the nature of this right. Different types of data require different approaches to the privacy versus security tradeoff. A 2003 panel by Wright et. al asks how “sensor data,” data that is collected through technology that tracks a user’s online or real-world movements, should be approached, …

Exploring Portrayals Of Cults In News Media: Establishing A Continuum, Ashley M. Reynolds
Exploring Portrayals Of Cults In News Media: Establishing A Continuum, Ashley M. Reynolds
Honors Theses
This thesis examines and analyzes the way cults are portrayed by various news media outlets. The intention of this thesis and my research in general is to convey the power of media influence in forming an individual’s perspective on cults. Each news media outlet (for purposes of this thesis, this includes Fox News, CNN, and the Associated Press) has their own definition of what a cult is, and this determines how they present those “cults” to the public. To understand how individuals form their opinions about cults and what exactly cults are via the media, it is necessary to investigate …
