Lignin nanoparticles have potential value in biomedical and environmental applications. Utilizing oil palm empty fruit bunches (OPEFB) for lignin nanoparticles production can improve the economics of oil palm. In this study, lignin was extracted from OPEFB by acid-catalyzed organosolv method, using either glycerol/glycerol carbonate or ethanol/water as the solvent. The FT-IR spectra of the lignin particles extracted by glycerol/glycerol carbonate and ethanol/water suggest that the ethanol/water system was able to remove more functional groups from the OPEFB than glycerol/glycerol carbonate. Without the homogenization, the organosolv lignin particle sizes extracted by glycerol/glycerol carbonate and ethanol/water were broadly distributed, ranging between 8-154 …

Epidermal growth factor receptor (EGFR) mutation is an important and highly prevalent oncogene driver in patients with non-small cell lung cancer (NSCLC) in East Asia. The detection of EGFR mutations is a standard biomarker testing that routinely performed in patients with advanced lung cancer for the selection of targeted therapy. The failure of GBM treatments is closely related to a subset of cells known as glioblastoma stem cells (GSCs), which possess stemness characteristics. While the Wnt signaling pathway plays a crucial role in regulating stem cell homeostasis, the interplay between this pathway and the mTORC2 signaling pathway in GBM remains unclear. The objective of this study is to examine the effect of information and communication technology (ICT) infrastructure on inward foreign direct investment (FDI) in the Asia-Pacific Economic Cooperation (APEC) region by using panel data from 20 APEC economies over the 2005-2020 period. Various indicators of ICT-related factors, including number fixed telephone subscriptions, mobile cellular subscriptions, broadband subscriptions, and internet users have been used to measure the level of ICT infrastructure development. As witnessed from 2008 to 2011 in the case of the Preah Vihear temple, boundary demarcation can become securitized and lead to armed clashes. The Royal Thai Army of the Kingdom of Thailand is primarily responsible for securing the land border. Along the Thai-Cambodian border, security threats still exist. This research consults with the "norm’s life cycle" under international norm dynamics concept to identify and analyze the challenges in establishing an ASEAN Peacekeeping Force. This study argues that the emergent norm of establishing an ASEAN Peacekeeping Force has not yet reached the threshold to transition into the second stage of norm cascade where it is widely embraced by ASEAN member states; and the norm has not reached the stage of norm internalization where it is accepted within the practices of ASEAN. The purpose of this independent_study is to examine Russian motivations for the 2007 cyberattacks on Estonia's critical information infrastructure and the 2015 Ukraine power grid breach. It also analyzes the aftermath and consequences of the attacks, as well as efforts to address the issues. The study found that Russia's primary purpose in cyberattacks is most likely to survive the anarchy of the international system, in which states can never trust each other and must rely on themselves. Malaria vaccine development confronts high genetic polymorphism in some antigenic components of the vaccine candidates, which could potentially limit the vaccine efficacy. An antigen of Plasmodium falciparum, designated glutamic acid-rich protein (PfGARP), has recently been considered as a strong vaccine target against asexual-blood-stages parasite. It has been shown that naturally acquired anti-PfGARP antibodies elicited clinical protection against severe malaria among people living in hyperendemic areas. Furthermore, PfGARP has been involved in binding to human erythrocyte band 3, which induces erythrocyte aggregation and might bring about severe malaria. After the body is invaded by pathogens, it responds by secreting cytokines, for example, interleukin 6 (IL-6), which activates an intracellular signaling pathway involving JAKs/STAT3 through phosphorylation. However, overexpression of pSTAT-3 can lead to a positive feedback loop of IL-6, causing the release of more cytokines and potentially leading to cytokine storm. การกระทำความผิดต่อทรัพย์ เป็นการกระทำความผิดที่พบมากในสังคมไทย แต่มีลักษณะการกระทำความผิดและสร้างความเสียหายต่อสังคมแตกต่างกันออกไป โดยเฉพาะการกระทำความผิดต่อทรัพย์อันมีราคาเล็กน้อยกับการกระทำความผิดต่อทรัพย์ที่มีมูลค่าหรือราคาจำนวนมากที่สร้างความเสียหายในระดับร้ายแรงแรง ซึ่งผู้กระทำความผิดมักมีมูลเหตุจูงใจหรือวัตถุที่มุ่งหมายกระทำแตกต่างกัน แต่กลับพบว่าตามประมวลกฎหมายอาญาของไทย มิได้มีการแบ่งแยกความผิดต่อทรัพย์อันมีราคาเล็กน้อยไว้โดยเฉพาะ ทำให้ผู้กระทำความผิดต่อทรัพย์อันมีราคาเล็กน้อย ซึ่งถือเป็นความผิดอาญาที่ไม่ร้ายแรง ต้องระวางโทษเช่นเดียวกับผู้ที่กระทำความผิดต่อทรัพย์ในลักษณะอื่น ซึ่งไม่เป็นไปตามหลักความได้สัดส่วนกับความผิดและผู้กระทำความผิด ผลจากการศึกษาวิวัฒนาการความผิดต่อทรัพย์อันมีราคาเล็กน้อยตั้งแต่อดีตถึงปัจจุบันของทั้งกฎหมายไทย กฎหมายของจักรวรรดิโรมัน ประเทศอินเดีย อังกฤษ และจีน พบว่า การบัญญัติฐานความผิดเกี่ยวกับทรัพย์อันมีราคาเล็กน้อยควรนำไปใช้กับการลักทรัพย์ เนื่องจากเป็นรูปแบบการกระทำต่อทรัพย์ที่ไม่มีความซับซ้อน ไม่มีการใช้กำลังประทุษร้าย หรือใช้อุบายหลอกลวง อันแสดงให้เห็นว่าผู้กระทำความผิดมีจิตใจที่ชั่วร้าย โดยการกำหนดฐานความผิดต่อทรัพย์อันมีราคาเล็กน้อยควรกำหนดหลักเกณฑ์ที่ชัดเจนว่าทรัพย์ราคาเท่าใดถือเป็นทรัพย์อันมีราคาเล็กน้อย เพื่อทำให้การบังคับใช้กฎหมายมีความชัดเจนแน่นอน และยกเลิกเงื่อนไขความจำใจหรือความยากจนเหลือทนทาน เนื่องจากทำให้เกิดปัญหาการตีความและไม่สอดคล้องกับวิวัฒนาการความผิดต่อทรัพย์อันมีราคาเล็กน้อยที่ไม่เคยปรากฏเงื่อนไขดังกล่าวมาก่อน โดยการบัญญัติฐานความผิดต่อทรัพย์อันมีราคาเล็กน้อย ผู้ร่างกฎหมายควรพิจารณาปัจจัยต่าง ๆ ให้ครอบคลุมทุกด้าน ทั้งหลักความได้สัดส่วนหรือแนวคิดทางอาชญาวิทยา เป็นต้น

ปัญหาการกำหนดความผิดฐานเหยียดหยามธงชาติ, จินต์จุฑา บำเพ็ญวัฒนา

วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์ปัญหาการกำหนดความผิดฐานเหยียดหยามธงชาติของประเทศไทยตามมาตรา 118 และมาตรา 135 แห่งประมวลกฎหมายอาญาและมาตรา 54 แห่งพระราชบัญญัติธง พ.ศ. 2522 โดยศึกษาเปรียบเทียบกับกฎหมายของประเทศสหรัฐอเมริกา ประเทศสาธารณรัฐอินเดีย ประเทศสหพันธ์สาธารณรัฐเยอรมนีและประเทศสาธารณรัฐเกาหลีเพื่อกำหนดแนวทางปรับปรุงแก้ไขกฎหมายไทย จากการศึกษา พบว่าความผิดฐานเหยียดหยามธงชาติของประเทศไทยมีข้อบกพร่องทางกฎหมาย 4 ประการ กล่าวคือ บทบัญญัติไม่สอดคล้องกับบริบททางสังคมและการเมือง ขัดกับหลักความชัดเจนแน่นอนของกฎหมายอาญา มีความเป็นอาญาและจำกัดเสรีภาพในการแสดงออกของประชาชนเกินสมควร เพื่อแก้ไขปัญหาทางกฎหมายทั้ง 4 ประการ วิทยานิพนธ์ฉบับนี้จึงเสนอให้มีการปรับปรุงแก้ไขความผิดฐานเหยียดหยามธงชาติของประเทศไทยโดยยกเลิกความผิดฐานเหยียดหยามธงชาติในมาตรา 54 แห่งพระราชบัญญัติธง พ.ศ. 2522 ซึ่งซ้ำซ้อนกับความผิดตามประมวลกฎหมายอาญา กำหนดขอบเขตของการกระทำให้ครอบคลุมเฉพาะการปลด การทำลาย การทำให้เสียหาย การทำให้ไร้ประโยชน์และการทำให้เปรอะเปื้อนซึ่งธงหรือเครื่องหมายอื่นใดอันมีความหมายถึงรัฐโดยเปิดเผยหรือในที่ประชุม กำหนดขอบเขตของธงอันมีความหมายถึงรัฐตามมาตรา 118 ให้ครอบคลุมเฉพาะผืนธงชาติไม่ว่าจะมีขนาดใดและทำมาจากวัสดุใด กำหนดขอบเขตของวัตถุแห่งการกระทำของมาตรา 135 ให้ครอบคลุมเฉพาะธงชาติและเครื่องหมายอื่นใดอันมีความหมายถึงรัฐต่างประเทศที่แสดงไว้เพื่อใช้แทนประเทศนั้นอย่างเป็นทางการ และกำหนดให้คำว่า “เหยียดหยาม” เป็นเจตนาพิเศษเช่นเดิม

The philosopher Nancy Fraser defines two paradigms for social justice: the economic and the cultural. These two paradigms often find themselves at odds (the familiar struggle between class politics and identi- ty politics), but only when working in conjunction, according to Fraser, can they reach their emancipatory potential. Contra Fraser, this paper argues that there exist some historical moments in which it is neces- sary for one paradigm to take precedence over the other. เอกัตศึกษาฉบับนี้มีวัตถุประสงค์ในการศึกษาถึงมาตรการทางกฎหมายในประเทศไทยที่เกี่ยวข้องเพื่อรองรับให้คาร์บอนเครดิตสามารถเป็นหลักประกันในการให้สินเชื่อแก่ ผู้ประกอบการวิสาหกิจขนาดกลาง ขนาดย่อม และรายย่อย (Micro-entrepreneurs, Small and Medium-sized Entrepreneurs : MSMEs) ของสถาบันการเงิน เพื่อแก้ปัญหาการไม่สามารถเข้าถึงเงินทุนจากสถาบันการเงินเนื่องจากขาดหลักประกันในการได้รับสินเชื่อ ตลอดจนลดผลกระทบที่จะเกิดขึ้นแก่ MSMEs จากการใช้บังคับของนโยบายการเงินเพื่อสิ่งแวดล้อมทั้งในประเทศและต่างประเทศ การวิจัยนี้พบว่า มีปัญหาในการกำหนดคำจำกัดความของทรัพย์สินที่สามารถนำมาเป็นหลักประกันได้ ภายใต้พระราชบัญญัติหลักประกันทางธุรกิจ พ.ศ. 2558 ที่ทำให้ผู้ประกอบการไม่สามารถนำทรัพย์สินที่มีมูลค่าทางเศรษฐกิจอื่นที่อยู่นอกเหนือมาตรา 8 และในกฎกระทรวงมาเป็นหลักประกันตามพระราชบัญญัติได้ อันทำให้เกิดความไม่สอดคล้องกับวัตถุประสงค์ของพระราชบัญญัติที่ต้องการแก้ปัญหาข้อจำกัดในการนำทรัพย์สินมาเป็นหลักประกัน นอกจากนี้ ยังมีข้อจำกัดในด้านกฎเกณฑ์ที่เกี่ยวข้องกับสถาบันการเงิน ที่วางข้อจำกัดเรื่องหลักประกันในการให้สินเชื่อ ทำให้สถาบันการเงินไม่สามารถยอมรับหลักประกันที่ไม่ได้ถูกกำหนดไว้หรือไม่ได้รับอนุญาตจากธนาคารแห่งประเทศไทยได้ ผู้วิจัยจึงได้เสนอแนวทางปรับปรุงพระราชบัญญัติหลักประกันทางธุรกิจ พ.ศ. 2558 ตลอดจนกฎเกณฑ์ที่เกี่ยวข้องกับสถาบันการเงิน เพื่อให้สถาบันการเงินสามารถให้สินเชื่อแก่ MSMEs โดยมีทรัพย์สินอันเป็นหลักประกันที่หลากหลายและคลอบคลุมทรัพย์สินที่มีมูลค่าทางเศรษฐกิจมากขึ้น

หลักการรักษาเงินทุนของบริษัทถือเป็นหลักการที่สำคัญของกฎหมายบริษัทที่มีขึ้นเพื่อเป็นหลักประกันแก่เจ้าหนี้ในการได้รับชำระหนี้ และเพื่อคุ้มครองผู้ถือหุ้นมิให้ได้รับความเสียหายจากการที่ทุนของบริษัทลดลง อย่างไรก็ดี ในปัจจุบันประเทศต่าง ๆ ได้มีการยกเลิกหรือผ่อนคลายหลักการดังกล่าวลง เนื่องจากการกำหนดหลักการรักษาเงินทุนนั้นก่อให้เกิดความขัดข้องทางธุรกิจในทางปฏิบัติและก่อให้บริษัทเกิดค่าใช้จ่ายที่ไม่จำเป็น หากแต่เมื่อพิจารณาตามกฎหมายว่าด้วยบริษัทจำกัดในประเทศไทยยังปรากฏว่าบทบัญญัติต่าง ๆ ยังคงรองรับหลักการรักษาเงินทุนอยู่โดยให้บริษัทปฏิบัติตามหลักเกณฑ์อย่างเคร่งครัด โดยมีบทบัญญัติซึ่งห้ามมิให้บริษัทถือหุ้นและซื้อหุ้นของตนเองคืนซึ่งไม่เหมาะสมต่อลักษณะการประกอบธุรกิจวิสาหกิจเริ่มต้น (Startup) ในปัจจุบันซึ่งเป็นธุรกิจที่ส่งผลกระทบต่อการพัฒนาเศรษฐกิจในประเทศ เอกัตศึกษาฉบับนี้จึงมุ่งศึกษาถึงปัญหากฎหมายการถือหุ้นของตนเองและการซื้อหุ้นคืนของวิสาหกิจเริ่มต้นในประเทศไทย โดยวิเคราะห์ถึงปัญหาที่เกิดขึ้นจากการที่วิสาหกิจเริ่มต้นซึ่งมักจะจัดตั้งในรูปแบบของบริษัทจำกัดไม่สามารถซื้อหุ้นของตนเองคืนกลับมาและนำมาถือเองเพื่อนำไปใช้บริหารทางการเงินและใช้เป็นเครื่องมือในการบริหารต่าง ๆ ของบริษัทได้ เช่น นำไปจัดสรรให้แก่พนักงานตามโครงการจัดสรรหุ้นให้พนักงานของบริษัท (ESOP) หรือการทยอยให้หุ้น (Vesting) ได้ และศึกษาเปรียบเทียบการปรับปรุงแก้ไขกฎหมายว่าด้วยบริษัทในสหรัฐอเมริกา สหราชอาณาจักร และประเทศสิงค์โปร์ รวมถึงหลักเกณฑ์ว่าด้วยวิธีการซื้อหุ้นคืนในบริษัทมหาชนจำกัดในประเทศไทยเพื่อเสนอแนวทางการแก้ไขปรับปรุงกฎหมายของประเทศไทยให้เหมาะสมและคุ้มครองผลกระทบที่เกิดขึ้นต่อผู้ถือหุ้นและเจ้าหนี้ของบริษัท

เนื่องจากทรัพย์สินเป็นเครื่องมือวัดความสามารถในการเสียภาษีของผู้เสียภาษีตามหลักการจัดเก็บภาษีจากฐานทรัพย์สิน จึงมุ่งประเด็นวิเคราะห์ในบทบรรเทาภาระภาษีตามพระราชบัญญัติภาษีที่ดินและสิ่งปลูกสร้าง ซึ่งให้อำนาจในการยกเว้นภาษีในสิ่งปลูกสร้างที่เป็น ถนน ลาน ตามกฎกระทรวง และให้อำนาจการลดภาษีในสิ่งปลูกสร้างที่เป็นที่ตั้งของถนนหรือทางยกระดับ ที่เป็นทางพิเศษหรือเป็นทางหลวงสัมปทาน ในอัตราร้อยละ 90 ของจำนวนภาษีที่จะต้องเสียสำหรับสิ่งปลูกสร้างนั้นตามพระราชกฤษฎีกา โดยไม่พิจารณาถึงลักษณะแห่งการใช้ประโยชน์เป็นเหตุผลที่สมควรและมีน้ำหนักเพียงพอหรือไม่ นอกจากนี้ในแนวทางตีความนิยามสิ่งปลูกสร้าง ถนนและลาน ยังมีประเด็นความไม่ชัดเจนว่าเข้าข่ายเป็นสิ่งปลูกสร้างหรือไม่ ผลการศึกษาพบว่า หลักการตีความกฎหมายภาษีอากร ต้องอาศัยการศึกษาวิเคราะห์จากกฎหมายเดิมอันเป็นรากฐานที่เคยมีการบังคับใช้ ซึ่ง ถนนและลาน ล้วนมีลักษณะเป็นสิ่งปลูกสร้าง อีกทั้ง การบรรเทาภาระภาษีด้วยการยกเว้นและลดภาษีในสิ่งปลูกสร้างที่เป็น ถนน ลาน โดยไม่มีข้อจำกัดแห่งการบรรเทาให้แตกต่างตามลักษณะการใช้ประโยชน์ นอกจากไม่เป็นไปตามหลักการยกเว้นภาษีและไม่สะท้อนหลักอำนวยรายได้แล้ว ยังไม่เคารพหลักความสามารถในการเสียภาษีอีกเช่นกัน ในขณะที่กฎหมายทรัพย์สินของกรณีศึกษาต่างประเทศ นอกจากจะกำหนดหลักเกณฑ์แห่งการยกเว้นภาษีทรัพย์สินตามหลักทฤษฎีแล้ว ยังมีกำหนดถึงข้อจำกัดแห่งการยกเว้นภาษี อีกทั้งยังมีความละเอียดถี่ถ้วนในการจัดแบ่งประเภทลักษณะการใช้ประโยชน์ จึงขอเสนอให้จัดเก็บภาษีที่ดินและสิ่งปลูกสร้าง จากสิ่งปลูกสร้างกรณี ถนนและลาน ให้มีความเหมาะสมตามสัดส่วนของความมั่งคั่งที่เพิ่มขึ้น และจำกัดกรณีแห่งการยกเว้นภาษีไว้เฉพาะลักษณะแห่งการใช้ประโยชน์บางประเภทเท่านั้น โดยควรจัดเก็บภาษีจากถนนและลานที่มีลักษณะการใช้ประโยชน์อื่นในทางพาณิชยกรรม

The study aimed to validate two-step procedure PRP protocol and assess the effect on skin healing process in rats treated with PRP and/or HA nanogel. A total of 46 Wistar rats were enrolled in the study. PRPwas produced and its hematological parameters were examined. In this thesis, I argue that civil defense failed to take hold in the United States because it required local communities to take responsibility for protective measures. Fargo, North Dakota provides a case study for this analysis. The first section examines how Fargo adopted many practices from federal, state, and municipal civil defense organizations in the early 1950s, but struggled to implement them due to volunteer shortages. The second section explains how the hydrogen bomb forced officials to revise civil defense policies. One way to understand the basic semiotic relation is that a sign-vehicle signifies an object to an interpretant. Biosemioticians sometimes talk about this relationship in terms of “codes”. When thinking about this relationship in the context of language, a natural move is to conceptualize semiotic relationships among speakers, meanings, and utterances as codes: speakers encode messages in sentences, which are then decoded by an interpreter.
