The Compulsory will (wasiyah wajibah) is one of the products of ijtihad in the field of contemporary Islamic jurisprudence. The case of compulsory wills is also included in the sub-discussion of inheritance in family or civil law in several countries with a majority Muslim community. The provision of a mandatory will appears as an alternative to several inheritance problems, such as the right to inheritance for heirs of different religions, children and adoptive parents. This condition is faced with the reality of the inheritance law of a society that cannot be separated from the structure, norms and traditions of a …

Choice of vote conversion method, as an element of the general election system, has implications for the degree of proportionality. The degree of proportionality in question is divided into two elements, namely between the percentage of seats acquired and the fairness to large and small parties. The author here is interested in measuring the degree of proportionality generated by each of the vote conversion methods. The author then performs a simulation to measure these two elements from two families of vote conversion methods, namely the Quota method and the Divisor method. The simulation results show that in terms of proportionality …

WTO commitments, particularly related to intellectual property rights in the TRIPS Agreement, could potentially hinder efforts to increase access to medicines and vaccines during the Covid-19 pandemic. In time of emergency, these commitments can be overridden using the WTO security exceptions clause. This article compares the WTO security exceptions to general exceptions in Article XX of the GATT 1994 and non-precluded measures in the Argentina-US BIT, India-Germany BIT, and India-Mauritius BIT, and analyses how the Covid-19 pandemic can be a valid reason to waive the obligations under the TRIPS Agreement using the security exceptions clause. In particular, this article discusses …

A Review Of Rice Tariffication In The Time Of Covid-19: Rationale And Road To Rice Self-Sufficiency In The Philippines, David Michael M. San Juan
Asia-Pacific Social Science Review
The Philippine government passed the Rice Tariffication Law (RTL) in 2019, despite a strong and united peasant opposition to rice industry liberalization, which the RTL facilitates and further accelerates. Amid falling Filipino farmers’ incomes due to the deluge of imported rice, negligible milled rice price decreases for consumers, rising rice prices globally, and in the context of the COVID-19 pandemic that has already disrupted food supplies and is poised to cause continuing instability in the price of imports, this paper is aimed at reviewing recent rice tariffication policy literature. Such review will be a springboard in making a case in …

Impact Investment For Brics Cooperation On Sustainable Development, Anita Mujumdar, Alexey Shadrin
Asia-Pacific Social Science Review
A sustainable development agenda has always been at the core of BRICS cooperation. However, the progress has been limited for many reasons, including economic diversity, over-reliance on Western technologies and capital, lack of own sources of financing, and common strategy. At the same time, accounting for over 40% of the global population, over 20% of the world’s GDP, and contributing to more than 40% of global CO2 emissions, BRICS countries are among the world’s most important players in sustainability and climate. Therefore, finding organic ways of sustainable growth in these countries is crucial to global efforts in achieving sustainable development …

Do Voluntary Corporate Risk Disclosures And Board Leadership Effectiveness Predict Firm Performance? The Moderating Role Of Audit Committee Financial Expertise In Malaysia, Wong Baan Wahh, Mazni Abdullah, Edward Wong Sek Khin
Asia-Pacific Social Science Review
Deficiencies in the quality of risk reporting impede investors’ ability to make well-informed investment decisions. In the wake of unexpected corporate collapses, calls for a greater amount of voluntary risk disclosures by the regulators are entirely legitimate, in the expectation that improved risk reporting published in the annual report enables investors to assess a firm’s risk profile and its firm value more accurately. This study investigates the relationship between the voluntary corporate risk disclosures (VCRD), board leadership effectiveness, audit committee financial expertise, and firm performance of 290 companies listed on the Kuala Lumpur Stock Exchange (KLSE). To collect and measure …

Asia-Pacific Social Science Review
This study examines two documentaries on the impact of Agent Orange in post-war Vietnam: Where War Has Passed (1997), by the Vietnamese director Vu Le My and Agent Orange: A Personal Requiem (2007), by Japanese director Masako Sakata. In order to depict the destructiveness of Agent Orange, these directors focus exclusively neither on the footprints of war in Vietnam’s physical landscape nor the sufferings of Vietnamese victims. By highlighting the existence of Agent Orange victims in the landscape that was once the target of a series of American spraying missions, both documentaries urge the audience to remove the boundaries between …

The research is based on the Russian approach to implementing the BRICS Plus concept. The “BRICS Plus Circle” could unite the members of the five integration blocks, driven by the BRICS countries, which are mainly developing countries. These countries call for the creation of a more balanced global architecture based on the principles of non-discrimination, equal access to resources, and their fair distribution. Multilateral cooperation in the Bretton Woods institutions (the WTO, IMF, and the World Bank) may become one of the main modalities of the BRICS Plus interaction. In this regard, the paper aims to analyze the prospects for …
