Negative Freedom In Crisis Times, Leslie Francis
Negative Freedom In Crisis Times, Leslie Francis
Utah Law Faculty Scholarship
Contemporary U.S. jurisprudence thus treats public health orders requiring masks or limiting attendance at religious services as conflicts between individual freedoms and the public safety. Courts have left unquestioned the scope of individual liberties. Choices about whether to cover one’s face or attend religious services are not, however, fully analogous to protections from physical injury by others. Instead, they are choices that may result in risks to others. It is thus at least open to question whether they are within the scope of protected individual liberties in the first place. The scope of personal liberty—whether liberty is distinct from license—is …

Examining The Implementation Fidelity Of A Police Field Training Officer Program: A Program Evaluation Perspective: A Mixed Methods Approach., Yale Y. Margolis
West Chester University Doctoral Projects
Although researchers have studied policing in general, there has been a lack of studies focused on better understanding field training for officers. This study addressed the gap in knowledge regarding the dynamics of a specific Field Training Program (FTP) in a large metropolitan police department in the United States and whether the FTP was implemented with fidelity. A mixed methods research design was used whereby 49 FTOs participated in a survey, and eight of these officers participated in follow-up semistructured interviews. Survey data were treated as quantitative data and analyzed through logistical regressions. Interview data were treated as qualitative data, …

Assessing And Measuring The Fiscal Health Of Local Governments: A Focus On Pennsylvania Municipalities, Rosa Quintana
West Chester University Doctoral Projects
This research provides empirical evidence of the efficacy of Brown’s Ten Point Test. It implements this fiscal assessment tool to analyze the fiscal health of local governments. It utilizes Pennsylvania Department of Community and Economic Development Statewide Municipal Annual Financial Reports, from 2006 through 2018 to examine the fiscal condition of a range of 2,483 – 2,536 Pennsylvania municipalities to help understand the following research questions:
1. How effective is the Ten Point Test?
2. What was the fiscal status of the Pennsylvania municipalities before the Great Recession (2008)?
3. What was the fiscal status of the Pennsylvania municipalities after …
The Benefits Of Evidence Based Practices In Public Administration: Does Therapeutic Listening Training Increase Emotional Intelligence To Affect Change Management Outcomes In Public And Private Sector Organizations, John Sillup
West Chester University Doctoral Projects
Abstract
This doctoral dissertation considers change management as it relates directly to evidence-based practices in public administration. The problem under study was the lack of scholarly research on the effect of an administrative leader’s emotional intelligence (EI) has on follower self-efficacy during change management. This study provided findings on the effect of therapeutic listening training as a means to increase emotional intelligence to potentially affect change management outcomes in public and private sector organizations. Change management is a systematic and structured process of developing and implementing strategies and interventions for organizations transitioning from current state to a desired state. The …

Offenders And Sorn Laws, Amanda Agan, J.J. Prescott
Book Chapters
Chapter 7 describes what we know about the effects of SORN laws on criminal behavior. A coherent story emerges from this review: there is virtually no evidence that SORN laws reduce recidivism or otherwise increase public safety. The chapter first delineates the various ways registration and notification alter the legal environment not only for registrants but also for nonregistrants, the public, and law enforcement. There are many channels through which SORN laws might impact the frequency of sex offenses, including some that would produce an increase in overall offending. The chapter assesses these possibilities in light of a large body …
Novice, Alternatively Licensed Career And Technical Education Teachers' Perceptions Of Professional Development, Desiree Seay
Novice, Alternatively Licensed Career And Technical Education Teachers' Perceptions Of Professional Development, Desiree Seay
Ed.D. Dissertations
In this qualitative study, I address novice, alternatively licensed Career Technical Education (CTE) teachers’ perceptions of professional development support in a southeastern school district in the state of Tennessee. The lack of tailored professional development opportunities created issues for CTE teachers because of the complexity of their teaching responsibilities. Research on effective methods of professional development for beginning CTE teachers existed; however, there were few research studies on program implementations and their effectiveness. To gather data, I used a Google survey to establish an initial, two-tiered criterion for participation, and participants who met the criteria participated in one-on-one interviews. Specifically, …
Soar: A Holistic Approach To Supporting Survivors, Sabrina Glass
Soar: A Holistic Approach To Supporting Survivors, Sabrina Glass
West Chester University Master’s Theses
In this thesis, I address the systemic issue of sexual violence and rape culture that affect students on college campuses at an alarming rate. By utilizing critical action research, I propose the creation of the Department of Survivor Outreach and Response (SOAR), a holistic and collaborative department that focuses on supporting and advocating for survivors of sexual violence while also conducting prevention and education initiatives. I emphasize the importance of Kimberlé Crenshaw’s concept of intersectionality (1993), encourage the use of the Social Change Model of Leadership (Astin & Astin, 1996), and empathy within leadership. SOAR is designed to ensure sexual …
How The Fourth Amendment Frustrates The Regulation Of Police Violence, Seth W. Stoughton
How The Fourth Amendment Frustrates The Regulation Of Police Violence, Seth W. Stoughton
Faculty Publications
Within policing, few legal principles are more widely known or highly esteemed than the “objective reasonableness” standard that regulates police uses of force. The Fourth Amendment, it is argued, is not only the facet of constitutional law that governs police violence, it sets out the only standard that state lawmakers, police commanders, and officers should recognize. Any other regulation of police violence is inappropriate and unnecessary. Ironically, though, the Constitution does not actually regulate the use of force. It regulates seizures. Some uses of force are seizures. This Article explains that a surprising number of others—including some police shootings—are not. …

Dismantling Policing For Profit: How To Build On Missouri's Post-Ferguson Court Reforms, Samuel Lev Rubinstein
Dismantling Policing For Profit: How To Build On Missouri's Post-Ferguson Court Reforms, Samuel Lev Rubinstein
University of Michigan Journal of Law Reform
This Note argues that legal reforms enacted after the 2014 Ferguson, Missouri uprising are insufficient to address the problem of using courts as revenue generators and the related problem of predatory policing. Reforms to date have merely capped how much money towns can raise from their courts; they have not fixed the perverse incentive problem, which allows towns like Ferguson to extract wealth from vulnerable, low-income residents through the court system. This Note argues that towns should be required to remit the money their courts raise to a state education fund, which puts legal separation between the entity collecting the …
Latest Developments Affecting Russian Protestant Seminaries And Churches, Mark R. Elliott
Latest Developments Affecting Russian Protestant Seminaries And Churches, Mark R. Elliott
Occasional Papers on Religion in Eastern Europe
Excerpt: "Of course, the Russian state assault on Protestant theological education does not occur in a vacuum, as can be seen by an ongoing parallel campaign against individual Protestant congregations. A sample of three cases of direct disruption of Baptist, Pentecostal, and Adventist worship by local authorities in 2019, 2020, and 2021 may illustrate the point."
