Civil Rights Law Equity: An Introduction To A Theory Of What Civil Rights Has Become, John Valery White Jan 2022

Civil Rights Law Equity: An Introduction To A Theory Of What Civil Rights Has Become, John Valery White

Scholarly Works

This Article argues that civil rights law is better understood as civil rights equity. It contends that the four-decade-long project of restricting civil rights litigation has shaped civil rights jurisprudence into a contemporary version of traditional equity. For years commentators have noted the low success rates of civil rights suits and debated the propriety of increasingly restrictive procedural and substantive doctrines. Activists have lost faith in civil rights litigation as an effective tool for social change, instead seeking change in administrative forums, or by asserting political pressure through social media and activism to compel policy change. As for civil rights …

Surveilling Potential Uses And Abuses Of Artificial Intelligence In Correctional Spaces, Justin Iverson

Scholarly Works

In section II, this paper will begin with an analysis of the development of AI, noting famous examples and establishing a baseline definition as a lens for the rest of this discussion. This paper will assess aspects of AI and machine learning to the extent it furthers our understanding of AI’s ability to collect data and make decisions. Some popular culture references will be brought into focus here to recognize storytelling’s ability to inspire and influence real-world scientific pursuits. Of preliminary importance, the AI we have both dreamed of and feared are certainly kept in mind as technology advances through …

Carrie Menkel-Meadow: Leading Us Toward Justice And Peace, Jean R. Sternlight Jan 2022

Carrie Menkel-Meadow: Leading Us Toward Justice And Peace, Jean R. Sternlight

Scholarly Works

This Essay explores how Carrie Menkel-Meadow's life and work have both highlighted the path of "And"-showing and explaining that it is not only possible but also desirable to seek justice as well as peace, to be both activist and neutral. Of course, tensions will remain. Regarding particular issues in specific moments we all must decide which path we can and should take. Which activism is best, and which goes too far? With whom can we or should we negotiate, and when should we instead say, "I can't negotiate with this person or group"? When should we talk and listen, and …

Geology Faculty Publications and Presentations

Co-authorship networks can provide key insights into the production of scientific knowledge. This is particularly interesting in Antarctica, where most human activity relates to scientific research. Bibliometric studies of Antarctic science have provided a useful understanding of international and interdisciplinary collaboration, yet most research has focused on broad-scale analyses over recent time periods. Here, we take advantage of a ‘Goldilocks’ opportunity in the McMurdo Dry Valleys, an internationally important region of Antarctica and the largest ice-free region on the continent. The McMurdo Dry Valleys have attracted continuous and diverse scientific activity since 1958. It is a geographically confined region with …

The Biochemistry Of Ursolic Acid: A Potential Therapeutic For Neuro-Inflammation, Emma Jane Arsenault Jan 2022

The Biochemistry Of Ursolic Acid: A Potential Therapeutic For Neuro-Inflammation, Emma Jane Arsenault

Master's Theses and Capstones

Ursolic acid (UA) is a naturally occurring triterpenoid found in a variety of plants and berries. This molecule has potent antioxidant and anti-inflammatory properties with the potential to treat a wide variety of conditions, including neuro-inflammatory disorders. However, the exact mechanism of action for UA is unknown. In this thesis, the fundamental biochemistry of UA was investigated by studying two potential targets: lipid rafts and protein phosphatases. Lipid rafts are an important platform for a wide variety of signal transduction pathways and are a docking point for the assembly of the pro-inflammatory NADPH oxidase 2. The impact of UA on …

Decitizenizing Asian Pacific American Women, Shoba Sivaprasad Wadhia, Margaret Hu Jan 2022

Decitizenizing Asian Pacific American Women, Shoba Sivaprasad Wadhia, Margaret Hu

University of Colorado Law Review

The Page Act of 1875 excluded Asian women immigrants from entering the United States, presuming they were prostitutes. This presumption was tragically replicated in the 2021 Atlanta Massacre of six Asian and Asian American women, reinforcing the same harmful prejudices. This Article seeks to illuminate how the Atlanta Massacre is symbolic of larger forms of discrimination, including the harms of decitizenship. These harms include limited access to full citizenship rights due to legal barriers, restricted cultural and political power, and a lack of belonging. The Article concludes that these harms result from the structure of past and present immigration laws …

Analyte-Sensing Particles And Impact Of Plastics On Environmentally Abundant Bacteria, Tania Thalyta Silva De Oliveira

Open Access Dissertations

Nano and microscale materials exhibit exciting chemical, physical and biological properties that dictate how they function. Furthermore, their surface chemistry influences how they respond to a specific application and interact with their surroundings. In this dissertation, a technique used to synthesize tunable hybrid gold nanoparticles for environmental sensing applications by Raman is presented, as well as the fate of nano and microplastics when in the presence of an abundant bacteria in the aquatic environment.Gold nanoparticles are widely used in many applications due to their various properties, such as facile synthesis, biocompatibility, surface conjugation with various ligand types, and tunability. The …

The Benefits Of Disclosing The Availability Of Some Complementary And Alternative Treatments In Clinical Practice., Brenda Gomes Jan 2022

The Benefits Of Disclosing The Availability Of Some Complementary And Alternative Treatments In Clinical Practice., Brenda Gomes

Harriet L Wilkes Honors College Theses 2020 - Present

This thesis assesses the benefits of disclosing the availability of complementary and alternative treatments in clinical practice. The history, current trends, and an overview of the current research on complementary and alternative medicine is outlined to delineate types of treatments that should be disclosed as alternative therapies. The discussion also incorporates an overview of medical paternalism to explain how the doctrines of patient autonomy and informed consent relate to the discussion. Disclosure of complementary and alternative treatments (CAM) promotes patient autonomy, more open communication regarding the use of CAM, can have preventative, palliative, or curative effects, and results in a …

Larvae Release Potential In Five Brooding Sponge Species, Valentina M. Garcia-Nunes

Harriet L Wilkes Honors College Theses 2020 - Present

To conserve marine sponges, we must understand their reproductive output. Previous studies suggest not all individuals are active during every reproductive event. The purpose of this study is to quantify the population reproductive output of five brooding sponge species; Haliclona caerulea, Mycale angulosa, Niphates erecta, Spongia sp., and Tedania ignis, off the coast of Florida, USA. Larvae traps were deployed on individuals of Spongia sp. off Summerland Key during the full moon of July 2021, and on H. caerulea, M. angulosa, N. erecta, and T. ignis off the Fort Pierce City Marina during August and September 2021. We quantified the …

Using The Protection Motivation Theory To Understand The Mental Health Impact Of Surviving Covid-19, Kaprea Johnson, Angel Spence, Yousef Sherif, Dana Brookover, Adrienne White

Adultspan Journal

Due to the widespread effects of COVID-19, mental health professionals need to understand the lived experiences of survivors. Data were collected from YouTube videos (N = 52), which contained firsthand perspectives from COVID-19 survivors. Survivors understood the high stakes of COVID-19, reported the dual threat to physical and mental health, entered “survival mode,” and had both positive and negative reflections on the experience. Implications for mental health professionals and future research directions are included.

Our Constitutionalism Of Force, Farah Peterson Jan 2022

Our Constitutionalism Of Force, Farah Peterson

Public Law and Legal Theory Working Papers

The Founders’ constitution—the one they had before the Revolution and the one they fought the Revolution to preserve—was one in which violence played a lawmaking role. An embrace of violence to assert constitutional claims is worked deeply into our intellectual history and culture. It was entailed upon us by the Founding generation, who sincerely believed that people “are only as free as they deserve to be” and that one could tell how much freedom people deserved by how much blood they were willing to shed to obtain it. This constitutionalism of force survived ratification. Its legacy is a constitutional order …

Streaming Property, Lee Anne Fennell Jan 2022

Streaming Property, Lee Anne Fennell

Public Law and Legal Theory Working Papers

People acquire property rights in objects and real estate in order to capture the stream of services that these assets can provide over time. The thing or parcel itself is merely a delivery mechanism, a way of packaging and protecting rights to that value stream. And, significantly, these assets cannot stream services to anyone without a set of facilitating conditions and complementary goods, such as public infrastructure, that do not lie within the asset owner’s individual control. This Essay argues that we can gain fresh traction on inequality by recasting property as service streams rather than as owned things. Doing …

Strategic Rulemaking Disclosure, Jennifer Nou, Edward H. Stiglitz Jan 2022

Strategic Rulemaking Disclosure, Jennifer Nou, Edward H. Stiglitz

Public Law and Legal Theory Working Papers

Congressional enactments and executive orders instruct agencies to publish their anticipated rules in what is known as the Unified Agenda. The Agenda’s stated purpose is to ensure that political actors can monitor regulatory development. Agencies have come under fire in recent years, however, for conspicuous omissions and irregularities. Critics allege that agencies hide their regulations from the public strategically, that is, to thwart potential political opposition. Others contend that such behavior is benign, perhaps the inevitable result of changing internal priorities or unforeseen events.

To examine these competing hypotheses, this Article uses a new dataset spanning over thirty years of …

Militant Democracy Comes To The Metaverse, Aziz Z. Huq Jan 2022

Militant Democracy Comes To The Metaverse, Aziz Z. Huq

Public Law and Legal Theory Working Papers

Social media platforms such as Facebook, Twitter, Instagram, and Parlor are an increasingly central part of the democratic public sphere in the United States. But the prevailing view of this platform-based public sphere has of late become increasingly dour and pessimistic. What were once seen as technologies of liberation have come to be viewed with skepticism as channels and amplifiers of “antisystemic” forces, damaging the quality and feasibility of democracies. If correct, this skepticism yields an interesting tension: How can the state protect its democratic character against unravelling pressure from actors who are necessary components of democratic practice in the …

Brains Without Money: Poverty As Disabling, Emily R. Murphy Jan 2022

Brains Without Money: Poverty As Disabling, Emily R. Murphy

Faculty Scholarship

e United States has long treated poverty and disability as separate legal and social categories, a division grounded in widespread assumptions about the “deserving” and “undeserving” poor. In the case of disability, individuals generally are not thought to be morally responsible for their disadvantage, whereas in the case of poverty, individuals are assumed to be at fault for their disadvantage and are therefore less deserving of aid. This Article argues that recent advances in brain and behavioral science undermine the factual basis for those assumptions. Poverty inhibits brain development during childhood and, later in life, adversely affects cognitive capacities that …

Egg-Freezing, Uterine Transplants, And In Vitro Gametogenesis: Disruptive Or Normalizing Reproductive Technologies?, Radhika Rao

Faculty Scholarship

In the last year, headlines have heralded the introduction of several radical new technologies that promise to revolutionize procreation and transform our understanding of reproduction. In March 2021, for example, scientists revealed that mouse embryos had been grown in" artificial wombs" for 11 days, roughly half the animal's natural gestation period. According to Jacob Hanna, the biologist at the Weizmann Institute of Science in Israel who led the research team: "This sets the stage for other species. I hope that it will allow scientists to grow human embryos until week five." At the same time, two groups of researchers reported …

Law In The Service Of Misinformation: How Anti-Vaccine Groups Use The Law To Help Spin A False Narrative, Dorit R. Reiss, Viridiana Ordonez

Faculty Scholarship

Social movements use legal tools to create narratives. Those narratives support social agendas which certain movements leverage to mislead their followers and potential followers. In this Article, we examine one influential anti-vaccine organization, the Informed Consent Action Network (ICAN), that uses its far-reaching platform to create false narratives around legal action. Again and again, this anti-vaccine group misrepresented both the legal and the factual meanings of court decisions, settlements, and other legal actions to create a narrative to galvanize its followers and influence newcomers. ICAN filed lawsuits that make anti-vaccine arguments—even when the legal framework did not fit doing so—and …

Drafting Agricultural Legislation, Jessica Vapnek Jan 2022

Drafting Agricultural Legislation, Jessica Vapnek

Faculty Scholarship

"Agricultural legislation” is an umbrella term that covers a broad range of topics, including food, veterinary matters, plant protection, seeds, forestry, fisheries, water, and land. Agricultural legislation also intersects with other discrete subject areas, including environment, health, and trade. Because of these interconnections the borderlines – where agriculture begins and these related topics end – are debatable. How different countries view agriculture varies significantly. In the developed world, agriculture is mostly a commercial enterprise, and “agricultural law” is considered largely to apply to the business of agriculture, including agricultural finance, supply chains, marketing, insurance (crop, drought, pest), real estate, intellectual …
