Land, Legacy, And Law: Amending Cercla To Account For Environmental Contamination Of Tribal Cultural Resources, Alexander Toke
Cardozo Journal of Equal Rights & Social Justice
The note advocates for amending the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) to enable Native American Tribes to recover damages for injuries to cultural resources. It argues that Tribal lands are disproportionately affected by environmental contamination and that current legal frameworks fail to address the unique cultural and spiritual significance of these resources.
The Monetization Of Childhood: How Child Social Media Stars Are Unprotected From Exploitation In The United States, Jessica Pacht-Friedman
The Monetization Of Childhood: How Child Social Media Stars Are Unprotected From Exploitation In The United States, Jessica Pacht-Friedman
Cardozo Journal of Equal Rights & Social Justice
The note highlights the legal vulnerabilities of child social media influencers, or "kidfluencers," who are increasingly exploited due to inadequate protections under U.S. labor laws. The Fair Labor Standards Act (FLSA) exempts child performers, and while some states have Coogan Laws, these are insufficient to address the unique challenges posed by digital platforms like YouTube. The author advocates for expanding these protections to include social media stars and adopting a "Right to be Forgotten" to safeguard children's privacy and financial interests.
Equal Education Means Equal Education: Confronting Education Access Disparities For New York Students Amid The Covid-19 Pandemic During The 2020-2021 School Year, Sara Gruber
Cardozo Journal of Equal Rights & Social Justice
The COVID-19 pandemic exacerbated existing educational disparities, particularly affecting low-income and minority students in New York due to the shift to online learning. The state's current legislation, such as the Dignity for All Students Act, fails to address these off-campus digital divide issues, necessitating legal reform to ensure equal educational opportunities.
“Traditional Mexican Midwifery” Tourism Excludes Indigenous “Others” And Threatens Sustainability, Rosalynn A. Vega
“Traditional Mexican Midwifery” Tourism Excludes Indigenous “Others” And Threatens Sustainability, Rosalynn A. Vega
Anthropology Faculty Publications
Drawn by the allure of “ancient cultures,” tourists inadvertently consume deauthenticated indigenous practices, including ethnomedical traditions such as midwifery. This is especially true in the case of “Traditional Mexican Midwifery” since stark differences exist between how midwifery practices unfold in indigenous contexts and how they are represented to global tourists. “Traditional Mexican Midwifery” tourism is a unique lens for examining some of the underlying, intersectional issues threatening “sustainability” in ethnomedical tourism. When nonindigenous individuals position themselves as representatives of “Traditional Mexican Midwifery” and indigenous midwives are excluded from profit chains, this type of tourism not only fails to meet the …

The Lived Experiences Of Black Pastors And Their Self-Care, Tracy D. Metcalf
All Student Theses and Dissertations
Black pastors tend to carry the burden of the Black community, church, congregants, family, and their own personal struggles. How these individuals handle their experiences, stress, and self-care can assist them in creating a healthy life and work balance. There is limited literature on Black male pastors and their lived experiences and self-care practices. This study explored the lived experiences of Black male pastors and how it affects their self-care practices. This study utilized a phenomenological qualitative research design. This qualitative approach allows for the Black male pastor’s voice to be heard and documented. The findings of this study show …
Widening The Feminist Lens: Gillian Flynn's Exploration Of Female Villainy, Ann M. Smith
Widening The Feminist Lens: Gillian Flynn's Exploration Of Female Villainy, Ann M. Smith
All Student Theses and Dissertations
Gillian Flynn challenges fiction's male-dominated presence by asserting female presence in number, relevance, and agency. Instead of following patriarchal expectations which maintain that female characters must be virtuous, Flynn evokes female villains whose complexities and monstrous actions extend beyond the limits of the Gothic tradition from which she draws. Although Flynn champions female agency within her fiction, her efforts meet harsh criticism from mainstream audience, specifically regarding Gone Girl. I assert the backlash stems from the audiences' failure to see Amy's character apart from their own expectations of what a feminist character must represent. While feminism in general means …

The Other Bar Hurdle: An Examination Of The Character And Fitness Requirement For Bar Admission, David L. Hudson Jr., Andrea Gemignani
Law Faculty Scholarship
In The Other Bar Hurdle, published in the Mitchell Hamline Law Review, the authors examine the character and fitness requirement as a critical yet under-scrutinized component of attorney licensing. The Article surveys the historical foundations, purposes, and contemporary administration of character and fitness investigations, highlighting their dual aims of protecting the public and safeguarding the integrity of the courts. It then synthesizes extensive scholarly criticism, focusing on concerns about discriminatory origins, lack of transparency, inconsistent application, deterrent effects on prospective applicants, and the disproportionate impact on individuals with criminal records, financial hardship, or mental health histories. While acknowledging …

Academic Leadership Is A Full-Contact Sport: Reflections From A Law School Dean, Jacob H. Rooksby
Law Faculty Publications
Leadership in any setting is hard, often physically as well as emotionally. Academic leadership requires a full-dimensional, mind-body-soul effort that uniquely calls upon one’s baseline character, positionality, and preparation for leadership. Our willingness and ability to read the word as we also read the world combine to shape our approach and range as leaders. And ultimately, our legacy is our imprint on people. This article shares the views of a law school dean on how life experiences, leadership lessons, and book learning intertwine to inform our humanity and charter our influence on people and organizations.
Whiteness As Contract, Marissa Jackson Sow
Whiteness As Contract, Marissa Jackson Sow
Law Faculty Publications
2020 forced scholars, policymakers, and activists alike to grapple with the impact of “twin pandemics”—the COVID-19 pandemic, which has devastated Black and Indigenous communities, and the scourge of structural and physical state violence against those same communities—on American society. As atrocious acts of anti-Black violence and harassment by law enforcement officers and white civilians are captured on recording devices, the gap between Black people’s human and civil rights and their living conditions has become readily apparent. Less visible human rights abuses camouflaged as private commercial matters, and thus out of the reach of the state, are also increasingly exposed as …

The Emergence Of Neutrality, Jud Campbell
The Emergence Of Neutrality, Jud Campbell
Law Faculty Publications
This Article traces two interwoven jurisprudential genealogies. The first of these focuses on the emergence of neutrality in speech and press doctrine. Content and viewpoint neutrality are now the bedrock principles of modern First Amendment law. Yet the history of these concepts is largely untold and otherwise misunderstood. Scholars usually assume that expressive-freedom doctrine was mostly undeveloped before the early twentieth century and that neutrality was central to its modern rebirth. But this view distorts and sometimes even inverts historical perspectives. For most of American history, the governing paradigm of expressive freedom was one of limited toleration, focused on protecting …
The Promise And Perils Of Private Enforcement, Luke Norris
The Promise And Perils Of Private Enforcement, Luke Norris
Law Faculty Publications
A new crop of private enforcement suits is sprouting up across the country. These laws permit people to bring enforcement actions against those who aid or induce abortions, against schools that permit transgender students to use bathrooms consistent with their gender identities, and against schools that permit transgender students to play on sports teams consistent with their gender identities. Similar laws permit people to bring enforcement actions against schools that teach critical race theory and against those who sell restricted firearms. State legislatures are considering a host of laws modeled on these examples, along with other novel regimes. These are …

Chulalongkorn University Theses and Dissertations (Chula ETD)
Di (2-ethylhexyl) phthalate (DEHP) is a toxic phthalate ester (PAE) plasticizer that is predominantly detected in marine sediment and biota. DEHP degradation by bacteria from several environments has been studied, but very little is known about marine sediment bacteria that can degrade DEHP and other PAEs. Therefore, in this study, we enriched a bacterial consortium C10 that can degrade four PAEs of varying alkyl chain lengths (DEHP, dibutyl phthalate, diethyl phthalate, and dimethyl phthalate ; separately and as a mixture) from marine sediment. The major bacterial genera in C10 during the degradation of the PAEs were Glutamicibacter, Ochrobactrum, Pseudomonas, Bacillus, …

Characterization And Property Investigation Of Novel Human Glucose 6-Phosphate Dehydrogenase Inhibitors In Lung Cancer Cell Lines, Makamas Chanda
Chulalongkorn University Theses and Dissertations (Chula ETD)
G6PD plays fundamental roles in many cellular processes, including redox balance and lipid and nucleotide synthesis. Overexpression of G6PD is required to promote the proliferation and survival of cancer cells, including lung cancer. Targeting G6PD is a prominent strategy to inhibit cancer cell progression. Finding novel natural compounds with anticancer properties to inhibit G6PD activity needs to be investigated. Our study indicated that SJ006, which is 1,2-naphthoquinone, promoted cytotoxic activity against NSCLC cell lines. Interestingly, SJ006 exhibited a direct inhibitory effect on G6PD activity without interfering with mRNA or protein levels, which were strongly observed in both A549 and H292. …
