An Opportunity To Study The Impact Of Legal Structures On Public Health: A Review Of Michigan State Juvenile Law On Status Offenders, Lakai Legg

Public Health Theses

Background/Introduction: There is a scarcity of studies in public health that investigate and address structural and political level factors, such as juvenile justice-related legislation and their implementation, and how they contribute to poor health outcomes and health inequities (i.e. by race/ethnicity and gender) in children and adolescents. By reviewing and analyzing the social and political context of juvenile justice and status offenses in the U.S. and Michigan and Michigan state legislation on status offenses, this narrative review aims to identify characteristics of status offense law that may contribute to the inequitable institutionalization of youth and perpetuate public health harms and …

A Reign Of Error: Property Rights And Stare Decisis, Michael Allan Wolf Jan 2021

A Reign Of Error: Property Rights And Stare Decisis, Michael Allan Wolf

UF Law Faculty Publications

Mistakes matter in law, even the smallest ones. What would happen if a small but substantively meaningful typographical error appeared in the earliest published version of a U.S. Supreme Court opinion and remained uncorrected for several decades in versions of the decision published by the two leading commercial companies and in several online databases? And what would happen if judges, legal commentators, and practitioners wrote opinions, articles, and other legal materials that incorporated and built on that mistake? In answering these questions, this Article traces the widespread, exponential replication of an error (first appearing in 1928) in numerous subsequent cases …

As public Confederate monuments finally begin to come down across the nation, we are seeing an emergence of Confederate monuments on private lands. The number of private Confederate monuments is increasing both with the construction of new monuments and, more significantly, the relocation of monuments from public land. This Article explains why private Confederate monuments are likely to be the next battleground over these controversial and troubling statues. Through ten detailed examples, we show how private Confederate monuments emerge and how communities are responding to them. The challenges related to monuments on private land are different than those on public …

Covid-19, Courts, And The 'Realities Of Prison Administration.' Part Ii: The Realities Of Litigation, Chad Flanders Jan 2021

Covid-19, Courts, And The 'Realities Of Prison Administration.' Part Ii: The Realities Of Litigation, Chad Flanders

All Faculty Scholarship

Lawsuits challenging prisons and jails for not doing enough to stop the spread of COVID-19 among inmates have faced mixed results in the courts: wins at the district court level are almost always followed by losses (in the form of stays of any orders to improve conditions) at the appeals court level or at the Supreme Court. This short article tries to explain why this is happening, and makes three comparisons between how district courts and appeals courts have analyzed these lawsuits. First, district courts and appeals courts tend to emphasize different facts in their decisions. District courts focus more …

Exploring Group-Threat And Police-Involved Homicide : A Spatial Analysis Of Police Involved Homicide In Us Counties, Kyle Demori Maksuta

Legacy Theses & Dissertations (2009 - 2024)

The recent advent of the Black Lives Matter movement has reinvigorated criminological inquiry into police violence. Recent advances in spatial analysis have opened new opportunities for understanding the spatial relationship between social structure and police violence. Spatial analysis is both statistically and substantively important to our understanding of police-involved-homicide (PIH), yet few studies have attempted to marry recent advances in spatial econometrics to this topic. The current study introduces spatial Durbin modeling (SDM) as a particularly useful approach to studying the spatial relationships between variables associated with group threat theory and PIH. Previous research has demonstrated the connections between group …

Longitudinal Examination Of Contextual Risk, Promotive Factors, And Psychosocial Functioning Using Structural Equation Modeling With A Sample Of Serious Adolescent Offenders, Daniel J. Knauer

Legacy Theses & Dissertations (2009 - 2024)

Mental health problems, including substance use problems, are more prevalent among adolescent criminal offenders than among the general population and are associated with an elevated risk of re-offending. It is important to understand what factors are associated with serious adolescent offenders’ future mental health and re-offending outcomes to promote their positive development. This study examined potential mechanisms behind established relationships between risk factors for mental health and criminal offending and psychosocial outcomes while integrating ecological theory and a risk and protective framework. To do this, a mediation model was examined using structural equation modeling in which contextual risk was hypothesized …

Bio-Spatial Policing In Theory And Practice: Examining Impacts And Resistance Through Mobilities And Children's Everyday Life, Emily Kaufman

Theses and Dissertations--Geography

Despite decades of reforms and technological innovations, increasing evidence shows that state securitization disproportionately harms already racially, spatially, and socio-economically marginalized communities. My research investigates uneven impacts of state securitization, from punitive welfare programs to school surveillance to policing. Across sites, I focus on scales, voices and the everyday lived experiences often left out of scholarly discourse and sensational media. In the current climate of growing awareness and scholarship on police violence, my dissertation addresses three less-studied areas: 1) the interplay between racial, gendered, spatial, and technified police practices; 2) how these practices impact the everyday lives of those racially …

“Victims’ Rights” And Diversion: Furthering The Interests Of Crime Survivors And The Community, Miriam Krinsky, Liz Komar Jan 2021

“Victims’ Rights” And Diversion: Furthering The Interests Of Crime Survivors And The Community, Miriam Krinsky, Liz Komar

SMU Law Review

Against the backdrop of the prosecutorial reform movement, this Article explores the origins of the tensions between victims’ rights and criminal justice reform efforts and argues that while victims’ rights may be in tension with diversion in some individual cases, the broader needs and interests of crime survivors do not conflict with decarceral diversion and deflection strategies. The Article describes the growing movement toward diversion among reform prosecutors and briefly recounts the history of the victims’ rights movement and “tough-on-crime” politics. The Article then discusses the demographics of crime survivors, who are disproportionately from the communities most harmed by “tough …

The ability to find the location of a mobile object and track it in two-dimensional (2D) and three-dimensional (3D) space is an indispensable feature of wireless communication systems. In particular, the increase in demand for using self-navigation technology in unmanned vehicles is attracting additional attention to this area of research. The methods and techniques developed for these systems compete in terms of simplicity, performance, and accuracy. However, the majority of solutions focus on only one of these performance metrics and are not applicable to the projected systems. In this study, a new location estimation solution that satisfies all three performance …

On Performance Analysis Of Multioperator Ran Sharing For Mobile Networkoperators, Yekta Türk, Engi̇n Zeydan

Turkish Journal of Electrical Engineering and Computer Sciences

Enhancing the coverage and eliminating the poor performance is key to balance end-user experience andfuture network investments for mobile network operators (MNOs). Although vast amounts of infrastructure investmentsare provided by MNOs, there are still coverage and capacity planning problems at remote locations. This is because,in most cases, the population density and return-of-investments are low in those areas. In this paper, radio accessnetwork (RAN) sharing paradigm is utilized on experimental sites in Turkey to accommodate user equipment of multiplenetwork operators under the same cell sites. We first investigate characteristics, benefits, and limitations of two differentRAN sharing deployment scenarios. Then, a city-wide …

Transportation Policy And The Underdevelopment Of Black Communities, Deborah N. Archer Jan 2021

Transportation Policy And The Underdevelopment Of Black Communities, Deborah N. Archer

Faculty Articles

Historian Manning Marable posited that “[t]he most striking fact about American economic history and politics is the brutal and systemic underdevelopment of Black people.” According to this theory, Black people “have never been equal partners in the American Social Contract, because [our] system exists not to develop, but to underdevelop Black people.” To effect this underdevelopment, racism is embedded into the core of power, the economy, culture, and society. The result is that Black people have been intentionally sacrificed to feed America’s growth and expansion. Our transportation system has always been a driver of racial inequality. Using Marable’s theory of …

Antiracism In Action, Daniel S. Harawa, Brandon Hasbrouck Jan 2021

Antiracism In Action, Daniel S. Harawa, Brandon Hasbrouck

Faculty Articles

Racism pervades the criminal legal system, influencing everything from who police stop and search, to who prosecutors charge, to what punishments courts apply. The Supreme Court’s fixation on colorblind application of the Constitution gives judges license to disregard the role race plays in the criminal legal system, and all too often, they do. Yet Chief Judge Roger L. Gregory challenges the facially race-neutral reasoning of criminal justice actors, often applying ostensibly colorblind scrutiny to achieve a color-conscious jurisprudence. Nor is he afraid of engaging directly in a frank discussion of the racial realities of America, rebuking those within the system …

Part I describes the recent pattern of retaliation against immigrant rights activists in the United States and its threat to the vibrancy of immigration policy debate. Part II explores how immigrants have been particularly vulnerable to retaliation, by discussing legal precedent and identifying protective mechanisms that have eroded over time. Part III outlines measures that can be taken to protect immigrant voices through robust administrative, legislative, and judicial oversight. Part IV concludes …

Disaggregating The Police Function, Barry Friedman Jan 2021

Disaggregating The Police Function, Barry Friedman

Faculty Articles

Policing imposes serious and extensive harms, from shootings and nonlethal uses of force, to stops, searches, arrests, and incarceration. And many of these harms involve pervasive racial disparities. Scholars and advocates tend to see these harms as collateral to policing and seek to address them with “harm-regulating” tools such as civil rights suits, prosecution of police officers, elimination of qualified immunity, more Department of Justice investigations, civilian review boards, and the like. Harm-regulation techniques are unlikely to be successful, however, as we see all too well in practice. Harm is not collateral to policing, it is innate to it. We …
