A Revised Perspective On Non-Debtor Releases, Joshua M. Silverstein Oct 2023

A Revised Perspective On Non-Debtor Releases, Joshua M. Silverstein

Law Faculty Scholarship

“Non-debtor releases” are bankruptcy orders that extinguish claims against a party other than a bankrupt debtor over the objection of the creditor. Also known as “third-party releases,” the legality of these orders is one of the most important and controversial issues in bankruptcy law specifically and business law generally. The split in the courts over the propriety of non-debtor releases stretches back thirty-five years. However, the United States Supreme Court is poised to resolve the split this term in the Purdue Pharma bankruptcy. In two prior articles published in 2006 and 2009, I argued that third-party releases are permissible under …

Language depends critically on the integration of lexical information across multiple words to derive semantic concepts. Limitations of spatiotemporal resolution have previously rendered it difficult to isolate processes involved in semantic integration. We utilized intracranial recordings in epilepsy patients (n = 58) who read written word definitions. Descriptions were either referential or non-referential to a common object. Semantically referential sentences enabled high frequency broadband gamma activation (70-150 Hz) of the inferior frontal sulcus (IFS), medial parietal cortex, orbitofrontal cortex (OFC) and medial temporal lobe in the left, language-dominant hemisphere. IFS, OFC and posterior middle temporal gyrus activity was modulated by …

The Use And Importance Of Gaming And Roleplay In Identity Negotiation, Sam Weigel, Justin Rudnick Oct 2023

The Use And Importance Of Gaming And Roleplay In Identity Negotiation, Sam Weigel, Justin Rudnick

Communication and Theater Association of Minnesota Journal

This paper presents roleplaying games as a safe and effective venue for self-expression that can help to mitigate the effect of societal pressures when exploring identity. Interviews with 11 participants from the roleplaying game community demonstrate how roleplay can help facilitate the creation of safe spaces and foster creativity and inclusivity. A thematic analysis revealed roleplaying games contribute to the creation of safe spaces, opportunities for self-expression and individual agency, and steps towards greater self-actualization. This study builds upon existing research into identity adaptation theory, queer theory, symbolic convergence theory, organizational communication theory, and the performance of identity.

"Talk To Your Doctor:" A Rhetorical Analysis Of Burkean Identification In Direct-To-Consumer Pharmaceutical Advertisements, Sophia N. Bates, Valerie Lynn Schrader

Communication and Theater Association of Minnesota Journal

In this article, we use rhetorical criticism as a research method to apply Burkean identification to four direct-to-consumer pharmaceutical television commercials, suggesting that the commercials create a state of consubstantiality with the audience. The identification strategies of common ground, the assumed “we” through the use of the word “you,” and dissociation are utilized in these commercials to inspire consumers to initiate a conversation with their doctor about their healthcare needs. Based on the success direct-to-consumer pharmaceutical advertisements have had with inspiring patients to engage in a dialogue with healthcare providers, Burkean identification could have significant implications when used in other …

“Neither Orthodox Nor Enlightened:” Dorothy Sayers And Classical Education In America, Jessica Richardi Oct 2023

“Neither Orthodox Nor Enlightened:” Dorothy Sayers And Classical Education In America, Jessica Richardi

New England Classical Journal

In 1947, accomplished author and intellectual Dorothy Leigh Sayers shared her unorthodox views on education with an audience at Oxford University. The concerns she expressed about the failings of modern schooling and her proposed remedy would catalyze the “classical education” movement in the United States decades later, a movement characterized by adherence to the medieval trivium as both a tool of learning and a model for child development. The transmission of Sayers’s ideas to America, variations in the classical learning movement, and Sayers’ continued influence are discussed.

Horace C. 3.27 And Virgil, Aeneid 9, Michael C. J. Putnam Oct 2023

Horace C. 3.27 And Virgil, Aeneid 9, Michael C. J. Putnam

New England Classical Journal

This essay examines the imaginative connection between c. 3.27 of Horace, one of the poet’s longest and most intense odes, and a salient episode in book 9 of Virgil’s Aeneid. In particular it searches out the multivalent appearances of the concept of pietas in the descriptions of Europe’s behavior toward her father and of Nisus and Euryalus. In their case we attend both to the association between the two innamorati themselves and to that between Euryalus and his mother. I take it for granted that the two Latin masters knew and valued the work of each other.

Crowdfunding Your Diy Project: Introducing Students To Kickstarter, Jason W. Luther Oct 2023

Crowdfunding Your Diy Project: Introducing Students To Kickstarter, Jason W. Luther

Open Educational Resources

The purpose of this learning module is to help instructors consider how crowdfunding can serve as a meaningful way to build culturally rich, entrepreneurial projects. Such projects — which include film, music, publications, video and board games, art, performance, and technology — invite amateurs to not only articulate their vision of the world, but to ask others to participate in it, telling their story publicly in such a way that their network feels compelled to support them. While the obvious value of crowdfunding is that it financially supports the work of creators, it also uses the exigence of capital to …

Out Of The Mouths Of Babes: Children And The Formation Of The Rio De La Plata Spanish Address System, Israel Sanz-Sánchez, María Irene Moyna

Languages & Cultures Faculty Publications

This paper analyzes the effects of child language acquisition as a critical factor in a morphological change, namely, the replacement of the etymologically singular second person paradigm (tuteo) by its plural counterpart (voseo) in 19th century Rio de la Plata Spanish. The account applies a sociohistorical model which proposes that young children can function as language change agents in environments characterized by unpredictable input variation, lack of normative mechanisms, and the emergence of peer networks among young learners. The model is then applied to explain the rapid generalization of voseo in the late 1800s, a well-documented but poorly understood process. …

Developing A Human Right To Research In International Law, Sanya Samtani

Joint PIJIP/TLS Research Paper Series

The covid-19 pandemic has highlighted issues concerning equitable access to and participation in research. But research has always been indispensable to human development. To what extent does international law guarantee access to research as well as the practice of researching? Drawing on the social anthropology definition of research as the pursuit of that which is not yet known, this paper locates a novel human right to research within the core international human rights covenants. The paper sets out the scope and content of the right and the nature and content of State obligations flowing from it. It concludes by outlining …

Global Health Interventions: The Military, The Magic Bullet, The Deterministic Model-And Intervention Otherwise, Emily Yates-Doerr, Lauren Carruth, Gideon Lasco, Rosario García-Meza

Development Studies Faculty Publications

"Intervention" is central to global health, but the significance and effects of how intervention is practiced are often taken for granted. This review takes interventions into health and medicine as subjects for ethnographic inquiry. We highlight three lines of anthropological contributions: studies of global health interventions that serve imperial and military objectives, studies of "magic bullet" interventions arising from laboratory science, and studies of interventions based on deterministic modeling techniques. We then outline examples of "intervention otherwise," in which people build relations of solidarity and care through global health programming, design interventions to be interactive and adaptable, and use data …

Causal Models And Causal Modelling In Obesity: Foundations, Methods And Evidence, Roger S Zoh, Xiaoxin Yu, Philip Dawid, George Davey Smith, Stephen J French, David B Allison

Children’s Nutrition Research Center Staff Publications

Discussing causes in science, if we are to do so in a way that is sensible, begins at the root. All too often, we jump to discussing specific postulated causes but do not first consider what we mean by, for example, causes of obesity or how we discern whether something is a cause. In this paper, we address what we mean by a cause, discuss what might and might not constitute a reasonable causal model in the abstract, speculate about what the causal structure of obesity might be like overall and the types of things we should be looking …

Is A Psychotic Anthropology Possible? Or How To Have Inclusive Anthropologies Of Subjectivity And Personhood, John Marlovits, Matthew J. Wolf-Meyer Oct 2023

Is A Psychotic Anthropology Possible? Or How To Have Inclusive Anthropologies Of Subjectivity And Personhood, John Marlovits, Matthew J. Wolf-Meyer

Faculty Research, Scholarly, and Creative Activity

Dominant anthropological theories of mind, cognition, and consciousness reify particular ways of being in the world as "normal," which marginalizes the experiences of people who do not meet normative expectations of personhood or exhibit nonnormative subjectivities. By focusing on atypical forms of communication and self-representation in the ethnographic record, which draws from work in the anthropology of disability and psychological anthropology, we argue for the need to attend to interactions and behavior as the necessary basis for anthropological studies of personhood and subjectivity. These foci, which build on a foundation provided by affect theory and disability studies, stand to open …

Standardizing The Measures Of Assessment In Legal Translation Profession, Alalddin Al-Tarawneh, Wafa Abu Hatab, Mohammad Al-Badawi

Information Sciences Letters

Practicing legal translations may lead to shortcomings that need to be assessed and addressed. Therefore, to respond to such shortcomings and specificities emerging during the legal translation process, the paper proposes a comprehensive model to evaluate translation quality. The proposed model is built on a functionalist perspective that links legal, contextual, macro-textual, and microtextual criteria to outline an appropriate translation strategy that drives endeavors to overcome issues throughout the translation process. The same criteria persistently appear from the translation brief through to the final translation product crossing intermediate stages – reception, revision, delivery assessment. In identifying predictable evaluation criteria and …

A Psychometric Analysis Of Natural Language Inference Using Transformer Language Models, Antonio Laverghetta Jr. Oct 2023

A Psychometric Analysis Of Natural Language Inference Using Transformer Language Models, Antonio Laverghetta Jr.

USF Tampa Graduate Theses and Dissertations

Large language models (LLMs) are poised to transform both academia and industry. But the excitement around these generative AIs has also been met with concern for the true extent of their capabilities. This dissertation helps to address these questions by examining the capabilities of LLMs using the tools of psychometrics. We focus on analyzing the capabilities of LLMs on the task of natural language inference (NLI), a foundational benchmark often used to evaluate new models. We demonstrate that LLMs can reliably predict the psychometric properties of NLI items were those items administered to humans. Through a series of experiments, we …

Panikkar On Mysticism As A Middle Way Between Contemplation And Action, Abraham Velez De Cea Oct 2023

Panikkar On Mysticism As A Middle Way Between Contemplation And Action, Abraham Velez De Cea

EKU Faculty and Staff Scholarship

Panikkar’s philosophy of mysticism is best understood as an attempt to overcome monistic and dualistic ways of thinking about the divine, human beings and the universe. Mysticism, for Panikkar, is irreducible to either monistic experiences of oneness without a second or to dualistic experiences where the divine is seen as wholly other. Rather, mysticism relates to holistic experiences of Reality and Life where the divine, the universe and human consciousness are seen as distinct yet constitutively interrelated. Mysticism has often been based on dualistic views of this life and the next, worldly existence and heavenly existence, the material and the …

Of Words And Whistles: Statistical Learning Operates Similarly For Identical Sounds Perceived As Speech And Non-Speechof Words And Whistles: Statistical Learning Operates Similarly For Identical Sounds Perceived As Speech And Non-Speech, Sierra J. Sweet, Stephen C. Van Hedger, Laura J. Batterink

Psychology Publications

Statistical learning is an ability that allows individuals to effortlessly extract patterns from the environment, such as sound patterns in speech. Some prior evidence suggests that statistical learning operates more robustly for speech compared to non-speech stimuli, supporting the idea that humans are predisposed to learn language. However, any apparent statistical learning advantage for speech could be driven by signal acoustics, rather than the subjective perception per se of sounds as speech. To resolve this issue, the current study assessed whether there is a statistical learning advantage for ambiguous sounds that are subjectively perceived as speech-like compared to the same …

Similarity Measure Of Plithogenic Cubic Vague Sets: Examples And Possibilities, S. Anitha, A. Francina Shalini Oct 2023

Similarity Measure Of Plithogenic Cubic Vague Sets: Examples And Possibilities, S. Anitha, A. Francina Shalini

Neutrosophic Systems with Applications

The crisp, fuzzy, intuitionistic fuzzy, and neutrosophic sets are the extension of the plithogenic set, in which elements are characterized by the number of attributes and each attribute can assume many values. To achieve more accuracy and precise exclusion, a contradiction or dissimilarity degree is specified between each attribute and the values of the dominating attribute. A plithogenic cubic vague set is a combination of a plithogenic cubic set and a vague set. The key tool for resolving problems with pattern recognition and clustering analysis is the similarity measure. In this research, we characterize and investigate the similarities between two …

The Impact Of Enterprise Resource Planning (Erp) Implementation On Performance Of Firms: A Case To Support Production Process Improvement., Kareem A. El-Baz, Tawfik T. El-Midany, Magdy S. Ghattas, Mona A. Aboueleaz

Mansoura Engineering Journal

Competitive globalization and automated process management through a functional information platform that supports technologies such as enterprise resource planning (ERP) are critical to improving the performance of any business. Research studies show that a large number of (ERP) projects fail during implementation. Other studies have shown that the effectiveness of ERP implementation in improving production processes is modest or low, even for well-designed systems. This study takes an in-depth look at the critical success factors of ERP implementation that impact business success, and conducts a case study to analyze the results obtained and assess their impact on performance.

Ehf-Fndm: An Efficient Hybrid Features Fake News Detection Methodology On Social Media, Haidy Samir Fahim, Asmaa Mohamed Al-Saied, Ahmed Shaban Samra, Abeer Twakol Khalil

Mansoura Engineering Journal

People are increasingly using social media to consume and share news. The inherent benefits of social media over traditional news media include its low cost and ease of access. In addition, publishing a news article requires less content censorship on social media. The rapid spread of "fake news" on social media, that is, news that contains intentionally false information, has a significant negative impact on society. For instance, false information about the coronavirus disease "2019" has spread around the world like a virus. Therefore, developing effective methods to detect fake news early has great importance. In this paper, the (Efficient …
