The Preventative Care Gap: Completing The Aca’S Vision For Health, Abby Nagaich
Seattle University Law Review
This Note examines the preventive care mandate under the Affordable Care Act (ACA) and the legal, political, and practical challenges that threaten its effectiveness. While the ACA significantly expanded access to no-cost preventive services, gaps remain—particularly in behavioral health, obesity management, and equitable service delivery. Ongoing litigation, potential administrative rollbacks, and shifting political leadership further destabilize this critical component of public health policy.
This Note argues that for the ACA to fulfill its original promise—and for any health framework to succeed—preventive care must be redefined as a comprehensive, early intervention approach grounded in both systemic access and patient education. It …

Reforming Funding To Better Defend Families: Holistic Preventive Legal Advocacy That Checks Cps Agency Power, Joshua Gupta-Kagan

The federal government has provided funds to support legal representation of parents facing allegations of child neglect or abuse since 2019, across administrations of both parties. That funding illustrates the field’s recognition of parent defense’s importance to improving outcomes and reducing harms from the family regulation system, especially once CPS agencies file petitions against parents. Federal Title IV-E funding supports parent representation in those family court cases and for parents at risk of facing such cases. That funding has been an essential boon to parent representation and the benefits that flow from it. It is nonetheless time to take a …

In this nonpayment proceeding, the court grants respondent's motion for summary judgment on the rent-impairing violation (RIV) defense, holding that proof of notice to the landlord—not proof that HPD actually mailed the notice of violation—is all that is required under MDL § 302-a. This represents a departure from recent housing court decisions that have interpreted the statute to require tenants to prove HPD actually mailed the notice.

Access to justice remains a central challenge across legal systems, particularly for immigrants and refugees, Indigenous communities, and survivors of domestic violence. While legal aid organizations play a critical role in bridging this gap, their effectiveness increasingly depends on how clearly and compassionately they communicate legal information online to their target audience. This thesis conducts a comparative content analysis of nine nonprofit legal aid organizations in the United States, Canada, and Australia, three countries united by a common law tradition but divided by the communication barriers their communities face, examining 180 social media posts and nine websites through the lens …

Disaster Justice reflects the intersection of environmental justice and disaster law. The study of disaster justice is becoming increasingly essential as disasters become more frequent and devastating in the face of accelerating climate change. Disaster law is marked by statutes such as the federal Stafford Act and by theory such as the “disaster cycle” of readiness, response, and recovery. Environmental justice recognizes that the distribution of harms such as bad air or water quality may be distributed inequitably among groups such as low-income populations or racial minorities. It is well established within psychological literature how burnout develops among human service professionals including nurses, therapists, police officers, and first responders. Despite facing the same kinds of risks for burnout development by helping professions, especially trauma and stressful client relationships, the development and consequences empathy burnout have been under-researched in lawyers. This project aims to explore existing literature around burnout and empathy as related to job competency in legal professionals and develop a survey that explores empathy as a potential indirect mediating variable from burnout to employee engagement. Historically, Tijuana has been the destination for migrants who have been left out from the United States, Mexico, and the rest of the world. The city is at the epicenter of globalization where many transit, leave, and arrive. Sometimes considered a “third country” due to its binational and bicultural identity with its sister city, San Diego, California. The growing number of Haitian refugees that arrived in Tijuana in the mid 2010s to seek asylum in the United States overwhelmed the city’s infrastructure and left the Haitian community vulnerable, yet it created new opportunities and reshaped new identities in the region. …

This paper is an oral history study focused on Latine immigration experiences in Connecticut from six different individuals sharing their stories and perspectives on the immigration process. I focus on the act of testimony as a source of grassroots knowledge and attempt to spread this notion of community wisdom further through the creation of zines (small-batch, self-published, non-commercial shortform magazines) as a means of making information more accessible and reaching a larger audience on a local level.

Dissertations
Activist burnout has been identified as one of the greatest threats to social movement sustainability, and the lived experience of paid immigrant rights activists remains undertheorized. This narrative inquiry explored activist burnout among 10 San Diego County immigrant rights activists, revealing how this community understands burnout, what factors contribute to its production, and how activists sustain themselves within it. Using Clandinin and Connelly’s (2000) narrative inquiry methodology, the researcher conducted in-depth individual interviews with ten activists representing a range of intersectional identities and roles. Artrepreneurs — freelance artists and small studio owners within creative industries — frequently lack training in essential business management skills in financial management, client pipeline development, and business sustainability. These factors exacerbate already statistically high business failure rates, adding to the burdens experienced by creative entrepreneurs. Conventional wisdom and guidance for entrepreneurs is found in experience-based advice from books, blogs and business mentors. While these offer valuable insights, the lack of data-driven advice highlights an opportunity to close the knowledge gap. In an era marked by democratic backsliding, systemic inequality, and widespread disillusionment with legal institutions, traditional legal education has proven not merely inadequate, but actively complicit in reproducing the institutional norms, professional identities, and hierarchies that have enabled democratic erosion and the misuse of law as a tool of exclusion and domination.
This Article describes a comprehensive, justice-oriented framework that reimagines the structure, content, and outcomes of legal education to better meet those needs. Attorney Generals wield immense power throughout the country and are charged with protecting the interests of the public. In Texas, the Attorney General manipulates this power for political capital and ideological warfare. This Note examines the case of Annunciation House v. Paxton and the administrative powers granted to the Texas Attorney General. Specifically, this Note examines the Request to Examine statute that authorizes the Texas Attorney General to investigate any business organization at anytime for any reason. Increasingly, many people, including Christians, have become addicted to technology, spending hours scrolling.
