Role-Reversibility, Ai, And Equitable Justice — Or: Why Mercy Cannot Be Automated, Stephen E. Henderson, Kiel Brennan-Marquez Jan 2023

Role-Reversibility, Ai, And Equitable Justice — Or: Why Mercy Cannot Be Automated, Stephen E. Henderson, Kiel Brennan-Marquez

Faculty Articles

A few years ago, we developed the concept of “role-reversibility” in AI governance: the idea that it matters whether a party exercising judgment is reciprocally vulnerable to the effects of judgment. This idea, we argued, supplies a deontic reason to maintain certain spheres of human judgment even if (or when) truly intelligent machines become demonstrably superior in every utilitarian sense. While computer science remains far from that holy grail, generative AI is raging through systems as diverse as healthcare, finance, advertising, law, and academe, making it imperative to further shore up our claim. We do so by situating role-reversibility within …

The Pro Se Gender Gap, Roger Michalski Jan 2023

The Pro Se Gender Gap, Roger Michalski

Faculty Articles

This article is the first to identify, name, and empirically measure the pro se gender gap. Drawing on a massive dataset of all federal civil dockets spanning 10 years, it finds a 2-to-1 gender imbalance. For every federal female pro se litigant there are two males. This finding is robust and stable. It holds true for plaintiffs, defendants, and other parties. It is also true across most subject areas, across time, across length of litigation, and across states, districts, and circuits. The study excludes prisoner-rights and habeas petitions (including them would widen the gender gap even further). This gender gap …

Department of Hospitality and Business Management

Purpose – This paper examines the post-COVID-19 travel intentions to Kenya among Hong Kong outbound travelers using the theory of planned behavior (TPB) over three different time horizons of 1, 5, and 10 years. Design/methodology/approach – An extension was made by including two new constructs of perceived destination image and travel constraints. A cross-sectional sample of Hongkongers was surveyed. Data were collected using a self-administrated bilingual (English and Chinese) online survey. Exploratory factor analysis, linear regression and mediation analysis were conducted to test the research model. Findings – The findings from 216 Hongkongers reveal that different combinations of the four …

Introduction: The COVID-19 pandemic, caused by the SARS-CoV-2 coronavirus, has forced all countries affected by it to introduce quarantine and isolation to prevent the spread of the virus, as well as masking and distancing. Not everyone is equally willing to follow the rules related to limit the extent of the coronavirus epidemic. This might be connected with personality traits, especially openness, positive attitude, and optimism. Materials and Methods: An online survey was created and completed by participants in April–May 2020. Self-assessment of personality traits and adherence to lockdown recommendations were assessed. A total of 7404 participants took part in the …

Cloud Seeding, Wildfire Smoke Emissions, And Solar Geoengineering: Why Is Climate Modification Unregulated?, Karen Bradshaw, Monika U. Ehrman Jan 2023

Cloud Seeding, Wildfire Smoke Emissions, And Solar Geoengineering: Why Is Climate Modification Unregulated?, Karen Bradshaw, Monika U. Ehrman

Faculty Journal Articles and Book Chapters

This Article is the first to identify that companies and agencies systemically modify climatic airspaces through wildfire smoke emissions, weather modification (cloud seeding to cause rain), and solar geoengineering. Climate modification is not a conspiracy theory or a hypothetical: it is happening, and it is changing weather patterns. Yet, climate modification is almost wholly unregulated. Further, it is also not recorded or tracked in systemic ways. That is to say, even government agencies do not have comprehensive records of whether; how often; or how much climate modification is occurring. The data is simply not gathered, aggregated, or stored. As a …

Variation In Antibiotic Resistance Patterns For Children And Adults Treated At 166 Non-Affiliated Us Facilities Using Ehr Data., Shivani Sivasankar, Jennifer Goldman, Mark A. Hoffman

Manuscripts, Articles, Book Chapters and Other Papers

Background: Antibiotic resistance (AR) is a global public health threat. Surveillance of baseline AR and trends and emerging resistance among priority bacterial isolates with respect to the age of the patients and the type of healthcare setting are required due to differences in antimicrobial need and use in these populations.

Methods: We performed a retrospective study using deidentified electronic health record (EHR) data in the Cerner Health Facts™ data warehouse. Antibiotic susceptibility data were extracted for all bacterial isolates of interest at 166 non-affiliated healthcare facilities reporting microbiology susceptibility results of the FDA recommended antibiotics between the years 2012 to …

Distributed Spatial Data Sharing: A New Era In Sharing Spatial Data, Majid Hojati Jan 2023

Distributed Spatial Data Sharing: A New Era In Sharing Spatial Data, Majid Hojati

Theses and Dissertations (Comprehensive)

The advancements in information and communications technology, including the widespread adoption of GPS-based sensors, improvements in computational data processing, and satellite imagery, have resulted in new data sources, stakeholders, and methods of producing, using, and sharing spatial data. Daily, vast amounts of data are produced by individuals interacting with digital content and through automated and semi-automated sensors deployed across the environment. A growing portion of this information contains geographic information directly or indirectly embedded within it. The widespread use of automated smart sensors and an increased variety of georeferenced media resulted in new individual data collectors. This raises a new …

Computational Decision Support For Socio-Technical Awareness Of Land-Use Planning Under Complexity—A Dam Resilience Planning Case Study, Andreas Tolk, Jennifer A. Richkus, F. Leron Shults, Wesley J. Wildman Jan 2023

Computational Decision Support For Socio-Technical Awareness Of Land-Use Planning Under Complexity—A Dam Resilience Planning Case Study, Andreas Tolk, Jennifer A. Richkus, F. Leron Shults, Wesley J. Wildman

VMASC Publications

Land-use planning for modern societies requires technical competence as well as social competence. We therefore propose an integrative solution enabling better land-use planning and management through better-informed decision-making. We adapt a method developed for cross-disciplinary team building to identify the stakeholders and their various objectives and value systems. We use these results to populate artificial societies embedded into a dynamic data analytics framework as a tool to identify, explore, and visualize the challenges resulting from the different objectives and value systems in land-use planning and management. To prove the feasibility of the proposed solution, we present two use cases from …

The Shortfalls Of Vulnerability Indexes For Public Health Decision-Making In The Face Of Emergent Crises: The Case Of Covid-19 Vaccine Uptake In Virginia, Lydia Cleveland Sa, Erika Frydenlund Jan 2023

The Shortfalls Of Vulnerability Indexes For Public Health Decision-Making In The Face Of Emergent Crises: The Case Of Covid-19 Vaccine Uptake In Virginia, Lydia Cleveland Sa, Erika Frydenlund

VMASC Publications

Equitable and effective vaccine uptake is a key issue in addressing COVID-19. To achieve this, we must comprehensively characterize the context-specific socio-behavioral and structural determinants of vaccine uptake. However, to quickly focus public health interventions, state agencies and planners often rely on already existing indexes of "vulnerability." Many such "vulnerability indexes" exist and become benchmarks for targeting interventions in wide ranging scenarios, but they vary considerably in the factors and themes that they cover. Some are even uncritical of the use of the word "vulnerable," which should take on different meanings in different contexts. The objective of this study is …

Third Sector Organizations In Iceland: Size, Scope, And Scale, Jeannie Entenza Jan 2023

Third Sector Organizations In Iceland: Size, Scope, And Scale, Jeannie Entenza

School of Business Student Theses and Dissertations

This study seeks to contribute missing data to existing studies on the comparative nature of global third sector economies. Iceland, a modern, high-income, high-service society on the cusp of the Arctic Circle has not been included in these studies while the other four Nordic countries have all been analyzed. This study aims to map over 12,000 registered third sector organizations in Iceland to demonstrate the type and level of public-facing organized activity in the country. The quantitative research design relied heavily on the concept and inspiration of the Johns Hopkins Comparative Nonprofit Sector Project and proved that Iceland was indeed …

Theorizing Cultural (Mis)Recognition In Rural School Staffing: Implementing A Social Justice Frame To Understand Challenges To Attract Rural Teachers, Hernan Cuervo Jan 2023

Theorizing Cultural (Mis)Recognition In Rural School Staffing: Implementing A Social Justice Frame To Understand Challenges To Attract Rural Teachers, Hernan Cuervo

The Rural Educator

Attracting teachers to rural schools continues to be a problem in Australian education. Debates on how to remedy staff shortages are based on a better distribution of financial and material resources. This emphasis on distribution has sidelined the role of recognition theory in understanding the challenges of rural staffing. I draw on the social justice frameworks of Nancy Fraser and Axel Honneth to argue that rural staffing challenges are anchored not just on matters of distribution but on issues that lead to the cultural misrecognition and disrespect of teaching and learning in rural places. Using data from a qualitative research …

Data Fusion Strategies For Multi-Modal Classification Of Auto-Immune Dysregulation With Vibrational Spectroscopy, Joseph K. Fitzgerald Jan 2023

Data Fusion Strategies For Multi-Modal Classification Of Auto-Immune Dysregulation With Vibrational Spectroscopy, Joseph K. Fitzgerald

Reports

This article assesses how the ‘Public Interest’ was used to (de)legitimize the acquisition of a national airline. It does this by adopting a case study approach that analyses the acquisition of Aer Lingus by International Consolidated Airlines Group (IAG). This acquisition is part of a broader trend of international consolidation that the aviation industry has experienced in recent years. The article also critiques whether the ‘Public Interest’ was constructed on valid grounds. Its analysis found that the public interest was constructed as the continuance of routes between Irish airports and London Heathrow as a means for Ireland to maintain international …

Singling Out Single-Family Zoning, John Infranca Jan 2023

Singling Out Single-Family Zoning, John Infranca

Suffolk University Law School Faculty Works

Single-family zoning is increasingly under attack in both the popular press and scholarly journals. Critics highlight how zoning districts that allow only detached, single-family homes exacerbate racial and economic segregation and perpetuate wealth disparities. Although a few local and state legislatures have eased regulations to permit denser development in existing single-family neighborhoods, such neighborhoods remain the dominant component of American zoning. The power of local governments to impose zoning derives from the police power—traditionally understood as the power to legislate in furtherance of health, safety, and the public welfare. These traditional concerns seem to provide little justification for prohibiting duplexes …

Annual Credit Checks For Adolescent Youth In Foster Care: Factors Associated With Identity Fraud Victimization, John Gyourko, Johanna K. P. Greeson Jan 2023

Annual Credit Checks For Adolescent Youth In Foster Care: Factors Associated With Identity Fraud Victimization, John Gyourko, Johanna K. P. Greeson

Department of Social Work - Faculty Scholarship

Child identity fraud, or the criminal exploitation of a child’s personal data, poses serious risks and challenges for youth in foster care. Despite the 10-year history of a federal mandate requiring state child welfare agencies to conduct annual credit checks for adolescent foster youth (42 U.S.C. § 675), identity fraud has received scant attention in child welfare research. Analyzing a state-level administrative dataset with linked child welfare and consumer credit records, we employed logistic regression to assess demographic and foster care placement factors associated with identity fraud victimization among a statewide population cohort of 1,176 youth (age 14 to …

Perceptions Of Paraprofessionals On The Grow Your Own Teacher Program In Three Rural School Districts In Eastern North Carolina, Tony Faison Jan 2023

Perceptions Of Paraprofessionals On The Grow Your Own Teacher Program In Three Rural School Districts In Eastern North Carolina, Tony Faison

Doctor of Education Dissertations

The Grow Your Own Teacher (GYOT) program addresses the shortage of qualified teachers by recruiting and training community residents to become qualified teachers. These programs look and feel like community-building strategies instead of teacher pipeline strategies. The GYOT initiative is not new, but the mainstream absorption of the GYOT initiative presents an exciting opportunity to link education policy and neighborhood revitalization more closely. The purpose of this qualitative study was to explore the perceptions of paraprofessionals on the GYOT program in three rural school districts in eastern North Carolina. The conceptual framework was based on Yosso's (2005) Cultural Wealth Model, …

School Curriculum: The Sigmatic Harm To Students And The Responsibility Of Congress To Act Again Jan 2023

School Curriculum: The Sigmatic Harm To Students And The Responsibility Of Congress To Act Again

Florida A & M University Law Review

When Brown was decided, the Supreme Court felt that it could not trust the States to encourage and facilitate equality on its own, which was proven true in the subsequent, decades-long resistance against integration following the Brown II mandate. Once again, the States cannot be trusted to move towards equality and away from backward community norms and bias without federal intervention. This is currently being exemplified by states like Florida—explicitly banning public schools from teaching Critical Race Theory. The Supreme Court does not seem willing to extend Brown any further, but the federal government may encourage and facilitate curriculum equality …

Electric Vehicle Charging Utilization In Disadvantaged And Non-Disadvantaged Communities, Camila Colandré Jan 2023

Electric Vehicle Charging Utilization In Disadvantaged And Non-Disadvantaged Communities, Camila Colandré

Open Access Master's Theses

The increasing affordability of electric vehicles (EVs) and the introduction of zero emission regulations have increased EV purchases. Consequently, the EV infrastructure must be developed to meet this rapidly rising demand. This need is particularly crucial in disadvantaged communities (DACs), as projections indicate that by 2030, over one-quarter of new EV owners will come from these communities. However, studies have revealed an unequal distribution of charging stations between DACs and non-disadvantaged communities (non-DACs), with a higher concentration in non-DACs. While governments have made efforts to expand charging stations through funding programs, a universal approach may not effectively address this issue …

Analysis Of Vote-By-Mail Processing And Tabulation: A Time Study From Salt Lake City, Leonie Samira Otte

Open Access Master's Theses

The number of vote-by-mail (VBM) ballots cast in the 2020 presidential election reached record highs. Reasons for the sudden increase in voters using VBM ballots range from accessibility to social distancing restrictions and other COVID-19 pandemic health and safety concerns. In conjunction with other circumstances encircling the presidential election, the reporting of VBM results was delayed. This led to mistrust and contributed to mis-, dis-, and mal-information surrounding the election results. Ultimately, it was difficult for election officials to predict how long it would take to verify and tabulate VBM ballots, especially due to the rapid adoption and expansion of …

Regulating History, Sara C. Bronin, Leslie R. Irwin Jan 2023

Regulating History, Sara C. Bronin, Leslie R. Irwin

Minnesota Law Review Vols. 106:2 onward (2021-present)

America’s local historic commissions collectively wield tremendous influence over millions of privately-owned parcels of land. By reviewing rehab proposals, blocking demolitions, and mandating property maintenance, these commissions have helped to protect many of America’s most beloved neighborhoods. They fill a vacuum left by federal and state governments, which have declined to offer robust legal protections to private historic sites.

Litigation challenging local historic decisions and press vilifying commissions for their alleged elitism, anti-environmental decisions, and general obstruction of progress have put preservation in the contemporary crosshairs. While we align with those who believe that clear-thinking commissions can successfully mediate between …
