This Article identifies, explores, and attempts to resolve nine conflicts that have arisen in the federal courts regarding the proper interpretation and scope of the Federal Rules of Evidence. For each conflict, we set forth the language of the current rule, its policy goals, and the differing positions taken by the courts. We then analyze the merits of the debate and propose new rule language to resolve the matter.

In this Article, we consider whether theft-based convictions are automatically admissible under Rule 609(a)(2), and how to calculate the passage of ten years for old convictions under Rule 609(b). We chart …

There is an ongoing body of scholarship in contemporary constitutional theory and legal history that can be labeled “fiduciary constitutionalism.” Some have wanted to strangle this work in its cradle, offering an argument pitched “against fiduciary constitutionalism,” full stop. But because there are enough different modalities of fiduciary constitutionalism – and particularly originalist varieties of it at the center of recent critiques – it is worth getting clearer about some methodological commitments of this work to help evaluate its promise and potential pitfalls. Understanding Perceptions Of New-Onset Type 1 Diabetes Education In A Pediatric Tertiary Care Center, Gabriel Betancurvelez

Background: Youth newly diagnosed with type 1 diabetes (T1D), and their families, require intensive education on the management of this chronic condition during this overwhelming period. Traditionally, our center conducts training in person during a hospital admission.

Methods: We studied family perceptions of our current patient education methods in an effort to elucidate strategies to augment education in the post-pandemic environment, where provider time in the room and visitation rules may limit face-to-face encounters.

Results: 25 families completed the survey (distributed to 156 in total, with approximately 21% response rate). The mean age at diagnosis was 9.52 ± 4.29 years …

Social needs screenings within healthcare systems have grown more common with increasing discourse around the contribution of systemic determinants to health outcomes. These screenings have been used to describe the prevalence of social needs within communities but have not been evaluated for the impact that they and the interventions to which they are attached may have on health outcomes. Here we evaluate social needs screenings and their potential impact on patient health at a federally qualified health center in New Haven, Connecticut. There is an emerging world order characterized by unilateral pledges within a legal or “legal-ish” architecture of commitments. The pledging world order has materialized in the international legal response to climate change and in other diverse sites. It crosses and blurs the public-private divide. It erodes distinctions between multilateralism and localism, law and not-law, and progress and stasis. It is both a symptom of and a contributor to the dismantling of the Westphalian and postwar orders. BackgroundFrontal variant Alzheimer's disease (fvAD) is considered a rare form of Alzheimer's disease (AD) which may be misdiagnosed as behavioural variant frontotemporal dementia (bvFTD). The literature has tended to conflate behavioural and executive dysfunction in fvAD cohorts and uses both AD diagnostic criteria and bvFTD diagnostic criteria to classify fvAD cohorts. The primary aim of this narrative synthesis was to summarise neuropsychological findings in fvAD cohorts in the context of established AD pathology.MethodsEMBASE, PsycINFO, PROQUEST and MEDLINE databases were searched for studies eligible for inclusion. Dispersal and connectivity within a population often promotes overall diversity and adaptive potential, therefore a disruption of existing patterns of connectivity by local extinction can have significant consequences for the affected species. However, the extent of these impacts on recovery is not always known. American flamingos (Phoenicopterus ruber) present an ideal opportunity to investigate how changes in gene flow influence within population diversity and genetic structure over the span of a century for a recovering population. Early embryonic loss is a significant factor in livestock species' infertility, resulting in an economic deficit. In cattle, the in vivo fertilization rate is ~90%, with an average calving rate of about 55%, indicating an embryonic-fetal mortality rate of roughly 35%. Further, 70-80% of total embryonic loss in cattle occurs during the first three weeks after insemination, particularly between days 7-16. Growing evidence indicates that the oocyte plays an active role in regulating critical aspects of the reproductive process required for successful fertilization, embryo development, and pregnancy. Academic work is increasingly important to court rulings on the Second Amendment and firearms law more generally. This article highlights two recent trends in social science research that supplement the traditional focus on guns and physical harm. The first strand of research focuses on the changing ways that gun owners connect with firearms, with personal security, status, identity, and cultural markers being key reasons people offer for possessing firearms. In the extreme environment of space, radiation induced health issues is a major concern. The ability to induce higher levels of free radicals and reactive oxidative species (ROS) are factors to be addressed. Ceria nanoparticles (CNPs) can provide a means to scavenge ROS through regenerative redox coupling that occurs on the surface and acts as a radioprotectant. Additionally, the defect levels in CNP can be categorized by the Ce3+/Ce4+ ratio with a high ratio indicating superoxide scavenging, a radical species with high oxidative potential. Magic Show is an animated short film created in the Unity game engine that follows a mischievous fairy named Faye, who attempts to deceive her human audience, the viewer, into believing she can do magic. My goal in the program was to create a themed entertainment experience. I created a point-of-view animated film as an alternative to traditional theme park 3D/4D attractions that typically take place in a theatrical setting with large audiences. Tin Hammock features the first four chapters of a novel. The keystone setting is a trailer park called Oak Hammock, located on a developed pine forest reaching into the swamplands off U.S. 41. The subsidiary settings are predominantly written in Florida with occasional shifts elsewhere. The literary project was written with nods to the Faulknerian Southern Gothic, borrowing from traditions of science fiction and horror, with an emphasis on expanding the forms of past hegemonic narratives. This thesis reflects my research and studio practice into how memory is gathered, interpreted, and affects the present. I discuss my historical and contemporary artistic influences, my history, and my visual narratives. I construct layered drawings using charcoal and soft pastel to interpret how we understand our inherently flawed memory. Memory can be clear and easy to understand but simultaneously distorted and convoluted. When recalling a memory, I purposely keep my initial drawn gestures visible to show the pentimenti or shift in marks. Shift-work conditions are a necessity for the constant provision of certain medical, industrial, and commercial services in modern society. Shift work is associated with the increased risk of many negative health outcomes, including type 2 diabetes, heart disease, reproductive issues, and cancer. Shift workers experience multiple levels of circadian-rhythm disruption, which may increase maladaptive decision making, and this may mediate the relation between shift work and negative health outcomes. Introduction: Pseudomonas is a group of ubiquitous non-fermenting Gram-negative bacteria (NFGNB). Of the several species associated with humans, Pseudomonas aeruginosa (PA) can acclimate to diverse environments. The global frequency of PA infections is rising and is complicated by this organism's high intrinsic and acquired resistance to several clinically relevant antibiotics. Data on the epidemiology, levels, and trends of antimicrobial resistance of PA in clinical settings in the MENA/GCC region is scarce. Introduction: Enterococci are usually low pathogenic, but can cause invasive disease under certain circumstances, including urinary tract infections, bacteremia, endocarditis, and meningitis, and are associated with peritonitis and intra-abdominal abscesses. Increasing resistance of enterococci to glycopeptides and fluoroquinolones, and high-level resistance to aminoglycosides is a concern. National antimicrobial resistance (AMR) surveillance data for enterococci from the Middle East and North Africa (MENA) and the Gulf region is scarce. The mechanisms of toxicity of engineered nanomaterials (ENMs) to the early life stages of freshwater fish, and the relative hazard compared to dissolved metals, is only partially understood. In the present study, zebrafish (Danio rerio) embryos were exposed to lethal concentrations of silver nitrate (AgNO3) or silver (Ag) ENMs (primary size 42.5 ± 10.2 nm). The 96 h-LC50 for AgNO3 was 32.8 ± 0.72 μg Ag L-1 (mean ± 95% CI) compared to 6.5 ± 0.4 mg L-1 of the whole material for Ag ENMs; with the ENMs being orders of magnitude less toxic than the metal salt. Wastewater-recovered phosphorus (P), in the form of the mineral struvite (MgNH4PO4∙6H2O), may provide a sustainable alternative to decreasing rock-phosphate reserves. Struvite can be generated via precipitation methods, potentially reducing the amount of P runoff to aquatic ecosystems. The objective of this greenhouse tub study was to evaluate the effects of chemically and electrochemically precipitated struvite (CPST and ECST, respectively) on aboveground plant response in a hybrid rice cultivar grown using furrow-irrigation compared to other common fertilizer-P sources [i.e., triple super phosphate (TSP) and diammonium phosphate (DAP)] using three replications of fertilizer treatment in a P-deficient silt loam (Typic Glossaqualfs). Background: Growing evidence supports the role of gut microbiota in obesity, yet exact associations remain largely unknown. Specifically, very little is known about this association in the Emirati population. Methods: We explored differences in gut microbiota composition, particularly the Firmicutes/Bacteroidetes (F/B) ratio, between 43 obese and 31 lean adult Emirate counterparts, and its association with obesity markers, by using V3-V4 regions of 16 S ribosomal RNA gene sequencing data. Furthermore, we collected anthropometric and biochemical data. Results: The two major phyla in obese and lean groups were Firmicutes and Bacteroidetes. This study sought to examine the role humor plays in defusing conflict between friends from an evolutionary perspective. Although a vast amount of research exists on humor, friendship, and conflict, no single study connects all three of these concepts together. This study attempted to fill this gap by examining how different humor styles used between friends in times of conflict relate to friendship satisfaction and life satisfaction. Specifically, the hypotheses predicted that friends who use affiliative humor to deescalate conflict are more inclined to report higher relational satisfaction and improved individual well-being than friends who use maladaptive humor to deescalate …

Within the largest population of African savanna elephants (Loxodonta africana) on the continent, Botswana’s Chobe Enclave is a group of agricultural communities bounded by protected areas and an international border. Human-elephant conflict (HEC) is a major concern for both Enclave residents and conservation practitioners. This research asked how institutional arrangements shape the governance of HEC in the Chobe Enclave.
