It is common for instructional designers to seek new tools, techniques, and innovations for the improvement of learning, access, quality, and student satisfaction. Towards An Equitable Review Of Pre-Embryo And Divorce Disputes For Women, Lilah Kleban Nov 2022

Towards An Equitable Review Of Pre-Embryo And Divorce Disputes For Women, Lilah Kleban

Northwestern Journal of Law & Social Policy

Pre-embryos, procured through in-vitro fertilization (IVF), become a source of dispute when couples divorce or separate before using them. Particularly, couples may fight over who has decision-making power to use or not use the frozen pre-embryos for pregnancy. State courts across jurisdictions typically apply one of three categorical approaches: disposition contracts, contemporaneous mutual consent, or a balancing interests test. Each approach fails to provide courts with structures to fully evaluate each party’s interests at the time of dispute and account for inherent sex and gender differences that impact their stakes in the dispute. This Note proposes a modified balancing test …

Law In The Service Of Misinformation: How Anti-Vaccine Groups Use The Law To Help Spin A False Narrative, Dorit R. Reiss, Viridiana Ordonez

Northwestern Journal of Law & Social Policy

Social movements use legal tools to create narratives. Those narratives support social agendas which certain movements leverage to mislead their followers and potential followers. In this Article, we examine one influential anti-vaccine organization, the Informed Consent Action Network (ICAN), that uses its far-reaching platform to create false narratives around legal action. Again and again, this anti-vaccine group misrepresented both the legal and the factual meanings of court decisions, settlements, and other legal actions to create a narrative to galvanize its followers and influence newcomers. ICAN filed lawsuits that make anti-vaccine arguments—even when the legal framework did not fit doing so—and …

Comments On The International Criminal Court Office Of The Prosecutor's Draft Policy On The Crime Of Gender Persecution Under The Rome Statute, Milena Sterio

Law Faculty Reports and Comments

The Draft Policy promises to be a seminal contribution not only to the Office of the Prosecutor's (OTP) policy and practice and the International Criminal Court's (ICC) jurisprudence on gender persecution, but also to the development of international criminal law generally. Building on its prior work, including the 2014 Policy Paper, the OTP is well placed to develop policies and procedures that protect historically marginalized and oppressed groups, deliver justice that accurately reflects the depth and breadth of the gender persecution suffered, and shed light on a crime that has to date received only limited attention.

As it finalizes the …

Medication Adherence And People Living With Hiv: A Qualitative Study, Lisa L. Dale Nov 2022

Medication Adherence And People Living With Hiv: A Qualitative Study, Lisa L. Dale

Electronic Theses and Dissertations Archive

Abstract While significant strides have developed evidence-based preventions and treatments for people living with HIV/AIDS (PLWHA), only 26% percent of HIV-positive people in care achieve the treatment objective of viral suppression (Viral Suppression, 2018). While the literature has identified a positive relationship between patient-provider communication and optimum treatment adherence, nonadherence is poorly understood, and no evidence-based model for such communication exists. This study aims to examine the perspectives of HIV-positive patients and family/friend caregivers (FFC) related to treatment adherence, as most of the literature has been dominated by the clinician’s point of view. Further, this work seeks to provide knowledge …

The Growing Dissonance Between The Kosmos And The Anthropos: A Hermeneutic Study Of The Mechanistic World View Brought By Classical Physics And The New Rationality Introduced By Einstein’S Relativity Theory And Heisenberg’S Indeterminacy Principle In Quantum Physics, Maria Eliza Cruz

Mabini Review

This paper centers on the implicit metaphysics beyond the Theory of Relativity and the Principle of Indeterminacy – two revolutionary theories that have changed 20th Century Physics – using the perspective of Husserlian Transcedental Phenomenology. Albert Einstein (1879-1955) and Werner Heisenberg (1901-1976) abolished the theoretical framework of Classical (Galilean-Newtonian) physics that has been complemented, strengthened by Cartesian metaphysics. Rene Descartes (1596-1850) introduced a separation between subject and object (as two different and self- enclosed substances) while Galileo and Newton did the “mathematization” of the world. Newtonian physics, however, had an inexplicable postulate of absolute space and absolute time – a …

Mabini Review

Apart from being an academic and a researcher, a philosopher also faces a great challenge to fulfill their role as a critic of their society. In response to this challenge, the current article seeks to unveil some manifestations of this role in the Filipino context by means of glimpsing into some significant stages in the History of Critical Filipino Philosophy. This discussion is divided into three parts: (1) the Beginnings of Critical Filipino Philosophy during the time of the Propagandists, (2) its decline entering the 1970’s due to the brewing Marcos Dictatorship, and (3) its re-strengthening after the Dictatorship. This …

Durkheim Revisited: Possible Contribution To The Understanding Of Gramsci’S Notion Of Hegemony, Artchil Fernandez

Mabini Review

The paper attempts to explore the possibility of using Durkheim to understand the Gramscian notion of hegemony building on the claim that Gramsci’s idea is fragmentary and contentious. Durkheim’s concepts such as social solidarity, integration, rites and collective conscience the paper argues maybe deployed to comprehend Gramsci’s notion of hegemony particularly consent generation. The paper also contends that Durkheim’s ideas on the state and secondary groups voluntary organizations (civil society) may be helpful in explaining the Gramscian concept of consent building. In effect, the paper also tries to demonstrate that sociological positions that are viewed as rivals can complement each …
