Perlindungan Hukum Terhadap Pejuang Lingkungan Hidup Dalam Mewujudkan Lingkungan Hidup Yang Baik Dan Sehat, Dinarjati Eka Puspitasari

Jurnal Hukum & Pembangunan

The right of environmental defenders not to be sued civilly or prosecuted criminally is part of human rights regulated in Article 66 of Law 32/2009 (UUPPLH), known as Anti Strategic Lawsuit Against Public Participation (Anti-SLAPP). But in practice, the law is used as a tool to curb public participation. In this case, environmental organizations have an important role to play in assisting communities in fighting for their environmental rights, ranging from non-judicial mechanisms to becoming amicus curiae in court. This research examines literature sources with a library research method through a statutory approach, case approach, and conceptual approach. The result …

Don't Tread On My Ip Rights: A Law And Economics Analysis Of "March-In Rights" Under The Bayh-Dole Act, Caitlin Grow

Cleveland State Law Review

The Bayh-Dole Act has been imperative to the development of the United States’ dynamic pharma-biotech sector. However, the use of march-in rights under the Bayh- Dole Act has remained controversial. On the one hand, there is the idea of market equilibrium with a need to secure health care for the public. Many believe march-in rights should be used to create this balance by regulating the pricing of drugs that were developed using federally funded research. On the other hand, some advocates recognize that the current relationship between public-sector institutions and business as the developers of basic research, and private-sector biotechnology …

Defining Genetic Information Under Gina, Shane Padilla Dec 2022

Defining Genetic Information Under Gina, Shane Padilla

Cleveland State Law Review

The Genetic Information Nondiscrimination Act (GINA) was enacted to prevent discrimination based on an employee’s genetic information. Although GINA undoubtedly provides employees protection from unjust genetic discrimination by employers, varying interpretations of what constitutes “genetic information” has raised legal uncertainties in how GINA is applied. Consequently, the genetic information of an employee’s family may be unduly placed at risk as a result of misinterpreting the statutory language and legislative intent of GINA. It is of the utmost importance that the definition of “genetic information” be construed with respect to the Act’s legislative history, which supports a broad interpretation and application …

Before the merger, Ticketmaster Entertainment was the leading live music ticketing and marketing company. Live Nation was the leading producer of live music events. Live Nation also entered the primary ticket sales market and led merchandising at its entertainment venues. Antitrust concerns arose that this newly formed entity would be a near-monopoly in live music. Despite general antitrust concerns and lawsuits from consumers, smaller promoters, seventeen state attorneys general, and the Department of Justice (“DOJ"), Live Nation Entertainment agreed to a consent decree …

These insights inform decarbonization, energy conservation, …

Living By Religion, Playing By Law: Early Glimpses Of The Ban On Triple Talaq, Kalindi Kokal Dec 2022

Living By Religion, Playing By Law: Early Glimpses Of The Ban On Triple Talaq, Kalindi Kokal

Socio-Legal Review

The Supreme Court of India declared triple talaq, a type of Islamic divorce, as unconstitutional in 2017. Following that, in 2019, the Parliament enacted the Muslim Women (Protection of Rights on Marriage) Act, 2019, which criminalised the pronouncement of triple talaq. Triple talaq as a form of divorce continues to hold legitimacy under the uncodified religious law that Muslims in India abide by in their everyday life. What, then, is the impact of the criminalisation of this practice at the level of the community? What does intervention by the criminal justice system mean for justice in inter-personal disputes that are …

The Majesty And Dignity Of Courts: Changes In Court Dynamics With The Onset Of The Covid-19 Pandemic In India, Rahela Khorakiwala

Socio-Legal Review

The procedures and practices of courts were brought to a sudden halt with the onset of the Covid-19 pandemic. This led to the promulgation of virtual courts where previously known traditions of the courts changed in many ways. The dress code was watered down and the understanding of the majesty and dignity of courts had to be re-established. This paper documents the seismic changes that occurred in virtual courts and how the courts had to keep redefining what contempt meant in the context of virtual courts. It is argued that majesty and theatrics affect the dispensation of justice, so when …

‘Private Acts’ And Structural Inequality: Law And Housing Discrimination, Rowena Robinson Dec 2022

‘Private Acts’ And Structural Inequality: Law And Housing Discrimination, Rowena Robinson

Socio-Legal Review

This paper focuses on law and housing discrimination within the context of a sociological understanding of the cumulative disadvantageous effects of what are legally considered ‘private acts’. It therefore brings a distinct perspective to the examination of vertical versus horizontal rights. The paper particularly focuses on housing discrimination against Muslims in urban areas against the background of marginalisation, conflict, and violence. It seeks to think about housing segregation as both producing discrimination, targeted violence, economic inequality, and social exclusion as well as itself being a product of these factors. Public policy in the form of equal opportunities legislation has been …

Women, Gender Politics, And Resistance In Kashmir, Seema Kazi Dec 2022

Women, Gender Politics, And Resistance In Kashmir, Seema Kazi

Socio-Legal Review

This article focuses on Kashmiri women and the gender politics underpinning the August 5, 2019 revocation of Article 370 in Kashmir. Reclaiming Kashmiri women’s property rights was among the justifications cited by the state for revoking Kashmir’s autonomy. Paradoxically, however, most analyses centered on its political implications. Kashmiri women’s opinions regarding the revocation, the state’s use of the women’s rights argument to justify the same, or Kashmiri women’s rights and experiences in the wake of the revocation were seldom the subjects of discussion or analysis. Beginning with a brief overview of Kashmiri women’s role in the Kashmiri struggle, I juxtapose …

Agenda Control In The Indian Parliament And The Impact On Its Oversight Function – Analysis And Evidence, Maansi Verma Dec 2022

Agenda Control In The Indian Parliament And The Impact On Its Oversight Function – Analysis And Evidence, Maansi Verma

Socio-Legal Review

Separation of powers is understood as the diffusion of powers among different branches of the government, with each branch acting as a check on the other. This principle is considered an anti-thesis to totalitarianism, preventing the absolute concentration of power and thus protecting liberty. The Cabinet-style parliamentary form of government, with its genesis in Britain, fused together the executive with the legislature. This resulted in powerful executives and weakened legislatures with limited oversight capabilities. As institutions evolved over time, internal rules and procedures also evolved both as constraints and enablers of executive dominance, by distributing the powers of agenda control. …

Applying Data Science And Machine Learning To Understand Health Care Transition For Adolescents And Emerging Adults With Special Health Care Needs, Lisamarie Turk

Nursing ETDs

A problem of classification places adolescents and emerging adults with special health care needs among the most at risk for poor or life-threatening health outcomes. This preliminary proof-of-concept study was conducted to determine if phenotypes of health care transition (HCT) for this vulnerable population could be established. Such phenotypes could support development of future studies that require data classifications as input. Mining of electronic health record data and cluster analysis were implemented to identify phenotypes. Subsequently, a machine learning concept model was developed for predicting acute care and medical condition severity. Three clusters were identified and described (Cluster 1, n …

An Update Of The Geographical Distribution Of Hylodes Pipilans (Canedo & Pombal, 2007), An Endemic Torrent Frog Of The Brazilian Atlantic Forest, With Comments On Its Conservation, Luiz Fernando Carmo, Manuella Folly, Leo Ramos Malagoli

Neotropical Biodiversity

The Brazilian Atlantic Forest (BAF) is hotspot for conservation priorities due to the high concentration and maintenance of biodiversity, comprising more than 600 species of amphibians, of which 88% are endemic to this biome. Many of these species are under some level of threat, especially those with restricted distributions to mountainous regions. Hylodes is the most speciose genus within Hylodidae, housing 26 recognized species of the diurnal frogs related to streams of forest massifs in the BAF. Hylodes pipilans is endemic to the state of Rio de Janeiro, considered restricted to the Serra do Órgãos mountains. Here, we updated its …

Neotropical Biodiversity

We added a new record of a freshwater sponge at the family level from Honduras. The presence of the Dosilia genus in Central America was confirmed, extending its distribution by 890 linear miles south of Mexico. This constitutes a new southern range extension of D. radiospiculata from the Nearctic to Neotropical region. The specimen was collected from the Pacific slope of Honduras. Although sponges constitute an important element of a freshwater ecosystem, environmental pressures and contamination of rivers or other aquatic environments, where they exist, have not been considered under any category of protection.

Pelaksanaan Sistem Pengawasan Hakim Konstitusi Di Indonesia, Al Amin Syayidin Ali Mustopa Dec 2022

Pelaksanaan Sistem Pengawasan Hakim Konstitusi Di Indonesia, Al Amin Syayidin Ali Mustopa

Jurnal Konstitusi & Demokrasi

The supervision system for constitutional judges in Indonesia based on the 1945 Constitution and Law 24/2003 explicitly involves two forms of supervision, namely internal supervision by the Honorary Council and external supervision by the Judicial Commission. The supervisory system finally changed after the Constitutional Court Decision Number 005 / PUU-IV / 2006. After this decision, the supervision system for constitutional judges in Indonesia underwent a substantial change in the form of supervision that eliminated external supervision. The existing internal supervision system often changes in accordance with the current statutory regime and implementing regulations. Changes related to the existing internal supervision …

Kerangka Praktik Kenegaraan Dalam Narasi Apriori Pembangunan Berkelanjutan Sebagai Hak Konstitusional: Sentralisasi Pendekatan Ekosentris Dalam Melawan Kenisbian Utilitas Pendekatan Antroposentris, Abdurrahman Al-Fatih Ifdal

Jurnal Konstitusi & Demokrasi

Sustainable development is a colossal narrative of state elites to institutionalize the right to development which, instead of being oriented towards harmonization of development efforts with efforts to protect the environment, is actually based on human interests. The inherent causality of this effort has an impact on systemic environmental damage in various countries. When the environment is no longer able to recover itself according to the timeline of meeting the needs of human civilization, an ambitious approach such as ecocentrism needs to be used as a counter-narrative to the anthropocentrism approach which tends to be relative: it looks useful, but …

The Regional Representative Council (DPD) as a regional representative institution that has a character of representation based on regions is essentially a character of broader representation of the DPR, because the dimension of representation is based on all the people contained in these regions. DPD as a new state institution after the amendment to the 1945 Constitution was initially expected to realize a bicameral system, as a representative body of the people, the DPD has functions as regulated in the 194 5 Constitution. In 2021, the Constitutional Court issued Decision Number 70/PUU-XVII/2019, partially granting the petitioner's request for judicial review. The content of the decision includes emphasizing the independence of the Corruption Eradication Commission (KPK) and confirming the position of the Corruption Eradication Commission Supervisory Board in the Corruption Eradication Commission's law enforcement structure. However, following the issuance of the verdict, there are several imperfect legal gaps related to the position of the Corruption Eradication Commission. These legal gaps relate to the extent of the independence of the Corruption Eradication Commission when linked to the independence of the judicial power, as the Corruption …

Preparing Global South Accountants To Be 'Superstar' Communicators, Pia Patricia P. Tenedero Dec 2022

Preparing Global South Accountants To Be 'Superstar' Communicators, Pia Patricia P. Tenedero

Journal of English and Applied Linguistics

This paper investigates how universities in the Philippines prepare accounting students for communication in global workplaces. As an emerging global leader in offshore accounting services, the Philippines is seeing a growing demand for communicatively competent accountants who can be deployed globally. This trend consequently places a greater onus on the higher education system to produce accounting graduates who can communicate effectively. This paper examines what constitutes “effective communication” in the context of two Manila-based, top-performing accounting schools. Using ethnographic data, I examine how communication is entextualized in curricular documents and how these notions are enacted in classroom interactions. Analysis of …

Analysis Of Core Claims, Assumptions, And Silences: A Basis For Re-Designing The Enacted K-12 English Curriculum And Reconceptualizing Communicative Competence, Alejandro S. Bernardo

Journal of English and Applied Linguistics

This paper examines the core claims, assumptions, and silences of the enacted K-12 English curriculum in the Philippines, guided by three important questions: What does the curriculum claim will happen to those using or exposed to it? What does the curriculum say about the English language and learning it? What does the curriculum say nothing about? These questions generate an understanding of how Philippine English (PE) and communicative competence are conceptualized in the written English curriculum currently running in the country. How the enacted curriculum (dis)regards Philippine English and how it (mis)construes communicative competence are problematized in this paper that …
