Warrantless Blood Draws And The Fourth Amendment: A Chronological Look At U.S. Supreme Court And State Supreme Court Cases From Missouri V. Mcneely To Commonwealth V. Bell, Jessica Rider
Court Review: Journal of the American Judges Association
The National Highway Traffic Safety Administration (NHTSA) reports in the United States 30 people die every day in drunk-driving crashes.1 Crashes involving alcohol-impaired drivers cost the United States $44 billion in 2010 (the most recent year for which cost data are available).2 The issue of impaired driving is not limited to alcohol; the NHTSA’s data show the number of drivers killed in crashes who test positive for marijuana doubling between 2007 and 2015.3 As states create laws to try and crackdown on the rates of impaired driving those finding themselves facing criminal prosecution have raised constitutional challenges. …
The Compassionate Court: Reforming The Justice System Inside And Outside, Jamey H. Hueston
The Compassionate Court: Reforming The Justice System Inside And Outside, Jamey H. Hueston
Court Review: Journal of the American Judges Association
There is growing scholarship and justice system attention regarding the quality and effect of court interactions on citizens who come before the bar, as well as court system employees. From this research and the impact of therapeutic court experience, the Compassionate Court is born. The Compassionate Court considers court matters from a wider perspective that factors human behavior and disabilities, as well as community and societal influences that caused conflicts, and encourages courts to formulate alternative therapeutic solutions. The Compassionate Court reflects a coherent, navigable, and humanistic judicial process no matter the severity of the matter or difficulty of the …

Court Review: Journal of the American Judges Association
Court Review, the quarterly journal of the American Judges Association, invites the submission of unsolicited, original articles, essays, and book reviews. Court Review seeks to provide practical, useful information to the working judges of the United States and Canada. In each issue, we hope to provide information that will be of use to judges in their everyday work, whether in highlighting new procedures or methods of trial, court, or case management, providing substantive information regarding an area of law likely to be encountered by many judges, or by providing background information (such as psychology or other social science research) …
Why Judges Should Not Mistake The Norm For The Neutral, Debra Stephens, Veronica Galván
Why Judges Should Not Mistake The Norm For The Neutral, Debra Stephens, Veronica Galván
Court Review: Journal of the American Judges Association
This statement from the Washington Supreme Court Open Letter, issued after Minneapolis police officers killed George Floyd on May 25, 2020, reflects both an acknowledgment of responsibility and a commitment to action. The Washington Supreme Court’s letter was one of many written by courts and individual judges across the United States, who felt compelled to speak out about racial injustice and our role as keepers of a system called Justice. Questions quickly followed: Are those who speak out against racial injustice taking sides on a social issue? What can a judge do or say within the ethical constraints of codes …
Second Amendment Animus, Jacob D. Charles
Second Amendment Animus, Jacob D. Charles
Faculty Scholarship
The Supreme Court’s animus doctrine has proven surprisingly adaptive. The Court has employed the doctrine not just in the typical equal protection context from which it arose, but also to claims that religious conduct or beliefs are the target of legislative hostility. Animus law and scholarship are flourishing after several invocations of the doctrine in the high Court’s recent Terms. Coinciding with these developments, gun-rights advocates and other supporters have increasingly railed against the hostility with which they believe government officials are treating the Second Amendment. This Essay connects these developments, mapping three types of gun-supporter claims that sound in …
Privilege And Health: The Inequitable Distribution Of Contemporary Environmental Harm, Rosie Holding
Privilege And Health: The Inequitable Distribution Of Contemporary Environmental Harm, Rosie Holding
Plymouth Law Review
This article examines the modern concept of environmental justice (EJ) with a focus on the inequitable distribution of environmental harm stemming from contemporary global issues. The article takes an expansive, global view of issues by analysing country-specific case studies. These case studies include assessing the impact of wildfires in California, sea level rise in the Maldives and air pollution in the UK. Through the lens of EJ and social justice, it is argued that negative impacts and harm resulting from environmental disasters are disproportionately borne by vulnerable populations. These vulnerable populations include low-income, less affluent communities. It also includes those …

Beyond Qualified Immunity, Fred O. Smith Jr.
Michigan Law Review Online
I never watched the video. The descriptions themselves have always felt like enough. Traumatizing enough. Invasive enough. George Floyd, father of two, laying on the ground, as an unfazed officer kneeled on his neck for at least eight minutes and forty-six seconds. He pleaded for his life and cried out to his deceased mother until he met his inevitable death. His name should be said for the record before saying almost anything else. The recording of the chilling final minutes of his life is, in all probability, one of the impetuses for this multi-journal Reckoning and Reform Symposium.

Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett
Rethinking Prosecutorial Discretion In Immigration Enforcement, Nicole Hallett
Articles
Prosecutorial discretion in immigration enforcement stands at a crossroads. It was the centerpiece of Obama's immigration policy after efforts to pass comprehensive immigration reform failed. Under the Trump administration, it was declared all but dead, replaced by an ethos of maximum enforcement. Biden has promised a return to the status quo ante, but the record of using prosecutorial discretion to accomplish humanitarian goals in immigration enforcement under Obama was, at best, mixed. Moreover, it is unclear whether Biden can depend on the availability of programs such as Deferred Action for Childhood Arrivals (DACA), Obama's signature prosecutorial discretion program. Although the …

An Examination Of Motivational Influences On Professional Choice, Perceived Preparedness, And Retention Of Alternatively Certified Teachers Of Career, Technical, And Agriculture Education In Northeast Georgia, Jonathan Stribling
Ed.D. Dissertations
Alternative routes to teacher certification have been utilized as a way to address the Career, Technical, and Agricultural Education teacher shortage, and this abbreviated path to a teaching career has attracted current educators from the industries for which they are trained. Career, Technical, and Agricultural Education teachers who have entered the teaching profession after prior industry experience intentionally chose, and continue to choose, to teach. There is a gap in the extant literature as to why. In this qualitative interpretive study, I examined the motivational influences on professional choice, perceived level of preparedness, and retention of alternatively certified teachers …

A Methodist Response To Infant Mortality In The 19th Century: Public Health, Foundling Hospitals, And Abortion Curbs, Philip F. Hardt
The Asbury Journal
During the 1850s, infant mortality greatly increased in New York City and other large cities. One of the leading physicians to address this problem in New York City was Dr. David Meredith Reese, an active Methodist layman, who was also involved in many other issues of the day: phrenology, colonization, and Bible reading in the schools. In 1857, his Report on Infant Mortality in Large Cities was published in which he both examined its extent and sources and also suggested ways to reduce it. Strikingly, two of his recommendations for its reduction coincided with efforts already underway. For example, his …

Privacy In Pandemic: Law, Technology, And Public Health In The Covid-19 Crisis, Tiffany C. Li
Loyola University Chicago Law Journal
The COVID-19 pandemic has caused millions of deaths and disastrous consequences around the world, with lasting repercussions for every field of law, including privacy and technology. The unique characteristics of this pandemic have precipitated an increase in use of new technologies, including remote communications platforms, healthcare robots, and medical AI. Public and private actors alike are using new technologies, like heat sensing, and technologically influenced programs, like contact tracing, leading to a rise in government and corporate surveillance in sectors like healthcare, employment, education, and commerce. Advocates have raised the alarm for privacy and civil liberties violations, but the emergency …

The Bi-Directional Amplifier (BDA) is the newest edition to Life Safety in the state of Florida. The Florida Fire Prevention Code (NFPA 1) section 11.10.1 states that “In all new and existing buildings, minimum radio signal strength for fire department communications shall be maintained at a level determined by the authority having jurisdiction (Committee NFPA 1: Fire Code 2018). That authority having jurisdiction for our local Tampa Bay area is the Hillsborough County Fire Rescue department and they have posted their own requirements along with the Florida Senate for emergency communication standards. The Impact Of Vavilov: Reasonableness And Vulnerability, Lorne Sossin
The Impact Of Vavilov: Reasonableness And Vulnerability, Lorne Sossin
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In Canada (Minister of Citizenship and Immigration) v. Vavilov and Bell Canada v. Canada (Attorney General) (the “Admin Law Trilogy”), the Supreme Court of Canada embarked on an ambitious revamp of the Canadian law of judicial review of administrative decisions. The Court’s lead decision, Vavilov, has broad implications for Canadian public law. Specifically, in this comment, I explore the Court’s introduction of an important, new contextual factor to the reasonableness analysis — that of the impact of an impugned decision on those affected by it, and particularly, those with existing vulnerabilities.
