The Wolf We Feed: Democracy, Caste, And Legitimacy, Benjamin Justice, Tracey L. Meares Jan 2021

The Wolf We Feed: Democracy, Caste, And Legitimacy, Benjamin Justice, Tracey L. Meares

Michigan Law Review Online

Procedure is central to American public legal discourse. From the soaring rhetoric of the Declaration of Independence to the Due Process Clause of the Fourteenth Amendment, the American legal tradition rests on the principle that law must be both derived and applied according to fair process. Consider that in the 2020 election the Trump Administration resorted to fervent and false allegations of widespread voter fraud—that the election process was fundamentally unfair—in order to weaponize Republican voters’ ostensible commitments to fairness against what was, objectively, one of the least procedurally unfair elections in history. Yet the four-year period of the Trump …

Meek Mill's Trauma: Brutal Policing As An Adverse Childhood Experience, Todd J. Clark, Caleb G. Conrad, Andre D.P. Cummings, Amy D. Johnson Jan 2021

Meek Mill's Trauma: Brutal Policing As An Adverse Childhood Experience, Todd J. Clark, Caleb G. Conrad, Andre D.P. Cummings, Amy D. Johnson

St. Thomas Law Review

Meek Mill, in his intimate autobiographical tracks of Trauma, Oodles O’Noodles Babies, and Otherside of America, describes experiencing not just several instances of childhood trauma as identified by the CDC-Kaiser Permanente study, but as a teenager, he suffered additional cruel trauma at the hands of U.S. police and a criminal justice system that wrongly imprisoned and unfairly positioned him in a revolving door between probation and prison. The data tells us that the trauma Meek experienced as a child and teenager statistically predicts a poorer life expectancy for him than those individuals that experienced no trauma or little trauma as …

From Tiktok To Racial Violence: Anti-Blackness In The Gendered Sphere, Dr. Donald F. Tibbs Jan 2021

From Tiktok To Racial Violence: Anti-Blackness In The Gendered Sphere, Dr. Donald F. Tibbs

St. Thomas Law Review

This article proceeds in four sections. Section I begins with a brief historiography of the danger of White gendered racism to Black life; specifically, when White women falsely accuse Black men of crimes. The seriousness of this provocative history is undisputed. It has been captured as a movie adaptation of a famous novel, well documented in academic scholarship, sang in negro spiritual songs, described in countless media stories, and documented by the federal government when the accusations involved brutal retaliation-style killings. After discussing the historical underpinnings of gendered racism, Section II uses a case study of a White woman, named …

Response To There Are No Hard-To-Serve Learners, Only Ill-Served Ones By Erik Jacobson, Montclair State University, Joni Schwartz Jan 2021

Response To There Are No Hard-To-Serve Learners, Only Ill-Served Ones By Erik Jacobson, Montclair State University, Joni Schwartz

Publications and Research

A decade and a half ago, the community of adult educators to which I belonged called the phenomenon that Jacobson describes in There Are No Hard-to-Serve Learners as “creaming.” This is the practice of choosing to serve certain students, in this case those with high scores on their initial GED® practice test or students with advanced TABE® scores, so that we fulfilled our performance objectives and more easily demonstrated employability. We knew what we were doing. The reasons were economic; we needed to show outcomes that would continue to make our adult education program eligible for funding.

Strategies And Techniques For Teaching Environmental Law, Heidi Gorovitz Robertson Jan 2021

Strategies And Techniques For Teaching Environmental Law, Heidi Gorovitz Robertson

Law Faculty Books

Teaching law students is an enormous privilege and an immense responsibility. Teaching Environmental Law, in particular, gives the professor an opportunity to help future lawyers understand some important lessons. First, contrary to the belief of many first-year law students, the legal system is not made up entirely of courts. It’s not all judicial and it’s not all adversarial. The statutes Congress creates need implementation and that’s the role of agencies. Lawyers can do a world of good by working in and around legislatures and agencies and with the people who staff them. Environmental lawyers can help shape legislation, the resulting …

Parole In Virginia, 2021: The Final Report Of The Washington And Lee Law Parole Representation Project, David I. Bruck, Bernadette M. Donovan, Matthew L. Engle

Scholarly Articles

The Virginia Capital Case Clearinghouse (“VC3”) was a yearlong ten-credit legal clinic at Washington and Lee University School of Law. Professor William Geimer created VC3 to assist in the defense of Virginia defendants who were facing the death penalty in the state’s trial courts. In 2017, recognizing both the waning need for capital defense support in Virginia and the almost total lack of legal representation for parole-eligible Virginia prisoners, VC3’s then-director, David Bruck, added the Parole Representation Project to VC3’s mission. Each year since then, VC3 students have represented at least sixteen prisoners in proceedings before the Virginia Parole Board …

Barriers To Medical Board Discipline: Cultural And Organizational Constraints, Elizabeth Chiarello Jan 2021

Barriers To Medical Board Discipline: Cultural And Organizational Constraints, Elizabeth Chiarello

Saint Louis University Journal of Health Law & Policy

Medical boards are responsible for disciplining physicians who inflict egregious harm on their patients, yet they often fail to do so. This Article develops a cultural and organizational framework for explaining why boards so often fail to discipline physicians. The framework highlights three types of barriers that impede board action: (1) input barriers that prevent hospitals and clinics from reporting harm to boards, (2) processing barriers that prevent boards from taking sufficient action against physicians who do harm, and (3) output barriers that prevent boards from sharing information about physicians who do harm with other disciplinary agencies like other medical …

Systemic Racism And Immigration Detention, Carrie L. Rosenbaum Jan 2021

Systemic Racism And Immigration Detention, Carrie L. Rosenbaum

Seattle University Law Review

The denouement of the Trump presidency was a white supremacist coup attempt against a backdrop of public reawakening to the persistence of institutionalized racism. Though the United States has entered a new administration with a leader that expresses his commitment to ending institutionalized racism, the United States continues to imprison Central American and Mexican immigrants at the southern border. If the majority of the people in immigration jails at the border are Latinx, does immigration law disparately impact them, and do they have a right to equal protection? If they do, would equal protection protect them? This Article explores whether …

Gangs And Democracy In Guatemala The Theory Of Democratic Legitimacy And Gang Violence, Austin Mason Jan 2021

Gangs And Democracy In Guatemala The Theory Of Democratic Legitimacy And Gang Violence, Austin Mason

Theses & ETDs

100,000 gang members are scattered across Central America, Mexico, and the US. Las Maras, a transnational gang, could present the single greatest threat to regional security in Central America since the civil wars1. In 2020 an estimated total of 2,574 people were victims of homicides related to gangs and the murder rate was up at 15.3 per 100,000 in Guatemala2. Very little has been written about how gang violence affects democracy. This thesis fills this gap by examining the relationship between gang violence and democratic legitimacy in Guatemala. I argue that gang violence has a negative impact democratic legitimacy because …

A Meta-Analysis Of Restorative Justice And Juvenile Recidivism Rates, Erin Dumond Jan 2021

A Meta-Analysis Of Restorative Justice And Juvenile Recidivism Rates, Erin Dumond

Theses & ETDs

In this thesis I ran a statistical analysis of various state and local programs that used restorative justice principles—typically victim-offender mediation and its variations—as a diversion tactic for juvenile offenders. I wanted to see if those restorative principles, which focus on the victim and the offender discussing the offense and coming to an agreement about how to handle the offense, had a significant effect on the recidivism rate (recidivism being defined as the tendency of a criminal to re-offend and measured by a new contact with the criminal justice system within a defined period of time, usually one to three …

Effects Of The Needle Exchange Program Implemented In West Virginia, Amber Graves, Anthony B. Uriarte, Katherine Duty

Theses, Dissertations and Capstones

Introduction: West Virginia has had a recent spike in infectious diseases such as HIV and hepatitis due to increased rates of injectable drug use. The rising costs associated with such diseases have been a cause for concern in the sector of healthcare and public health. In the state, the exchanging of dirty needles has resulted in the spread of bloodborne pathogens, however, the implementation of needle exchange programs has sought to decrease the rates of infection, improve health outcomes, and lower healthcare costs. However, there is a question as to the effectiveness of such programs.

Cybercrimes Against National Security Of Smart City Infrastructures - Legal And Technical Challenges And Confrontation Strategy, Dr. Emadeldin Mohamed Kammel Abdulhamed

Faculty Peer-Reviewed Papers | بحوث هيئة التدريس المحكمة

The facilities and infrastructure institutions of smart cities in various countries of the world have been based on cyberspace. The cyberspace and what it contains of secrets, information and data for these facilities and institutions has become an attractive force for attacking it with various crimes, whether information crimes or cyber national security crimes. Cyber national security crimes may be committed in the form of cyber terrorism crimes or cyber wars, and the means of committing them are cross-border cyber-attacks around the world, which start and end these attacks in a few seconds, achieving their desired goal, with the difficulty …

The Emergence And Recognition Of Symptoms Of “Shell Shock” Or Post-Traumatic Stress Disorder, Julia Swirbalus Jan 2021

The Emergence And Recognition Of Symptoms Of “Shell Shock” Or Post-Traumatic Stress Disorder, Julia Swirbalus

Undergraduate Review

This article explores the origins of the understanding of trauma and post- traumatic stress disorder through analyzing the written work of Charles S. Myers who studied and treated soldiers suffering from “shell shock” in World War I. As a result of Charles S. Myers’s research, recognition of causations and symptoms, and treatment of soldiers with “shell shock” during the Great War he unknowingly provided the world with a basic understanding of post-traumatic stress disorder and how stress effects humans. I argue without Charles S. Myers’s research and various publications regarding “shell shock” it is hard to say if the modern …
