Empathy For The Vulnerable? The Fourth Circuit's Internal Struggle To Grapple With The Trump Administration's Immigration Policies: Part I, Anne Marie Lofaso, Isabella Anderson, Anna Filatova, Blake Humphrey, Mckenna Meadows, Brice Phillips Feb 2021

Empathy For The Vulnerable? The Fourth Circuit's Internal Struggle To Grapple With The Trump Administration's Immigration Policies: Part I, Anne Marie Lofaso, Isabella Anderson, Anna Filatova, Blake Humphrey, Mckenna Meadows, Brice Phillips

West Virginia Law Review Online

The Trump Administration’s immigration policies consistently targeted immigrants, refugees, children, victims of gang violence, and individuals classified as “public charges.” For example, one of former President Trump’s first Executive Orders increased detention of immigrants at the border, including women and children, and limited access to asylum nationwide by expanding expedited removal. Another Order issued the very same day cut federal funding to “sanctuary cities” —jurisdictions that refuse to cooperate with federal authorities in enforcing immigration laws for the sake of protecting immigrant communities. And still another originally suspended the issuance of visas to nationals from Iran, Iraq, Sudan, Syria, Libya, …

University Honors Theses

In the United States, legal financial obligations (LFO's), also known as monetary sanctions or criminal justice financial obligations, refer to the fines and fees that result from an individual’s involvement in the criminal justice system. Today, these fines and fees have become the most common form of punishment used by the United States' legal system. This paper answers the following research question: How can the ability to pay legal financial obligations shape the rehabilitation of incarcerated people in the United States?

Ghosts Of Landuse Past: Legacy Effects Of Milldams For Riparian Nitrogen (N) Processing And Water Quality Functions, Shreeram Inamdar, Marc Peipoch, Arthur J. Gold, Evan Lewis, Johanna Hripto, Melissa Sherman, Kelly Addy, Dorothy Merritts, Jinjun Kan, Peter M. Groffman, Robert Walter, Tara L E Trammel

Advanced Science Research Center

Milldams and their legacies have significantly influenced fluvial processes and geomorphology. However, less is known about their effects on riparian zone hydrology, biogeochemistry, and water quality. Here, we discuss the potential effects of existing and breached milldams on riparian nitrogen (N) processing through multiple competing hypotheses and observations from complementary studies. Competing hypotheses characterize riparian zone processes that remove (sink) or release (source) N. Elevated groundwater levels and reducing soil conditions upstream of milldams suggest that riparian zones above dams could be hotspots for N removal via denitrification and plant N uptake. On the other hand, dam removals and subsequent …

Instructor Strategies To Alleviate Stress And Anxiety Among College And University Stem Students, Jeremy L. Hsu, Gregory R. Goldsmith

Biology, Chemistry, and Environmental Sciences Faculty Articles and Research

While student stress and anxiety are frequently cited as having negative effects on students’ academic performance, the role that instructors can play in mitigating these challenges is often underappreciated. We provide summaries of different evidence-based strategies, ranging from changes in instructional strategies to specific classroom interventions, that instructors may employ to address and ameliorate student stress and anxiety. While we focus on students in science, technology, engineering, and mathematics, the strategies we delineate may be more broadly applicable. We begin by highlighting ways in which instructors can learn about and prepare to act to alleviate stress and anxiety. We then …

De-Escalation: A Necessity For The Survival Of Law Enforcement, James Ross

Master of Arts in Criminal Justice Leadership

The topic of de-escalation has gained a great deal of attention in recent years due to a high number of high-profile tragic events that involved great bodily harm or the use of deadly force. De-escalation tactics are nonphysical skills used to prevent a potentially dangerous situation from escalating into a physical confrontation. There is no shortage of news stories highlighting the conflict between law enforcement officers, law enforcement agencies, and the general public. Many times, conflict can be eliminated or reduced by breaking down barriers that may exist between law enforcement agencies and the communities they serve. Many agencies have …

Information Technology Solutions For Overdose Prevention: Perspectives From The Field, Sarah Ali, Aliese Alter, Jeff Beeson

Journal of Applied Research on Children: Informing Policy for Children at Risk

Drug addiction and misuse haves long plagued communities throughout the country, with drug overdose claiming more than 750,000 lives over the past two decades. As the crisis is multifaceted, it requires and beckons all sectors to respond, including the public, private, and nonprofit sectors. This creates unique data sharing challenges. In response to those challenges and recognizing the need for more accurate and timely data, the Washington Baltimore HIDTA created the Overdose Detection Mapping Application Program (ODMAP). This platform provides near real-time suspected overdose surveillance data across jurisdictions to support public health and safety response efforts. This article discusses the …

While the COVID-19 crisis has caused many to fear the threat that the virus poses to the health and safety of themselves and their loved ones, for others, and particularly for those with certain religious beliefs, the cure is worse than the disease. The possibility of a government mandated vaccine has caused extreme anxiety for many Americans. In this article, Ben Davisson discusses the constitutionality of mandatory vaccination programs and how such programs may come into conflict with the Free Exercise Clause of the First Amendment.

The Juvenile Injustice System Of Minorities, Sanjuanita Rodriguz Feb 2021

The Juvenile Injustice System Of Minorities, Sanjuanita Rodriguz

Master of Arts in Criminal Justice Leadership

The History of juvenile justice started out to be something that would help juveniles grow into being strong and educated children. Instead, it has been used to incarcerate young adults who are uneducated, have mental disabilities, and even sentence them to lifetimes behind bars for offences that are not against the law, but are status offences.

Mission statements, Personal Development Programs and Communication within facilities are a starting point that need to be improved before we can even start repair the damage. The current juvenile justice system is failing and has many issues including racial disparities within the system. The …

Revisiting Background Principles In Takings Litigation, Michael C. Blumm, Rachel G. Wolfard Feb 2021

Revisiting Background Principles In Takings Litigation, Michael C. Blumm, Rachel G. Wolfard

Florida Law Review

Libertarian property rights enthusiasts celebrated the United States Supreme Court’s 1992 decision in Lucas v. South Carolina Coastal Council as a landmark decision that would revolutionize interpretation of the Constitution’s takings clause and finally fulfill its potential as a vehicle for deregulation. Over a quarter-century later, the Lucas decision has failed to meet those expectations. A major reason is that Justice Antonin Scalia’s opinion created an exception that effectively swallowed the rule that Lucas established.

Lucas held that land use regulations whose effect on landowners’ property produced a total loss of economic value were per se categorical takings. However, Justice …

Implementation of a financial coaching program as a component of a holistic officer wellness program can serve to greatly reduce one of the single largest causes of stress in society; money. One of the hallmarks of successful public safety is planning and preparation for the unknown. Individuals armed with practical knowledge and well-defined financial plans are better suited to confront personal and professional decisions with a clear mind and eyes fixed on the future. Successful implementation of a financial coaching …
