Metanarratives Of Traffic Policing, Jordan Blair Woods Sep 2021

Metanarratives Of Traffic Policing, Jordan Blair Woods

Connecticut Law Review

This Essay, written for the Commentary Issue on police and prison abolition, draws on principles of postmodern feminist and queer theory to evaluate the dominance of a police-reliant, “one-size-fits-all” model of traffic enforcement in the United States. Traffic stops are currently the most common interaction between police and civilians in the United States and are a persistent source of racial and economic injustice. This Essay theorizes the dominance of a police-reliant, one-size-fits-all model of traffic enforcement in terms of metanarratives of public order and public safety. As discussed, these metanarratives shape the structure of police agencies, the nature of the …

A Decarceral Cadence: Neurologic Music Therapy As An Abolitionist Project, Mallori D. Thompson, Richard A. Kirby

Connecticut Law Review

Because police and prison abolition must be approached while simultaneously improving quality of life, and thus reducing harm, abolitionist discourse should include health policies that regard the (de)regulation, use, and culture of addictive substances. This Essay calls for research into neurologic music therapy as a response to addiction, improving quality of life and paving the way for police and prison abolition.

The Legal Consequences Of Climate Change And The Durability Of U.S. Forest Service Sky Area Permits And Water Rights, Kiefer Armitage Stenseng Sep 2021

The Legal Consequences Of Climate Change And The Durability Of U.S. Forest Service Sky Area Permits And Water Rights, Kiefer Armitage Stenseng

Water Law Review

Water, an already scarce and valuable resource in the arid western United States, will only become more important as competing demands for water increase and water availability decreases. Lower precipitation driven by climate change is likely to worsen in the coming decades. The lasting impact of climate change can also manifest itself legally. Thus, the law operates to balance conflicting uses of water (and the associated rights) between public and private entities.

Differing views on the nature of property rights, particularly the nature of private nights in public resources, become determinative of how public and private interests should be balanced. …

Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield Sep 2021

Blackness And Existential Crimes In The Modern Racial State, Natalie P. Byfield

Connecticut Law Review

This Essay presents the concept of “existential crime.” It argues that our notion of crime has conflated acts that challenge the racial premise on which a state is founded with acts that breach what Karim Murji (2009) calls “norms of propriety.”1 It argues that the conflation of these different types of social acts into our conceptualization of crime is a problem because this unnecessary and deliberate synthesis (1) privileges Western liberal philosophies that presume justice for everyone is achievable in states that were originally built on criteria for racial inclusion/exclusion, e.g., racial domination of one group over others; and (2) …

Improving Overweight And Over-Dimensional Logistics And Truck Routing, Jerry Kissick, Jerry Pigman, Jennifer Walton Sep 2021

Improving Overweight And Over-Dimensional Logistics And Truck Routing, Jerry Kissick, Jerry Pigman, Jennifer Walton

Kentucky Transportation Center Research Report

In 2012, the Kentucky Transportation Cabinet’s (KYTC) Division of Motor Carriers (DMC) issued 98,196 overweight or over-dimensional (OW/OD) permits. To determine whether a route can accommodate an OW/OD vehicle, analysts must have current and accurate data on construction schedules, road conditions, and detour routes, among other factors. This study documents processes used by DMC for permitting and routing OW/OD vehicles. It includes detailed flowcharts that capture each aspect analysts follow during the decision-making process. As part of this project, state transportation agency representatives from states bordering Kentucky (Illinois, Indiana, Ohio, West Virginia, Virginia, Tennessee, and Missouri) were interviewed to identify …

Dissertations, Theses, and Capstone Projects

This dissertation consists of three chapters.

Chapter 1: Immigration Policy Shocks and Infant Health

This paper evaluates the effect of positive and negative immigration policy shocks on infant health outcomes in the U.S. I examine changes in mean birth weight and the incidence of low birth weight (LBW) at the metropolitan statistical area (MSA) level around two major institutional shocks: The 1986 Immigration Reform Act (IRCA), which favored immigrants, and the increase in Immigration and Customs Enforcement (ICE) agency arrests at the start of 2017 which might have put immigrants at greater risk of apprehension. It uses a triple …

Treatment, Diagnostic, Demographic, And Historical Factors Affecting Mental Health Diversion Outcomes, Amanda L. Reed Sep 2021

Treatment, Diagnostic, Demographic, And Historical Factors Affecting Mental Health Diversion Outcomes, Amanda L. Reed

Dissertations, Theses, and Capstone Projects

The deinstitutionalization movement, which began in the 1950s and culminated in the closure of most psychological institutions by the 1980s, promised to usher in a new era of community mental health (Torrey et al., 2010). While the movement, which began largely due to advances in psychological treatment and the exposure of widespread abuses in asylums, was well-intentioned, it ultimately created new problems for people experiencing mental illness. Many of the programs designed to handle the influx of newly-released patients were never fully funded or well-received (Human Rights Watch, 2003). The criminal justice landscape also changed dramatically around the same time, …

From Rulay To Rules: Perceptions Of Prison Life And Reforms In The Dominican Republic’S Traditional And New Prisons, Jennifer Peirce

Dissertations, Theses, and Capstone Projects

This project explores the implementation of reforms to the prison system in the Dominican Republic, with an emphasis on how incarcerated people perceive their conditions and daily life in confinement. In 2003, the Dominican Republic established a New Prison Management Model, focused on international human rights standards and rehabilitation. This model now manages over half of the prison facilities and a third of the incarcerated population, while the previous, “traditional” model continues to operate in tandem. The “new” and reformed facilities (Centers for Correction and Rehabilitation) feature new buildings, programs, and correctional officer staff with multi-disciplinary training. In contrast, the …

Covid, Immigrant Nonprofits, And Online Services: A Case Study Of An Esol Program In Queens, Sabrina Lara

Dissertations, Theses, and Capstone Projects

The coronavirus pandemic has presented challenges to both the public and private spheres of life. For public facing staff in nonprofit organizations, there has been a need to adapt service delivery from in-person to online services. This transition has presented benefits and challenges for participants, especially immigrants who regularly depend on nonprofits for different service needs, as well as nonprofit staff. This case study examines the impact of the COVID-19 pandemic on Jacob A. Riis Neighborhood Settlement, an immigrant-serving nonprofit organization in Queens, New York, and it analyzes how they addressed the transition to fully online service delivery. This organization …

Examining The Relationship Between Crime And Major Weather Events And Disasters In The 10 Largest Cities In Texas, Daniel Augusto Sep 2021

Examining The Relationship Between Crime And Major Weather Events And Disasters In The 10 Largest Cities In Texas, Daniel Augusto

Doctoral Dissertations and Projects

This dissertation uses Social Disorganization Theory as a foundation to examine the relationship between yearly days with a major weather event or disaster and crime in the 10 largest cities in Texas. Multiple regressions and moderation analyses were conducted, with models that incorporated total Days with Disaster or major weather event, Social Disorganization, Population Density, and Disaster Consequences predicting all Index Crimes other than Arson. Days with Disaster significantly predicted Robbery, Murder, Rape, Burglary, and Auto Theft, but did not significantly predict Larceny or Assault. Additionally, Social Disorganization and Population Density were often found to predict crime. Moderation analysis also …

R. C. Bissonnette And The (Un)Constitutionality Of Consecutive Periods Of Parole Ineligibility For A Life Sentence: Why The Qcca Got It Right And Why Section 745.51 Should Never Be Re-Written, Adelina Iftene Sep 2021

R. C. Bissonnette And The (Un)Constitutionality Of Consecutive Periods Of Parole Ineligibility For A Life Sentence: Why The Qcca Got It Right And Why Section 745.51 Should Never Be Re-Written, Adelina Iftene

Articles, Book Chapters, & Popular Press

This article reviews the constitutional arguments upheld by the QCCA in Bissonnette and weighs them against the challenges that trial judges have encountered in applying s. 745.51 since 2012. By drawing on a qualitative review of cases in which s. 745.51 has been applied, as well as Charter principles, sentencing case law, and international practices, this article posits that the QCCA was correct in its approach to s. 745.51, both in finding it unconstitutional and in finding that the provision should not be read down to render it constitutional. This article advances the central argument that, in the context of …

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett Sep 2021

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett

Cardozo Law Review

Prosecutorial discretion in immigration enforcement stands at a crossroads. It was the centerpiece of Obama’s immigration policy after efforts to pass comprehensive immigration reform failed. Under the Trump administration, it was declared all but dead, replaced by an ethos of maximum enforcement. Biden has promised a return to the status quo ante, but the record of using prosecutorial discretion to accomplish humanitarian goals in immigration enforcement under Obama was, at best, mixed. Moreover, it is unclear whether Biden can depend on the availability of programs such as Deferred Action for Childhood Arrivals (DACA), Obama’s signature prosecutorial discretion program. Although the …

Examining Probation And Judicial Adherence To The Nyc Disposition Matrix, Susruta Sudula Sep 2021

Examining Probation And Judicial Adherence To The Nyc Disposition Matrix, Susruta Sudula

Dissertations, Theses, and Capstone Projects

Decisions made by criminal justice professionals in the juvenile justice system can have long-lasting and far-reaching impacts on youth. Structured decision-making (SDM) models, such as disposition matrices, seek to reduce unwarranted disparity and ensure uniformity in sentencing, while still safeguarding public safety and improving youth outcomes. This dissertation is the first to review the New York City (NYC) Disposition Matrix. Using bivariate and multivariate analyses, the present study examines factors that predict probation and judicial adherence to the matrix and provides some reasons for probation deviations. It also explores whether matrix recommendations and judicial adherence predict rearrests.

Findings demonstrate that …
