Data Transfers After Schrems Ii: The Eu-Us Disagreements Over Data Privacy And National Security, Monika Zalnieriute
Data Transfers After Schrems Ii: The Eu-Us Disagreements Over Data Privacy And National Security, Monika Zalnieriute
Vanderbilt Journal of Transnational Law
In the long-awaited Schrems II decision, the Court of Justice of the European Union (CJEU) took a radical, although not an unexpected, step in invalidating the Privacy Shield Agreement, which facilitated data transfers between the European Union and the United States. Schrems II illuminates long-lasting international disagreements between the EU and the United States over data protection, national security, and the fundamental differences between the public and private approaches to the protection of human rights in the data-driven economy and modern state. This Article approaches the decision via an interdisciplinary lens of international law and international relations and situates it …
Artificial Waterways In International Water Law: An American Perspective, Tamar Meshel
Artificial Waterways In International Water Law: An American Perspective, Tamar Meshel
Vanderbilt Journal of Transnational Law
Freshwater is a fleeting natural resource that can never be fully harnessed or appropriated by humans. Nonetheless, under both domestic and international law, freshwater is a regulated resource and legal principles have developed to govern its allocation and use. But what of freshwater that, rather than flowing naturally, has been made to so flow by human intervention? Should artificial waterways be subject to the same legal principles that govern the ownership and use of waterways that are naturally occurring?
This Article takes a first step toward clarifying when and how international water law principles applicable to natural transboundary waterways should …

Reusable data/code and reproducible analyses are foundational to quality research. This aspect, however, is often overlooked when designing interactive stream analysis workflows for time-series data (e.g., eye-tracking data). A mechanism to transmit informative metadata alongside data may allow such workflows to intelligently consume data, propagate metadata to downstream tasks, and thereby auto-generate reusable, reproducible analytic outputs with zero supervision. Moreover, a visual programming interface to design, develop, and execute such workflows may allow rapid prototyping for interdisciplinary research. Capitalizing on these ideas, we propose StreamingHub, a framework to build metadata propagating, interactive stream analysis workflows using visual programming. We conduct …

Recent breakthroughs in deep learning-based protein structure prediction show that it is possible to obtain highly accurate models for a wide range of difficult protein targets for which only the amino acid sequence is known. The availability of accurately predicted models from sequences can potentially revolutionise many modelling approaches in structural biology, including the interpretation of cryo-EM density maps. Although atomic structures can be readily solved from cryo-EM maps of better than 4 Å resolution, it is still challenging to determine accurate models from lower-resolution density maps. Here, we report on the benefits of models predicted by AlphaFold2 (the best-performing …

Recently, the Allen Institute for Artificial Intelligence released the Semantic Scholar Open Research Corpus (S2ORC), one of the largest open-access scholarly big datasets with more than 130 million scholarly paper records. S2ORC contains a significant portion of automatically generated metadata. The metadata quality could impact downstream tasks such as citation analysis, citation prediction, and link analysis. In this project, we assess the document linking quality and estimate the document conflation rate for the S2ORC dataset. Using semi-automatically curated ground truth corpora, we estimated that the overall document linking quality is high, with 92.6% of documents correctly linking to six major …

Cryptocurrencies are more than a decade old and several issues have been discovered since their then. One of these issues is a partial negation of the intent to “democratize” money by decentralizing control of the infrastructure that creates, transmits, and stores monetary data. The Programmatic Proof of Work (ProgPoW) algorithm is intended as a possible solution to this problem for the Ethereum cryptocurrency. This paper examines ProgPow’s claim to be Application Specific Integrated Circuit (ASIC) resistant. This is achieved by isolating the proof-of-work code from the Ethereum blockchain, inserting the ProgPoW algorithm, and measuring the performance of the new implementation …

Closing The Achievement Gap Among Foster Care Children, Ralph Cheriza
Closing The Achievement Gap Among Foster Care Children, Ralph Cheriza
Graduate Student Dissertations, Theses, Capstones, and Portfolios
In recent years, the legal landscape has changed to support a framework that guarantees educational stability to foster care students as a subgroup facing myriad adverse developmental outcomes and risk factors that impede academic achievement. In 2013, California has discovered an invisible achievement gap among this distinct subgroup with unrecognized and unmet educational needs. Nationwide, the trend has not been different, prompting a need to get insight into the school setting in Florida to meet the needs of foster care students.
The literature review has suggested that foster care students remain invisible to teachers and have unmet, unstudied, and unrecognizable …

Breaking The Cycle: Effects Of Classroom-Based Behavior Interventions On Disproportionate School Discipline, Gregory L. Murphy Jr.
Graduate Student Dissertations, Theses, Capstones, and Portfolios
Disproportionality in school discipline has plagued our nation since the 1970s. Numerous studies have covered this from various viewpoints. However, the level of disproportionality has continued to grow throughout the years. This study looks deeper into the nationwide issue and examines the impact of classroom-based behavior interventions on school discipline after implementing a required intervention form. This study applied the mixed method approach for research and used archival data from the year before the implementation of the mandated intervention form and the third year after implementation, which is also pre-covid. Phase two included the data results from phase one to …
Estimation Of The Capacity Of A Basic Freeway And Weaving Segment Under Traditional, Autonomous, And Connected Autonomous Vehicles, Using Oversaturated Traffic Condition Data, Niloy Saha
Civil and Environmental Engineering
Autonomous vehicles (AVs) and connected autonomous vehicles (CAVs) will be the standard in transportation in the future. The use of such vehicles could minimize traffic oscillation and travel time and boost safety and mobility on freeways. An AV is a self-driving vehicle that can make decisions by itself in any situation. CAVs include all the characteristics of AVs and additional communication with other vehicles or the infrastructure (signal system). The use of AVs and CAVs will substantially increase motorway capacity in upcoming decades. Moreover, vehicle dynamics will change as technology and algorithms become more commonplace. In the short term, capacity …

Glioblastoma (GBM) is a high-grade, aggressive brain tumor with dismal median survival time of 15 months. Chromosome 6q (Ch6q) is a hotspot of genomic alterations, which is commonly deleted or hyper-methylated in GBM. Two neighboring genes in this region, QKI and PRKN have been appointed as tumor suppressors in GBM. While a genetically modified mouse model (GEMM) of GBM has been successfully generated with Qk deletion in the central nervous system (CNS), in vivo genetic evidence supporting the tumor suppressor function of Prkn has not been established. In the present study, we generated a mouse model with Prkn-null allele …

While most patients with depression respond to pharmacotherapy and psychotherapy, about one-third will present treatment resistance to these interventions. For patients with treatment-resistant depression (TRD), invasive neurostimulation therapies such as vagus nerve stimulation, deep brain stimulation, and epidural cortical stimulation may be considered. We performed a narrative review of the published literature to identify papers discussing clinical studies with invasive neurostimulation therapies for TRD. After a database search and title and abstract screening, relevant English-language articles were analyzed. Vagus nerve stimulation, approved by the U.S. Food and Drug Administration as a TRD treatment, may take several months to show therapeutic …
Bringing Section 8 Home: An Argument For Recognizing A Reasonable Expectation Of Privacy In Metadata Collected From Smart Home Devices, Ana Qarri
Canadian Journal of Law and Technology
Internet of Things devices (also known as smart home devices) are a fast-growing trend in consumer home electronics. The information collected from these devices could prove very useful to law enforcement investigations. These individual pieces of metadata — the collection of which might appear harmless on its face — can be highly revealing when combined with other metadata or information otherwise available to law enforcement. This article builds an argument in favour of recognizing a reasonable expectation of privacy in metadata collected from smart home devices under section 8 of the Canadian Charter of Rights and Freedoms. This article presents …

Manuscripts, Articles, Book Chapters and Other Papers
Treatment fidelity is the use of methodological strategies to monitor and enhance reliability and validity of behavioral intervention trials. Despite availability of guidelines and checklists, treatment fidelity remains underreported, hindering evaluation, interpretation, and cross-study comparisons. Treatment fidelity is particularly important for music interventions given the inherent complexity of musical stimuli and flexibility required for tailored delivery. The purpose of this paper is to define and describe treatment fidelity strategies for our trial of a music-based play intervention for young children with cancer and parents grounded in the NIH Behavior Change Consortium Treatment Fidelity Recommendations. We report strategies for all 5 …

This symposium Issue of the Columbia Law Review marks a moment of convergence and opportunity for an emerging field of legal scholarship focused on America’s state civil trial courts. Historically, legal scholarship has treated state civil courts as, at best, a mere footnote in conversations about civil law and procedure, federalism, and judicial behavior. But the status quo is shifting. As this Issue demonstrates, legal scholars are examining our most common civil courts as sites for understanding law, legal institutions, and how people experience civil justice. This engagement is essential for inquiries into how courts shape and respond to social …
Intellectual Property, Independent Creation, And The Lockean Commons, Mala Chatterjee
Intellectual Property, Independent Creation, And The Lockean Commons, Mala Chatterjee
Faculty Scholarship
Copyrights and patents are differently structured intellectual property rights in different kinds of entities. Nonetheless, they are widely regarded by U.S. scholars as having the same theoretical underpinnings. Though scholars have sought to connect philosophical theories of property to intellectual property, with a particular interest in the labor theory of John Locke, these explorations have not sufficiently probed copyrights’ and patents’ doctrinal differences or their philosophical implications for the theories explored. This Article argues that a defining difference between copyrights and patents has normative significance for the framework of Lockean property theory: namely, that copyright law treats independent creation as …

Effects Of Socioeconomic Status, Demographic Characteristics, And Education On Sarcopenic Obesity, Moruf Oladele Olaleye
Walden Dissertations and Doctoral Studies
The general problem is that although the body of research about obesity is robust, there is a lack of research addressing the problem of sarcopenic obesity. Specifically, there is a lack of research examining the statistical significance of the relationship between the independent variables of socioeconomic status, demographic characteristics, and education and the dependent variable of sarcopenic obesity. This research may advance practice and policy by lending support for developing interventions to address factors that have a statistically significant relationship with sarcopenic obesity. The purpose of this quantitative causal-comparative study was to identify independent variables among socioeconomic, demographic, and education …

Experiences Of Critical Care Nurse Managers In Addressing Nurses' Work-Related Stress, Mariana Tsucuneli
Walden Dissertations and Doctoral Studies
AbstractNurses who work in the critical care unit are more likely to experience work-related stress, fatigue, understaffing, undesirable performance outcomes, and compromised workplace safety than general care nurses. Nurse managers in these units possess insights into nurses' stress-inducing challenges, in addition to managerial and administrative perspectives. Yet there is a lack of available knowledge about the experiences of critical care nurse managers in addressing nurses' work-related stress. The purpose of this study was to explore critical care nurse managers’ experiences of potential strategies to effectively address work-related stress among nurses. The job-demand resource model was the theoretical framework for the …

Semiparametric Copula-Based Regression Modeling Of Semi-Competing Risks Data, Hong Zhu, Yu Lan, Jing Ning, Yu Shen
Faculty, Staff and Student Publications
Semi-competing risks data often arise in medical studies where the terminal event (e.g., death) censors the non-terminal event (e.g., cancer recurrence), but the non-terminal event does not prevent the subsequent occurrence of the terminal event. This article considers regression modeling of semi-competing risks data to assess the covariate effects on the respective non-terminal and terminal event times. We propose a copula-based framework for semi-competing risks regression with time-varying coefficients, where the dependence between the non-terminal and terminal event times is characterized by a copula and the time-varying covariate effects are imposed on two marginal regression models. We develop a two-stage …
