Concentrated Incarceration And The Public-Housing-To-Prison Pipeline In New York City Neighborhoods, Jay Holder, Ivan Calaff, Brett Maricque, Van C Tran

Using public housing developments as a strategic site, our research documents a distinct pathway linking disadvantaged context to incarceration-the public-housing-to-prison pipeline. Focusing on New York City Housing Authority (NYCHA) housing developments as a case study, we find that incarceration rates in NYCHA tracts are 4.6 times higher than those in non-NYCHA tracts. More strikingly, 94% of NYCHA tracts report rates above the median value for non-NYCHA tracts. Moreover, 17% of New York State's incarcerated population originated from just 372 NYCHA tracts. Compared with non-NYCHA tracts, NYCHA tracts had higher shares of Black residents and were significantly more disadvantaged. This NYCHA …

This review collects and critiques the academic literature on criminal defense lawyering, with an emphasis on empirical work. Research on criminal defense attorneys in the United States has traditionally emphasized scarcity of resources: too many people facing criminal charges who are “too poor to pay” for counsel and not enough funding to pay for the constitutionally mandated lawyers. Scholars have focused on the capacity of different delivery systems, such as public defender offices, to change the ultimate outcomes in criminal cases within their tight budgetary constraints. The history of immigration in the US goes back to its founding. However, in recent years, immigration trends at the US-Mexico border have gained media and political attention as more migrants flee to the border and face challenges as they seek refuge in the US. The inadequate immigration system has been exacerbated as legislation like the Migrant Protection Protocols and metering complicates the legal system and forces asylum seekers into border towns. The Center for Human Services Research (CHSR), in collaboration with the University at Albany School of Social Welfare (SSW), worked with Lifespan of Greater Rochester, the Weill Cornell Medicine’s New York City Elder Abuse Center (NYCEAC), NYCAging (formerly the New York City Department for the Aging), and the New York State Office for the Aging (NYSOFA) to develop and complete a program evaluation of the Elder Abuse Interventions and Enhanced Multidisciplinary Team (E-MDT) Initiative in New York State. E-MDTs use a collaborative approach to intervene in complex cases of elder abuse (financial, physical, psychological, sexual, and neglect by others). Members …

There are haves and have-nots in the federal appellate courts, and the haves get more attention. For decades the courts have used a triage regime where they distribute judicial attention selectively: some appeals receive a lot of judicial attention, some appeals receive barely any. What this work unearths is that this triage system produces demonstrably unequal results depending on the circuit handling the appeal and whether the appellant has counsel or not. Together, these two factors produce dramatic disparities: in one circuit, for example, an unrepresented appellant receives, on average, a decision less than a tenth the length of a …

The Trafficking Victims Protection Act of 2000 (TVPA) is a contemporary effort to combat human trafficking. In 2000, the Congress enacted the T Nonimmigrant Status (or T visa) in the effort to protect victims of trafficking and to enhance law enforcement’s ability to investigate and prevent these crimes in the U.S. This thesis explores from a legal and social point of view the obstacles, hurdles, and challenges that victims of human trafficking face, when applying for a T visa. This qualitative phenomenological study examined the lived experiences of Black men in the United States who have overcome barriers to advance to leadership positions at predominantly White institutions (PWI). The qualitative phenomenological approach was used to examine three research questions that addressed the factors that encouraged Black men on their paths to pursue executive leadership positions, the obstacles they encountered, and how identifying as a Black male at a PWI affected their career pursuits. Social support theory (SST) guided the theorical framework and critical race theory (CRT) guided the conceptional framework. Interviews from six participants were used. During the interviews, …

Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe

Law schools must recognize and seek to remove the barriers to teaching cultural competence and DEI and provide appropriate training and workshops for law professors. Providing law professors with the tools to integrate cultural competency into existing curricula is a first and crucial step to ensure that law professors are well-versed in both their own cultural competency, and in the ability to provide cultural competency training to their students. The culturally competent student will become a culturally competent lawyer with the skillset to make impactful contributions towards DEI in and beyond the practice of law.

The extant research literature indicates that human trafficking survivors have a myriad of service needs, including acute and long-term needs. A statewide resource guide, needs assessment, and service inventory were developed for Missouri through community action research involving a partnership with an anti-trafficking coalition, a consortium of funders, and a series of small research teams. Consulting for a startup company is an effective way for Master of Business Administration (MBA) students to learn about management consulting, and the ways and means of a startup company. This paper discusses the experience of an MBA startup project within the context of a core corporate finance course. The project requires the active engagement of several groups of stakeholders—MBA students, the university’s entrepreneurship incubator, a selection of startup companies, and the project’s academic collaborators. In line with the literature, we find that entrepreneurship education through student-startup collaboration contributes to the students’ entrepreneurial learning, and that the offering of an …

The Influence Of Landmark Judgments And Statutory Changes On The Family Litigation Explosion: A Citation Network Analysis, Joseph Hickey, Lyndsay Campbell, Jörn Davidsen

Family law in many countries has changed radically since the 1960s. However, despite family law’s central importance, few detailed quantitative analyses of the relationship between legal developments (landmark judgments and statutory changes) and the amount and subject of family litigation have been made. We examine this relationship using a unique dataset of citations among Canadian family law judgments from all levels of the court hierarchy. The network analysis draws attention to significant changes in law and legal practice over time. Not only did litigation increase overall, but the number of judgments involving multiple legal issues grew dramatically in the mid-1990s, …

Eviction Court Displacement Rates, Nicole Summers

This Essay introduces the concept of eviction court displacement rates, defined as the percentage of eviction filings that result in tenant displacement. The Essay argues that a jurisdiction’s eviction court displacement rate provides crucial insight into the role of its legal system in driving substantive eviction outcomes. The Essay then compiles existing data on court displacement rates and compares those rates across jurisdictions. This comparison reveals massive variation in court displacement rates nationwide. In some jurisdictions, a tenant’s likelihood of displacement upon receiving an eviction filing is approximately one in twenty. In other jurisdictions, it is higher than one in …
