Capital Punishment And Domestic Terrorism: Reconsidering Domestic Terrorism As An Aggravating Factor, Josh B. Starner
Criminal Law Society Blog
Federal law permits the death penalty when an individual commits an offense after substantial planning to cause death or commit terrorism. Yet the ambiguity surrounding the term “terrorism,” particularly in domestic contexts, complicates the application of the federal statute. This Article argues that invoking the terrorism aggravating factor in domestic cases undermines the justifications for capital punishment and risks inconsistent enforcement. Drawing on recent examples, including the prosecution of Luigi Mangione and the deaths of Renee Good and Alex Pretti by ICE officials, this Article illustrates how the “domestic terrorist” label can cause harsh prosecutorial discretion, intensify political polarization, and …

Race, Sexual Danger, And The Moral Logic Of Punishment In The Registry Era, Edith Meade

Across U.S. history, sexual regulation has operated as a powerful tool for producing racial hierarchy, defining moral boundaries, and legitimating punishment. From the colonial construction of Indigenous “savagery” to the hypersexualization of Black Americans under slavery and Jim Crow, sexual deviance has repeatedly been mobilized to justify surveillance, punishment, and racial terror. This project argues that the contemporary sex offender registry, widely understood as a neutral mechanism of public safety, is best understood as a modern extension of long-standing racialized narratives that link sexuality, danger, and exclusion.

Friend Or Tether: How Regulation Can Cut The Strings Of Manipulative Chatbots, Steve Hammerton

In the time since AI chatbots and other LLMs became widely available to the public, there has been a pattern of deaths linked to interactions with this technology. While it was settled in early 2026, Garcia v. Character Technologies serves as a case study of how AI chatbots can negatively prey on vulnerable groups in the absence of interventions to mitigate harmful AI behaviors and tragic human outcomes. There is not a singular approach to regulating the harmful effects of predatory chatbots; however, this paper advocates for a harms-based regime influenced by protections in human-subject research. Introduction: There is a need for evidence-based pre-employment physical fitness test standards in paramedic organisations. This study aimed to assess the feasibility of implementing an existing, international, standardised pre-employment paramedic physical capacity test, the Ottawa Paramedic Physical Abilities Test (OPPATTM), in the Australian context. Malicious rumours on social media platforms like Facebook, Twitter, and others can be widely disseminated because of social problems. It is challenging to manage a rumour once it gains growth and quickly moves throughout a network. One of the main issues with information dissemination is figuring out how to reduce the propagation of rumours within a social network. A deep reinforcement learning technique might be an effective strategy to manage the rumour issue. Art Intervention In A Time Of Momentum: A Transformative Pedagogy On Immigration In Undergraduate Art Education, Marissa A. Gutierrez-Vicario
Journal of Social Theory in Art Education
This article explores how art education can address social issues like immigration through an art intervention at a university in New York City. The author, a Mexican-American educator, guides students in using art to critically engage with immigration, challenge oppressive structures, and envision a more inclusive world. Through storytelling and public art, students invite campus members to reflect on immigration, encouraging dialogue and critical thinking. The intervention highlights the complex nature of social-engaged art, fostering creativity and questioning societal norms while promoting discussions around identity, migration, and belonging in the pursuit of social change.

The rapid growth of the collaborative or sharing economy has posed numerous challenges to traditional legal systems, particularly in relation to short-term accommodation. As a decentralized, intermediary platform, Airbnb raises complex legal issues concerning the allocation of civil liability, enforceability of contracts, and mechanisms for consumer protection. In the context of Vietnamese law, where there is a lack of clear regulatory frameworks to govern digital platforms, consumers risk having their rights infringed without effective legal remedies. The U Visa At 25: Legislative Missteps, Bureaucratic Neglect, And Geographic Roulette, Jason A. Cade
Scholarly Works
A quarter century ago, Congress created the U visa with dual goals: protecting immigrant crime victims and facilitating law enforcement cooperation by removing deportation barriers to crime reporting. Yet the program as implemented has fallen dramatically short of these aims. This Essay provides the first comprehensive analysis of the U visa's structural failures at its twenty-fifth anniversary. Two fundamental design flaws plague the program. First, Congress capped U visas at 10,000 annually-far below actual need-while the immigration agency has consistently failed to implement congressionally-authorized interim protections. The result is that, as of 2025, applicants wait five years for work authorization …

The Constitution and conventional wisdom suggest that lower courts must follow the most persuasive interpretations of U.S. Supreme Court precedent. But that does not always happen. Scholars recognize judicial under enforcement of Supreme Court precedent in several fields. This Essay contributes to this scholarship by analyzing lower court applications of New York State Rifle & Pistol Ass’n v. Bruen, in which the Supreme Court held that firearm laws must be consistent with the nation’s historical tradition of firearm regulation. Disarming Data: An Empirical Take On The Loaded Debate About Felon-In-Possession Of A Firearm, Jonathan Abel

This Article answers a crucial empirical question at the heart of the scholarly and judicial debates about the laws governing felon-in-possession of a firearm: How often do defendants charged with this offense have violent felony convictions? Using a comprehensive dataset of over 27,000 defendants charged in California from 2021 through 2024, the study provides a novel, large-scale analysis of how prosecutors deploy this most-common gun charge. The findings substantiate longstanding concerns that felon-in-possession is overbroad in its application to nonviolent felons—only 8.5% of defendants had a “violent felony” conviction as defined by California law, rising to just 28.8% under a …

This addendum complements the 2008 Plaster Creek Watershed Management Plan (WMP), which tells the full story of the Plaster Creek Watershed’s current condition, impairments, and need for restoration. This addendum focuses on chloride, an emerging pollutant of concern in Michigan that was not addressed in Plaster Creek’s 2008 WMP. This addendum meets the nine elements required by the United States Environmental Protection Agency (EPA) for a watershed management plan to be officially approved; as such, its content and layout are intended for a technical audience.

High-profile failures of infrastructure systems are often attributed to design flaws. However, these incidents can also stem from a broader set of interconnected decisions made by stakeholders involved in the planning, management, and operation of these systems. While ethical guidelines and professional codes are designed to prevent such failures, cognitive biases may undermine adherence. Previous research efforts, primarily focused on ethical violations using case studies, have overlooked how behavioral ethics constructs and professional conduct could drive these breaches. Rehumanizing Reintegration: Intensive Case Management Effectively Supporting Community Re-Entry Post Incarceration In Canada, Sheena Brown, Ardavan Eizadirad

This article examines the effectiveness of intensive case management (ICM) as a rehumanizing framework for supporting racialized individuals transitioning from incarceration to community re-entry in Canada. The study focuses on the Prosper program delivered by the community organization Amadeusz (learn more at https://amadeusz.ca/home), which provides culturally responsive, relationship-centered supports for individuals facing firearm-related charges. Guided by Critical Race Theory and Culturally Sustaining Pedagogies, two focus groups with six racialized female caseworkers were conducted alongside examining archival interviews and program evaluation data. The Kentucky Transportation Cabinet’s (KYTC) Department of Vehicle Regulation (DVR) administers numerous fees and taxes. Many administered by the two divisions in DVR — Motor Vehicle Licensing (DMVL) and Motor Carriers (DMC) — have remained unchanged for many years despite salary increases, the adoption of more complex and expensive technologies, and inflation raising administrative costs. This report provides in-depth assessments of 10 fees and taxes (selected by division administrators). Six are administered by DMVL — certificate of title, duplicate title, vehicle title history report, additional registration fee, reflectorized license plate fund, and trailer registrations — and four are managed by …
