The Mob Lawyer's Constitution, Sara Mayeux Oct 2023

The Mob Lawyer's Constitution, Sara Mayeux

Vanderbilt Law School Faculty Publications

This article reconstructs the constitutional rhetoric of mob lawyers, as well as drug lawyers and other icons of the high-priced criminal defense bar, from the 1970s through the 1990s-the heyday of federal organized crime prosecutions and thus, of the lawyers who defended against them. Drawing upon pop-culture sources including archival television footage, magazine features, newspaper coverage, and ghost-written mass-market memoirs, the article pieces together the constellation of soundbites through which mob lawyers disseminated their views. As the subjects of frequent media coverage, these lawyers advanced a coherent and distinctive (if crude) set of ideas about the proper relationship between individuals, …

Bordering On Solutions: A Comparative Study Of Mexican And U.S. Policies To Address Human Trafficking Along The Mexico-United States Border, Taylor Rosenbleeth

The International Law Review Association Student Forum

Mexico and the United States both contend with the issue of human trafficking and implement measures to address this prevalent challenge, not only within their respective territories, but also along their shared border region. Despite significant efforts, both nations encounter obstacles in their anti-trafficking endeavors. The U.S. promotes a comprehensive legal framework, exemplified by the Victims of Trafficking and Violence Protection Act, yet faces criticism regarding deportation policies and inadequate victim support mechanisms. In contrast, Mexico has demonstrated progress through legislative advancements such as the 2012 anti-trafficking law and initiatives like the "Blue Heart" campaign, yet the country struggles with …

The Anticommons Intersection Of Heirs Property And Gentrification, Emma R. White Oct 2023

The Anticommons Intersection Of Heirs Property And Gentrification, Emma R. White

Vanderbilt Law Review

Throughout history, internal and external pressures on Black landowners have resulted in the fragmentation of ownership through heirs property. This fragmentation is analogous to the erosion of community ties within minoritized neighborhoods susceptible to gentrification. Both contexts contribute directly to involuntary exit and land loss within the Black community. This Note analyzes the history of Black property ownership within the United States to illustrate the roots of heirs property and gentrification and evaluates traditional responses to these phenomena through the lens of the tragedy of the anticommons. In doing so, it highlights flaws in existing solutions to heirs property. It …

The advent of large language models (LLMs) and their adoption by the legal community has given rise to the question: what types of legal reasoning can LLMs perform? To enable greater study of this question, we present LegalBench: a collaboratively constructed legal reasoning benchmark consisting of 162 tasks covering six different types of legal reasoning. LegalBench was built through an interdisciplinary process, in which we collected tasks designed and hand-crafted by legal professionals. Because these subject matter experts took a leading role in construction, tasks either measure legal reasoning capabilities that are practically useful, or measure reasoning skills that lawyers …

Migrant Protection Protocols: An Examination Of Its Consequences And Impact On Child Enrollees, Mercedes Valadez Sep 2023

Migrant Protection Protocols: An Examination Of Its Consequences And Impact On Child Enrollees, Mercedes Valadez

Journal of Family Strengths

The Trump administration made major changes to long standing immigration and asylum protocols and practices. Among the changes was the implementation of the 2019 Migrant Protections Protocols (MPP), otherwise known as the “remain in Mexico” program. MPP required asylum seekers to reside in Mexico until their U.S. immigration court hearing. Asylum-seekers, including children, were forced to live in unstable and unsafe conditions. Families were separated and children were forced to endure unanticipated hardships and trauma. Using secondary data of child MPP enrollment from fiscal year (FY) 2019 through FY 2021 and letters from child MPP enrollees, this study explores the …

Mental Health And The Intersectionality Of Race And Gender Of Crossover Youth, James Freeman, Shieláh Deblanc, Shani Yeldell, Passion Williams, Christine White-Taylor, Jacquet Toliver

Journal of Family Strengths

Abstract

African American youth and their kinship families engaged in dual systems of care (i.e., child welfare system and juvenile justice system) commonly known as “crossover youth” can become overwhelmed by the competing priorities of both systems. While one system purports to advance a best interests standard of children in out of home care, the other, is stated to be centered on tenets of restorative justice. Children and families simultaneously involved in systems that are incompatible can be very difficult to negotiate. In addition to the traditional developmental gaps in crossover youth development there are subsequent layers that contribute to …

Gentles V. Day Sep 2023

Gentles V. Day

All Decisions

In this non-payment proceeding, the court denied respondent's motion seeking dismissal based on lack of a lease and privity of contract. Despite the absence of a written lease, the court found a landlord-tenant relationship existed due to the acceptance of ERAP benefits by the landlord and the tenant's continued occupancy. Respondent's objections to jurisdiction and failure to serve a thirty-day notice were waived by their participation in the case without objection earlier. The court restored the case for trial or settlement, holding that ERAP benefits constituted a binding agreement akin to a lease.

Landlord brought a holdover proceeding against tenant for failing to vacate the premises after the tenant of record passed away. Tenant claimed succession rights based on an alleged family-type relationship with the deceased tenant. Court applied the Braschi test and found tenant failed to meet her burden of proof to establish a family-type relationship. Judgment of possession granted to landlord. Key Legal Points: 1) Factors considered under the Braschi test to determine a family-type relationship; 2) Importance of providing concrete evidence to support a succession claim; 3) Being married to other people does not necessarily negate a family-type relationship, but …

Unaccompanied Children And The Need For Legal Representation In Immigration Proceedings, Sejal Singh Sep 2023

Unaccompanied Children And The Need For Legal Representation In Immigration Proceedings, Sejal Singh

St. John's Law Review

(Excerpt)

An unaccompanied child is defined as someone who enters the United States under the age of eighteen, without lawful status, and without an accompanying parent or legal guardian. Despite the term’s implication, many children do not enter the country alone but are either separated from their family members at the border or left by smugglers or other migrants near the border. The number of unaccompanied minors plunged in early 2020 due to border closures and restrictions amid the COVID-19 pandemic; however, a recent surge has led to a strain on government resources and a backlog of cases in immigration …

Theses and Dissertations

Community-based organizations (CBOs) have emerged as crucial actors in aid delivery of global efforts, including in Egypt, where they have gained recent attention. The qualitative research approach presents comprehensive case studies of interviews and focus group discussions with CBO leaders and communities, providing data on four of the Syrian and South Sudanese CBOs and their communities’ experiences and perspectives on these contributions. The Road To Prosperity. Reflections On Polish Antitrust In Turbulent Times, Jan Polański Sep 2023

The Road To Prosperity. Reflections On Polish Antitrust In Turbulent Times, Jan Polański

internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)

The “end of history”, which was once speculated, did not happen. In international politics, this resulted in much turbulence, in particular in 2022. In antitrust, in turn, there is a renewed interest in discussing its goals and assessment methods. When it comes to international politics and military reforms, Poland has taken important actions to ensure that in spite of the turbulent times, it will still take further steps on the road to prosperity, on which it had embarked in 1989. Less has been said about economic policy. Yet, it is economic policy that provides a solid base for an active …

Heirs Property: An Examination Of Probate Costs And The Costs Of Postmortem Probate Inaction, Reid Kress Weisbord

ACTEC Law Journal

“Heirs property” describes a legal limbo that occurs when multiple heirs or will beneficiaries inherit real property as tenants-in-common without promptly probating the estate to transfer marketable title out of the decedent’s name. This Article draws on recent empirical research to examine the demography of heirs property. It then takes a closer look at the adverse economic impact of postmortem probate inaction by and upon the decedent’s inheritors.
