In Search Of Ordinary Meaning: What Can Be Learned From The Textualist Opinions Of Bostock V. Clayton County?, Sam Capparelli

In Bostock v. Clayton County, the Supreme Court held that Title VII protects gay and transgender individuals from employment discrimination. Writing for the majority, Justice Neil Gorsuch adhered to textualist principles and relied on the ordinary public meaning of the phrase “discriminate because of sex.” Despite the ma-jority opinion purportedly not reaching beyond the words of the statute, three other conservatives on the Court accused Justice Gorsuch of legislating from the bench. Central to this Comment, Justice Brett Kavanaugh took exception with how Justice Gorsuch reached his ordinary meaning of the phrase. The debate between these two Justices can be …

The Scope Of Evidentiary Review In Constitutional Challenges To Agency Action, Conley K. Hurst

When reviewing agency action, the Administrative Procedure Act (APA) instructs courts to “review the whole record or those parts of it cited by a party.” The Supreme Court has interpreted this brief statement as a restriction on the evidentiary scope of judicial review under the APA. Courts may consider only the administrative record compiled by the agency, which includes all materials before the decisionmaker at the time he or she made the decision. The Asian citrus psyllid, Diaphorina citri, is a major threat to citrus production worldwide, as it transmits ‘Candidatus Liberibacter asiaticus’, the pathogen associated with the devastating Asian form of huanglongbing. The psyllid has spread widely from its native South Asia during the past 300 years, most recently to Africa. We report the first population genomic analyses of D. citri in Kenya and La Réunion based on next-generation sequencing of their mitochondrial genomes. We analyzed mitochondrial sequences of 264 D. citri individuals to establish genetic relationships among accessions from D. citri populations from Asia, North America and Africa. Testing the reliability of a two dimensional numerical model of SOFC using COMSOL (FEMLAB 3.1) software against neural network model is another important issue that will be considered in this paper. This paper critiques philosophical efforts to biologize race as racial projects (Omi and Winant, Racial Formation in the United States). The paper argues that the deeply social phenomenon of race defies the analytic schema employed by biologizing philosophers. The very (social) act of theorizing race is already in an involuted relationship with its target concept: analyzing race must be seen as a racial project, in that it simultaneously helps to manage how race is represented in society and helps organize society’s resources along particular racial lines. Sleep apnea is a common sleep disorder characterized by periodic breathing cessation and intermittent hypoxia (IH). Although previous studies have demonstrated that IH alone can influence metabolic outcomes such as body weight, it remains unclear how the timing of IH can specifically affect these outcomes. Here, we examine how pairing 10-h periods of IH to either the animals’ resting phase (e.g., IH during the day) or active phase (e.g., IH during the night) differentially affects body weight, macronutrient selection, energy expenditure, respiratory exchange rate, and glucose tolerance. Importance: Low diastolic blood pressure (DBP) has been found to be associated with increased adverse cardiovascular events; however, it is unknown whether intensifying blood pressure therapy in patients with an already low DBP to achieve a lower systolic blood pressure (SBP) target is safe or effective.

Objective: To evaluate whether there is an association of baseline DBP and intensification of blood pressure-lowering therapy with the outcomes of all-cause death and cardiovascular events.

Several pediatric mitochondrial disorders, including Leigh syndrome (LS), impact mitochondrial (mt) genetics, development, and metabolism, leading to complex pathologies and energy failure. The extent to which pathogenic mtDNA variants regulate disease severity in LS is currently not well understood. To better understand this relationship, we computed a glycolytic bioenergetics health index (BHI) for measuring mitochondrial dysfunction in LS patient fibroblast cells harboring varying percentages of pathogenic mutant mtDNA (T8993G, T9185C) exhibiting deficiency in complex V or complex I (T10158C, T12706C). When the United States Constitution was written in 1787, its defining phrase “We the people” did not include women, LGBTQ+ people, people of color, or immigrants. In 2021, these groups, among others, still lack fundamental equality under the law. Two pieces of legislation are pending in Congress that would strengthen legal protections against discrimination based on sex, sexual orientation, and gender identity: the Equal Rights Amendment (ERA) and the Equality Act.

In migratory birds, among- and within-species heterogeneity in response to climate change may be attributed to differences in migration distance and environmental cues that affect timing of arrival at breeding grounds. We used eBird observations and a within-species comparative approach to examine whether migration distance (with latitude as a proxy) and weather predictors can explain spring arrival dates at the breeding site in a raptor species with a widespread distribution and diverse migration strategies, the American Kestrel Falco sparverius. Confirmation bias is a daily and commonly under-recognized cognitive bias, one in which requires more research. More specifically, confirmation bias is when individuals seek out information to confirm beliefs and reject opposing views. This phenomenon is readily studied in economics and psychology to name a few. However, confirmation bias is often neglected in an empirical setting. Rest and recovery are vital for athletes to give their bodies time to repair and strengthen between workouts. Whole-body cryotherapy involves exposing the body to vapors that reach ultra-low temperatures, ranging from -200°F to -300°F. There are several possible beneficial mechanisms from whole-body cryotherapy that support a fast recovery such as muscle temperature decrease, reduction in muscle damage, reduction in inflammation, reduction in heart rate and cardiac output, peripheral vasoconstriction, reduction in peripheral edema formation, and pain-relieving effects. This paper dissects the adaptations cryotherapy provides in athletic recovery, and additionally notes some draw backs of this cooling technique.

Environmental light that animal receives (i.e., photoperiod and light intensity) has recently been shown that it affects avian central nervous system for the physiological responses to the environment by up or downregulation of dopamine and serotonin activities, and this, in turn, affects the reproductive function and stress-related behavior of birds. The effects of immunomodulatory activity of two types of carboxymethyl pachymaran (CMP-1 and CMP-2) on cyclophosphamide (CTX)-induced mice were investigated. Both CMP-1 and CMP-2 were found to restore the splenomegaly and alleviate the spleen lesions and the mRNA ex-pressions of TLR4, MyD88, p65 and NF-κB in spleen were also increased. CMP-1 and CMP-2 could enhance the immunity by increasing the levels of TNF-α, IL-2, IL-6, IFN-γ, Ig-A and Ig-G in serum. In addition, CMP-1 could increase the relative abundance of Bacteroidetes and reduce the relative richness of Firmicutes at the phylum level. CMP-1 and CMP-2 could reduce the relative abundance …

The purpose of this study was to examine teachers' perceptions of data notebooks after implementation in an elementary school in Northeast Florida. This quantitative study was founded on the goal-setting theory, which focuses on setting attainable goals for motivation. The research participants were 45 teachers from a K-5 school. The participants varied in grade level and experience. Data were collected via a survey after teachers had fully implemented data notebooks in the classroom. Understanding teachers' perceptions of data notebooks will encourage school leaders to implement data notebooks to strengthen student accountability, student motivation, and the instructional process in the classroom.

The anthropometrics of the external auditory canal (EAC) is clinically pertinent to producing effective custom hearing protection devices (HPD). If custom HPDs are incorrectly fit, they will not attenuate an appropriate level of sound, increasing the likelihood that the user might be exposed to hazardous intensity levels. This essay examines the Adam Family Papers as a case study representing the Early American Republic’s economic elite. It argues that individual business practices affected the relationships between relatives—sometimes positively, other times negatively. The first section concerns other historians’ work on the family and on the Salisbury Iron District. The second section discusses women’s roles within their male relatives’ businesses. The third section relates to gift exchanges, while the fourth concerns business transactions between family members. Camera Trap Survey Suggests Forestry And Prescribed Burns Attract Wildlife, But May Not Enhance Diversity, Melissa S. Vilgats, Ryan Ott, Stephanie S. Coster

This study explored whether habitat management techniques such as forest thinning and burning promoted biodiversity. Fifteen camera trap stations were established at Fort A.P. Hill in Bowling Green, VA across forest stands with low, medium, and high basal area. Camera traps were deployed for a total of 532 trap nights, and trap success and species diversity were calculated using Shannon’s index. At each site, the distance to trafficable roadways and water sources, vegetation composition, and the percent groundcover, canopy cover, and understory were measured.
