The Americans with Disabilities Act (ADA) was enacted with the hope that it would solve issues regarding discrimination against the disabled. However, the outcome fell short of its aspirations. Many people with disabilities still suffer from ongoing discrimination. This Note argues that the ADA’s heavy reliance on private enforcement is the main reason for this shortcoming. This Note analyzes the effectiveness of public enforcement in South Korea under the Act on the Prohibition of Discrimination Against Persons with Disabilities, Remedy Against Infringement of Their Rights (Korean Disability Discrimination Act. Many coastal forests stretching from central California to southwest Oregon are threatened or have been impacted by the invasive forest pathogen Phytophthora ramorum, the cause of sudden oak death. We analyzed a set of stand-level forest treatments aimed at preventing or mitigating disease impacts on stand composition, biomass, and fuels using a before–after-control-intervention experiment with a re-evaluation after 5 years. We compared the effects of restorative management for invaded stands and preventative treatments for uninvaded forests with two stand-level experiments. Several research studies and personal anecdotes show that home-based hospice care patients report better quality of life than their inpatient care counterparts – suggesting that the location of care/built environment is a critical component of hospice care. As a result, other research studies have attempted to provide evidence-based design recommendations for inpatient hospice facilities; however, several of these recommendations either conflict with each other or are vaguely prescribed – which may dull any attempts to implement them.

Education is a critical part of nation-building. More specifically, it can also be a powerful pathway to liberty and a tool for disseminating knowledge. However, historically it has been used to subjugate and censor vulnerable groups like women, socio-economically disadvantaged persons, as well as men of color. Therefore, to avoid subordinating members of such minoritized groups and suppressing uncomfortable historical facts, advocates must continually evaluate the purpose and method of education. Such persistent monitoring can provide a basis for constructive reform of public education in the United States. Such reform must also consider changing social conditions.

Long-term suspensions and expulsions can be enormously consequential for students and their families. Not only do exclusionary disciplinary measures directly result in lost learning opportunities for children, but school discipline decisions can also result in significant collateral consequences. These consequences range from lower rates of graduation and higher rates of contact with the criminal justice system to disruptions in foster care placements, violations of juvenile probation, and even possible immigration consequences for undocumented students.

This Note will focus on the Supreme Court’s decisions in the Insular Cases to demonstrate the origins of denying jus soli citizenship to those born in unincorporated territories and to analyze its direct contradiction to the Fourteenth Amendment and other Supreme Court decisions. It will argue that the Court’s decisions in the Insular Cases were influenced by colonial rule and rooted in racism. Part I traces the history of qualified immunity and the doctrine’s analytical changes over time, detailing the twofold test as it currently stands. Part II considers Large and Sweetin, comparing the courts’ approaches to essentially similar scenarios and evaluating the differences in outcome. Part III addresses the Supreme Court’s denial of the Large plaintiffs’ petition for certiorari and explicates the “scope of authority” question the Court declined to address. Yet, there is a serious deficiency of legal discourse on the rights and liberties of friends in America’s courts. In the absence of such discourse—perhaps partially because of it—friendship as a social institution experiences a lack of legal protection in the United States. The State of Alaska Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) offers nutrition education for low-income women and children, addressing the nutrition knowledge gap among low-income parents to improve health outcomes. However, the State of Alaska WIC program does not currently use smartphone apps for participant education even though the population served by WIC generally relies on smartphones for trusted information. Background: Healthy eating and active living policy, systems, and environmental (PSE) changes are implemented across the United States through Cooperative Extension. However, translating multisector PSE changes to practice in community settings is challenging and there is a lack of knowledge about barriers and facilitators to PSE changes among state Extension systems using standardized frameworks. Emerging research suggests that body dissatisfaction (BD) is prevalent among midlife and older women (i.e., upwards of 70%). Cross-sectionally, BD is associated with myriad poor health and wellness outcomes (e.g., depression, disordered eating, bad nutrition) in midlife/older women. However, relatively few studies have examined the longitudinal relations between BD and health outcomes in this population. This preliminary study investigated the longitudinal associations of BD with wellbeing and health-related quality of life (QOL) among midlife/older adult women over one year. Background: Alterations in DNA methylation (DNAm) have been reported to be a mechanism by which bariatric surgeries resulted in considerable metabolic improvements. Previous studies have mostly focused on change in DNAm following weight-loss interventions, yet whether DNAm prior to intervention can explain the variability in glycemic outcomes has not been investigated. Here, we aim to examine whether baseline DNAm is differentially associated with glycemic outcomes induced by different types of weight-loss interventions. Health care accessibility studies are well established in the US but lacking in Austria, even though both experience high costs and have hospital care as the largest contributor to health care spending. This study aims to examine multiscale spatial accessibility to acute hospitals in Carinthia, Austria. Using the most recent data at census block and 250 meter grid levels, we refine proximity and generalized two-step floating catchment area (G2SFCA) methods while accounting for the modifiable areal unit problem (MAUP) and edge effects. BACKGROUND: Currently, most pitching instructors suggest a shorter arm path-the total distance the arm travels during pitching. Theoretically, this combination allows for better body segment sequencing, a more efficient energy transfer through the kinetic chain, and increased ball velocity, while limiting elbow varus torque.
HYPOTHESIS: Shorter arm paths would be associated with increased ball velocity and decreased elbow varus torque.
STUDY DESIGN: Descriptive laboratory study.

One may view happiness as a simple wish, but then arises the question: what exactly does one wish for in wishing for happiness? Poverty is widely considered the root cause of child labor in the Philippines. Thus, the Pantawid Pamilyang Pilipino Program (4Ps) was designed to alleviate poverty and reduce child labor through financial assistance, conditional on welfare investments like children’s education. Using 2017, 2019, and 2020 data from the Annual Poverty Indicators Survey (APIS), the study estimated the differential impact of 4Ps on child labor before and during COVID-19 across varying demographic, socio-economic, and locational characteristics. Human mesenchymal stem cells (hMSCs) have gained popularity in clinical trials due to their multipotent differentiation characteristics, ability to secrete bioactive molecules, migrate into diseased or damaged tissues, and their immunosuppressive properties. HMSC cultures are heterogeneous, containing stem cells, partially differentiated progenitor cells, and fully differentiated cells. One of the major challenges with hMSCs therapeutic potential is the inability to select specific cell subpopulations due to an insufficient number of biomarkers. Existing research has demonstrated that bilingual education in the United States is highly inequitable, providing greater benefits to white English speakers than to students from minoritized backgrounds (e.g., Babino & Stewart, 2017; Palmer, 2009). Additional research has suggested that bilingual spaces also uphold whiteness and English hegemony outside of classrooms, in spaces like parent groups to administrative decisions (e.g., Gallo, 2017; Jacobsen et al., 2019). Adopting subscription models has become a popular trend in e-commerce. Digital content platforms often use free trials to attract potential subscribers. However, rigorous research on platforms’ free trial strategies is lacking. Our paper aims to fill this gap using a horizontal duopoly framework. We investigate both the scenario of market symmetry and of market asymmetry. We study the benchmark case with no free trial for each scenario and derive equilibrium results with free trial promotion. The objectives of this study were to: (1) quantify levels of genetic intermixing in remnant Illinois eastern woodrat populations augmented with Ozark woodrats, and (2) assess genetic health and population viability in remnant and reintroduced woodrat populations. This dissertation is arranged into 3 chapters. DNA extractions, microsatellite genotyping, and mtDNA haplotype sequencing were conducted for individuals from the western Shawnee National Forest (WSNF) (i.e., LaRue Pine Hills [LPH], Fountain Bluff, Horseshoe Bluff), eastern Arkansas (AR), southern Missouri (MO), and 5 locations in the eastern Shawnee National Forest (ESNF), Illinois. Background: There are no known published reports on outcomes for medically and psychiatrically compromised patients with binge eating disorder (BED) treated remotely in higher level of care settings. This case report presents outcomes of an intentionally remote weight-inclusive partial hospitalization and intensive outpatient program based on Health at Every Size® and intuitive eating principles. Case presentation: The patient presented with an extensive trauma background and long history of disturbed eating and body image. She was diagnosed with BED along with several comorbidities, most notably major depressive disorder with suicidality and non-insulin dependent diabetes mellitus. She completed a total of 186 …

Micropollutants in water sources are found in higher concentrations in areas with high levels of urban and agricultural land. These pollutants can be introduced into water sources during storms and rain events, through water treatment outputs, and commercial or residential waste. The development and evaluation of graphene oxide (GO) coatings as a replacement for the aluminum foil layer in retort grade pouches is an important area of interest as we look to send humans to Mars. The packaging needs to not only restrict the permeation of oxygen and water vapor molecules, but also needs to be capable of thermally degrading. Compared to aluminum foil, which is responsible for the hermetic barrier properties of retort grade pouches, a GO coating is a more flexible barrier material and allows for ash-free incineration.
