Nomos And Nation: On Nation In An Age Of "Populism", John Valery White

Robert Cover's Nomos and Narrative points to the need to recognize a second, novel dimension for understanding rights. His concept of nomos, applied to competing notions of nation in pluralistic societies, suggests that the current dimension for understanding rights, which conceives of them fundamentally as protections for the individual against the state, is too narrow. Rather a second dimension, understanding rights of individuals against the nation, and aimed at ensuring individuals' ability to participate in the development of an idea of nation, is necessary to avoid "a total crushing of the jurisgenerative character" of nomoi by the state, or by …

Everyone is finally noticing that the current Supreme Court is changing its jurisprudence on religious freedom. The commentators are finally paying more attention to the fact that seven of the Court's current Justices were raised Catholic. What role have Catholics played in the Supreme Court's history? This article traces their contributions on religious freedom and civil rights, starting with Chief Justice Taney and ending with Justice Barrett.

Eros As Interpretation: Isaac Ibn Sahula's Commentary On The Song Of Songs And The Invention Of A Kabbalistic Hermeneutics, Jesse Noily

Isaac ibn Sahula was a marginal figure in the Castile community of medieval Spanish kabbalists, which included those mystics who would come to compose the groundbreaking book of Zohar toward the end of the thirteenth century. While Ibn Sahula is best known for his anthology of animal fables, this essay casts his more obscure Commentary on the Song of Songs (ca. 1283) as a key document in tracing the genealogy of the Song's interpretation in classical Kabbalah. Through the translation and analysis of two exemplary sections of the Commentary, this essay will discuss its uniquely kabbalistic reading of the Song …

Revisiting A Jurisprudence Of Obligation, Ariel Evan Mayse, Kenneth A. Bamberger

Through his landmark exploration of obligation as the conceptual touchstone of what he describes as the “Jewish jurisprudence of the social order,” Robert Cover offered an alternate language for legal regimes grounded in a rhetoric of individual rights. The present essay revisits Cover’s account of the socially embedded nature of law and juridical process, taking seriously both its claims, as well as the cautions of its critics. Demographic And Neurocognitive Predictive Factors Impacting On Expressed Vocational Interests, Tamar Runyan

This study examined multiple demographic and neurocognitive variables to determine which ones were predictive of expressed range of occupational interests and occupational interest types. This study used archival data from an outpatient community training clinic that included the Strong Interest Inventory (SII), tests of intellectual functioning, and tests of executive functioning. It was hypothesized that demographic variables (age, gender, years of education, and socioeconomic status) and cognitive variables (intelligence and executive functioning) would be predictive of the expressed range of occupational interests; and that there would be differences in career interests by gender and race/ethnicity. In this Essay, I explore, compare, and evaluate two theoretical models of judicial review in individual rights cases, each proposed by Professor Michael J. Perry, albeit in books separated by three and a half decades. In his 1982 book, The Constitution, the Courts, and Human Rights: An Inquiry into the Legitimacy of Constitutional Policymaking by the Judiciary, Early Perry embraced an aggressive form of judicial activism, urging the Supreme Court to test political judgments through an open-ended search for political-moral truth. Drawing from visual studies scholarship, we highlight current and persistent critiques of sociological visualization, note recent developments in visualization tools for sociologists, and propose how sociologists can be reflective about their visualization choices. As a case study, we outline the visualization development and selection process in our project of mapping Chinese religious venues. We explain the visualization challenges we faced, the visual biases we hoped to manage, the strengths and limitations of various visualization methods we identified, and how we selected visualizations for varying research queries. This Article discusses conflicts with religious or worldview dimensions, and why creative approaches are uniquely suited to intervening in them. Conflicts centered around identity, cosmology, and other aspects of worldviews need tools that reach beyond presenting logic and traditional conflict intervention approaches to parties' "grammars of being." "Grammars of being" refer to structural ideas and values below the surface of conscious awareness that influence beliefs, opinions, and actions, just as grammar organizes written or spoken language. Through the second half of the 20th century, the North American Great Plains saw widespread rural out-migration, a continuation of trends that began with the Dust Bowl crisis during the Great Depression of the 1930s. As part of a wider academic focus on the roles climate and environmental changes have on migration, this research project sought to understand the relationship between drought conditions and rural population decline on the Great Plains. Abstract

This dissertation explores the changing nature of mission among Pentecostal churches in Ontario. The findings of this grounded theory qualitative research project suggest that mission in those Pentecostal churches in Ontario under review have switched the priority of the juxtaposed foci of salvific and humanitarian such that the latter is now their primary means for expressing mission.

The present thesis examines the core issue of how to understand and situate the agency of a religious actor in International Relations (IR). This is investigated through a case study of the Catholic Bishops Conference of the Philippines (CBCP) in two comparative policy contexts: agrarian land reform and family planning. The CBCP is a permanent institution within the Catholic Church as a collective of the bishops of the Philippines. The research employs analytic eclecticism as the method to integrate select works from four principal scholars: Colin Wight, Adrian Pabst, Atalia Omer and Mariano Barbato. This study aimed to 1) investigate the effects of self-directed learning on lifelong learning attitudes of functional literacy facilitators; and to 2) propose recommendations for using self-directed learning to foster lifelong learning. The research used quantitative method by employing quasi-experimental design where pre-test and post-test are employed to explore whether self-directed learning activities would foster lifelong learning attitudes of functional literacy facilitators in the five aspects. With subject group consisted of 37 functional literacy facilitators who were working as teachers in functional literacy programs in Cambodia.
