The Anti-Parent Juvenile Court, Barbara A. Fedders Jan 2022

The Anti-Parent Juvenile Court, Barbara A. Fedders

Faculty Publications

This Article identifies and analyzes features of the juvenile delinquency court that harm the people on whom children most heavily depend: their parents. By negatively affecting a child’s family—creating financial stress, undermining a parent’s central role in rearing her child, and damaging the parent-child bond—these parent-harming features imperil a child’s healthy growth and development. In so doing, the Article argues, they contravene the juvenile court’s stated commitment to rehabilitation.

In juvenile court, fees and fines are assessed against parents, who also often must incur lost wages to comply with court orders. In addition, while youths of all economic backgrounds and …

The Gender Gap In Academic Patenting, W. Michael Schuster, Miriam Marcowitz-Bitton, Deborah R. Gerhardt Jan 2022

The Gender Gap In Academic Patenting, W. Michael Schuster, Miriam Marcowitz-Bitton, Deborah R. Gerhardt

Faculty Publications

The gender gap in academia has long been the focus of public discourse regarding the role of universities in promoting social values. In this study, we consider women’s participation in transferring knowledge from the academy to industry. A prominent model for such transfer is reflected in patent registration for inventions developed through scholarly research. And while academic patenting is a significant component of the professional activities of many faculty members, the extent to which women’s scientific discoveries are patented and commercialized has received relatively little attention.

The U.S. academy is a leader in science and a pioneer of technology transfer. …

Nonmarriage And Choice In South Africa And The United States, Holning Lau, Suzanne A. Kim Jan 2022

Nonmarriage And Choice In South Africa And The United States, Holning Lau, Suzanne A. Kim

Faculty Publications

In this Article, we examine three insights about free choice that emerge from studying the development of South Africa’s law of nonmarriage. First, South African jurisprudence advances understandings of nonmarriage as a valid choice. Unlike U.S. jurisprudence, which has been accused of overprivileging marriage and demeaning nonmarriage, South African jurisprudence draws attention to people’s legitimate reasons for choosing not to marry and the dignity interests attached to that choice. South African law helps to broaden the imagination of what is possible when nonmarriage is respected as a valid choice.

Second, South African jurisprudence illuminates the fact that the choice whether …

Regulating Big Tech is now a matter of intense public debate. We ask how well Big Tech companies fulfill their role as gatekeepers of the public square. We ponder whether their dominant market positions merit an antitrust response. We assess their culpability and complicity in spreading online misinformation and hate. However, in the many normative debates over how Big Tech should use its power, the source of that power remains largely unexamined.

Big Tech, like Big Tobacco before it, is an industry founded on addiction. Although typically “free” to use, the world’s largest digital platforms exploit users’ dopamine pathways to …

Love Is Love: The Fundamental Right To Love, Marriage, And Obergefell V. Hodges, Reginald Oh Jan 2022

Love Is Love: The Fundamental Right To Love, Marriage, And Obergefell V. Hodges, Reginald Oh

Law Faculty Articles and Essays

Fourteenth Amendment substantive due process fundamental rights doctrine is about love. It is, at least, based on a close reading of Justice Anthony Kennedy’s majority opinion in Obergefell v. Hodges, the case in which the Supreme Court held that same-sex marriage is a fundamental right of individual autonomy and dignity.

Part I of this Article discusses the concept of love. Part II examines Justice Kennedy’s majority opinion in Obergefell and argues that it expresses unconditional love for LGBT people in tone, language, and substance. Part III argues that, in Obergefell, Kennedy’s key reasons for concluding that marriage is …

Mapping The Dna Damaging Effects Of Polypyridyl Copper Complexes With Dna Electrochemical Biosensors, Anna Banasiak, Nicolò Zuin Fantoni, Andrew Kellett, John Colleran

Articles

Several classes of copper complexes are known to induce oxidative DNA damage that mediates cell death. These compounds are potentially useful anticancer agents and detailed investigation can reveal the mode of DNA interaction, binding strength, and type of oxidative lesion formed. We recently reported the development of a DNA electrochemical biosensor employed to quantify the DNA cleavage activity of the well-studied [Cu(phen)2]2+ chemical nuclease. However, to validate the broader compatibility of this sensor for use with more diverse—and biologically compatible—copper complexes, and to probe its use from a drug discovery perspective, analysis involving new compound libraries is …

Approximately 1.5 million individuals in Ontario are supplied by private water wells (private groundwater supplies). Unlike municipal supplies, private well water quality remains unregulated, with owners responsible for testing, treating, and maintaining their own water supplies. The COVID-19 global pandemic and associated non-pharmaceutical interventions (NPIs) have impacted many environmental (e.g., surface water and air quality) and human (e.g., healthcare, transportation) systems over the past 15-months (January 2020 to March 2021). To date, the impact of these interventions on private groundwater systems remains largely unknown. Accordingly, the current study aimed to investigate the impact of a province-wide COVID-19 lockdown (late-March 2020) …

Application Of High-Intensity Ultrasound To Improve Food Processing Efficiency: A Review, Prasad Chavan, Pallavi Sharma, Sajeev Rattan Sharma, Tarsem Chand Mittal, Amit Jaiswal

Articles

The use of non-thermal processing technologies has grown in response to an ever-increasing demand for high-quality, convenient meals with natural taste and flavour that are free of chemical additions and preservatives. Food processing plays a crucial role in addressing food security issues by reducing loss and controlling spoilage. Among the several non-thermal processing methods, ultrasound technology has shown to be very beneficial. Ultrasound processing, whether used alone or in combination with other methods, improves food quality significantly and is thus considered beneficial. Cutting, freezing, drying, homogenization, foaming and defoaming, filtration, emulsification, and extraction are just a few of the applications …

Calculating the disease burden due to injury is complex, as it requires many methodological choices. Until now, an overview of the methodological design choices that have been made in burden of disease (BoD) studies in injury populations is not available. The aim of this systematic literature review was to identify existing injury BoD studies undertaken across Europe and to comprehensively review the methodological design choices and assumption parameters that have been made to calculate years of life lost (YLL) and years lived with disability (YLD) in these studies.

Compositional Datasets And The Nested Dirichlet Distribution, Bianca Luedeker Jan 2022

Compositional Datasets And The Nested Dirichlet Distribution, Bianca Luedeker

Statistical Science Theses and Dissertations

Compositional data is a type of multivariate data where each component of a vector is sandwiched between 0 and 1 and the sum of the components is 1. For example, the proportion of time that each of 7 mice spend in one of four quadrants of a circular water maze is between 0 and 1, and the total proportion of time spent in the maze is 1. If there are two sets of mice, one set of normal mice and one set of cognitively impaired mice, the experiment has a two-sample design. Such data is frequently analyzed incorrectly by comparing …

Artificial Intelligence System For Automatic Imaging, Quantification, And Identification Of Arthropods In Leaf Litter And Pitfall Samples, Pierce Helton, Khoa Luu, Ashley Dowling Jan 2022

Artificial Intelligence System For Automatic Imaging, Quantification, And Identification Of Arthropods In Leaf Litter And Pitfall Samples, Pierce Helton, Khoa Luu, Ashley Dowling

Inquiry: The University of Arkansas Undergraduate Research Journal

It is well known that arthropods are the most diverse and abundant eukaryotic organisms on the planet. Museum and research collections have huge insect accumulations from expeditions conducted over history that contain specimens of both temporal and spatial value, including hundreds of thousands of species. This biodiversity data is inaccessible to the research community, resulting in a vast amount of “dark data”. The primary objective of this study is to develop an artificial intelligence-driven system for specimen identification that greatly minimizes the time and expertise required to identify specimens in atypical environments. Successful development will have profound impacts on both …

Gendered Normativities: The Role And Rule Of Law, Susanne Baer Jan 2022

Gendered Normativities: The Role And Rule Of Law, Susanne Baer

Book Chapters

In the 21st century, human rights are as present as they are endangered. Specifically, sex/gender equality rights are contested, or actively abridged, which is to be understood as an attack on women and on people who do not fit a ‘normal’ pattern of gender relations. Yet in addition, these are attacks on democratic constitutionalism itself. The article argues that to properly understand the recent contestations of human rights, one must distinguish between critique and attack, and revisit the very form and content of human rights, to deal with law’s ambivalence, such as ‘legal colonialism’, and also take into account critical …

Life-Cycle Assessment Of Non-Domestic Building Stocks: A Meta-Analysis Of Current Modelling Methods, Julian Bischoff, Aidan Duffy Jan 2022

Life-Cycle Assessment Of Non-Domestic Building Stocks: A Meta-Analysis Of Current Modelling Methods, Julian Bischoff, Aidan Duffy

Articles

Building stock models (BSMs) are essential for simulating the contributions of regional and national building sectors to climate change under different policy scenarios, and for identifying pathways to climate change mitigation. To date, BSMs have focused on the operational life-cycle impacts of domestic dwellings; there has been less emphasis either on non-domestic buildings (NDBs) or full life-cycle analysis. This paper provides a first review of the theory and practice of NDB stock modelling which considers life-cycle energy, emissions and costs. A meta-analysis of the literature was undertaken involving a structured search of relevant articles in key scientific repositories. 98 in-scope …

When Goods Become Gods: Fractured Identities And The Call For Safe Spaces In Sports, Cynthia A. White, Elizabeth Bounds

Movement and Being: The Journal of the Christian Society for Kinesiology, Leisure and Sports Studies

What is the relationship between identity, idolatry, wholeness, and community? What are the ways in which sports culture bolsters or misdirects God-given identity? How can leaders in sports cultivate authentic, loving community that provides athletes safe spaces to explore and discern messages from the world and truth from God? In this paper, we will explore existential questions such as these. First, we will describe how identity is inherently physiological, psychological, social, and spiritual, developing subconsciously through explicit and implicit messaging. Then, we will explore the ways in which sports – organized play, human creation, and a good gift from God …

(Wp 2022-02) Keynes's Treatise On Probability 100 Years Later: Small Vs. Large Worlds And Closed Vs. Open Systems, John B. Davis

Economics Working Papers

The meaning and significance of Keynes’s Treatise on Probability has changed over the 100 years since its publication. Initially it stood on its own as an original contribution to probability theory. After The General Theory some saw the Treatise strengthening Keynes’s later arguments. Yet by the time New Classical Economics became dominant it became largely ignored. This paper attributes that later rejection to the mainstream economics’ reliance on Savage’s subjective expected utility restriction of probability thinking to what he called small worlds. It argues that his small worlds-large worlds distinction produces a small worlds-closed worlds conception of economics the mainstream …

Preliminary Report 2021: Coring And Excavations At Hof In Hjaltadalur, John M. Steinberg, Zachary N. Guttman, Guðný Zoëga

Andrew Fiske Memorial Center for Archaeological Research Publications

This report outlines the 2021 work at Hof as part of the Hjaltadalur Archaeological Survey Project (HASP). The results of soil coring suggest that the site of Hof is relatively small compared to other settlement farms. The footprint of the farmstead expands substantially after the 11th Century. The midden from the 11th and 12th centuries appears to be located just north of the main farmhouse (Hof 1). Cores from this area show an abundance of midden on either side of the white AD 1104 tephra. There is a notable absence of post-1300 midden deposits. The excavation unit …

Fostering Production Of Pharmaceutical Products In Developing Countries, William Fisher, Ruth L. Okediji, Padmashree Gehl Sampath Jan 2022

Fostering Production Of Pharmaceutical Products In Developing Countries, William Fisher, Ruth L. Okediji, Padmashree Gehl Sampath

Michigan Journal of International Law

The ways in which pharmaceutical products are currently developed, manufactured, and distributed fail to meet the needs of developing countries. The recent emergence of new infectious diseases, the associated surge of healthcare nationalism, and the prevalence of substandard and falsified drugs have strengthened substantially the net benefits of augmenting the capacity of developing countries to produce such products locally. Most previous efforts to do so have foundered. The chance of success in the future would be maximized by the adoption of five strategies : (a) clarifying the zones of discretion created by the relevant treaties to ensure that local firms …

Information As Power: Democratizing Environmental Data, Annie Brett

UF Law Faculty Publications

Environmental data systems have largely escaped scrutiny in the past decades. But these systems are the foundations for evaluating environmental priorities, making management decisions, and deciding which perspectives to value. Information is the foundation of effective regulation. The decisions regulators make about gathering, assimilating, and sharing information are, in many cases, determinative of the outcomes they reach. This is certainly true in the case of the environment.

This paper looks at how current environmental regulation has created data systems that undermine scientific legitimacy and systematically prevent stakeholder participation in environmental decision-making. These data systems concentrate power within federal and state …
