Chulalongkorn University Theses and Dissertations (Chula ETD)

And What Of The “Black” In Black Letter Law?: A Blaqueer Reflection, T. Anansi Wilson
Faculty Scholarship
This is a reflective, analytical essay remarking on the role that Blackness has and continues to play in the construction, understanding and application of "black letter law." This essay is written from a Black and BlaQueer perspective and displays how a shift in standpoint--moving from the invisible, standard white "reasonable person"--underscores and illuminates the current legal and sociopolitical crisis we find ourselves in. It is continuation of the discussion began in my earlier articles "Furtive Blackness: On Blackness & Being," "The Strict Scrutiny of Black and BlaQueer Life" and the working paper "Sexual Profiling & BlaQueer Furtivity: BlaQueers On The …

Reforming And Clarifying Special Immigrant Juvenile Status, Brad Reynolds
Journal of Legislation
Special Immigrant Juvenile Status (“SIJS” or “SIJ status”) is a form of immigration relief for undocumented minor children who have been abused, abandoned, and/or neglected by one or both parents. Most applicants for SIJ status hail from the “Northern Triangle” countries of El Salvador, Honduras, and Guatemala, and have travelled thousands of miles, often alone and in dangerous conditions, to seek protection in the United States that one or both of their parents are unable or unwilling to provide them in their country of origin, typically from gangs.1 To ensure that the best interests of these children are protected, the …

The Information Shortfalls Of Prosecuting Irresponsible Executives, Miriam H. Baer
The Information Shortfalls Of Prosecuting Irresponsible Executives, Miriam H. Baer
Faculty Scholarship
This Essay, written for the 2020 Clifford Symposium on Tort Law and Social Policy, focuses on the prosecution and conviction of three corporate executives under the responsible corporate officer (RCO) doctrine in connection with Purdue Pharma’s misbranding of OxyContin. The RCO doctrine relieves prosecutors of having to demonstrate a difficult-to-prove mental state such as purpose or knowledge and instead holds corporate officers criminally responsible for certain violations that take place on their watch. Although Purdue Pharma’s three executives suffered economic consequences from their 2007 convictions, they received no term of imprisonment. This result elicited a fair amount of criticism, which …

Who Wants To Be A Prosecutor? And Why Care? Law Students’ Career Aspirations And Reform Prosecutors’ Goals, Shih-Chun Steven Chien, Stephen Daniels
Law Faculty Articles and Essays
Often called “progressive” or “reform” prosecutors, a number of reform-minded prosecutors have been elected recently across the United States—promising a distinctive vision of criminal justice and signaling that their role will be more attuned to issues of race and equity than “law and order.” Furthering this vision requires dramatic changes to the working cultures—the norms, practices, and even personnel—of their offices. Diversity plays a major role.
One central challenge is identifying, attracting, and hiring newly-minted lawyers who can, over time, be socialized into and sustain a changing organizational culture. This article empirically examines that challenge, which involves two sides of …

Introduction – 2019 Constitutional Cases At The Supreme Court: Up Close And In Person, Sonia Lawrence
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
From the vantage point of Summer 2020, 2019 seems almost a mirage. The conditions created across Canada by government and individual responses to COVID-19 were all but unimaginable when 2019 drew to a close, and the legal issues that preoccupy those interested in constitutional and public law now revolve around rapidly evolving rules and policies designed to protect public goods like health and health care. Questions of profound significance to constitutional lawyers, such as the location of limits on state powers, the appropriate roles and relative competencies of courts and governments, the place of state law in creating the good …

Policing Arbitrariness: Fleming V. Ontario And The Ancillary Powers Doctrine, Terry Skolnik, Vanessa Macdonnell
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In 2019, the Supreme Court of Canada released its decision in Fleming v. Ontario. The case is significant because it is one of the very few police powers cases in the past three decades in which the Supreme Court has declined to recognize a new power. Since the pivotal case of Dedman, police powers jurisprudence has been characterized by the recognition of increasingly more intrusive common law powers to detain, investigate and search. This trend seemed to reach its zenith in Saeed, in which a majority of the Court recognized a common law power to conduct a warrantless penile swab …

Editorial: Investigating Black Activism In The Civil War Era, Jeffery Hardin Hobson
Civil War Book Review
This special thematic issue of the Civil War Book Review is dedicated to recent works that uncover, reveal, and recast the history of Black Americans’ emancipation activism in the Civil War Era. The concept of emancipation carried myriad meanings among nineteenth-century Black Americans, which the scholarship reviewed below reflects. These authors have catalogued nineteenth-century Black Americans’ vibrant and dynamic efforts to emancipate themselves from slavery, to achieve citizenship and its attendant rights, to secure personal safety, to gain social standing, and to attain economic stability. These books emphasize nineteenth-century African Americans possessed a complex political consciousness that was finely tuned …

Until Justice Be Done: America’S First Civil Rights Movement, From The Revolution To Reconstruction, Ben Davidson
Civil War Book Review
Masur contends historians have overlooked a decades’-long, Black-led civil rights movement that flourished in the nineteenth century. "Until Justice Be Done is necessary reading for any scholar of U.S. history,” and is a book that should "receive a wide readership beyond academia,” as Masur’s “non-polemical” examination of citizenship rights “may well challenge those of various political stripes to reexamine their idea and strategies for honoring, changing, or using the Constitution.”

Mining Learner-Friendly Security Patterns From Huge Published Histories Of Software Applications For An Intelligent Tutoring System In Secure Coding, Xu Du, Aparna S. Varde
Department of Computer Science Faculty Scholarship and Creative Works
Security patterns are proven solutions to recurring problems in software development. The growing importance of secure software development has introduced diverse research efforts on security patterns that mostly focused on classification schemes, evolution and evaluation of the patterns. Despite a huge mature history of research and popularity among researchers, security patterns have not fully penetrated software development practices. Besides, software security education has not been benefited by these patterns though a commonly stated motivation is the dissemination of expert knowledge and experience. This is because the patterns lack a simple embodiment to help students learn about vulnerable code, and to …
Police Use Of Force Laws In Texas, Gerald S. Reamey
Police Use Of Force Laws In Texas, Gerald S. Reamey
Faculty Articles
At the heart of calls for police reform lie use of force laws. While policing agencies adopt and enforce their own policies regarding when and how force may be used by officers of those agencies, state laws rarely define the uniform limits under which officers operate. Policing in the United States is highly fractured; of the hundreds of law enforcement agencies operating, most are autonomous, and they determine the policies under which they operate, including those for use of force. They also decide whether and how to investigate violations of internal policies, as well as the punishment that will be …

Warrants Needed For Biometric Analysis, Ted Claypoole
Warrants Needed For Biometric Analysis, Ted Claypoole
Saint Louis University Law Journal
This article argues that U.S. courts and legislatures should limit law enforcement application of biometric identification technologies within Constitutional bounds. Specifically, warrant requirements should be enforced for police to use facial recognition artificial intelligence and software. Such warrant requirement is practical for law enforcement and is already within the bounds of current Fourth Amendment cases.
The Real Problem With Katz Circularity, Raff Donelson
The Real Problem With Katz Circularity, Raff Donelson
Saint Louis University Law Journal
The Fourth Amendment protects people against “unreasonable searches” by police. To operationalize this protection, courts must have a workable definition of a search. Since 1967, the Supreme Court has used the two-step Katz test as a primary measure of when a search has occurred. Under Katz, a court will find that something has been subject to search when (1) the individual in question has a subjective expectation of privacy in that thing and (2) such an expectation of privacy would be reasonable. From early on, commentators have decried the Katz test as circular and have urged courts to adopt …
